BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Section537.600,RSMo,isrepealedandonenewsectionenactedinlieu 2thereof,tobeknownassection537.600,toreadasfollows: 537.600.1.Suchsovereignorgovernmentaltortimmunityasexistedatcommonlaw 2inthisstatepriortoSeptember12,1977,excepttotheextentwaived,abrogatedormodified 3bystatutesineffectpriortothatdate,shallremaininfullforceandeffect;exceptthat,the 4immunityofthepublicentityfromliabilityandsuitforcompensatorydamagesfornegligent 5actsoromissionsisherebyexpresslywaivedinthefollowinginstances: 6 (1)Injuriesdirectlyresultingfromthenegligentactsoromissionsbypublic 7employeesarisingoutoftheoperationofmotorvehiclesormotorizedvehicleswithinthe 8courseoftheiremployment; 9 (2)Injuriescausedbytheconditionofapublicentity'spropertyiftheplaintiff 10establishesthatthepropertywasindangerousconditionatthetimeoftheinjury,thatthe 11injurydirectlyresultedfromthedangerouscondition,thatthedangerousconditioncreateda 12reasonablyforeseeableriskofharmofthekindofinjurywhichwasincurred,andthateithera 13negligentorwrongfulactoromissionofanemployeeofthepublicentitywithinthecourseof 14hisemploymentcreatedthedangerousconditionorapublicentityhadactualorconstructive 15noticeofthedangerousconditioninsufficienttimepriortotheinjurytohavetakenmeasures 16toprotectagainstthedangerouscondition.Inanyactionunderthissubdivisionwhereina 17plaintiffallegesthathewasdamagedbythenegligent,defectiveordangerousdesignofa EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18highwayorroad,whichwasdesignedandconstructedpriortoSeptember12,1977,thepublic 19entityshallbeentitledtoadefensewhichshallbeacompletebartorecoverywheneverthe 20publicentitycanprovebyapreponderanceoftheevidencethattheallegednegligent, 21defective,ordangerousdesignreasonablycompliedwithhighwayandroaddesignstandards 22generallyacceptedatthetimetheroadorhighwaywasdesignedandconstructed. 23 2.Theexpresswaiverofsovereignimmunityintheinstancesspecifiedin 24subdivisions(1)and(2)ofsubsection1ofthissectionareabsolutewaiversofsovereign 25immunityinallcaseswithinsuchsituationswhetherornotthepublicentitywasfunctioning 26inagovernmentalorproprietarycapacityandwhetherornotthepublicentityiscoveredbya 27liabilityinsurancefortort. 28 3.Theterm"publicentity"asusedinthissectionshallincludeanymultistate 29compactagencycreatedbyacompactformedbetweenthisstateandanyotherstatewhichhas 30beenapprovedbytheCongressoftheUnitedStates. 31 4.Whenactingwithinthescopeofagovernmentcontract,privatecontractorsof 32apublicentity,excludingthoseprivatecontractorsprovidedforinsection210.114,shall 33havesovereignorgovernmentaltortimmunitytothesameextentasapublicentity, 34includinganylimitationonawardsforliabilityprovidedforinsection537.610. ✔ HB101 2
