HB1185 7 104.090.1.Thenormalannuityofamembershallequaloneandsix-tenthspercent 2oftheaveragecompensationofthemembermultipliedbythenumberofyearsofcreditable 3serviceofsuchmember.Inaddition,thenormalannuityofauniformedmemberofthepatrol 4shallbeincreasedbythirty-threeandone-thirdpercent. 5 2.Inaddition,auniformedmemberofthehighwaypatrolwhoisretiringwitha 6normalannuityafterattainingnormalretirementageshallreceiveanadditionalsumofninety 7dollarspermonthasacontributionbythesystemuntilsuchmemberattainstheageofsixty- 8fiveyears,whensuchcontributionshallcease.Toqualifyforthecontributionprovidedin 9thissubsectionbythesystem,theretireduniformedmemberofthehighwaypatrolismade, 10constituted,appointedandemployedbytheboardasaspecialconsultantontheproblemsof 11retirement,agingandotherstatematters.Suchadditionalcontributionshallbereducedeach 12monthbysuchamountearnedbytheretireduniformedmemberofthehighwaypatrolin 13gainfulemployment.Inordertoqualifyfortheadditionalcontributionprovidedinthis 14subsection,theretireduniformedmemberofthehighwaypatrolshallhavebeen: 15 (1)HiredbytheMissouristatehighwaypatrolpriortoJanuary1,1995;and 16 (2)EmployedbytheMissouristatehighwaypatrolorreceivinglong-termdisability 17orwork-relateddisabilitybenefitsonthedaybeforetheeffectivedateofthemember's 18retirement. 19 3.Inlieuoftheannuitypayabletothememberpursuanttosection104.100,a 20memberwhoseageatretirementisforty-eightormoremayelectinthemember'sapplication 21forretirementtoreceiveoneofthefollowing: 22 Option1. 23 Anactuarialreductionapprovedbytheboardofthemember'sannuityinreduced 24monthlypaymentsforlifeduringretirementwiththeprovisionthatuponthemember'sdeath 25thereducedannuityatdateofdeathshallbecontinuedthroughoutthelifeof,andbepaidto, 26themember'sspouse;or 27 Option2. 28 Themember'snormalannuityinregularmonthlypaymentsforlifeduringretirement 4.Theelectionmaybemadeonlyintheapplicationforretirement,andsuch 52applicationshallbefiledatleastthirtydaysbutnotmorethanninetydayspriortothedateon 53whichtheretirementofthememberistobeeffective,providedthatifeitherthememberor 54thespousenominatedtoreceivethesurvivorshippaymentdiesbeforetheeffectivedateof 55retirement,theelectionshallnotbeeffective.Ifafterthereducedannuitycommences,the 56spousepredeceasestheretiredmember,thereducedannuitycontinuestotheretiredmember 57duringthemember'slifetime. 58 5.EffectiveJuly1,2000,amembermaymakeanelectionunderoption1or2after 59thedateretirementbenefitsareinitiatedifthemembermakestheelectionwithinoneyear 60fromthedateofmarriageorJuly1,2000,whicheverislater,underanyofthefollowing 61circumstances: 62 (1)Thememberelectedtoreceiveanormalannuityandwasnoteligibletoelect 63option1or2onthedateretirementbenefitswereinitiated;or 64 (2)Themember'sannuityrevertedtoanormalannuitypursuanttosubsection7of 65thissectionorsubsection[7or]8ofsection104.103andthememberremarried;or 66 (3)Thememberelectedoption1or2butthemember'sspouseatthetimeof 67retirementhasdiedandthememberhasremarried. 68 6.AnypersonwhoterminatesemploymentorretirespriortoJuly1,2000,shallbe 69made,constituted,appointedandemployedbytheboardasaspecialconsultantonthe 70problemsofretirement,agingandotherstatematters,andforsuchservicesshallbeeligibleto 71electtoreceivethebenefitsdescribedinsubsection5ofthissection. 72 7.ForretirementapplicationsfiledonorafterAugust28,2004,thebeneficiaryfor 73eitheroption1oroption2ofsubsection3ofthissectionshallbethemember'sspouseatthe 74timeofretirement.Ifthemember'smarriageendsafterretirementasaresultofadissolution HB1185 9 75ofmarriage,suchdissolutionshallnotaffecttheoptionelectionandtheformerspouseshall 76continuetobeeligibletoreceivesurvivorbenefitsupondeathofthemember,excepta 77membermaycancelhisorherelectionif: 78 (1)Thedissolutionofmarriageofthememberandformerspouseoccurredonorafter 79January1,2021,andthedissolutiondecreeprovidesforsoleretentionbythememberofall 80rightsintheannuityandprovidesthattheformerspouseshallnotbeentitledtoanysurvivor 81benefitspursuanttothischapter;or 82 (2)Thedissolutionofmarriageofthememberandformerspouseoccurredpriorto 83January1,2021,and: 84 (a)Thedissolutiondecreeprovidedforthesoleretentionbythememberofallrights 85intheannuitypursuanttothischapter,andthepartiesobtainedanamendedormodified 86dissolutiondecreeafterJanuary1,2021,providingforimmediateremovaloftheformer 87spouseasthebeneficiaryentitledtosurvivorbenefitstothesatisfactionofthesystem;or 88 (b)Thedissolutiondecreedoesnotprovideforthesoleretentionbythememberofall 89rightsintheannuityandthepartiesobtainedanamendedormodifieddissolutiondecreeafter 90January1,2021,whichprovidesforthesoleretentionbythememberofallrightsinthe 91annuityandprovidesthattheformerspouseshallnotbeentitledtoanysurvivorbenefits 92pursuanttothischapter. 93 94Uponmeetingtherequirementsofsubdivision(1)or(2)ofthissubsection,themonthly 95benefitpayableforthelifetimeofthemembershallbetheactuarialequivalentoftheannuity 96payablepursuanttotheprovisionsofoption1oroption2ofsubsection3ofthissection,as 97adjustedforearlyretirementifapplicable.Innoeventshallthemonthlybenefitpayablefor 98thelifetimeofthememberbegreaterthantheamountthatwouldhavebeenpayabletothe 99memberundersubsection7or8ofsection104.103,whicheverisapplicable,hadtheformer 100spousediedonthedateofthedissolutionofmarriage.Anyincreaseintheannuityamount 101pursuanttothissubsectionshallbeprospectiveandeffectivethefirstofthemonthfollowing 102thedateofreceiptbythesystemofacertifiedcopyofthedissolutiondecreethatmeetsthe 103requirementsofthissubsection. 104 8.Anyapplicationforretirementshallonlybecomeeffectiveonthefirstdayofthe 105month. 104.170.1.Theboardshallelect[bysecretballot] onememberaschairandone 2memberasvicechairatthefirstboardmeetingofeachyear.Thechairmaynotservemore 3thantwoconsecutivetermsbeginningafterAugust13,1988.Thechairshallpresideover 4meetingsoftheboardandperformsuchotherdutiesasmayberequiredbyactionofthe 5board.Thevicechairshallperformthedutiesofthechairintheabsenceofthelatterorupon 6thechair'sinabilityorrefusaltoact. HB1185 10 7 2.Theboardshallappointafull-timeexecutivedirector,whoshallnotbe 8compensatedforanyotherdutiesunderthestatehighwaysandtransportationcommission. 9Theexecutivedirectorshallhavechargeoftheofficesandrecordsandshallhiresuch 10employeesthattheexecutivedirectordeemsnecessarysubjecttothedirectionoftheboard. 11Theexecutivedirectorandallotheremployeesofthesystemshallbemembersofthesystem 12andtheboardshallmakecontributionstoprovidetheinsurancebenefitsavailablepursuantto 13section104.270onthesamebasisasprovidedforotherstateemployeespursuanttothe 14provisionsofsection104.515,andalsoshallmakecontributionstoprovidetheretirement 15benefitsonthesamebasisasprovidedforotheremployeespursuanttotheprovisionsof 16sections104.090to104.260.Theexecutivedirectorisauthorizedtoexecutealldocuments 17includingcontractsnecessarytocarryoutanyandallactionsoftheboard. 18 3.Anysummonsorotherwritissuedbythecourtsofthestateshallbeservedupon 19theexecutivedirectoror,intheexecutivedirector'sabsence,ontheassistantdirector. 104.200.Shouldanyerrorinanyrecordsresultinany[member's] memberor 2[beneficiary's] beneficiaryreceivingmoreorlessthanheorshewouldhavebeenentitledto 3receivehadtherecordsbeencorrect,theboardshallcorrectsucherror,and,asfaras 4practicable,makefuturepaymentsinsuchamannerthattheactuarialequivalentofthebenefit 5towhichsuchmemberorbeneficiarywasentitledshallbepaid,andtothisendmayrecover 6anyoverpayments.Inallcasesinwhichsucherrorhasbeenmade,nosucherrorshallbe 7correctedunlessthesystemdiscoversorisnotifiedofsucherrorwithintenyearsafterthe 8[initial] member'sannuitystartingdateordateoferror,whicheveroccurslater.Incases 9offraud,anyerrordiscoveredshallbecorrectedwithoutconcernfortheamountoftime 10thathaspassed. 7thepartiestoanyactionfordissolutionofmarriage.Adivisionofbenefitsorderissued 8pursuanttothissection: 9 (1)Shallnotrequiretheapplicableretirementsystemtoprovideanyformortypeof 10annuityorretirementplannotselectedbythememberandnotnormallymadeavailableby 11thatsystem; 12 (2)Shallnotrequiretheapplicableretirementsystemtocommencepaymentsuntil (4)Shallnotrequirethepaymentofanannuityamounttothememberandalternate 29payeewhichintotalexceedstheamountwhichthememberwouldhavereceivedwithout 30regardtotheorder; 31 (5)Shallprovidethatanybenefitformulaincreases,additionalyearsofservice, 32increasedaveragecompensationorothertypeofincreasesaccruedafterthedateofthe (9)Shallbeconsistentwithanyotherdivisionofbenefitsorderswhichareapplicable 44tothesamemember; 45 (10)Shallnotrequiretheapplicableretirementsystemtocontinuepaymentstothe 46alternatepayeeifthemember'sretirementbenefitissuspendedorwaivedasprovidedbythis 47chapterbutsuchpaymentsshallresumewhentheretireebeginstoreceiveretirementbenefits 48inthefuture. 49 2.Asystemestablishedbythischaptershallprovidethecourthavingjurisdictionofa 50dissolutionofmarriageproceedingorthepartiestotheproceedingwithinformation 51necessarytoissueadivisionofbenefitsorderconcerningamemberofthesystem,upon HB1185 12 52writtenrequestfromeitherthecourt,thememberorthemember'sspouse,whichcitesthis 53sectionandidentifiesthecasenumberandparties. 54 3.Asystemestablishedbythischaptershallhavethediscretionaryauthoritytoreject 55adivisionofbenefitsorderforthefollowingreasons: 56 (1)Theorderdoesnotclearlystatetherightsofthememberandthealternatepayee; 57 (2)Theorderisinconsistentwithanylawgoverningtheretirementsystem. 58 4.Theamountpaidtoanalternatepayeeunderanorderissuedpursuanttothis 59sectionshallbebasedontheplanthememberwasinonthedateofthedissolutionof 60marriage;exceptthatanyannualbenefitincreasessubjecttodivisionshallbebasedonthe 61actualannualbenefitincreasesreceivedaftertheretirementplanelection. 