88 To amend chapter 162, RSMo, by adding thereto one new section relating to the creation of wards

1111 Be it enacted by the General Assembly of the State of Missouri, as follows:
1212 Section A. Chapter 162, RSMo, is ame nded by adding thereto 1
1313 one new section, to be known as section 162.386, to read as 2
1414 follows:3
1515 162.386. 1. Notwithstanding any other provision of 1
1616 law to the contrary, in any school district in which is 2
1717 located, or which adjoins a school district in which is 3
1818 located, in whole or in part, a street light maintenance 4
1919 district with a registration of more than one thousand but 5
2020 less than three thousand voters, or in which is wholly 6
2121 located a street light maintenance district with a 7
2222 registration of more than five hundred but less than one 8
2323 thousand voters, and that is located within a county with a 9
2424 charter form of government and with more than nine hundred 10
2525 fifty thousand inhabitants, the board of election 11
2626 commissioners of the county sitting as an appo rtionment 12
2727 commission shall establish seven wards for the purpose of 13
2828 electing directors of such districts. In the event of a tie 14
2929 vote in adopting an apportionment or reapportionment of the 15
3030 wards, the chairperson of the school board of the affected 16
3131 school district shall break the tie. 17 SB 949 2
3232 2. (1) The ward boundaries shall be drawn by the 18
3333 commissioners within ninety days after the effective date of 19
3434 this act, and within six months after each decennial census 20
3535 is reported to the President of the United States. 21
3636 (2) The commissioners shall apportion the wards by 22
3737 dividing the population, determined by the preceding 23
3838 decennial census, of the district by the number of directors 24
3939 and shall establish each ward so that the population of that 25
4040 ward shall, as nearly as possible, equal that figure or be 26
4141 within one percent thereof. Each ward shall be composed of 27
4242 contiguous territory as compact as may be. 28
4343 3. All board members elected or appointed in any such 29
4444 district shall be elected or appointed to represent one of 30
4545 the wards, beginning with the first general municipal 31
4646 election or vacancy occurring after August 28, 2022. Each 32
4747 member shall reside for one year prior to the date of his or 33
4848 her election in the ward from which he or she is elected, 34
4949 or, in the case of a vacancy, the ward from which he or she 35
5050 is appointed, and shall forfeit their office if they remove 36
5151 their residence from the ward. Such vacancy may be 37
5252 declared, and the office filled by the remaining members of 38
5353 the board as provided by law. 39
5454 4. Elected members of the board in office on August 40
5555 28, 2022, shall hold office for the length of term for which 41
5656 they were elected, and until their successors are elected 42
5757 and qualified, and any members appointed to fill vacancies 43
5858 in office occurring after August 28, 2022, shall serve until 44
5959 the next general municipal election, at which time a 45
6060 successor shall be elected to serve for the remainder of the 46
6161 term to which the replaced member was elected. 47
6262 5. At the first general municipal election to occur 48
6363 after the effective date of this act, the elections for the 49 SB 949 3
6464 seats of any expiring terms or appointed terms, as provided 50
6565 herein, of at-large board members shall be filled by persons 51
6666 elected from the lowest -numbered wards, as those war ds are 52
6767 created and numbered by the apportionment commission. The 53
6868 second such general municipal election shall be for the 54
6969 lowest-numbered wards not filled at the prior election, and 55
7070 the third such election shall be for the remaining wards not 56
7171 filled at the prior two elections. 57
7272 6. The law governing school districts and seven - 58
7373 director school districts shall continue to apply to any 59
7474 district described in this section, except as expressly 60
7575 provided in this section. 61
