10	10	To repeal sections 115.365, 115.603, 115.619, and 115.621, RSMo, and to enact in lieu thereof
11	11	four new sections relating to county commission district political party committees.

13	13	Be it enacted by the General Assembly of the State of Missouri, as follows:
14	14	Section A. Sections 115.365, 115.603, 115.619, and 1
15	15	115.621, RSMo, are repealed and four new sections enacted i n 2
16	16	lieu thereof, to be known as sections 115.365, 115.603, 115.619, 3
17	17	and 115.621, to read as follows:4
18	18	115.365. 1. The nominating committee authorized to 1
19	19	select a candidate for nomination or election to office 2
20	20	pursuant to section 115.363 shall be on e of the following: 3
21	21	(1) To select a candidate for [county] countywide 4
22	22	office, the nominating committee shall be the county 5
23	23	committee of the party , provided that in the case a vacancy 6
24	24	in the county commission to be filled by a special election, 7
25	25	or to select a candidate for county commissioner, county 8
26	26	council, or county legislator, the nominating committee 9
27	27	shall be the county commission district committee ; 10
28	28	(2) To select a candidate for state representative, 11
29	29	the nominating committee shall be the legislative district 12
30	30	committee of the party; 13
31	31	(3) To select a candidate for state senator, the 14
32	32	nominating committee shall be the senatorial district 15
33	33	committee of the party; 16 SB 901 2
34	34	(4) To select a candidate for circuit court judge not 17
35	35	subject to the provisions of Article V, Section 25 of the 18
36	36	State Constitution, the nominating committee shall be the 19
37	37	judicial district committee of the party; 20
38	38	(5) To select a candidate for representative in 21
39	39	Congress, the nominating committee shall be the 22
40	40	congressional district committee of the party; 23
41	41	(6) To select a candidate for statewide office, the 24
42	42	nominating committee shall be the state committee of the 25
43	43	party. 26
44	44	2. After any decennial redistricting, the nominating 27
45	45	committee shall be compose d from the new districts, and the 28
46	46	new district lines shall be used in the selection of a 29
47	47	candidate; provided, however, that members of nominating 30
48	48	committees for candidates for special elections to fill 31
49	49	vacancies conducted pursuant to section 21.130 sha ll be from 32
50	50	the old districts. 33
51	51	115.603. Each established political party shall have a 1
52	52	state committee, a congressional district committee for each 2
53	53	congressional district in the state, a judicial district 3
54	54	committee for each circuit ju dge district in the state not 4
55	55	subject to the provisions of Article V, Section 25 of the 5
56	56	state constitution, a senatorial district committee for each 6
57	57	senatorial district in the state, a legislative district 7
58	58	committee for each legislative district in the state, a 8
59	59	county commission district committee for each county 9
60	60	commission district, county council district, and county 10
61	61	legislative district in each county in the state, and a 11
62	62	county committee for each county in the state, except any 12
63	63	city not within a county which shall have a city committee 13
64	64	in lieu of a county committee. 14 SB 901 3
65	65	115.619. 1. A legislative district committee shall 1
66	66	consist of the precinct, ward, or township committeeman and 2
67	67	committeewoman from such precincts, wards, or to wnships 3
68	68	included in whole or in part of the legislative district. 4
69	69	There shall be elected from the membership of each 5
70	70	legislative district committee a chairman and a vice 6
71	71	chairman, one of whom shall be a woman and one of whom shall 7
72	72	be a man, and each legislative district at the same time 8
73	73	shall elect a secretary and a treasurer, one of whom shall 9
74	74	be a woman and one of whom shall be a man, but who may or 10
75	75	may not be members of the legislative district committee. 11
76	76	Party state committees may provide for voting by proxy and 12
77	77	for weighted or fractional voting. 13
78	78	2. The congressional, senatorial, or judicial 14
79	79	committee of a district which is composed of: 15
80	80	(1) One or more whole counties; or 16
81	81	(2) One or more whole counties and part of one or mor e 17
82	82	counties; 18
83	83	shall consist of the county committee chair and vice chair 19
84	84	of each county within the district and the committeeman and 20
85	85	committeewoman of each legislative district committee within 21
86	86	the district. 22
87	87	3. The congressional, senatorial, or jud icial 23
88	88	committee of a district which consists of: 24
