SectionA.Chapters565and569,RSMo,areamendedbyaddingtheretotwonew
2sections,tobeknownassections565.096and569.154,toreadasfollows:
565.096.1.Asusedinthissection,thefollowingtermsandphrasesmean:
2 (1)"Harassment",verbalornonverbalbehaviorbyapersonthatwouldcausea
3reasonablepersontobeplacedinfearofreceivingbodilyharm;
4 (2)"Recreationathleticcontestofficial",anyreferee,umpire,coach,instructor,
5administrator,staffperson,orrecreationemployeeofanypublicorquasi-public
6recreationprogram;
7 (3)"Schoolathleticcontestofficial",anyreferee,umpire,coach,instructor,
8administrator,staffperson,orschoolorschoolboardemployeeofanypublicorprivate
9elementaryorsecondaryschool.
10 2.Apersoncommitstheoffenseofharassmentofaschoolorrecreationathletic
11contestofficialiftheharassmentoccursunderthefollowingcircumstances:
12 (1)Whiletheschoolorrecreationathleticcontestofficialisactivelyengagedin
13theconducting,supervising,refereeing,orofficiatingofaschool-sanctioned
14interscholasticathleticcontestorasanctionedrecreationathleticcontest;or
15 (2)Intheimmediatevicinityofaschool-sanctionedinterscholasticathletic
16contestorasanctionedrecreationathleticcontestandisbasedontheofficial's
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17performanceintheconducting,supervising,refereeing,orofficiatingofaschool-
18sanctionedinterscholasticathleticcontestorasanctionedrecreationathleticcontest.
19 3.Apersonwhocommitstheoffenseofharassmentofaschoolorrecreation
20athleticcontestofficialshallbefinednomorethanfivehundreddollars,imprisonedfor
21nomorethanninetydays,orboth.
22 4.Inadditiontoanyotherpenaltyimposed,thecourtshallordertheperson:
23 (1)Toperformfortyhoursofcourt-approvedcommunityservicework;and
24 (2)Toparticipateinacourt-approvedcounselingprogramthatmayinclude
25angermanagement,abusivebehaviorinterventiongroups,oranyothertypeof
26counselingdeemedappropriatebythecourt.Anycostsassociatedwiththecounseling
27programshallbepaidbysuchperson.
28 5.Participationinthecommunityserviceandcounselingprogramrequired
29undersubsection4ofthissectionshallnotbesuspended.
569.154.1.Apersoncommitstheoffenseofentryorremainingonsiteofa
2schoolorrecreationathleticcontestifsuchperson,withoutauthority,goesintoorupon
3orremainsinorupon,orattemptstogointooruponorremaininorupon,any
4immovablepropertyorothersiteorlocationthatbelongstoanotherandthatisusedfor
5anyschoolorrecreationathleticcontest,includinganyareaintheimmediatevicinityof
6thesiteorlocationoftheschoolorrecreationathleticcontest,afterhavingbeen
7forbiddentodoso,eitherorallyorinwriting,byanyowner,lessee,orcustodianofthe
8propertyorbyanyotherauthorizedperson.
9 2.Apersonwhoviolatessubsection1ofthissectionshallbefinednomorethan
10fivehundreddollars,imprisonedfornomorethansixmonths,orboth.
