13 | 13 | | Be it enacted by the General Assembly of the State of Missouri, as follows: |
---|
14 | 14 | | Section A. Sections 115.277, 115.279, 115.283, and 1 |
---|
15 | 15 | | 115.291, RSMo, are repealed and four new sections enacted in 2 |
---|
16 | 16 | | lieu thereof, to be known as sections 115.277, 115.279, 115.283, 3 |
---|
17 | 17 | | and 115.291, to read as follows:4 |
---|
18 | 18 | | 115.277. 1. Except as provided in subsections 2, 3, 1 |
---|
19 | 19 | | 4, and 5 of this section, any registered voter of this state 2 |
---|
20 | 20 | | may vote by absentee ballot for all can didates and issues 3 |
---|
21 | 21 | | for which such voter [would be] is eligible to vote at the 4 |
---|
22 | 22 | | polling place [if such voter expects to be prevented from 5 |
---|
23 | 23 | | going to the polls to vote on election day due to: 6 |
---|
24 | 24 | | (1) Absence on election day from the jurisdiction of 7 |
---|
25 | 25 | | the election authority in which such voter is registered to 8 |
---|
26 | 26 | | vote; 9 |
---|
27 | 27 | | (2) Incapacity or confinement due to illness or 10 |
---|
28 | 28 | | physical disability, including a person who is primarily 11 |
---|
29 | 29 | | responsible for the physical care of a person who is 12 |
---|
30 | 30 | | incapacitated or confined du e to illness or disability; 13 |
---|
31 | 31 | | (3) Religious belief or practice; 14 |
---|
32 | 32 | | (4) Employment as an election authority, as a member 15 |
---|
33 | 33 | | of an election authority, or by an election authority at a 16 |
---|
34 | 34 | | location other than such voter's polling place; 17 SB 730 2 |

35 | 35 | | (5) Incarceration, provided all qualifications for 18 |
---|
36 | 36 | | voting are retained; 19 |

37 | 37 | | (6) Certified participation in the address 20 |

39 | 39 | | to 589.681 because of safety concerns; or 22 |
---|
40 | 40 | | (7) For an election that occurs during the year 2020, 23 |
---|
41 | 41 | | the voter has contracted or is in an at -risk category for 24 |
---|
42 | 42 | | contracting or transmitting severe acute respiratory 25 |
---|
43 | 43 | | syndrome coronavirus 2. This subdivision shall expire on 26 |
---|
44 | 44 | | December 31, 2020]. 27 |
---|
45 | 45 | | 2. Any covered voter who is eligible to re gister and 28 |
---|
46 | 46 | | vote in this state may vote in any election for federal 29 |
---|
47 | 47 | | office, statewide office, state legislative office, or 30 |
---|
48 | 48 | | statewide ballot initiatives by submitting a federal 31 |
---|
49 | 49 | | postcard application to apply to vote by absentee ballot or 32 |
---|
50 | 50 | | by submitting a federal postcard application at the polling 33 |
---|
51 | 51 | | place even though the person is not registered. A federal 34 |
---|
52 | 52 | | postcard application submitted by a covered voter pursuant 35 |
---|
53 | 53 | | to this subsection shall also serve as a voter registration 36 |
---|
54 | 54 | | application under section 115. 908 and the election authority 37 |
---|
55 | 55 | | shall, if satisfied that the applicant is entitled to 38 |
---|
56 | 56 | | register, place the voter's name on the voter registration 39 |
---|
57 | 57 | | file. Each covered voter may vote by absentee ballot or, 40 |
---|
58 | 58 | | upon submitting an affidavit that the person is qu alified to 41 |
---|
59 | 59 | | vote in the election, may vote at the person's polling place. 42 |
---|
60 | 60 | | 3. Any interstate former resident may vote by absentee 43 |
---|
61 | 61 | | ballot for presidential and vice presidential electors. 44 |
---|
62 | 62 | | 4. Any intrastate new resident may vote by absentee 45 |
---|
63 | 63 | | ballot at the election for presidential and vice 46 |
---|
64 | 64 | | presidential electors, United States senator, representative 47 |
---|
65 | 65 | | in Congress, statewide elected officials and statewide 48 |
---|
66 | 66 | | questions, propositions and amendments from such resident's 49 SB 730 3 |

