88 To repeal section 488.426, RSMo, and to enact in lieu thereof one new section relating to court

1111 Be it enacted by the General Assembly of the State of Missouri, as follows:
1212 Section A. Section 488.426, RSMo, is repealed and one new 1
1313 section enacted in lieu thereof, to be known as section 488.426, 2
1414 to read as follows:3
1515 488.426. 1. The judges of the circuit court, en banc, 1
1616 in any circuit in this state may require any party filing a 2
1717 civil case in the circuit court, at the time of filing the 3
1818 suit, to deposit with the clerk of the court a surcharge in 4
1919 addition to all other deposits required by law or court 5
2020 rule. Sections 488.426 to 488.432 shall not apply to 6
2121 proceedings when costs are waived or are to be paid by the 7
2222 county or state or any city. 8
2323 2. The surcharge in effect on August 28, 2001, shall 9
2424 remain in effect until changed by the circuit court. The 10
2525 circuit court in any circuit, except the circuit court in 11
2626 Jackson County or the circuit court in any circ uit that 12
2727 reimburses the state for the salaries of family court 13
2828 commissioners under and pursuant to section 487.020, may 14
2929 change the fee to any amount not to exceed fifteen dollars. 15
3030 The circuit court in Jackson County , the circuit court in 16
3131 the city of St. Louis, or the circuit court in any circuit 17
3232 that reimburses the state for the salaries of family court 18 SB 1209 2
3333 commissioners under and pursuant to section 487.020 may 19
3434 change the fee to any amount not to exceed twenty dollars. 20
3535 A change in the fee shall beco me effective and remain in 21
3636 effect until further changed. 22
3737 3. Sections 488.426 to 488.432 shall not apply to 23
3838 proceedings when costs are waived or are paid by the county 24
3939 or state or any city. 25
4040 4. In addition to any fee authorized by subsection 1 26
4141 of this section, any county of the first classification with 27
4242 more than one hundred one thousand but fewer than one 28
4343 hundred fifteen thousand inhabitants may impose an 29
4444 additional fee of ten dollars excluding cases concerning 30
4545 adoption and those in small claims court. The provisions of 31
4646 this subsection shall expire on December 31, 2019. 32
