217.690.1.Allreleasesorparolesshallissueuponorderoftheparoleboard,duly
2adopted.Theparoleboardhasnoauthoritytoprovideahearingtotheoffender,order
3release,ororderparoleofanoffenderuntilsuchtimeastheoffenderhasservedthe
4minimumtermofthesentenceimposedupontheoffender.
5 2.Beforeorderingtheparoleofanyoffender,theparoleboardshallconducta
6validatedriskandneedsassessmentandevaluatethecaseundertherulesgoverningparole
7thatarepromulgatedbytheparoleboard.Theparoleboardshallthenhavetheoffender
8appearbeforeahearingpanelandshallconductapersonalinterviewwithhimorher,unless
9waivedbytheoffender,oriftheguidelinesindicatetheoffendermaybeparoledwithoutneed
10foraninterview.Theguidelinesandrulesshallnotallowforthewaiverofahearingifa
11victimrequestsahearing.Theappearanceorpresencemayoccurbymeansofa
12videoconferenceatthediscretionoftheparoleboard.Aparolemaybeorderedforthebest
13interestofsocietywhenthereisareasonableprobability,basedontheriskassessmentand
14indicatorsofreleasereadiness,thatthepersoncanbesupervisedunderparolesupervisionand
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 15successfullyreintegratedintothecommunity,notasanawardofclemency;itshallnotbe
16consideredareductionofsentenceorapardon.Everyoffenderwhileonparoleshallremain
17inthelegalcustodyofthedepartmentbutshallbesubjecttotheordersoftheparoleboard.
18 3.Thedivisionofprobationandparolehasdiscretionaryauthoritytorequirethe
19paymentofafee,nottoexceedsixtydollarspermonth,fromeveryoffenderplacedunder
20divisionsupervisiononprobation,parole,orconditionalrelease,towaiveallorpartofany
21fee,tosanctionoffendersforwillfulnonpaymentoffees,andtocontractwithaprivateentity
22forfeecollectionsservices.Allfeescollectedshallbedepositedintheinmatefund
23establishedinsection217.430.Feescollectedmaybeusedtopaythecostsofcontracted
24collectionsservices.Thefeescollectedmayotherwisebeusedtoprovidecommunity
25correctionsandinterventionservicesforoffenders.Suchservicesincludesubstanceabuse
26assessmentandtreatment,mentalhealthassessmentandtreatment,electronicmonitoring
27services,residentialfacilitiesservices,employmentplacementservices,andotheroffender
28communitycorrectionsorinterventionservicesdesignatedbythedivisionofprobationand
29paroletoassistoffenderstosuccessfullycompleteprobation,parole,orconditionalrelease.
30Thedivisionofprobationandparoleshalladoptrulesnotinconsistentwithlaw,inaccordance
31withsection217.040,withrespecttosanctioningoffendersandwithrespecttoestablishing,
32waiving,collecting,andusingfees.
33 4.Theparoleboardshalladoptrulesnotinconsistentwithlaw,inaccordancewith
34section217.040,withrespecttotheeligibilityofoffendersforparole,theconductofparole
35hearingsorconditionstobeimposeduponparoledoffenders.Wheneveranorderforparole
36isissueditshallrecitetheconditionsofsuchparole.
37 5.Whenconsideringparoleforanoffenderwithconsecutivesentences,theminimum
38termforeligibilityforparoleshallbecalculatedbyaddingtheminimumtermsforparole
39eligibilityforeachoftheconsecutivesentences,excepttheminimumtermforparole
40eligibilityshallnotexceedtheminimumtermforparoleeligibilityforanordinarylife
41sentence.
42 6.Anyoffendersentencedtoatermofimprisonmentamountingtofifteenyearsor
43moreormultipletermsofimprisonmentthat,takentogether,amounttofifteenormoreyears
44whowasundereighteenyearsofageatthetimeofthecommissionoftheoffenseoroffenses
45maybeeligibleforparoleafterservingfifteenyearsofincarceration,regardlessofwhether
46thecaseisfinalforthepurposesofappeal,andmaybeeligibleforreconsiderationhearingsin
47accordancewithregulationspromulgatedbytheparoleboard.
48 7.Theprovisionsofsubsection6ofthissectionshallnotapplytoanoffenderfound
49guiltyofmurderinthefirstdegreeorcapitalmurderwhowasundereighteenyearsofage
50whentheoffendercommittedtheoffenseoroffenseswhomaybefoundineligibleforparole
51orwhoseparoleeligibilitymaybecontrolledbysection558.047or565.033.
HB1227	2 52 8.Anyoffenderunderasentenceforfirstdegreemurderwhohasbeendeniedrelease
53onparoleafteraparolehearingshallnotbeeligibleforanotherparolehearinguntilatleast
54threeyearsfromthemonthoftheparoledenial;however,thissubsectionshallnotpreventa
55releasepursuanttosubsection4ofsection558.011.
56 9.Avictimwhohasrequestedanopportunitytobeheardshallreceivenoticethatthe
57paroleboardisconductinganassessmentoftheoffender'sriskandreadinessforreleaseand
58thatthevictim'sinputwillbeparticularlyhelpfulwhenitpertainstosafetyconcernsand
59specificprotectivemeasuresthatmaybebeneficialtothevictimshouldtheoffenderbe
60grantedrelease.