62 5.Anyannuitypayableundersection104.625thatissubjecttoadivisionof 63benefitorderunderthissectionshallbecalculatedasfollows: 64 (1)Ininstancesofdivorceafterretirement,anyserviceorcompensationofa 65memberbetweentheretroactivestartingdateandtheannuitystartingdateshallnotbe 66consideredcreditableserviceorcompensation;and 67 (2)Thelump-sumpaymentdescribedinsubdivision(3)ofsection104.625shall 68notbesubjecttoanydivisionofbenefitorder. 104.410.1.Anyuniformedmemberofthewaterpatrolwhoshallbeaffirmatively 2foundbytheboardtobewhollyandpermanentlyincapableofholdinganypositionofgainful 3employmentasaresultofinjuriesorillnessincurredintheperformanceofthemember's 4dutiesshallbeentitledtoreceivedisabilitybenefitsinanamountequaltoone-halfofthe 5compensationthattheemployeewasreceivingatthetimeoftheoccurrenceoftheinjury 6entitlingtheemployeetosuchdisabilitybenefits.Anydisabilitybenefitpayablepursuantto 7thissubsectionshallbedecreasedbyanyamountpaidtosuchuniformedmemberofthewater 8patrolbyreasonoftheworkers'compensationlawsofthisstate.Afterterminationof 9paymentunderworkers'compensation,however,anysuchreductionanddisabilitybenefits 10shallberestored. 11 2.Theboardoftrusteesmayrequireamedicalexaminationofanyuniformed 12memberofthewaterpatrolwhoisreceivingdisabilitybenefitspursuanttothissectionatany 13timebyadesignatedphysician,anddisabilitybenefitsshallbediscontinuediftheboardfinds 14thatsuchmemberisabletoperformthedutiesofthemember'sformerposition,orifsuch 15memberrefusestosubmittosuchanexamination. 16 3.Thedisabilitybenefitsdescribedinthissectionshallnotbepaidtoanyuniformed 17memberofthewaterpatrolwhohasretainedorregainedmorethanfiftypercentofthe 18member'searningcapacity.Ifanyuniformedmemberofthewaterpatrolwhohasbeen 19receivingdisabilitybenefitsagainbecomesanemployee,themember'sdisabilitybenefits 20shallbediscontinued,themember'spriorperiodofcreditableserviceshallberestored,and HB1185 13 21anysubsequentdeterminationofbenefitsduethememberorthemember'ssurvivorsshallbe 22basedonthesumofthemember'screditableserviceaccruedtothedatethemember's 23disabilitybenefitscommencedandtheperiodofcreditableserviceafterthemember'sreturn 24toemployment. 25 4.Anyuniformedmemberofthewaterpatrolreceivingbenefitspursuanttothe 26provisionsofthissectionforfiveormoreyearsimmediatelypriortoattainmentofagefifty- 27fiveshallbeconsideredanormalretirantatagefifty-five,andmayelect,withinthirtydays 28precedingtheattainmentofagefifty-five,option1ofsection104.395,butonlyforthe 29member'sspousewhowasthemember'sspousefortwoormoreyearspriortothemember's 30attainmentofagefifty-five. 31 5.AnymemberwhoisreceivingdisabilitybenefitsasofDecember31,1985,orany 32memberwhoisdisabledonDecember31,1985,andwouldhavebeenentitledtoreceive 33disabilitybenefitspursuanttothissectionastheprovisionsofthissectionexisted 34immediatelypriortoSeptember28,1985,shallbeeligibletoreceiveorshallcontinueto 35receivebenefitsinaccordancewithsuchpriorprovisionsofthissectionuntilthemember 36againbecomesanemployee;however,allemployeesofthedepartmentofconservationwho 37aredisabledshallreceivebenefitspursuantonlytothissectionorsection104.518,whichever 38isapplicable,andshallnotbeeligibleforbenefitsunderanyotherplanorprogrampurchased 39orprovidedafterSeptember28,1985. 40 6.Anymemberwhoqualifiesfordisabilitybenefitspursuanttosubsection1ofthis 41sectionorpursuanttotheprovisionsofsection104.518,orunderalong-termdisability 42programprovidedbythemember'semployingdepartmentasaconsequenceofemployment 43bythedepartment,shallcontinuetoaccruecreditableservicebasedonthemember'srateof 44payimmediatelypriortothedatethememberbecamedisabledinaccordancewithsections 45104.370,104.371,104.374and104.615,untilthedatethemember'sretirementbenefitgoes 46intopaystatus,thedisabilitybenefitsceasebeingpaidtothemember,orthememberisno 47longerdisabled,whichevercomesfirst.Personscoveredbytheprovisionsofsections 48476.515to476.565orsections287.812to287.855,whoqualifyfordisabilitybenefits 49pursuanttotheprovisionsofsection104.518,atthedatethepersonbecomesdisabled,shall 50continuetoaccruecreditableservicebasedontheperson'srateofpayimmediatelypriorto 51thedatethepersonbecomesdisableduntilthedatetheperson'sretirementbenefitgoesinto 52paystatus,thedisabilitybenefitsceasebeingpaidtothepersonorthepersonisnolonger 53disabled,whichevercomesfirst.Membersorpersonscontinuingtoaccruecreditableservice 54pursuanttothissubsectionshallbeentitledtocontinuetheirlifeinsurancecoveragesubjectto 55theprovisionsofthelifeinsuranceplanadministeredbytheboardpursuanttosection 56104.517.Therateofpayforpurposesofcalculatingretirementbenefitsforamemberor 57persondescribedinthissubsectionwhobecomesdisabledandretiresonorafterAugust28, HB1185 14 581999,shallbethemember'sorperson'sregularmonthlycompensationreceivedatthetimeof 59disablement,increasedthereafterforanyincreasesintheconsumerpriceindex.Such 60increasesinthemember'smonthlypayshallbemadeannuallybeginningtwelvemonthsafter 61disablementandshallbeequaltoeightypercentoftheincreaseintheconsumerpriceindex 62duringthecalendaryearpriortotheadjustment,butnotmorethanfivepercentofthe 63member'smonthlypayimmediatelybeforetheincrease.Suchaccrualsshallcontinueuntil 64theearliestof:receiptofanearlyretirementannuity,attainmentofnormalretirement 65eligibilityorterminationofdisabilitybenefits. 66 7.Amemberorpersonwhocontinuestobedisabledasprovidedinsubsection6of 67thissectionuntilthemember'snormalretirementageshallbeeligibletoretireonthefirstday 68ofthemonthnextfollowingthemember'sorperson'sfinalpaymentpursuanttosection 69104.518or,ifapplicable,subsection1ofthissection.Amemberorpersonwhoretires 70pursuanttothissubsectionshallreceivethegreaterofthenormalannuityortheminimum 71annuity,ifapplicable,determinedpursuanttosections104.370,104.371,104.374and 72104.615,andsection287.820,andsection476.530asifthememberorpersonhadcontinued 73intheactiveemployoftheemployeruntilthemember'sorperson'sretirementbenefitgoes 74intopaystatus,thedisabilitybenefitsceasebeingpaidtothememberorperson,orthe 75memberorpersonisnolongerdisabled,whichevercomesfirstandthemember'sorperson's 76compensationforsuchperiodhadbeenthemember'sorperson'srateofpayimmediately 77precedingthedatethememberorpersonbecamedisabled. 78 8.Ifamemberwhohasbeendisabledbecomesanemployeeagainandifthemember 79wasdisabledduringtheentireperiodofthemember'sabsence,thenthemembershallresume 80activeparticipationasofthedateofreemployment.Suchamembershallreceivecreditable 81servicefortheentireperiodthememberwasdisabledasprovidedinsubsection6ofthis 82section. 83 9.Ifamemberceasestobedisabledandifthememberdoesnotreturntoworkas 84providedinsubsection8ofthissection,themember'srightstofurtherbenefitsshallbe 85determinedinaccordancewithsections104.335,104.380,104.400,104.420and104.615as 86thoughthememberhadwithdrawnfromserviceasofthedatethememberceasedtobe 87disabled,asdeterminedbythesystem. 88 10.Membersofthegeneralassemblywhoareaccruingserviceundersubsection 896ofthissectionshallcontinuetoaccrueserviceuntiltheearliestofattainmentofnormal 90retirementageeligibility,terminationofdisabilitybenefits,ortheendofthemember's 91constitutionallymandatedlimitonserviceasamemberofthegeneralassemblyforthe 92chamberinwhichthememberwasservingatthetimeofdisablement. 93 11.Statewideelectedofficialswhoareaccruingserviceundersubsection6ofthis 94sectionshallcontinuetoaccrueserviceuntiltheearliestofattainmentofnormal HB1185 15 95retirementageeligibility,terminationofdisabilitybenefits,ortheendofthestatewide 96electedofficial'sconstitutionallymandatedlimitonserviceasastatewideelectedofficial 97fortheofficeinwhichthestatewideelectedofficialwasservingatthetimeof 98disablement. 104.436.1.Theboardintendstofollowafinancingpatternwhichcomputesand 2requirescontributionamountswhich,expressedaspercentsofactivememberpayroll,will 3remainapproximatelylevelfromyeartoyearandfromonegenerationofcitizenstothenext 4generation.Suchcontributiondeterminationsrequireregularactuarialvaluations,whichshall 5bemadebytheboard'sactuary,usingassumptionsandmethodsadoptedbytheboardafter 6consultingwithitsactuary.Theentryagenormalcostvaluationmethodshallbeusedin 7determiningthenormalcost[, andcontributionsforunfundedaccruedliabilitiesshallbe 8determinedusinglevelpercent-of-payrollamortization] calculation. 9 2.Atleastninetydaysbeforeeachregularsessionofthegeneralassembly,theboard 10shallcertifytothedivisionofbudgetthecontributionratenecessarytocovertheliabilitiesof 11theplanadministeredbythesystem,includingcostsofadministration,expectedtoaccrue 12duringthenextappropriationperiod.Thecommissionerofadministrationshallrequest 13appropriationoftheamountcalculatedpursuanttotheprovisionsofthissubsection. 14Followingeachpayperiod,thecommissionerofadministrationshallrequisitionandcertify 15thepaymenttotheexecutivedirectoroftheMissouristateemployees'retirementsystem.The 16executivedirectorshallpromptlydeposittheamountscertifiedtothecreditoftheMissouri 17stateemployees'retirementfund. 18 3.Theemployersofmembersofthesystemwhoarenotpaidoutoffundsthathave 19beendepositedinthestatetreasuryshallremitpromptlytotheexecutivedirectoranamount 20equaltotheamountwhichthestatewouldhavepaidifthosemembershadbeenpaidentirely 21fromstatefunds.Theexecutivedirectorshallpromptlydeposittheamountscertifiedtothe 22creditoftheMissouristateemployees'retirementsystemfund. 23 4.Theseamountsarefundsofthesystem,andshallnotbecommingledwithany 24fundsinthestatetreasury. 