2knownassection407.021,toreadasfollows:
407.021.1.Forthepurposesofthissection,thefollowingtermsshallmean:
2 (1)"Counterfeitlighter",anylighterthatinfringesontheintellectualproperty
3rightsofanycitizenoftheUnitedStatesoranyentitythatisprotectedbyanyfederalor
4stateintellectualpropertylaw;
5 (2)"Lighter",anyelectricalormechanicaldevicethat:
6 (a)Operatesusinganytypeoffuelorpowersource,including,butnotlimitedto,
7butane,isobuteneoranotherliquidfuel,orsourceofelectricalenergy,includingbutnot
8limitedtoalltypesofbatteries;and
9 (b)Istypicallyusedtolightcigarettes,cigarsorpipes,candles,charcoalorgas
10grills,orfireplaces;
11 (3)"Noveltylighter",lightersthatarerecognizedasappealingtoorintendedfor
12useofchildrenunderfiveand:
13 (a)Thatphysicallyresembleinshapeacartooncharacter,toy,gun,watch,
14musicalinstrument,vehicle,toyanimal,foodorbeverageorsimilararticles;or
15 (b)Thatplaymusicalnotes,orhaveflashinglightsforentertainment;provided,
16however,that"noveltylighters"donotincludestandarddisposableorrefillablelighters
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17thatareprintedordecoratedwithlogos,labels,decals,artwork,emblems,engravings,
18etchings,inscriptions,orheatshrinkablesleeves;
19 (4)"Unsafelighter":
20 (a)AnydisposableorrefillablelightersthatdonotcomplywithAmerican
21SocietyforTestingandMaterialsStandardF400-20,asamended;and
22 (b)AnygrillorutilitylightersthatdonotcomplywithAmericanSocietyfor
23TestingandMaterialsStandardF2201-20,asamended.
24 2.Exceptasprovidedinsubsection3ofthissection,nopersonshallofferorsell
25anynoveltylighters,counterfeitlighters,orunsafelightersinthisstate,including,but
26notlimitedto,bywayofprovidingafreesampletoapersoninthisstate,regardlessof
27whethersuchpersonisofferingorsellingsuchlightersonaretailbasis,wholesalebasis,
28online,orinperson.
29 3.Theprovisionsofthissectionshallnotbeconstruedtoprohibit:
30 (1)Theinterstatetransportationofcounterfeitlightersorunsafelighters
31throughthisstate;or
32 (2)Thestorageofcounterfeitlightersorunsafelightersinanydistribution
33centerorwarehouselocatedinthisstateifsuchdistributioncenterorwarehouseis
34closedtothepublicanddoesnotdistributeorsell,atretail,suchlighterstothepublic.