89	89	(1) Parts of one or more counties; 25
90	90	(2) Part of a city not within the county; 26
91	91	(3) A whole city not within a county; or 27
92	92	(4) Part of a city not within a county and parts of 28
93	93	one or more counties; 29 SB 901 4
94	94	shall consist of the committeemen and committeewomen of the 30
95	95	precinct, ward, or township included in whole or in part of 31
96	96	the district and the chair and vice chair of each 32
97	97	legislative district committee within the district in whole 33
98	98	or in part. 34
99	99	4. A county commission district committee shall 35
100	100	consist of the precinct, ward, or township committeeman and 36
101	101	committeewoman from such precincts, wards, or townships 37
102	102	included in whole or in part of the county commission 38
103	103	district, county council di strict, or county legislative 39
104	104	district, as the case may be. There shall be elected from 40
105	105	the membership of each county commission district committee 41
106	106	a chair and a vice chair, one of whom shall be a woman and 42
107	107	one of whom shall be a man, and each county commission 43
108	108	district committee at the same time shall elect a secretary 44
109	109	and a treasurer, one of whom shall be a woman and one of 45
110	110	whom shall be a man, but who may or may not be members of 46
111	111	the county commission district committee. Party state 47
112	112	committees may provide for voting by proxy and for weighted 48
113	113	or fractional voting. 49
114	114	115.621. 1. Notwithstanding any other provision of 1
115	115	this section to the contrary, any legislative, senatorial, 2
116	116	or judicial district committee that is wholly cont ained 3
117	117	within a county or a city not within a county may choose to 4
118	118	meet on the same day as the respective county or city 5
119	119	committee. All other committees shall meet as otherwise 6
120	120	prescribed in this section. 7
121	121	2. The members of each county committee s hall meet at 8
122	122	the county seat not earlier than two weeks after each 9
123	123	primary election but in no event later than the third 10
124	124	Saturday after each primary election, at the discretion of 11
125	125	the chairman at the committee. In each city not within a 12 SB 901 5
126	126	county, the city committee shall meet on the same day at the 13
127	127	city hall. In all counties of the first, second, and third 14
128	128	classification, the county courthouse shall be made 15
129	129	available for such meetings and any other county political 16
130	130	party meeting at no charge to the party committees. In all 17
131	131	cities not within a county, the city hall shall be made 18
132	132	available for such meetings and any other city political 19
133	133	party meeting at no charge to the party committees. At the 20
134	134	meeting, each committee shall organize by electing t wo of 21
135	135	its members, a man and a woman, as chair and vice chair, and 22
136	136	a man and a woman who may or may not be members of the 23
137	137	committee as secretary and treasurer. 24
138	138	3. The members of each congressional district 25
139	139	committee shall meet at some place and t ime within the 26
140	140	district, to be designated by the current chair of the 27
141	141	committee, not earlier than five weeks after each primary 28
142	142	election but in no event later than the sixth Saturday after 29
143	143	each primary election. The county courthouse in counties of 30
144	144	the first, second and third classification in which the 31
145	145	meeting is to take place, as designated by the chair, shall 32
146	146	be made available for such meeting and any other 33
147	147	congressional district political party committee meeting at 34
148	148	no charge to the committee. At the meeting, the committee 35
149	149	shall organize by electing one of its members as chair and 36
150	150	one of its members as vice chair, one of whom shall be a 37
151	151	woman and one of whom shall be a man, and a secretary and a 38
152	152	treasurer, one of whom shall be a woman and o ne of whom 39
153	153	shall be a man, who may or may not be members of the 40
154	154	committee. 41
155	155	4. The members of each legislative district committee 42
156	156	shall meet at some place and date within the legislative 43
157	157	district or within one of the counties in which the 44 SB 901 6
158	158	legislative district exists, to be designated by the current 45
159	159	chair of the committee, not earlier than three weeks after 46
160	160	each primary election but in no event later than the fourth 47
161	161	Saturday after each primary election. The county courthouse 48
162	162	in counties of the first, second and third classification in 49
163	163	which the meeting is to take place, as designated by the 50