104.490.1.Shouldanyerrorresultinanymemberorbeneficiaryreceivingmoreor 2lessthanheorshewouldhavebeenentitledtoreceivehadtheerrornotoccurred,theboard 3shallcorrectsucherror,and,asfaraspracticable,makefuturepaymentsinsuchamannerthat 4theactuarialequivalentofthebenefittowhichsuchmemberorbeneficiarywasentitledshall 5bepaid,andtothisendmayrecoveranyoverpayments.Inallcasesinwhichsucherrorhas 6beenmade,nosucherrorshallbecorrectedunlessthesystemdiscoversorisnotifiedofsuch 7errorwithintenyearsafterthe[initial] member'sannuitystartingdateordateoferror, 8whicheveroccurslater.Incasesoffraud,anyerrordiscoveredshallbecorrected 9withoutconcerntotheamountoftimethathaspassed. HB1185 16 10 2.Apersonwhoknowinglymakesafalsestatement,orfalsifiesorpermitstobe 11falsifiedarecordofthesystem,inanattempttodefraudthesystemissubjecttofineor 12imprisonmentpursuanttotheMissourirevisedstatutes. 13 3.TheboardoftrusteesoftheMissouristateemployees'retirementsystemshall 14ceasepayingbenefitstoanysurvivororbeneficiarywhoischargedwiththeintentional 15killingofamemberwithoutlegalexcuseorjustification.Asurvivororbeneficiarywhois 16convictedofsuchchargeshallnolongerbeentitledtoreceivebenefits.Ifthesurvivoror 17beneficiaryisnotconvictedofsuchcharge,theboardshallresumepaymentofbenefitsand 18shallpaythesurvivororbeneficiaryanybenefitsthatweresuspendedpendingresolutionof 19suchcharge. 104.515.1.Separateaccountsformedical,lifeinsuranceanddisabilitybenefits 2providedpursuanttosections104.517and104.518shallbeestablishedaspartofthefund. 3Thefunds,propertyandreturnoninvestmentsoftheseparateaccountshallnotbe 4commingledwithanyotherfunds,propertyandinvestmentreturnofthesystem.Allbenefits 5andpremiumsarepaidsolelyfromtheseparateaccountformedical,lifeinsuranceand 6disabilitybenefitsprovidedpursuanttothissection. 7 2.Thestateshallcontributeanamountasappropriatedbylawandapprovedbythe 8governorpermonthformedicalbenefits,lifeinsuranceandlong-termdisabilitybenefitsas 9providedpursuanttothissectionandsections104.517and104.518.Suchamountsshall 10includethecostofprovidinglifeinsurancebenefitsforeachactiveemployeewhoisa 11memberoftheMissouristateemployees'retirementsystem,amemberofthepublicschool 12retirementsystemandwhoisemployedbyastateagencyotherthananinstitutionofhigher 13learning,amemberoftheretirementsystemestablishedbysections287.812to287.855,the 14judicialretirementsystem,eachlegislatorandofficialholdinganelectivestateoffice, 15membersnotonpayrollstatuswhoarereceivingworkers'compensationbenefits,andifthe 16statehighwaysandtransportationcommissionsoelects,thoseemployeeswhoaremembers 17ofthestatetransportationdepartmentemployees'andhighwaypatrolretirementsystem;ifthe 18statehighwaysandtransportationcommissionsoelectstojointheplan,thestateshall 19contributeanamountasappropriatedbylawformedicalbenefitsforthoseemployeeswho 20aremembersofthetransportationdepartmentemployees'andhighwaypatrolretirement 21system;anadditionalamountequaltotheamountrequired,basedoncompetitivebiddingor 24104.518.Thisamountshallbereportedasaseparateiteminthemonthlycertificationof 25requiredcontributionswhichthecommissionerofadministrationsubmitstothestate 26treasurerandshallbedepositedtotheseparateaccountformedical,lifeinsuranceand 27disabilitybenefits.Allcontributionsmadeonbehalfofmembersofthestatetransportation HB1185 17 28departmentemployees'andhighwaypatrolretirementsystemshallbemadefromhighway 29funds.Ifthehighwaysandtransportationcommissionsoelects,thespousesand 30unemancipatedchildrenundertwenty-threeyearsofageofemployeeswhoaremembers 31ofthestatetransportationdepartmentemployees'andhighwaypatrolretirementsystemshall 32beabletoparticipateintheprogramofinsurancebenefitstocovermedicalexpensespursuant 33totheprovisionsofsubsection3ofthissection. 34 3.Theboardshalldeterminethepremiumamountsrequiredforparticipating 35employees.Thepremiumamountsshallbetheamount,which,togetherwiththestate's 36contribution,isrequiredtofundthebenefitsprovided,takingintoaccountnecessaryactuarial 37reserves.Separatepremiumsshallbeestablishedforemployees'benefitsandaseparate 38premiumorscheduleofpremiumsshallbeestablishedforbenefitsforspousesand 39unemancipatedchildrenundertwenty-threeyearsofageofparticipatingemployees.The 40employee'spremiumsforspouseandchildrenbenefitsshallbeestablishedtocoverthat 41portionofthecostofsuchbenefitswhichisnotpaidforbycontributionsbythestate.All 42suchpremiumamountsshallbepaidtotheboardoftrusteesatthetimethateachemployee's 43wagesorsalarywouldnormallybepaid.Thepremiumamountssoremittedwillbeplacedin 44theseparateaccountformedical,lifeinsuranceanddisabilitybenefits.Inlieuofthe 45availabilityofpremiumdeductions,theboardmayestablishalternativemethodsforthe 46collectionofpremiumamounts. 47 4.Eachspecialconsultanteligibleforlifebenefitsemployedbyaboardoftrusteesof 48aretirementsystemasprovidedinsection104.610whoisamemberoftheMissouristatelife 49insuranceplanorMissouristatetransportationdepartmentandMissouristatehighwaypatrol 50lifeinsuranceplanshall,inadditiontodutiesprescribedinsection104.610oranyotherlaw, 51anduponrequestoftheboardoftrustees,givetheboard,orallyorinwriting,ashortdetailed 52statementonlifeinsuranceanddeathbenefitproblemsaffectingretirees.Ascompensation 53fortheextradutyimposedbythissubsection,anyspecialconsultantasdefinedabove,other 54thanaspecialconsultantentitledtoadeferrednormalannuitypursuanttosection104.035or 55104.335,whoretiresonorafterSeptember28,1985,shallreceiveasapartofcompensation 56fortheseextraduties,adeathbenefitoffivethousanddollars,andanyspecialconsultantwho 57terminatesemploymentonorafterAugust28,1999,afterreachingnormalorearlyretirement 58ageandbecomesaretireewithin[sixty] sixty-fivedaysofsuchterminationshallreceivefive 59thousanddollarsoflifeinsurancecoverage.Inaddition,eachspecialconsultantwhoisa 60memberofthetransportationdepartmentemployees'andhighwaypatrolretirementsystem 61medicalinsuranceplanshallalsoprovidetheboard,uponrequestoftheboard,orallyorin 62writing,ashortdetailedstatementonphysical,medicalandhealthproblemsaffectingretirees. 63Ascompensationforthisextraduty,eachspecialconsultantasdefinedaboveshallreceive,in 64additiontoallothercompensationprovidedbylaw,ninedollars,oranamountequivalentto HB1185 18 65thatprovidedtootherspecialconsultantspursuanttotheprovisionsofsection103.115.In 66addition,anyspecialconsultantasdefinedinsection287.820orsection476.601who 67terminatesemploymentandimmediatelyretiresonorafterAugust28,1995,shallreceiveasa 68partofcompensationfortheseduties,adeathbenefitoffivethousanddollarsandanyspecial 69consultantwhoterminatesemploymentonorafterAugust28,1999,afterreachingtheageof 70eligibilitytoreceiveretirementbenefitsandbecomesaretireewithin[sixty] sixty-fivedays 71ofsuchterminationshallreceivefivethousanddollarsoflifeinsurancecoverage. 72 5.Anyformeremployeewhoisreceivingdisabilityincomebenefitsfromthe 73Missouristateemployees'retirementsystemorthetransportationdepartmentemployees'and 74highwaypatrolretirementsystemshall,uponapplicationwiththeboardoftrusteesofthe 75Missouriconsolidatedhealthcareplanorthetransportationdepartmentemployeesand 76highwaypatrolmedicalplan,bemade,constituted,appointedandemployedbytherespective 77boardasaspecialconsultantontheproblemsofthehealthofdisabilityincomerecipientsand, 78uponrequestoftheboardoftrusteesofeachmedicalplan,givetheboard,orallyorinwriting, 79ashortdetailedstatementofphysical,medicalandhealthproblemsaffectingdisability 80incomerecipients.Ascompensationfortheextradutyimposedbythissubsection,eachsuch 81specialconsultantasdefinedinthissubsectionmayreceive,inadditiontoallother 82compensationprovidedbylaw,anamountcontributedtowardmedicalbenefitscoverage 83providedbytheMissouriconsolidatedhealthcareplanorthetransportationemployeesand 84highwaypatrolmedicalplanpursuanttoappropriations. 104.625.EffectiveJuly1,2002,anymemberretiringpursuanttotheprovisionsof 2sections104.010to104.801,exceptanelectedofficialoramemberofthegeneralassembly, 3whohasnotbeenpaidretirementbenefitsandcontinuesemploymentforatleasttwoyears 4beyondnormalretirementage,mayelecttoreceiveanannuityandlumpsumpaymentor 5payments,determinedasfollows: 6 (1)Aretroactivestartingdateshallbeestablishedwhichshallbeadateselectedby 7themember;provided,however,thattheretroactivestartingdateselectedbythemember 8shallnotbeadatewhichisearlierthanthedatewhenanormalannuitywouldhavefirstbeen 9payable.Inaddition,theretroactivestartingdateshallnotbemorethanfiveyearspriortothe 10annuitystartingdate,whichshallbethefirstdayofthemonthwithrespecttowhichan 11amountispaidasanannuitypursuanttothissection.Themember'sselectionofaretroactive 12startingdateshallbedoneintwelve-monthincrements,exceptthisrestrictionshallnotapply 13whenthememberselectsthetotalavailabletimebetweentheretroactivestartingdateandthe 14annuitystartingdate; 15 (2)Theprospectiveannuitypayableasoftheannuitystartingdateshallbe 16determinedpursuanttotheprovisionsotherwiseapplicableunderthelaw,withtheexception 17thatitshallbetheamountwhichwouldhavebeenpayablehadthememberactuallyretiredon HB1185 19 18theretroactivestartingdateundertheretirementplanselectedbythemember.Otherthanfor 19thelumpsumpaymentorpaymentsspecifiedinsubdivision(3)ofthissection,noother 20amountshallbeduefortheperiodbetweentheretroactivestartingdateandtheannuity 21startingdate; 22 (3)Thelumpsumpayableshallbeninetypercentoftheannuityamountswhich 23wouldhavebeenpaidtothememberfromtheretroactivestartingdatetotheannuitystarting 24datehadthememberactuallyretiredontheretroactivestartingdateandreceivedanormal 25annuity.Themembershall[electto]receivethelumpsumamount[either] initsentiretyat 26thesametimeastheinitialannuitypaymentismade[orinthreeequalannualinstallments 27withthefirstpaymentmadeatthesametimeastheinitialannuitypayment]; and 28 (4)[Anyannuitypayablepursuanttothissectionthatissubjecttoadivisionof 29benefitorderpursuanttosection104.312shallbecalculatedasfollows: 30 (a)Anyserviceofamemberbetweentheretroactivestartingdateandtheannuity 31startingdateshallnotbeconsideredcreditableserviceexceptforpurposesofcalculatingthe 32divisionofbenefit;and 33 (b)Thelumpsumpaymentdescribedinsubdivision(3)ofthissectionshallnotbe 34subjecttoanydivisionofbenefitorder;and 35 (5)]Forpurposesofdeterminingannualbenefitincreasespayableaspartofthelump 36sumandannuityprovidedpursuanttothissection,theretroactivestartingdateshallbe 37consideredthemember'sdateofretirement. 