8	8	To repeal section 115.349, RSMo, and to enact in lieu thereof one new section relating to candidate
9	9	filing deadlines, with an emergency clause.

11	11	Be it enacted by the General Assembly of the State of Missouri, as follows:
12	12	Section A. Section 115.349, RSMo, is repealed and one new 1
13	13	section enacted in lieu thereof, to be known as section 115.349, 2
14	14	to read as follows:3
15	15	115.349. 1. Except as otherwise provided in sections 1
16	16	115.361 to 115.383 or sections 115.755 to 115 .785, no 2
17	17	candidate's name shall be printed on any official primary 3
18	18	ballot unless the candidate has filed a written declaration 4
19	19	of candidacy in the office of the appropriate election 5
20	20	official by 5:00 p.m. on the last Tuesday in March 6
21	21	immediately preceding the primary election. 7
22	22	2. No declaration of candidacy for nomination in a 8
23	23	primary election shall be accepted for filing prior to 8:00 9
24	24	a.m. on the last Tuesday in February immediately preceding 10
25	25	the primary election. 11
26	26	3. Each declaration of candidacy for nomination in a 12
27	27	primary election shall state the candidate's full name, 13
28	28	residence address, office for which such candidate proposes 14
29	29	to be a candidate, the party ticket on which he or she 15
30	30	wishes to be a candidate and that if nominated and elected 16
31	31	he or she will qualify. The declaration shall be in 17
32	32	substantially the following form: 18 SB 749 2
33	33	If the declaration is to be filed in person, it shall be 44
34	34	subscribed and sworn to by the candidate before an official 45
35	35	authorized to accept his or her declaration of candidacy. 46
36	36	If the declaration is to be filed by certified mail pursuant 47
37	37	to the provisions of subsection 2 of section 115.355, it 48
38	38	shall be subscribed and sworn to by the candidate before a 49

93	93	4. Notwithstanding subsecti on 1 of this section to the 52
94	94	contrary, for the primary election held on the first Tuesday 53
95	95	after the first Monday in August 2022, no candidate's name 54
96	96	shall be printed on any official primary ballot unless the 55
97	97	candidate has filed a written declaration of candidacy in 56
98	98	the office of the appropriate election official by 5:00 p.m. 57
99	99	on the first Tuesday in April immediately preceding the 58
100	100	primary election. 59
101	101	Section B. Because of the need to ensure the orderly 1
102	102	conduct of the 2022 primary e lection, section A of this act 2
103	103	is deemed necessary for the immediate preservation of the 3
104	104	public health, welfare, peace, and safety, and is hereby 4
105	105	declared to be an emergency act within the meaning of the 5
106	106	constitution, and section A of this act shall be in full 6
107	107	force and effect upon its passage and approval. 7
