Torepealsection386.370,RSMo,andtoenactinlieuthereofonenewsectionrelatingto
assessmentsagainstpublicutilities.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section386.370,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection386.370,toreadasfollows:
386.370.1.Thecommissionshall,priortothebeginningofeachfiscalyear
2beginningwiththefiscalyearcommencingonJuly1,1947,makeanestimateoftheexpenses
3tobeincurredbyitduringsuchfiscalyearreasonablyattributabletotheregulationofpublic
4utilitiesasprovidedinchapters386,392and393andshallalsoseparatelyestimatethe
5amountofsuchexpensesdirectlyattributabletosuchregulationofeachofthefollowing
6groupsofpublicutilities:electricalcorporations,gascorporations,watercorporations,
7heatingcompaniesandtelephonecorporations,telegraphcorporations,sewercorporations,
8andanyotherpublicutilityasdefinedinsection386.020,aswellastheamountofsuch
9expensesnotdirectlyattributabletoanysuchgroup.Forpurposesofthissection,water
10corporationsandsewercorporationswillbecombinedandconsideredonegroupofpublic
11utilities.
12 2.Thecommissionshallallocatetoeachsuchgroupofpublicutilitiestheestimated
13expensesdirectlyattributabletotheregulationofsuchgroupandanamountequaltosuch
14proportionoftheestimatedexpensesnotdirectlyattributabletoanygroupasthegross
15intrastateoperatingrevenuesofsuchgroupduringtheprecedingcalendaryearbearstothe
16totalgrossintrastateoperatingrevenuesofallpublicutilitiessubjecttothejurisdictionofthe
17commission,asaforesaid,duringsuchcalendaryear.Thecommissionshallthenassessthe

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18amountsoallocatedtoeachgroupofpublicutilities,subjecttoreductionashereinprovided,
19tothepublicutilitiesinsuchgroupinproportiontotheirrespectivegrossintrastateoperating
20revenuesduringtheprecedingcalendaryear,exceptthatthetotalamountsoassessedtoall
21suchpublicutilitiesshallnotexceedthreehundredfifteenthousandthsofonepercentofthe
22totalgrossintrastateoperatingrevenuesofallutilitiessubjecttothejurisdictionofthe
23commission.BeginningJanuary1,2024,thetotalamountassessedonthetotalgross
24intrastateoperatingrevenuesofallutilitiessubjecttothejurisdictionofthecommission
25shallnotexceedthreehundredfiftythousandthsofonepercentandshallincreaseevery
26twoyearsthereafterbyonehundredthofonepercentuntilsuchtimeasthemaximum
27amountavailabletobeassessedisequaltoone-halfofonepercent.Allcorporations
28subjecttothejurisdictionofthecommissionshalldefertoanassetorliabilityaccount
29anydifferenceintheassessmentactuallyincurredandthoseonwhichtherevenue
30requirementusedtosetratesinthecorporation'smostrecentlycompletedgeneralrate
31proceedingwasbased.Theassetorliabilityaccountbalancesshallbeincludedinthe
32revenuerequirementusedtosetratesthroughanamortizationoverareasonableperiod
33oftimeinsuchcorporation'ssubsequentgeneralrateproceedings.Thecommission
34shallalsoadjusttheratebaseusedtoestablishtherevenuerequirementoftheutilityto
35reflecttheunamortizedassetorliabilityaccountbalancesinsuchgeneralrate
36proceedings.
37 3.Thecommissionshallrenderastatementofsuchassessmenttoeachsuchpublic
38utilityonorbeforeJulyfirstandtheamountsoassessedtoeachsuchpublicutilityshallbe
39paidbyittothedirectorofrevenueinfullonorbeforeJulyfifteenthnextfollowingthe
40renditionofsuchstatement,exceptthatanysuchpublicutilitymayatitselectionpaysuch
41assessmentinfourequalinstallmentsnotlaterthanthefollowingdatesnextfollowingthe
42renditionofsaidstatement,towit:Julyfifteenth,Octoberfifteenth,Januaryfifteenthand
43Aprilfifteenth.Thedirectorofrevenueshallremitsuchpaymentstothestatetreasurer.
44 4.Thestatetreasurershallcreditsuchpaymentstoaspecialfund,whichishereby
45created,tobeknownas"ThePublicServiceCommissionFund",whichfund,oritssuccessor
46fundcreatedpursuanttosection33.571,shallbedevotedsolelytothepaymentof
47expendituresactuallyincurredbythecommissionandattributabletotheregulationofsuch
48publicutilitiessubjecttothejurisdictionofthecommission,asaforesaid.Anyamount
49remaininginsuchspecialfundoritssuccessorfundattheendofanyfiscalyearshallnot
50reverttothegeneralrevenuefund,butshallbeapplicablebyappropriationofthegeneral
51assemblytothepaymentofsuchexpendituresofthecommissioninthesucceedingfiscalyear
52andshallbeappliedbythecommissiontothereductionoftheamounttobeassessedtosuch
53publicutilitiesinsuchsucceedingfiscalyear,suchreductiontobeallocatedtoeachgroupof
HB1198	2 54publicutilitiesinproportiontotherespectivegrossintrastateoperatingrevenuesofthe
55respectivegroupsduringtheprecedingcalendaryear.
56 5.Inordertoenablethecommissiontomaketheallocationsandassessmentsherein
57providedfor,eachpublicutilitysubjecttothejurisdictionofthecommissionasaforesaid
58shallfilewiththecommission,withintendaysafterAugust28,1996,andthereafteronor
59beforeMarchthirty-firstofeachyear,astatementunderoathshowingitsgrossintrastate
60operatingrevenuesfortheprecedingcalendaryear,andifanypublicutilityshallfailtofile
61suchstatementwithinthetimeaforesaidthecommissionshallestimatesuchrevenuewhich
62estimateshallbebindingonsuchpublicutilityforthepurposeofthissection.
