| 11 | 11 | | Be it enacted by the General Assembly of the State of Missouri, as follows: |
|---|
| 12 | 12 | | Section A. Section 488.426, RSMo, is repealed and one new 1 |
|---|
| 13 | 13 | | section enacted in lieu thereof, to be known as section 488.426, 2 |
|---|
| 14 | 14 | | to read as follows:3 |
|---|
| 15 | 15 | | 488.426. 1. The judges of the circuit court, en banc, 1 |
|---|
| 16 | 16 | | in any circuit in this state may require any party filing a 2 |
|---|
| 17 | 17 | | civil case in the circuit court, at the time of filing the 3 |
|---|
| 18 | 18 | | suit, to deposit with the clerk of the court a surcharge in 4 |
|---|
| 19 | 19 | | addition to all other deposits required by law or court 5 |
|---|
| 20 | 20 | | rule. Sections 488.426 to 488.432 shall not apply to 6 |
|---|
| 21 | 21 | | proceedings when costs are waived or are to be paid by the 7 |
|---|
| 22 | 22 | | county or state or any city. 8 |
|---|
| 23 | 23 | | 2. The surcharge in effect on August 28, 2001, shall 9 |
|---|
| 24 | 24 | | remain in effect until changed by the circuit court. The 10 |
|---|
| 25 | 25 | | circuit court in any circuit, except the circuit court in 11 |
|---|
| 26 | 26 | | Jackson County or the circuit court in any circ uit that 12 |
|---|
| 27 | 27 | | reimburses the state for the salaries of family court 13 |
|---|
| 28 | 28 | | commissioners under and pursuant to section 487.020, may 14 |
|---|
| 29 | 29 | | change the fee to any amount not to exceed fifteen dollars. 15 |
|---|
| 30 | 30 | | The circuit court in Jackson County , the circuit court in 16 |
|---|
| 31 | 31 | | the city of St. Louis, or the circuit court in any circuit 17 |
|---|

| 34 | 34 | | change the fee to any amount not to exceed twenty dollars. 20 |

| 35 | 35 | | A change in the fee shall beco me effective and remain in 21 |

| 37 | 37 | | 3. Sections 488.426 to 488.432 shall not apply to 23 |

| 38 | 38 | | proceedings when costs are waived or are paid by the county 24 |

| 40 | 40 | | 4. In addition to any fee authorized by subsection 1 26 |

| 41 | 41 | | of this section, any county of the first classification with 27 |

| 42 | 42 | | more than one hundred one thousand but fewer than one 28 |

| 43 | 43 | | hundred fifteen thousand inhabitants may impose an 29 |
|---|
| 44 | 44 | | additional fee of ten dollars excluding cases concerning 30 |
|---|
| 45 | 45 | | adoption and those in small claims court. The provisions of 31 |

| 46 | 46 | | this subsection shall expire on December 31, 2019. 32 |
