Torepealsection565.184,RSMo,andtoenactinlieuthereofonenewsectionrelatingtothe
offenseofabuseofanelderlyperson,apersonwithadisability,oravulnerable
person,withpenaltyprovisions.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section565.184,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection565.184,toreadasfollows:
565.184.1.Apersoncommitstheoffenseofabuseofanelderlyperson,aperson
2withadisability,oravulnerablepersonifheorshe:
3 (1)Purposelyengagesinconductinvolvingmorethanoneincidentthatcauses
4emotionaldistresstoanelderlyperson,apersonwithadisability,oravulnerableperson.The
5courseofconductshallbesuchaswouldcauseareasonableelderlyperson,personwitha
6disability,orvulnerablepersontosuffersubstantialemotionaldistress;or
7 (2)Intentionallyfailstoprovidecare,goodsorservicestoanelderlyperson,aperson
8withadisability,oravulnerableperson.Theresultoftheconductshallbesuchaswould
9causeareasonableelderlyperson,personwithadisability,orvulnerablepersontosuffer
10physicaloremotionaldistress;or
11 (3)Knowinglyactsorknowinglyfailstoactinamannerwhichresultsina
12substantialrisktothelife,bodyorhealthofanelderlyperson,apersonwithadisability,ora
13vulnerableperson.
14 2.Theoffenseofabuseofanelderlyperson,apersonwithadisability,ora
15vulnerablepersonisaclassAmisdemeanor; however,ifapersoncommitstheoffenseof
16abuseofanelderlyperson,apersonwithadisability,oravulnerablepersonunder
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17subdivision(3)ofsubsection1ofthissectionandsuchpersonisacareprovider,the
18offenseofabuseofanelderlyperson,apersonwithadisability,oravulnerablepersonis
19aclassEfelony. Nothinginthissectionshallbeconstruedtomeanthatanelderlyperson,a
20personwithadisability,oravulnerablepersonisabusedsolelybecausesuchpersonchooses
21torelyonspiritualmeansthroughprayer,inlieuofmedicalcare,forhisorherhealthcare,as
22evidencebysuchperson'sexplicitconsent,advancedirectiveforhealthcare,orpractice.
