88 To repeal section 115.349, RSMo, and to enact in lieu thereof one new section relating to candidate

1111 Be it enacted by the General Assembly of the State of Missouri, as follows:
1212 Section A. Section 115.349, RSMo, is repealed and one new 1
1313 section enacted in lieu thereof, to be known as section 115.349, 2
1414 to read as follows:3
1515 115.349. 1. Except as otherwise provided in sections 1
1616 115.361 to 115.383 or sections 115.755 to 115 .785, no 2
1717 candidate's name shall be printed on any official primary 3
1818 ballot unless the candidate has filed a written declaration 4
1919 of candidacy in the office of the appropriate election 5
2020 official by 5:00 p.m. on the last Tuesday in March 6
2121 immediately preceding the primary election. 7
2222 2. No declaration of candidacy for nomination in a 8
2323 primary election shall be accepted for filing prior to 8:00 9
2424 a.m. on the last Tuesday in February immediately preceding 10
2525 the primary election. 11
2626 3. Each declaration of candidacy for nomination in a 12
2727 primary election shall state the candidate's full name, 13
2828 residence address, office for which such candidate proposes 14
2929 to be a candidate, the party ticket on which he or she 15
3030 wishes to be a candidate and that if nominated and elected 16
3131 he or she will qualify. The declaration shall be in 17

3333 If the declaration is to be filed in person, it shall be 44
3434 subscribed and sworn to by the candidate before an official 45
3535 authorized to accept his or her declaration of candidacy. 46
3636 If the declaration is to be filed by certified mail pursuant 47
3737 to the provisions of subsection 2 of section 115.355, it 48
3838 shall be subscribed and sworn to by the candidate before a 49

9393 4. Notwithstanding subsecti on 1 of this section to the 52
9494 contrary, for the primary election held on the first Tuesday 53
9595 after the first Monday in August 2022, no candidate's name 54
9696 shall be printed on any official primary ballot unless the 55
9797 candidate has filed a written declaration of candidacy in 56
9898 the office of the appropriate election official by 5:00 p.m. 57
9999 on the first Tuesday in April immediately preceding the 58

101101 Section B. Because of the need to ensure the orderly 1
102102 conduct of the 2022 primary e lection, section A of this act 2
103103 is deemed necessary for the immediate preservation of the 3
104104 public health, welfare, peace, and safety, and is hereby 4
105105 declared to be an emergency act within the meaning of the 5
106106 constitution, and section A of this act shall be in full 6
107107 force and effect upon its passage and approval. 7