104.810.1.EmployeesoftheMissouristatewaterpatrolwhoareearningcreditable 2serviceintheclosedplanoftheMissouristateemployees'retirementsystemandwhoare 3transferredtothedivisionofwaterpatrolwiththeMissouristatehighwaypatrolshallelect 4withinninetydaysofJanuary1,2011,toeitherremainamemberoftheMissouristate 5employees'retirementsystemortransfermembershipandcreditableservicetotheclosedplan 6oftheMissouridepartmentoftransportationandhighwaypatrolemployees'retirement 7system.Theelectionshallbemadeinwritingaftertheemployeehasreceivedadetailed 8analysiscomparingretirement,lifeinsurance,disabilitybenefits,andmedicalbenefitsofa 9memberoftheMissouristateemployees'retirementsystemwiththecorrespondingbenefits 10providedanemployeeofthehighwaypatrolcoveredbytheclosedplanoftheMissouri 11departmentoftransportationandhighwaypatrolemployees'retirementsystem.Inelecting 12planmembershiptheemployeeshallacknowledgeandagreethatanelectionmadeunderthis 13subsectionisirrevocable,andconstitutesawaivertoreceiveretirement,lifeinsurance, 14disabilitybenefits,andmedicalbenefitsexceptasprovidedbythesystemelectedbythe 15employee.Furthermore,inconnectionwiththeelection,theemployeeshallberequiredto 16acknowledgethatthebenefitsprovidedbyvirtueofmembershipineithersystem,andany 17associatedcoststotheemployee,maybedifferentnoworinthefutureasaresultofthe HB1185 20 18electionandthattheemployeeagreestoholdbothsystemsharmlesswithregardtobenefit 19differencesresultingfromtheelection.Intheeventanemployeeterminatesemployment 20andlaterreturnstothesameposition,theemployeeshallbeamemberofthesystemin 21whichheorshewasamemberpriortotermination.Iftheemployeereturnstoany 22otherposition,theemployeeshallbeamemberofthesystemthatcurrentlycoversthat 23position. 24 2.EmployeesoftheMissouristatewaterpatrolwhoareearningcreditedservicein 25theyear2000planoftheMissouristateemployees'retirementsystemandwhoaretransferred 26tothedivisionofwaterpatrolwiththeMissouristatehighwaypatrolshallelectwithinninety 27daysofJanuary1,2011,toeitherremainamemberoftheMissouristateemployees' 28retirementsystemortransfermembershipandcreditableservicetotheyear2000planofthe 29Missouridepartmentoftransportationandhighwaypatrolemployees'retirementsystem.The 30electionshallbemadeinwritingaftertheemployeehasreceivedadetailedanalysis 31comparingretirement,lifeinsurance,disabilitybenefits,andmedicalbenefitsofamemberof 32theMissouristateemployees'retirementsystemwiththecorrespondingbenefitsprovidedan 33employeeofthehighwaypatrolcoveredbytheyear2000planoftheMissouridepartmentof 34transportationandhighwaypatrolemployees'retirementsystem.Inelectingplan 35membershiptheemployeeshallacknowledgeandagreethatanelectionmadeunderthis 36subsectionisirrevocable,andconstitutesawaivertoreceiveretirement,lifeinsurance, 37disabilitybenefits,andmedicalbenefitsexceptasprovidedbythesystemelectedbythe 38employee.Furthermore,inconnectionwiththeelection,theemployeeshallberequiredto 39acknowledgethatthebenefitsprovidedbyvirtueofmembershipineithersystem,andany 40associatedcoststotheemployee,maybedifferentnoworinthefutureasaresultofthe 41electionandthattheemployeeagreestoholdbothsystemsharmlesswithregardtobenefit 42differencesresultingfromtheelection. 43 3.TheMissouristateemployees'retirementsystemshallpaytotheMissouri 44departmentoftransportationandhighwaypatrolemployees'retirementsystem,byJune30, 452011,anamountactuariallydeterminedtoequaltheliabilityatthetimeofthetransferforany 46employeewhoelectsundersubsection1or2ofthissectiontotransfertotheMissouri 47departmentoftransportationandhighwaypatrolemployees'retirementsystem,totheextent 48thatliabilityisfundedasofthemostrecentactuarialvaluationandbasedontheactuarial 49valueofassetsnottoexceedonehundredpercent. 50 4.Innoeventshallanyemployeereceiveservicecreditforthesameperiodofservice 51undermorethanoneretirementsystemasaresultoftheprovisionsofthissection. 52 5.Theonlymedicalcoverageavailableforanyemployeewhoelectsundersubsection 531or2ofthissectiontotransfertotheMissouridepartmentoftransportationandhighway 54patrolemployees'retirementsystemshallbethemedicalcoverageprovidedinsection HB1185 21 55104.270.TheeffectivedateforcommencementofmedicalcoverageshallbeJuly1,2011. 56However,thisdoesnotprecludemedicalcoverageforthetransferredemployeeasa 57dependentunderanyotherhealthcareplan. 58 6.Anyemployeewhoelectsundersubsection1or2ofthissectiontotransfertothe 59Missouridepartmentoftransportationandhighwaypatrolemployees'retirementsystemand 60whoisalsothereafterauniformedmemberofthehighwaypatrolshallbesubjecttothe 61mandatoryretirementagestatedinsection104.081. 104.1003.1.Unlessadifferentmeaningisplainlyrequiredbythecontext,the 2followingwordsandphrasesasusedinsections104.1003to104.1093shallmean: 3 104.1018.1.Whenamemberisnolongeremployedinapositioncoveredbythe 2system,membershipinthesystemshallthereuponcease.Ifamemberhasfiveormoreyears 3ofcreditedserviceuponsuchmember'sterminationofmembership,suchmembershallbea 4vestedformermemberentitledtoadeferredannuitypursuanttosection104.1036, exceptas 5otherwiseprovidedinsubsection7ofsection104.1024. Ifamemberhasfewerthanfive 6yearsofcreditedserviceuponterminationofmembership,suchformermember'scredited 7serviceshallbeforfeited,providedthatifsuchformermemberbecomesreemployedina 8positioncoveredbythesystem,suchformermembershallagainbecomeamemberofthe 9systemandtheforfeitedcreditedserviceshallberestoredafterreceivingcreditableservice 10continuouslyforoneyear. 11 2.Uponamemberbecomingaretiree,membershipshallceaseand,exceptas 12otherwiseprovidedinsection104.1039,thepersonshallnotagainbecomeamemberofthe 13system. 14 3.Ifavestedformermemberbecomesreemployedinapositioncoveredbythe 15systembeforesuchvestedformermember'sannuitystartingdate,membershipshallbe 16restoredwiththepreviouscreditedserviceandincreasedbysuchreemployment. 104.1024.1.Anymemberwhoterminatesemploymentmayretireonorafter 2attainingnormalretirementeligibilitybymakingapplicationinwrittenformandmanner 3approvedbytheappropriateboard.Thewrittenapplicationshallsetforththeannuitystarting 4datewhichshallnotbeearlierthanthefirstdayofthesecondmonthfollowingthemonthof HB1185 25 5theexecutionandfilingofthemember'sapplicationforretirementnorlaterthanthefirstday 6ofthefourthmonthfollowingthemonthoftheexecutionandfilingofthemember's 7applicationforretirement.Thepaymentoftheannuityshallbemadethelastworkingdayof 8eachmonth,providingalldocumentationrequiredundersection104.1027forthecalculation 9andpaymentofthebenefitsisreceivedbytheboard. 10 2.Amember'sannuityshallbepaidintheformofalifeannuity,exceptasprovided 11insection104.1027,andshallbeanamountforlifeequaltooneandseven-tenthspercentof 12thefinalaveragepayofthemembermultipliedbythemember'syearsofcreditedservice. 13 3.Thelifeannuitydefinedinsubsection2ofthissectionshallnotbelessthana 14monthlyamountequaltofifteendollarsmultipliedbythemember'sfullyearsofcredited 15service. 16 4.Ifasoftheannuitystartingdateofamemberwhohasattainednormalretirement 17eligibilitythesumofthemember'syearsofageandyearsofcreditedserviceequalseightyor 18moreyearsandifthemember'sageisatleastforty-eightyearsbutlessthansixty-twoyears, 19or,inthecaseofamemberofthehighwaypatrolwhoshallbesubjecttothemandatory 20retirementprovisionofsection[104.080] 104.081, themandatoryretirementageand 21completionoffiveyearsofcreditedservice,theninadditiontothelifeannuitydescribedin 22subsection2ofthissection,themembershallreceiveatemporaryannuityequaltoeight- 23tenthsofonepercentofthemember'sfinalaveragepaymultipliedbythemember'syearsof 24creditedservice.Thetemporaryannuityandanycost-of-livingadjustmentsattributabletothe 25temporaryannuitypursuanttosection104.1045shallterminateattheendofthecalendar 26monthinwhichtheearlierofthefollowingeventsoccurs:themember'sdeathorthe 27member'sattainmentoftheearliestageofeligibilityforreducedSocialSecurityretirement 28benefits,butnolaterthanagesixty-two. 29 5.Theannuitydescribedinsubsection2ofthissectionforanypersonwhohas 30creditedservicenotcoveredbythefederalSocialSecurityAct,asprovidedin[sections 31105.300to105.430] subdivision(1)ofsubsection7ofsection104.342, shallbecalculated 32asfollows:thelifeannuityshallbeanamountequaltotwoandfive-tenthspercentofthe 33finalaveragepayofthemembermultipliedbythenumberofyearsofservicenotcoveredby 34thefederalSocialSecurityActinadditiontooneandseven-tenthspercentofthefinalaverage 35payofthemembermultipliedbythemember'syearsofcreditedservicecoveredbythe 36federalSocialSecurityAct. 