164	164	chair, shall be made available for such meeting and any 51
165	165	other legislative district political party committee meeting 52
166	166	at no charge to the committee. At the meeting, the 53
167	167	committee shall organize by electing two of its members, a 54
168	168	man and a woman, as chair and vice chair, and a man and a 55
169	169	woman who may or may not be members of the committee as 56
170	170	secretary and treasurer. 57
171	171	5. The members of each senatori al district committee 58
172	172	shall meet at some place and date within the district, to be 59
173	173	designated by the current chair of the committee, if there 60
174	174	is one, and if not, by the chair of the congressional 61
175	175	district in which the senatorial district is principally 62
176	176	located, not earlier than four weeks after each primary 63
177	177	election but in no event later than the fifth Saturday after 64
178	178	each primary election. The county courthouse in counties of 65
179	179	the first, second and third classification in which the 66
180	180	meeting is to take place, as so designated pursuant to this 67
181	181	subsection, shall be made available for such meeting and any 68
182	182	other senatorial district political party committee meeting 69
183	183	at no charge to the committee. At the meeting, the 70
184	184	committee shall organize by electin g one of its members as 71
185	185	chair and one of its members as vice chair, one of whom 72
186	186	shall be a woman and one of whom shall be a man, and a 73
187	187	secretary and a treasurer, one of whom shall be a woman and 74
188	188	one of whom shall be a man, who may or may not be members of 75

190	190	6. The members of each senatorial district shall also 77
191	191	meet at some place within the district, to be designated by 78
192	192	the current chair of the committee, if there is one, and if 79
193	193	not, by the chair of the congressional district in wh ich the 80
194	194	senatorial district is principally located, on the Saturday 81
195	195	after each general election or concurrently with the 82
196	196	election of senatorial officers, if designated or not 83
197	197	objected to by the chair of the congressional district where 84
198	198	the senatorial district is principally located. At the 85
199	199	meeting, the committee shall proceed to elect two registered 86
200	200	voters of the district, one man and one woman, as members of 87
201	201	the party's state committee. 88
202	202	7. The members of each judicial district may meet at 89
203	203	some place and date within the judicial district or within 90
204	204	one of the counties in which the judicial district exists, 91
205	205	to be designated by the current chair of the committee or 92
206	206	the chair of the congressional district committee, not 93
207	207	earlier than six weeks after each primary election but in no 94
208	208	event later than the seventh Saturday after each primary 95
209	209	election. The county courthouse in counties of the first, 96
210	210	second and third classification in which the meeting is to 97
211	211	take place, as so designated pursuant to this subsection, 98
212	212	shall be made available for such meeting and any other 99
213	213	judicial district political party committee meeting at no 100
214	214	charge to the committee. At the meeting, the committee 101
215	215	shall organize by electing two of its members, a man and a 102
216	216	woman, as chair and vice chair, and a man and a woman who 103
217	217	may or may not be members of the committee as secretary and 104
218	218	treasurer. 105
219	219	8. The members of each county commission district 106
220	220	shall meet at some place and date within the county 107
221	221	commission district, to be designated by the current chair 108 SB 901 8
222	222	of the committee or, if there is none, the chair of the 109
223	223	county committee, on September 25, 2022, and thereafter, not 110
224	224	earlier than seven weeks after each primary election but in 111
225	225	no event later than the eighth Sat urday after each primary 112
226	226	election. The county courthouse in counties of the first, 113
227	227	second, and third classification in which the meeting is to 114
228	228	take place, as so designated pursuant to this subsection, 115
229	229	shall be made available for such meeting and any o ther 116
230	230	county commission district political party committee meeting 117
231	231	at no charge to the committee. At the meeting, the 118
232	232	committee shall organize by electing two of its members, a 119
233	233	man and a woman, as chair and vice chair, and a man and a 120
234	234	woman who may or may not be members of the committee as 121
235	235	secretary and treasurer. 122
