SectionA.Chapter191,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection191.1175,toreadasfollows:
191.1175.1.Subjecttoappropriation,thereisherebyestablishedathree-year
2pilotprogramforthepurposeofimplementingandstudyingtheefficacy,publichealth,
3andpublicsafetyoutcomesoftheuseoffentanyltestingstripsbyindividualsaddictedto
4opioidsandothersubstances.
5 2.Thedepartmentofhealthandseniorservicesshalldevelopthethree-yearpilot
6programtoimplementandstudythepublichealthandpublicsafetyoutcomesof
7fentanyltestingstrips.Thepilotprogramshallbeacompetitivegrantprocess.The
8departmentofhealthandseniorservicesshalldevelopcriteriaforgranteligibility,
9whichshallincludetheimplementationofafentanyltestingprogramthatshallbe
10designedto:
11 (1)Enablethosestrugglingwithopioidandotherdrugaddictiontotestforthe
12presenceoffentanylandotherderivativesbeforeeachepisodeofdruguse;
13 (2)Studytheprogram'spublichealthandpublicsafetyoutcomes,includingany
14strategiesorbehaviorsadoptedbyindividualsusingteststripsthatresultinthe
15reductionofoverdoseandoverdosedeath;and
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 16 (3)Enabletheuseoffentanylteststripsbypolice,serviceproviders,individuals
17dependentondrugs,andotherstosupportthecreationofrapidresponsesystemsand
18publichealthwarningstoreduceincidenceofoverdosedeaths.
19 3.Thedepartmentofhealthandseniorservicesshalldevelopandmakepublica
20listoflaboratoriesofferingqualityteststrips.Thelistshallbeupdatedannuallyaspart
21ofthepilotprogram.
22 4.(1)Thereisherebycreatedinthestatetreasurythe"FentanylTestingStrip
23ProgramFund",whichshallconsistofmoneysappropriatedtoitbythegeneral
24assemblyandanygifts,contributions,grants,orbequestsreceivedfromfederal,private,
25orothersources.Thestatetreasurershallbecustodianofthefund.Inaccordancewith
26sections30.170and30.180,thestatetreasurermayapprovedisbursements.Thefund
27shallbeadedicatedfundand,uponappropriation,moneysinthisfundshallbeused
28solelyasprovidedinthissection.
29 (2)Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys
30remaininginthefundattheendofthebienniumshallnotreverttothecreditofthe
31generalrevenuefund.
32 (3)Thestatetreasurershallinvestmoneysinthefundinthesamemanneras
33otherfundsareinvested.Anyinterestandmoneysearnedonsuchinvestmentsshallbe
34creditedtothefund.
35 5.(1)Thedepartmentofhealthandseniorservicesmaypromulgaterulesand
36regulationsforthepilotprogram,whichmayinclude,butnotbelimitedto:
37 (a)Rulesthatregulatethenatureandmanneroftesting;
38 (b)Rulesthatregulatetheproceduresandapparatusfortesting;
39 (c)Rulesthatrequireandprovideforadatacollectionandmanagementplanto
40beusedbythedepartmentofhealthandseniorservicestomanageoutreach,testing,
41dataaccess,feesandfeepayments,andanyrequiredreports;and
42 (d)Rulesthatallowforthoseparticipatingintheprogram,inadditiontoany
43andallnecessaryeducation,treatment,orrehabilitationprograms,toaccess
44governmentandnongovernmentaldrugaddictiontreatmentprogramswhile
45accessingfentanyltestingstrips.
46 (2)Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
47createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifit
48complieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,
49section536.028.Thissectionandchapter536arenonseverableandifanyofthepowers
50vestedwiththegeneralassemblypursuanttochapter536toreview,todelaythe
51effectivedate,ortodisapproveandannularulearesubsequentlyheldunconstitutional,
HB1032	2 52thenthegrantofrulemakingauthorityandanyruleproposedoradoptedafterAugust
5328,2023,shallbeinvalidandvoid.
54 6.Thedepartmentofhealthandseniorservicesshalldevelopguidelinesandan
55evaluationprocessforreviewofthefentanyltestingstripprogram.
56 7.Thedepartmentofhealthandseniorservicesshallreportannuallyonthe
57activitiesandstatusoftheprogramtothegeneralassemblyandtothechairsofboththe
58houseofrepresentativesandsenatestandingcommitteeswithjurisdictionovermatters
59relatingtohealthcare.Thereportshallincludealistanddescriptionofallprograms
60thatreceivedgrantfunds,thesizeofthegrantawardedtoeachprogram,othersources
61ofpublicfundsthatsupportedeachprogram,andadetailedanalysisoftheimpactof
62eachprogram,includingthenumberofindividualsparticipating,thetypesofservices
63eachparticipantreceived,thehealthandsafetyoutcomesoftheparticipantsatthetime
64theycompletedtheprogramandone,six,twelve,andtwenty-fourmonthsfollowing
65participationintheprogram,andthelivessavedandestimatedsavingsduetoreduced
66overdoses.