37 6.EffectiveJuly1,2002,anymember,exceptanelectedofficialoramemberofthe 38generalassembly,whohasnotbeenpaidretirementbenefitsandcontinuesemploymentforat 39leasttwoyearsbeyondthedateofnormalretirementeligibility,mayelecttoreceivean 40annuityandlumpsumpaymentorpayments,determinedasfollows: HB1185 26 41 (1)Aretroactivestartingdateshallbeestablishedwhichshallbeadateselectedby 42themember;provided,however,thattheretroactivestartingdateselectedbythemember 43shallnotbeadatewhichisearlierthanthedatewhenanormalannuitywouldhavefirstbeen 44payable.Inaddition,theretroactivestartingdateshallnotbemorethanfiveyearspriortothe 45annuitystartingdate.Themember'sselectionofaretroactivestartingdateshallbedonein 46twelve-monthincrements,exceptthisrestrictionshallnotapplywhenthememberselectsthe 47totalavailabletimebetweentheretroactivestartingdateandtheannuitystartingdate; 48 (2)Theprospectiveannuitypayableasoftheannuitystartingdateshallbe 49determinedpursuanttotheprovisionsofthissection,withtheexceptionthatitshallbethe 50amountwhichwouldhavebeenpayableattheannuitystartingdatehadthememberactually 51retiredontheretroactivestartingdateundertheretirementplanselectedbythemember. 52Otherthanforthelumpsumpaymentorpaymentsspecifiedinsubdivision(3)ofthis 53subsection,nootheramountshallbeduefortheperiodbetweentheretroactivestartingdate 54andtheannuitystartingdate; 55 (3)Thelumpsumpayableshallbeninetypercentoftheannuityamountswhich 56wouldhavebeenpaidtothememberfromtheretroactivestartingdatetotheannuitystarting 57datehadthememberactuallyretiredontheretroactivestartingdateandreceivedalife 58annuity.Themembershall[electto]receivethelumpsumamount[either] initsentiretyat 59thesametimeastheinitialannuitypaymentismade[orinthreeequalannualinstallments 60withthefirstpaymentmadeatthesametimeastheinitialannuitypayment]; and 61 (4)[Anyannuitypayablepursuanttothissectionthatissubjecttoadivisionof 62benefitorderpursuanttosection104.1051shallbecalculatedasfollows: 63 (a)Anyserviceofamemberbetweentheretroactivestartingdateandtheannuity 64startingdateshallnotbeconsideredcreditedserviceexceptforpurposesofcalculatingthe 65divisionofbenefit;and 66 (b)Thelumpsumpaymentdescribedinsubdivision(3)ofthissectionshallnotbe 67subjecttoanydivisionofbenefitorder;and 68 (5)]Forpurposesofdeterminingannualbenefitincreasespayableaspartofthelump 69sumandannuityprovidedpursuanttothissection,theretroactivestartingdateshallbe 70consideredthemember'sdateofretirement. 71 7.Anyvestedformermemberwhoterminatedemploymentafterattaining 72normalretirementeligibilityshallbeconsideredamemberforthepurposesofthis 73section. 104.1051.1.Anyannuityprovidedpursuanttotheyear2000planismaritalproperty 2andacourtofcompetentjurisdictionmaydividesuchannuitybetweenthepartiestoany 3actionfordissolutionofmarriageifatthetimeofthedissolutionthememberhasatleastfive HB1185 27 4yearsofcreditedservicepursuanttosections104.1003to104.1093.Adivisionofbenefits 5orderissuedpursuanttothissection: 6 (1)Shallnotrequiretheapplicableretirementsystemtoprovideanyformortypeof 7annuityorretirementplannotselectedbythemember; 8 (2)Shallnotrequiretheapplicableretirementsystemtocommencepaymentsuntil 9themember'sannuitystartingdate; 10 (3)Shallidentifythemonthlyamounttobepaidtotheformerspouse,whichshallbe 11expressedasapercentageandwhichshallnotexceedfiftypercentoftheamountofthe 12member'sannuityaccruedduringallorpartoftheperiodofthemarriageofthememberand 13formerspouseexcludingserviceaccruedundersubsection2ofsection104.1021;and 14whichshallbebasedonthemember'svestedannuityonthedateofthedissolutionof 15marriageoranearlierdateasspecifiedintheorder,whichamountshallbeadjusted 16proportionatelyupontheannuitystartingdateifthemember'sannuityisreducedduetothe 17receiptofanearlyretirementannuityorthemember'sannuityisreducedpursuanttosection 18104.1027underanannuityoptioninwhichthemembernamedthealternatepayeeas 19beneficiarypriortothedissolutionofmarriage; 20 (4)Shallnotrequirethepaymentofanannuityamounttothememberandformer 21spousewhichintotalexceedstheamountwhichthememberwouldhavereceivedwithout 22regardtotheorder; 23 (5)Shallprovidethatanyannuityincreases,additionalyearsofcreditedservice, 24increasedfinalaveragepay,increasedpaypursuanttosubsections2and5ofsection 25104.1084,orothertypeofincreasesaccruedafterthedateofthedissolutionofmarriageand 26anytemporaryannuityreceivedpursuanttosubsection4ofsection104.1024shallaccrue 27solelytothebenefitofthemember;exceptthatonorafterSeptember1,2001,anycost-of- 28livingadjustment(COLA)dueaftertheannuitystartingdateshallnotbeconsideredtobean 29increaseaccruedafterthedateofterminationofmarriageandshallbepartofthemonthly 30amountsubjecttodivisionpursuanttoanyorderissuedafterSeptember1,2001; 31 (6)Shallterminateuponthedeathofeitherthememberortheformerspouse, 32whicheveroccursfirst; 33 (7)Shallnotcreateaninterestwhichisassignableorsubjecttoanylegalprocess; 34 (8)Shallincludethename,address,anddateofbirthofboththememberandthe 35formerspouse,andtheidentityoftheretirementsystemtowhichitapplies; 36 (9)Shallbeconsistentwithanyotherdivisionofbenefitsorderswhichareapplicable 37tothesamemember; 38 (10)Shallnotrequiretheapplicableretirementsystemtocontinuepaymentstothe 39alternatepayeeifthemember'sretirementbenefitissuspendedorwaivedasprovidedbythis HB1185 28 40chapterbutsuchpaymentsshallresumewhentheretireebeginstoreceiveretirementbenefits 41inthefuture. 42 2.Asystemshallprovidethecourthavingjurisdictionofadissolutionofamarriage 43proceedingorthepartiestotheproceedingwithinformationnecessarytoissueadivisionof 44benefitsorderconcerningamemberofthesystem,uponwrittenrequestfromeitherthecourt, 45themember,orthemember'sspouse,citingthissectionandidentifyingthecasenumberand 46parties. 47 3.Asystemshallhavethediscretionaryauthoritytorejectadivisionofbenefitsorder 48forthefollowingreasons: 49 (1)Theorderdoesnotclearlystatetherightsofthememberandtheformerspouse; 50 (2)Theorderisinconsistentwithanylawgoverningtheretirementsystem. 51 4.Anymemberoftheclosedplanwhoelectedtheyear2000planpursuanttosection 52104.1015andthenbecomesdivorcedandsubjecttoadivisionofbenefitsordershallhavethe 53divisionofbenefitsordercalculatedpursuanttotheprovisionsoftheyear2000plan. 54 5.Anyannuitypayableundersection104.1024thatissubjecttoadivisionof 55benefitorderunderthissectionshallbecalculatedasfollows: 56 (1)Ininstancesofdivorceafterretirement,anyserviceorpayofamember 57betweentheretroactivestartingdateandtheannuitystartingdateshallnotbe 58consideredcreditableserviceorpay;and 59 (2)Thelump-sumpaymentdescribedinsubdivision(3)ofsubsection6ofsection 60104.1024shallnotbesubjecttoanydivisionofbenefitorder. 104.1060.1.Shouldanyerrorresultinanypersonreceivingmoreorlessthanthe 2personwouldhavebeenentitledtoreceivehadtheerrornotoccurred,theboardshallcorrect 3sucherror,and,asfaraspracticable,makefuturepaymentsinsuchamannerthattheactuarial 4equivalentoftheannuitytowhichsuchpersonwasentitledshallbepaid,andtothisendmay 5recoveranyoverpayments.Inallcasesinwhichsucherrorhasbeenmade,nosucherror 6shallbecorrectedunlessthesystemdiscoversorisnotifiedofsucherrorwithintenyearsafter 7the[initial] member'sannuitystartingdateorthedateoferror, whicheveroccurslater. 8Incasesoffraud,anyerrordiscoveredshallbecorrectedwithoutconcerntotheamount 9oftimethathaspassed. 10 2.Apersonwhoknowinglymakesafalsestatement,orfalsifiesorpermitstobe 11falsifiedarecordofthesystem,inanattempttodefraudthesystemshallbesubjecttofineor 12imprisonmentundertheMissourirevisedstatutes. 13 3.Aboardshallnotpayanannuitytoanysurvivororbeneficiarywhoischargedwith 14theintentionalkillingofamember,retireeorsurvivorwithoutlegalexcuseorjustification.A 15survivororbeneficiarywhoisconvictedofsuchchargeshallnolongerbeentitledtoreceive 16anannuity.Ifthesurvivororbeneficiaryisnotconvictedofsuchcharge,theboardshall HB1185 29 17resumeannuitypaymentsandshallpaythesurvivororbeneficiaryanyannuitypaymentsthat 18weresuspendedpendingresolutionofsuchcharge. 104.1066.1.Theyear2000planintendstofollowafinancingpatternwhich 2computesandrequirescontributionamountswhich,expressedaspercentsofactivemember 3payroll,willremainapproximatelylevelfromyeartoyearandfromonegenerationof 4citizenstothenextgeneration.Suchcontributiondeterminationsrequireregularactuarial 5valuations,whichshallbemadebytheboard'sactuary,usingassumptionsandmethods 6adoptedbytheboardafterconsultingwithitsactuary.Theentryage-normalcostvaluation 7methodshallbeusedindeterminingthenormalcost[,andcontributionsforunfundedaccrued 8liabilitiesshallbedeterminedusinglevelpercent-of-payrollamortization] calculation. For 9purposesofthissubsectionandsection104.436,theactuaryshalldetermineasingle 10contributionrateapplicabletobothclosedplanandyear2000planparticipantsand,in 11determiningsuchrate,makeestimatesoftheprobabilitiesofclosedplanparticipants 12transferringtotheyear2000plan. 13 2.Atleastninetydaysbeforeeachregularsessionofthegeneralassembly,theboard 14oftheMissouristateemployees'retirementsystemshallcertifytothedivisionofbudgetthe 15contributionratenecessarytocovertheliabilitiesoftheyear2000planadministeredbysuch 16system,includingcostsofadministration,expectedtoaccrueduringthenextappropriation 17period.Thecommissionerofadministrationshallrequestappropriationsbaseduponthe 18contributionratesocertified.Fromappropriationssomade,thecommissionerof 19administrationshallcertifycontributionamountstothestatetreasurerwhointurnshall 20immediatelypaythecontributionstotheyear2000plan. 21 3.TheemployersofmemberscoveredbytheMissouristateemployees'retirement 22systemwhoarenotpaidoutoffundsthathavebeendepositedinthestatetreasuryshallremit 23followingeachpayperiodtotheyear2000plananamountequaltotheamountwhichthe 24statewouldhavepaidifthosemembershadbeenpaidentirelyfromstatefunds.Such 25employersshallmaintainpayrollrecordsforaminimumoffiveyearsandshallproduceall 26suchrecordsasrequestedbythesystem.Thesystemisauthorizedtorequestfromthestate 27officeofadministrationanappropriationoutoftheannualbudgetofanysuchemployerinthe 28eventsuchrecordsindicatethatsuchemployerhasnotcontributedtheamountsrequiredby 29thissection.Theofficeofadministrationshallrequestsuchappropriationwhichshallbe 30equaltotheamountnecessarytoreplaceanyshortfallincontributionsasdeterminedbythe 31system.Fromappropriationssomade,thecommissionerofadministrationshallcertify 32contributionamountstothestatetreasurerwhointurnshallimmediatelypaysuch 33contributionstotheyear2000plan. 34 4.Atleastninetydaysbeforeeachregularsessionofthegeneralassembly,theboard 35ofthetransportationdepartmentandhighwaypatrolretirementsystemshallcertifytothe HB1185 30 36departmentoftransportationandthedepartmentofpublicsafetythecontributionrate 37necessarytocovertheliabilitiesoftheyear2000planadministeredbysuchsystem,including 38costsofadministration,expectedtoaccrueduringthenextbiennialorotherappropriation 39period.Eachdepartmentshallincludeinitsbudgetandinitsrequestforappropriationsfor 40personalservicethesumsocertifiedtoitbysuchboard,andshallpresentthesametothe 41generalassemblyforallowance.Thesumssocertifiedandappropriated,whenavailable, 42shallbeimmediatelypaidtothesystemanddepositedinthehighwayandtransportation 43employees'andhighwaypatrolretirementandbenefitfund. 