67 | 67 | | new jurisdiction of residence af ter registering to vote in 50 |

69 | 69 | | 5. Any new resident may vote by absentee ballot for 52 |
---|
70 | 70 | | presidential and vice presidential electors after 53 |
---|
71 | 71 | | registering to vote in such resident's new jurisdiction of 54 |

73 | 73 | | [6. For purposes of this section, the voters who are 56 |

75 | 75 | | severe acute respiratory syndrome coronavirus 2 are voters 58 |

78 | 78 | | (2) Live in a long-term care facility licensed under 61 |

80 | 80 | | (3) Have chronic lung disease or moderate to severe 63 |
---|
81 | 81 | | asthma; 64 |

82 | 82 | | (4) Have serious heart conditions; 65 |
---|
83 | 83 | | (5) Are immunocompromised; 66 |
---|
84 | 84 | | (6) Have diabetes; 67 |
---|
85 | 85 | | (7) Have chronic kidney disease and ar e undergoing 68 |
---|
86 | 86 | | dialysis; or 69 |
---|
87 | 87 | | (8) Have liver disease.] 70 |

88 | 88 | | 115.279. 1. Application for an absentee ballot may be 1 |

89 | 89 | | made by the applicant in person, or by mail, or for the 2 |
---|
90 | 90 | | applicant, in person, by his or her guardian or a relative 3 |
---|
91 | 91 | | within the second degree by consanguinity or affinity. The 4 |
---|
92 | 92 | | election authority shall accept applications by facsimile 5 |
---|
93 | 93 | | transmission and by electronic mail within the limits of its 6 |
---|
94 | 94 | | telecommunications capacity. 7 |
---|
95 | 95 | | 2. Each application shall be made to the ele ction 8 |
---|
96 | 96 | | authority of the jurisdiction in which the person is or 9 |
---|
97 | 97 | | would be registered. Each application shall be in writing 10 |
---|
98 | 98 | | and shall state the applicant's name, address at which he or 11 SB 730 4 |

99 | 99 | | she is or would be registered, [his or her reason for voting 12 |
---|
100 | 100 | | an absentee ballot] whether the applicant is incapacitated 13 |

107 | 107 | | address if electronic transmission is requested. If the 20 |
---|
108 | 108 | | [reason for the applicant voting absentee is due to the 21 |
---|
109 | 109 | | reasons established under subdivision (6) of subsection 1 of 22 |
---|
110 | 110 | | section 115.277] applicant is a certified participant in the 23 |
---|
111 | 111 | | address confidentiality program established under sections 24 |
---|
112 | 112 | | 589.660 to 589.681, the applicant shall state the voter' s 25 |
---|
113 | 113 | | identification information provided by the address 26 |
---|
114 | 114 | | confidentiality program in lieu of the applicant's name, 27 |
---|
115 | 115 | | address at which he or she is or would be registered, and 28 |
---|
116 | 116 | | address to which the ballot is to be mailed, if mailing is 29 |
---|
117 | 117 | | requested. Each application to vote in a primary election 30 |
---|
118 | 118 | | shall also state which ballot the applicant wishes to 31 |
---|
119 | 119 | | receive. If any application fails to designate a ballot, 32 |
---|
120 | 120 | | the election authority shall, within three working days 33 |
---|
121 | 121 | | after receiving the application, notify the appli cant by 34 |
---|
122 | 122 | | mail that it will be unable to deliver an absentee ballot 35 |
---|
123 | 123 | | until the applicant designates which political party ballot 36 |
---|
124 | 124 | | he or she wishes to receive. If the applicant does not 37 |
---|
125 | 125 | | respond to the request for political party designation, the 38 |
---|
126 | 126 | | election authority is authorized to provide the voter with 39 |
---|
127 | 127 | | that part of the ballot for which no political party 40 |
---|
128 | 128 | | designation is required. 41 |
---|
129 | 129 | | 3. [Except as provided in subsection 3 of section 42 |