44 5.Theseamountsarefundsoftheyear2000planandshallnotbecommingledwith 45anyfundsinthestatetreasury. 104.1072.1.Eachboardshallprovideorcontract,orboth,forlifeinsurancebenefits 2foremployeescoveredpursuanttotheyear2000planasfollows: 3 (1)Employeesshallbeprovidedfifteenthousanddollarsoflifeinsuranceuntil 4December31,2000.EffectiveJanuary1,2001,thesystemshallprovideorcontractorboth 5forbasiclifeinsuranceforemployeescoveredunderanyretirementplanadministeredbythe 6systempursuanttothischapter,personscoveredbysections287.812to287.856,for 7employeeswhoaremembersofthejudicialretirementsystemasprovidedinsection476.590, 8and,attheelectionofthestatehighwaysandtransportationcommission,employeeswhoare 9membersofthe[highwaysand]Missouridepartmentoftransportation[employees'] and 10highwaypatrolemployees'retirementsystem,intheamountequaltoonetimesannualpay, 11subjecttoaminimumamountoffifteenthousanddollars.Theboardshallestablishbyruleor 12contractthemethodfordeterminingtheannualrateofpayandanyothertermsofsuch 13insuranceasitdeemsnecessarytoimplementtherequirementspursuanttothissection. 14Annualrateofpayshallnotincludeovertimeoranyotherirregularpaymentsasdetermined 15bytheboard.Suchlifeinsuranceshallprovidefortripleindemnityintheeventthecauseof 16deathisaproximateresultofapersonalinjuryordiseasearisingoutofandinthecourseof 17actualperformanceofdutyasanemployee; 18 (2)Anymemberwhoterminatesemploymentafterreachingnormalorearly 19retirementeligibilityandbecomesaretireewithin[sixty] sixty-fivedaysofsuchtermination 20shallreceivefivethousanddollarsoflifeinsurancecoverage. 21 2.(1)Inadditiontothelifeinsuranceauthorizedbytheprovisionsofsubsection1of 22thissection,anypersonforwhomlifeinsuranceisprovidedorcontractedforpursuanttosuch 23subsectionmaypurchase,attheperson'sownexpenseandonlyifmonthlyvoluntarypayroll 24deductionsareauthorized,additionallifeinsuranceatacosttobestipulatedinacontractwith 25aprivateinsurancecompanyorasmayberequiredbyasystemiftheboardoftrustees 26determinesthatthesystemshouldprovidesuchinsuranceitself.Themaximumamountof 27additionallifeinsurancewhichmaybesopurchasedpriortoJanuary1,2004,isthatamount HB1185 31 28whichequalssixtimestheamountoftheperson'sannualrateofpay,subjecttoanymaximum 29establishedbyaboard,exceptthatifsuchmaximumamountisnotevenlydivisiblebyone 30thousanddollars,thenthemaximumamountofadditionalinsurancewhichmaybepurchased 31isthenexthigheramountevenlydivisiblebyonethousanddollars.Themaximumamountof 32additionallifeinsurancewhichmaybesopurchasedonorafterJanuary1,2004,isanamount 33tobestipulatedinacontractwithaprivateinsurancecompanyorasmayberequiredbythe 34systemiftheboardoftrusteesdeterminesthatthesystemshouldprovidetheinsuranceitself. 35 (2)Anypersondefinedinsubdivision(1)ofthissubsectionmayretainanamountnot 36toexceedsixtythousanddollarsoflifeinsurancefollowingthedateofhisorherretirementif 37suchpersonbecomesaretireethemonthfollowingterminationofemploymentandmakes 38writtenapplicationforsuchlifeinsuranceatthesametimesuchperson'sapplicationismade 39totheboardforretirementbenefits.Suchlifeinsuranceshallonlybeprovidedifsuchperson 40paystheentirecostoftheinsurance,asdeterminedbytheboard,byallowingvoluntary 41deductionsfromthemember'sannuity. 42 (3)Inadditiontothelifeinsuranceauthorizedinsubdivision(1)ofthissubsection, 43anypersonforwhomlifeinsuranceisprovidedorcontractedforpursuanttothissubsection 44maypurchase,attheperson'sownexpenseandonlyifmonthlyvoluntarypayrolldeductions 45areauthorized,lifeinsurancecoveringtheperson'schildrenortheperson'sspouseorbothat 46coverageamountstobedeterminedbytheboardatacosttobestipulatedinacontractwitha 47privateinsurerorasmayberequiredbythesystemiftheboardoftrusteesdeterminesthatthe 48systemshouldprovidesuchinsuranceitself. 49 (4)EffectiveJuly1,2000,anymemberwhoappliesandiseligibletoreceivean 50annuitybasedontheattainmentofatleastforty-eightyearsofagewithatotalofyearsofage 51andyearsofcreditedservicewhichisatleasteightyshallbeeligibletoretainanyoptional 52lifeinsurancedescribedinsubdivision(1)ofthissubsection.Theamountofsuchretained 53insuranceshallnotbegreaterthantheamountineffectduringthemonthpriortotermination 54ofemployment.Suchinsurancemayberetaineduntilthemember'sattainmentoftheearliest 55ageforeligibilityforreducedSocialSecurityretirementbenefitsbutnolaterthanagesixty- 56two,atwhichtimetheamountofsuchinsurancethatmayberetainedshallbethatamount 57permittedpursuanttosubdivision(2)ofthissubsection. 58 3.Thestatehighwaysandtransportationcommissionmayprovideforinsurance 59benefitstocovermedicalexpensesformembersofthe[highwaysand]Missouridepartment 60oftransportation[employees'] andhighwaypatrolemployees'retirementsystem.Thestate 61highwaysandtransportationcommissionmayprovidemedicalbenefitsfordependentsof 62membersandforretiredmembers.Contributionsbythestatehighwaysandtransportation 63commissiontoprovidethebenefitsshallbeonthesamebasisasprovidedforotherstate 64employeespursuanttotheprovisionsofsection104.515.Exceptasotherwiseprovidedby HB1185 32 65law,thecostofbenefitsfordependentsofmembersandforretireesandtheirdependentsshall 66bepaidbythemembersorretirees.Thecommissionmaycontractwithotherpersonsor 67entitiesincludingbutnotlimitedtothird-partyadministrators,healthnetworkprovidersand 68healthmaintenanceorganizationsforall,oranypartof,thebenefitsprovidedforinthis 69section.Thecommissionmayrequirereimbursementofanymedicalclaimspaidbythe 70commission'smedicalplanforwhichtherewasthird-partyliability. 71 4.The[highwaysand]Missouridepartmentoftransportation[employees'] and 72highwaypatrolemployees'retirementsystemmayrequestthestatehighwaysand 73transportationcommissiontoprovidelifeinsurancebenefitsasrequiredinsubsections1 74and2ofthissection.Ifthestatehighwaysandtransportationcommissionagreestothe 75request,the[highwaysand]Missouridepartmentoftransportation[employees'] and 76highwaypatrolemployees'retirementsystemshallreimbursethestatehighwaysand 77transportationcommissionforanyandallcostsforlifeinsuranceprovidedpursuantto 78subdivision(2)ofsubsection1ofthissection.Thepersonwhoiscoveredpursuantto 79subsection2ofthissectionshallbesolelyresponsibleforthecostsofanyadditionallife 80insurance.Inlieuofthelifeinsurancebenefitinsubdivision(2)ofsubsection1ofthis 81section,the[highwaysand]Missouridepartmentoftransportation[employees'] and 82highwaypatrolemployees'retirementsystemisauthorizedinitssolediscretiontoprovidea 83deathbenefitoffivethousanddollars. 84 5.Totheextentthattheboardentersorhasenteredintoanycontractwithanyinsurer 85orserviceorganizationtoprovidelifeinsuranceprovidedforpursuanttothissection: 86 (1)Theobligationtoprovidesuchlifeinsuranceshallbeprimarilythatoftheinsurer 87orserviceorganizationandsecondarilythatoftheboard; 88 (2)Anymemberwhohasbeendeniedlifeinsurancebenefitsbytheinsurerorservice 89organizationandhasexhaustedallappealproceduresprovidedbytheinsurerorservice 2shallsupplementorreplacetheindicatedotherprovisionsoftheyear2000plan."Normal 3retirementeligibility"meansattainmentofagefifty-fiveforamemberwhohasservedatleast 4threefullbiennialassembliesortheattainmentofatleastagefiftyforamemberwhohas HB1185 33 5servedatleastthreefullbiennialassemblieswithatotalofyearsofageandyearsofcredited 6servicewhichisatleasteighty.Amembershallreceivetwoyearsofcreditedservicefor 7everyfullbiennialassemblyserved.Afullbiennialassemblyshallbeequaltotheperiodof 8timebeginningonthefirstdaythegeneralassemblyconvenesforafirstregularsessionuntil 9thelastdayofthefollowingyear.Ifamemberserveslessthanafullbiennialassembly,the 29isastatewideelectedofficialmusthaveatleastfouryearsasastatewideelectedofficial. 30 7.Theprovisionsofsection104.1045shallnotapplytopersonscoveredbythe 31generalassemblyandstatewideelectedofficialprovisionsofthissection.Personscoveredby 32thegeneralassemblyprovisionsandreceivingayear2000planannuityshallbeentitledtoa 33cost-of-livingadjustment(COLA)whenthereareincreasesinpayformembersofthegeneral 34assembly.Personscoveredbythestatewideelectedofficialprovisionsandreceivingayear 8.Anymemberwhoservesunderthischapterasamemberofthegeneralassemblyor 40asastatewideelectedofficialonorafterAugust28,1999,shallnotbeeligibletoreceiveany 41retirementbenefitsfromthesystemundereithertheclosedplanortheyear2000planbased HB1185 34 42onservicerenderedonorafterAugust28,1999,asamemberofthegeneralassemblyorasa 43statewideelectedofficialifsuchmemberisconvictedofafelonythatisdeterminedbyacourt 44oflawtohavebeencommittedinconnectionwiththemember'sdutieseitherasamemberof 45thegeneralassemblyorasastatewideelectedofficial,unlesssuchconvictionislaterreversed 46byacourtoflaw. 47 9.Amemberofthegeneralassemblywhohaspurchasedortransferredcreditable 48serviceshallnotbesubjecttothecaponbenefitspursuanttosubsection2ofthissectionfor 49thatportionofthebenefitattributabletothepurchasedortransferredservice. 50 10.Forthepurposesofsection104.1042,theservicecreditaccruedbyamember 51ofthegeneralassemblywhilereceivinglong-termdisabilitybenefitsshallcontinueto 52accrueuntiltheearliestreceiptofattainmentofnormalretirementageeligibility, 53terminationofdisabilitybenefits,ortheendofthemember'sconstitutionallymandated 54limitonserviceasamemberofthegeneralassemblyforthechamberinwhichthe 55memberwasservingatthetimeofdisablement. 56 11.Forthepurposesofsection104.1042,theservicecreditaccruedbya 57statewideelectedofficialwhilereceivinglong-termdisabilitybenefitsshallcontinueto 58accrueuntiltheearliestofattainmentofnormalretirementageeligibility,termination 59ofdisabilitybenefits,ortheendofthestatewideelectedofficial'sconstitutionally 60mandatedlimitonserviceasastatewideelectedofficialfortheofficeinwhichthe 24andcreditedserviceequalingatleastninety;orinthecaseofamemberwhoisservingasa 25uniformedmemberofthehighwaypatrolandsubjecttothemandatoryretirementprovisions 26ofsection104.081,thetemporaryannuityshallbepayableifthememberhasattainedatleast 27agesixty,oratleastagefifty-fivewithtenyearsofcreditedservice. 28 5.Amember,otherthanamemberwhoisservingasauniformedmemberofthe 29highwaypatrolandsubjecttothemandatoryretirementprovisionsofsection104.081,shall 30beeligibleforanearlyretirementannuityupontheattainmentofatleastagesixty-twoand 31thecompletionofatleasttenyearsofcreditedservice.Avestedformermemberwho 32terminatedemploymentpriortotheattainmentofearlyretirementeligibilityshallnotbe 33eligibleforearlyretirement. 34 6.Theprovisionsofsubsection6ofsection104.1021andsection104.344asapplied 35pursuanttosubsection7ofsection104.1021andsection104.1090shallnotapplytomembers 36coveredbythissection. 37 7.Theminimumcreditedservicerequirementsoffiveyearscontainedinsections 38104.1018,104.1030,104.1036,and104.1051shallbetenyearsformemberscoveredbythis 39section.Thenormalandearlyretirementeligibilityrequirementsinthissectionshallapply 40forpurposesofadministeringsection104.1087. 41 8.Amembershallberequiredtocontributefourpercentofthemember'spaytothe 42retirementsystem,whichshallstandtothemember'screditinhisorherindividualaccount 43withthesystem,togetherwithinvestmentcreditsthereon,forpurposesoffundingretirement 44benefitspayableundertheyear2000plan,subjecttothefollowingprovisions: 45 (1)ThestateofMissouriemployer,pursuanttotheprovisionsof26U.S.C.Section 46414(h)(2),shallpickupandpaythecontributionsthatwouldotherwisebepayablebythe 47memberunderthissection.Thecontributionssopickedupshallbetreatedasemployer 48contributionsforpurposesofdeterminingthemember'spaythatisincludableinthemember's 49grossincomeforfederalincometaxpurposes; 50 (2)Membercontributionspickedupbytheemployershallbepaidfromthesame 51sourceoffundsusedforthepaymentofpaytoamember.Adeductionshallbemadefrom 52eachmember'spayequaltotheamountofthemember'scontributionspickedupbythe HB1185 36 53employer.Thisdeduction,however,shallnotreducethemember'spayforpurposesof 54computingbenefitsundertheretirementsystempursuanttothischapter; 55 (3)Membercontributionssopickedupshallbecreditedtoaseparateaccountwithin 56themember'sindividualaccountsothattheamountscontributedpursuanttothissectionmay 57bedistinguishedfromtheamountscontributedonanafter-taxbasis; 58 (4)Thecontributions,althoughdesignatedasemployeecontributions,shallbepaid 59bytheemployerinlieuofthecontributionsbythemember.Themembershallnothavethe 60optionofchoosingtoreceivethecontributedamountsdirectlyinsteadofhavingthempaidby 61theemployertotheretirementsystem; 62 (5)InterestshallbecreditedannuallyonJunethirtiethbasedonthevalueinthe 63accountasofJulyfirstoftheimmediatelyprecedingyearatarateoffourpercent.Effective 64June30,2014,andeachJunethirtieththereafter,theinterestcreditingrateshallbeequalto 65theinvestmentratethatispublishedbytheUnitedStatesDepartmentofTreasury,orits 66successoragency,forfifty-twoweektreasurybillsfortherelevantauctionthatisnearestto 67theprecedingJulyfirst,orasuccessortreasurybillinvestmentrateasapprovedbytheboard 68ifthefifty-twoweektreasurybillisnolongerissued.Interestcreditsshallceaseupon 69terminationofemploymentifthememberisnotavestedformermember.Otherwise,interest 70creditsshallceaseuponretirementordeath; 71 (6)Avestedformermemberoraformermemberwhoisnotvestedmayrequesta 72refundofhisorhercontributionsandinterestcreditedthereon.Ifsuchmemberismarriedat 73thetimeofsuchrequest,suchrequestshallnotbeprocessedwithoutconsentfromthespouse. 74Suchmemberisnoteligibletorequestarefundifsuchmember'sretirementbenefitissubject 75toadivisionofbenefitorderpursuanttosection104.1051.Suchrefundshallbepaidbythe 76system[after] withinanadministrativelyreasonableperiod,butnosoonerthanninety 77daysfromthedateofterminationofemployment[ortherequest,whicheverislater,and]. 78Theamountrefundedshallincludeallemployeecontributionsmadetoanyretirementplan 79administeredbythesystemandinterestcreditedthereon.Avestedformermembermaynot 80requestarefundaftersuchmemberbecomeseligiblefornormalretirement.Avestedformer 81memberoraformermemberwhoisnotvestedwhoreceivesarefundshallforfeitallthe 82member'screditedserviceandfuturerightstoreceivebenefitsfromthesystemandshallnot 83beeligibletoreceiveany[long-term] disabilitybenefits;providedthatanymemberorvested 84formermemberreceiving[long-term] disabilitybenefitsshallnotbeeligibleforarefund.If 85suchmembersubsequentlybecomesanemployeeandworkscontinuouslyforatleastone 86year,thecreditedservicepreviouslyforfeitedshallberestoredifthememberreturnstothe 87systemtheamountpreviouslyrefundedplusinterestatarateestablishedbytheboard; 88 (7)Thebeneficiaryofanymemberwhomadecontributionsshallreceivearefund 89uponthemember'sdeathequaltotheamount,ifany,ofsuchcontributionsandinterest HB1185 37 90creditedthereonlessanyretirementbenefitsreceivedbythememberunlessanannuityis 91payabletoasurvivororbeneficiaryasaresultofthemember'sdeath.Inthatevent,the 92beneficiaryofthesurvivororbeneficiarywhoreceivedtheannuityshallreceivearefund 93uponthesurvivor'sorbeneficiary'sdeathequaltotheamount,ifany,ofthemember's 94contributionslessanyannuityamountsreceivedbythememberandthesurvivoror 95beneficiary. 96 9.Theemployeecontributionrate,thebenefitsprovidedundertheyear2000planto 97memberscoveredunderthissection,andanyotherprovisionoftheyear2000planwith 98regardtomemberscoveredunderthissectionmaybealtered,amended,increased,decreased, 99orrepealed,butonlywithrespecttoservicesrenderedbythememberaftertheeffectivedate 100ofsuchalteration,amendment,increase,decrease,orrepeal,or,withrespecttointerest 101credits,forperiodsoftimeaftertheeffectivedateofsuchalteration,amendment,increase, 102decrease,orrepeal. 103 10.Forpurposesofmemberscoveredbythissection,theoptionsundersection 104104.1027shallbeasfollows: 105 Option1. 106 Aretiree'slifeannuityshallbereducedtoacertainpercentoftheannuityotherwise 107payable.Suchpercentshallbeeighty-eightandonehalfpercentadjustedasfollows:ifthe 108retiree'sageontheannuitystartingdateisyoungerthansixty-sevenyears,anincreaseof 109three-tenthsofonepercentforeachyeartheretiree'sageisyoungerthanagesixty-seven 110years;andifthebeneficiary'sageisyoungerthantheretiree'sageontheannuitystartingdate, 111adecreaseofthree-tenthsofonepercentforeachyearofagedifference;andiftheretiree's 112ageisyoungerthanthebeneficiary'sageontheannuitystartingdate,anincreaseofthree- 113tenthsofonepercentforeachyearofagedifference;provided,afteralladjustmentsthe 114option1percentcannotexceedninety-fourandonequarterpercent.Upontheretiree'sdeath, 115fiftypercentoftheretiree'sreducedannuityshallbepaidtosuchbeneficiarywhowasthe 116retiree'sspouseontheannuitystartingdateorasotherwiseprovidedbysubsection5ofthis 117section. 118 Option2. 119 Aretiree'slifeannuityshallbereducedtoacertainpercentoftheannuityotherwise 120payable.Suchpercentshallbeeighty-onepercentadjustedasfollows:iftheretiree'sageon 121theannuitystartingdateisyoungerthansixty-sevenyears,anincreaseoffour-tenthsofone 122percentforeachyeartheretiree'sageisyoungerthansixty-sevenyears;andifthe 123beneficiary'sageisyoungerthantheretiree'sageontheannuitystartingdate,adecreaseof 124five-tenthsofonepercentforeachyearofagedifference;andiftheretiree'sageisyounger 125thanthebeneficiary'sageontheannuitystartingdate,anincreaseoffive-tenthsofone 126percentforeachyearofagedifference;provided,afteralladjustmentstheoption2percent HB1185 38 127cannotexceedeighty-sevenandthreequarterpercent.Upontheretiree'sdeathonehundred 128percentoftheretiree'sreducedannuityshallbepaidtosuchbeneficiarywhowastheretiree's 129spouseontheannuitystartingdateorasotherwiseprovidedbysubsection5ofthissection. 130 Option3. 131 Aretiree'slifeannuityshallbereducedtoninety-threepercentoftheannuity 132otherwisepayable.Iftheretireediesbeforehavingreceivedonehundredtwentymonthly 133payments,thereducedannuityshallbecontinuedfortheremainderoftheonehundred 134twenty-monthperiodtotheretiree'sdesignatedbeneficiaryprovidedthatifthereisno 135beneficiarysurvivingtheretiree,thepresentvalueoftheremainingannuitypaymentsshallbe 136paidasprovidedundersubsection3ofsection104.620.Ifthebeneficiarysurvivestheretiree 137butdiesbeforereceivingtheremainderofsuchonehundredtwentymonthlypayments,the 138presentvalueoftheremainingannuitypaymentsshallbepaidasprovidedundersubsection3 139ofsection104.620. 