136 | 136 | | facsimile transmission, by electronic mail, or by a guardian 49 |

138 | 138 | | immediately prior to the election shall be accepted by any 51 |
---|
139 | 139 | | election authority. No application for an absentee bal lot 52 |
---|
140 | 140 | | submitted by the applicant in person after 5:00 p.m. on the 53 |

142 | 142 | | authority, except as provided in subsections 6, 8 and 9 of 55 |

144 | 144 | | 4. Each application for an absentee ballot shall be 57 |
---|
145 | 145 | | signed by the applicant or, if the application is made by a 58 |
---|
146 | 146 | | guardian or relative pursuant to this section, the 59 |
---|
147 | 147 | | application shall be signed by the guardian or relative, who 60 |
---|
148 | 148 | | shall note on the application his or her relationship to the 61 |
---|
149 | 149 | | applicant. If an applicant, guardian or relative is blind, 62 |
---|
150 | 150 | | unable to read or write the English language or physically 63 |
---|
151 | 151 | | incapable of signing the application, he or she shall sign 64 |
---|
152 | 152 | | by mark, witnessed by the signature of an election official 65 |
---|
153 | 153 | | or person of his or her own cho osing. Any person who 66 |
---|
154 | 154 | | knowingly makes, delivers or mails a fraudulent absentee 67 |
---|
155 | 155 | | ballot application shall be guilty of a class one election 68 |
---|
156 | 156 | | offense. 69 |
---|
157 | 157 | | 5. (1) Notwithstanding any law to the contrary, any 70 |
---|
158 | 158 | | resident of the state of Missouri who resides outside the 71 |
---|
159 | 159 | | boundaries of the United States or who is on active duty 72 |
---|
160 | 160 | | with the Armed Forces of the United States or members of 73 |
---|
161 | 161 | | their immediate family living with them may request an 74 SB 730 6 |
---|
162 | 162 | | absentee ballot for both the primary and subsequent general 75 |
---|
163 | 163 | | election with one application. 76 |
---|
164 | 164 | | (2) The election authority shall provide each absent 77 |
---|
165 | 165 | | uniformed services voter and each overseas voter who submits 78 |
---|
166 | 166 | | a voter registration application or an absentee ballot 79 |
---|
167 | 167 | | request, if the election authority rejects the applicati on 80 |
---|
168 | 168 | | or request, with the reasons for the rejection. 81 |
---|
169 | 169 | | (3) Notwithstanding any other law to the contrary, if 82 |
---|
170 | 170 | | a standard oath regarding material misstatements of fact is 83 |
---|
171 | 171 | | adopted for uniformed and overseas voters pursuant to the 84 |
---|
172 | 172 | | Help America Vote Act o f 2002, the election authority shall 85 |
---|
173 | 173 | | accept such oath for voter registration, absentee ballot, or 86 |
---|
174 | 174 | | other election-related materials. 87 |
---|
175 | 175 | | (4) Not later than sixty days after the date of each 88 |
---|
176 | 176 | | regularly scheduled general election for federal office, 89 |
---|
177 | 177 | | each election authority which administered the election 90 |
---|
178 | 178 | | shall submit to the secretary of state in a format 91 |
---|
179 | 179 | | prescribed by the secretary a report on the combined number 92 |
---|
180 | 180 | | of absentee ballots transmitted to, and returned by, absent 93 |
---|
181 | 181 | | uniformed services voters and overseas voters for the 94 |
---|
182 | 182 | | election. The secretary shall submit to the Election 95 |
---|
183 | 183 | | Assistance Commission a combined report of such information 96 |
---|
184 | 184 | | not later than ninety days after the date of each regularly 97 |

185 | 185 | | scheduled general election for federal office and in a 98 |

186 | 186 | | standardized format developed by the commission pursuant to 99 |