140 Option4. 141 Aretiree'slifeannuityshallbereducedtoeighty-sixpercentoftheannuityotherwise 142payable.Iftheretireediesbeforehavingreceivedonehundredeightymonthlypayments,the 143reducedannuityshallbecontinuedfortheremainderoftheonehundredeighty-monthperiod 144totheretiree'sdesignatedbeneficiaryprovidedthatifthereisnobeneficiarysurvivingthe 145retiree,thepresentvalueoftheremainingannuitypaymentsshallbepaidasprovidedunder 146subsection3ofsection104.620.Ifthebeneficiarysurvivestheretireebutdiesbefore 147receivingtheremainderofsuchonehundredeightymonthlypayments,thepresentvalueof 148theremainingannuitypaymentsshallbepaidasprovidedundersubsection3ofsection 149104.620. 150 11.Theprovisionsofsubsection6ofsection104.1024shallnotapplytomembers 151coveredbythissection. 152 12.EffectiveJanuary1,2018,amemberwhoisnotastatewideelectedofficialora 153memberofthegeneralassemblyshallbeeligibleforretirementunderthissubsectionsubject 154tothefollowingconditions: 155 (1)Amember'snormalretirementeligibilityshallbebasedontheattainmentofat 156leastagesixty-sevenandthecompletionofatleastfiveyearsofcreditedservice;orthe 157member'sattainmentofatleastagefifty-fivewiththesumofthemember'sageandcredited 158serviceequalingatleastninety;orinthecaseofamemberwhoisservingasauniformed 159memberofthehighwaypatrolandsubjecttothemandatoryretirementprovisionsofsection 160104.081,suchmember'sattainmentofatleastagesixtyortheattainmentofatleastagefifty- 161fivewithfiveyearsofcreditedservice; 162 (2)Avestedformermember'snormalretirementeligibilityshallbebasedonthe 163attainmentofatleastagesixty-sevenandthecompletionofatleastfiveyearsofcredited HB1185 39 164service;exceptthat,avestedformermemberwhoterminatesemploymentafterthe 165attainmentofnormalretirementeligibilityasdefinedinsubdivision(1)ofthis 166subsectionshallbecoveredundersuchsubdivision; HB1185 40 5 2.Anypersonwhoisatleastsixty-sevenyearsofage,hasservedinthisstatean 6aggregateofatleasttwelveyears,continuouslyorotherwise,asajudge,andceasestohold 7officebyreasonoftheexpirationofthejudge'sterm,voluntaryresignation,orretirement 8pursuanttotheprovisionsofSubsection2ofSection24ofArticleVoftheConstitutionof 9Missourimayreceivebenefitsasprovidedinsections476.515to476.565.Thetwelve-year 10requirementofthissubsectionmaybefulfilledbyserviceasjudgeinanyofthecourts 11covered,orbyserviceinanycombinationasjudgeofsuchcourts,totalinganaggregateof 12twelveyears.Anyjudgewhoisatleastsixty-sevenyearsofageandwhohasservedlessthan 13twelveyearsandisotherwisequalifiedundersections476.515to476.565mayretireafter 14reachingagesixty-seven,orthereafter,atareducedretirementcompensationinasumequal 15totheproportionoftheretirementcompensationprovidedinsection476.530thathisorher 16periodofjudicialservicebearstotwelveyears. 17 3.Anypersonwhoisatleastsixty-twoyearsofageorolder,hasservedinthisstate 18anaggregateofatleasttwentyyears,continuouslyorotherwise,asajudge,andceasestohold 19officebyreasonoftheexpirationofthejudge'sterm,voluntaryresignation,orretirement 20pursuanttotheprovisionsofSubsection2ofSection24ofArticleVoftheConstitutionof 21Missourimayreceivebenefitsasprovidedinsections476.515to476.565.Thetwenty-year 22requirementofthissubsectionmaybefulfilledbyserviceasajudgeinanyofthecourts 23covered,orbyserviceinanycombinationasjudgeofsuchcourts,totalinganaggregateof 24twentyyears.Anyjudgewhoisatleastsixty-twoyearsofageandwhohasservedlessthan 25twentyyearsandisotherwisequalifiedundersections476.515to476.565mayretireafter 26reachingagesixty-two,atareducedretirementcompensationinasumequaltotheproportion 27oftheretirementcompensationprovidedinsection476.530thathisorherperiodofjudicial 28servicebearstotwentyyears. 29 4.AlljudgesunderthissectionrequiredbytheprovisionsofSection26ofArticleV 30oftheConstitutionofMissouritoretireattheageofseventyyearsshallretireuponreaching 31thatage. 32 5.Theprovisionsofsections104.344,476.524,and476.690shallnotapplytojudges 33coveredbythissection. 34 6.Ajudgeshallberequiredtocontributefourpercentofthejudge'scompensationto 35theretirementsystem,whichshallstandtothejudge'screditinhisorherindividualaccount 36withthesystem,togetherwithinvestmentcreditsthereon,forpurposesoffundingretirement 37benefitspayableasprovidedinsections476.515to476.565,subjecttothefollowing 38provisions: 39 (1)ThestateofMissouriemployer,pursuanttotheprovisionsof26U.S.C.Section 40414(h)(2),shallpickupandpaythecontributionsthatwouldotherwisebepayablebythe 41judgeunderthissection.Thecontributionssopickedupshallbetreatedasemployer HB1185 41 42contributionsforpurposesofdeterminingthejudge'scompensationthatisincludableinthe 43judge'sgrossincomeforfederalincometaxpurposes; 44 (2)Judgecontributionspickedupbytheemployershallbepaidfromthesamesource 45offundsusedforthepaymentofcompensationtoajudge.Adeductionshallbemadefrom 46eachjudge'scompensationequaltotheamountofthejudge'scontributionspickedupbythe 47employer.Thisdeduction,however,shallnotreducethejudge'scompensationforpurposes 48ofcomputingbenefitsundertheretirementsystempursuanttothischapter; 49 (3)Judgecontributionssopickedupshallbecreditedtoaseparateaccountwithinthe 50judge'sindividualaccountsothattheamountscontributedpursuanttothissectionmaybe 51distinguishedfromtheamountscontributedonanafter-taxbasis; 52 (4)Thecontributions,althoughdesignatedasemployeecontributions,arebeingpaid 53bytheemployerinlieuofthecontributionsbythejudge.Thejudgeshallnothavetheoption 54ofchoosingtoreceivethecontributedamountsdirectlyinsteadofhavingthempaidbythe 55employertotheretirementsystem; 56 (5)InterestshallbecreditedannuallyonJunethirtiethbasedonthevalueinthe 57accountasofJulyfirstoftheimmediatelyprecedingyearatarateoffourpercent.Effective 58June30,2024,andeachJunethirtieththereafter,theinterestcreditingrateshallbe 59equaltotheinvestmentratethatispublishedbytheUnitedStatesDepartmentof 60Treasury,oritssuccessoragency,forfifty-two-weektreasurybillsfortherelevant 61auctionthatisnearesttotheprecedingJulyfirst,orasuccessortreasurybillinvestment 62rateasapprovedbytheboardifthefifty-two-weektreasurybillisnolongerissued. 63Interestcreditsshallceaseuponretirementordeathofthejudge; 64 (6)Ajudgewhoseemploymentisterminatedmayrequestarefundofhisorher 65contributionsandinterestcreditedthereon.Ifsuchjudgeismarriedatthetimeofsuch 66request,suchrequestshallnotbeprocessedwithoutconsentfromthespouse.Ajudgeisnot 67eligibletorequestarefundifthejudge'sretirementbenefitissubjecttoadivisionofbenefit 68orderpursuanttosection104.312.Suchrefundshallbepaidbythesystemafterninetydays 69fromthedateofterminationofemploymentortherequest,whicheverislaterandshall 70includeallcontributionsmadetoanyretirementplanadministeredbythesystemandinterest 71creditedthereon.Ajudgemaynotrequestarefundaftersuchjudgebecomeseligiblefor 72retirementbenefitsundersections476.515to476.565.Ajudgewhoreceivesarefundshall 73forfeitallthejudge'sserviceandfuturerightstoreceivebenefitsfromthesystemandshall 74notbeeligibletoreceiveanylong-termdisabilitybenefits;providedthatanyjudgeorformer 75judgereceivinglong-termdisabilitybenefitsshallnotbeeligibleforarefund.Ifsuchjudge 76subsequentlybecomesajudgeandworkscontinuouslyforatleastoneyear,theservice 77previouslyforfeitedshallberestoredifthejudgereturnstothesystemtheamountpreviously 78refundedplusinterestatarateestablishedbytheboard; HB1185 42 79 (7)Thebeneficiaryofanyjudgewhomadecontributionsshallreceivearefundupon 80thejudge'sdeathequaltotheamount,ifany,ofsuchcontributionsandinterestcredited 81thereon,lessanyretirementbenefitsreceivedbythejudgeunlessanannuityispayabletoa 82survivororbeneficiaryasaresultofthejudge'sdeath.Inthatevent,thebeneficiaryofthe 83survivororbeneficiarywhoreceivedtheannuityshallreceivearefunduponthesurvivor'sor 84beneficiary'sdeathequaltotheamount,ifany,ofthejudge'scontributionslessanyannuity 85amountsreceivedbythejudgeandthesurvivororbeneficiary. 86 7.Theemployeecontributionrate,thebenefitsprovidedundersections476.515to 87476.565tojudgescoveredunderthissection,andanyotherprovisionofsections476.515to 88476.565withregardtojudgescoveredunderthissectionmaybealtered,amended,increased, 89decreased,orrepealed,butonlywithrespecttoservicesrenderedbythejudgeafterthe 90effectivedateofsuchalteration,amendment,increase,decrease,orrepeal,or,withrespectto 91interestcredits,forperiodsoftimeaftertheeffectivedateofsuchalteration,amendment, 92increase,decrease,orrepeal. 93 8.Anyjudgewhoisreceivingretirementcompensationundersection476.529or 94476.530whobecomesemployedasanemployeeeligibletoparticipateintheclosedplanorin 95theyear2000planunderchapter104,shallnotreceivesuchretirementcompensationforany 96calendarmonthinwhichtheretiredjudgeissoemployed.Anyjudgewhoisreceiving 97retirementcompensationundersection476.529orsection476.530whosubsequentlyserves 98asajudgeasdefinedpursuanttosubdivision(4)ofsubsection1ofsection476.515shallnot 99receivesuchretirementcompensationforanycalendarmonthinwhichtheretiredjudgeis 100servingasajudge;exceptthatuponretirementsuchjudge'sannuityshallberecalculatedto 101includeanyadditionalserviceorsalaryaccruedbasedonthejudge'ssubsequentservice.A 102judgewhoisreceivingcompensationundersection476.529or476.530maycontinueto 103receivesuchretirementcompensationwhileservingasaseniorjudgeorseniorcommissioner 104andshallreceiveadditionalcreditandsalaryforsuchservicepursuanttosection476.682.