61 10.Parolehearingsshall,ataminimum,containthefollowingprocedures:
62 (1)Thevictimorpersonrepresentingthevictimwhoattendsahearingmaybe
63accompaniedbyoneotherperson;
64 (2)Thevictimorpersonrepresentingthevictimwhoattendsahearingshallhavethe
65optionofgivingtestimonyinthepresenceoftheinmateortothehearingpanelwithoutthe
66inmatebeingpresent;
67 (3)Thevictimorpersonrepresentingthevictimmaycallorwritetheparoleboard
68ratherthanattendthehearing;
69 (4)Thevictimorpersonrepresentingthevictimmayhaveapersonalmeetingwitha
70paroleboardmemberattheparoleboard'scentraloffice;
71 (5)Thejudge,prosecutingattorneyorcircuitattorneyandarepresentativeofthe
72locallawenforcementagencyinvestigatingthecrimeshallbeallowedtoattendthehearingor
73provideinformationtothehearingpanelinregardtotheparoleconsideration;and
74 (6)Theparoleboardshallevaluateinformationlistedinthejuvenilesexoffender
75registrypursuanttosection211.425,providedtheoffenderisbetweentheagesofseventeen
76andtwenty-one,asitimpactsthesafetyofthecommunity.
77 11.Theparoleboardshallnotifyanypersonoftheresultsofaparoleeligibility
78hearingifthepersonindicatestotheparoleboardadesiretobenotified.
79 12.Theparoleboardmay,atitsdiscretion,requireanyoffenderseekingparoleto
80meetcertainconditionsduringthetermofthatparolesolongassaidconditionsarenotillegal
81orimpossiblefortheoffendertoperform.Theseconditionsmayincludeanamountof
82restitutiontothestateforthecostofthatoffender'sincarceration.
83 13.Specialparoleconditionsshallberesponsivetotheassessedriskandneedsofthe
84offenderortheneedforextraordinarysupervision,suchaselectronicmonitoring.Theparole
85boardshalladoptrulestominimizetheconditionsplacedonlow-riskcases,tofrontload
86conditionsuponrelease,andtorequirethemodificationandreductionofconditionsbasedon
87theperson'scontinuingstabilityinthecommunity.Paroleboardrulesshallpermitparole
88conditionstobemodifiedbyparoleofficerswithreviewandapprovalbysupervisors.
HB1227	3 89 14.Nothingcontainedinthissectionshallbeconstruedtorequirethereleaseofan
90offenderonparolenortoreducethesentenceofanoffenderheretoforecommitted.
91 15.BeginningJanuary1,2001,theparoleboardshallnotorderaparoleunlessthe
92offenderhasobtainedahighschooldiplomaoritsequivalent,orunlesstheparoleboardis
93satisfiedthattheoffender,whilecommittedtothecustodyofthedepartment,hasmadean
94honestgood-faithefforttoobtainahighschooldiplomaoritsequivalent;providedthatthe
95directormaywaivethisrequirementbycertifyinginwritingtotheparoleboardthatthe
96offenderhasactivelyparticipatedinmandatoryeducationprogramsorisacademicallyunable
97toobtainahighschooldiplomaoritsequivalent.
98 16.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
99createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies
100withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.
101Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe
102generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto
103disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof
104rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2005,shallbeinvalid
105andvoid.
217.760.1.InallfelonycasesandclassAmisdemeanorcases,thebasisofwhich
2misdemeanorcasesarecontainedinchapters565and566andsection577.023,attherequest
3ofacircuitjudgeofanycircuitcourt,thedivisionofprobationandparoleshallassignoneor
4morestateprobationandparoleofficerstomakeaninvestigationofthepersonconvictedof
5thecrimeoroffensebeforesentenceisimposed.Inallfelonycasesinwhichthe
6recommendedsentenceestablishedbythesentencingadvisorycommissionpursuantto
7subsection[7]6ofsection558.019includesprobationbuttherecommendationofthe
8prosecutingattorneyorcircuitattorneydoesnotincludeprobation,thedivisionofprobation
9andparoleshall,priortosentencing,providethejudgewithareportonavailablealternatives
10toincarceration.Ifapresentenceinvestigationreportiscompletedthentheavailable
11alternativesshallbeincludedinthepresentenceinvestigationreport.
12 2.Thereportofthepresentenceinvestigationorpreparoleinvestigationshallcontain
13anypriorcriminalrecordofthedefendantandsuchinformationabouthisorher
14characteristics,hisorherfinancialcondition,hisorhersocialhistory,thecircumstances
15affectinghisorherbehaviorasmaybehelpfulinimposingsentenceoringrantingprobation
16orinthecorrectionaltreatmentofthedefendant,informationconcerningtheimpactofthe
17crimeuponthevictim,therecommendedsentenceestablishedbythesentencingadvisory
18commissionandavailablealternativestoincarcerationincludingopportunitiesforrestorative
19justice,aswellasarecommendationbytheprobationandparoleofficer.Theofficershall
20securesuchotherinformationasmayberequiredbythecourtand,wheneveritispracticable
HB1227	4 21andneeded,suchinvestigationshallincludeaphysicalandmentalexaminationofthe
22defendant.
558.011.1.Theauthorizedtermsofimprisonment,includingbothprisonand
2conditionalreleaseterms,are:
3 (1)ForaclassAfelony,atermofyearsnotlessthantenyearsandnottoexceed
4thirtyyears,orlifeimprisonment;
5 (2)ForaclassBfelony,atermofyearsnotlessthanfiveyearsandnottoexceed
6fifteenyears;
7 (3)ForaclassCfelony,atermofyearsnotlessthanthreeyearsandnottoexceedten
8years;
9 (4)ForaclassDfelony,atermofyearsnottoexceedsevenyears;
10 (5)ForaclassEfelony,atermofyearsnottoexceedfouryears;
11 (6)ForaclassAmisdemeanor,atermnottoexceedoneyear;
12 (7)ForaclassBmisdemeanor,atermnottoexceedsixmonths;
13 (8)ForaclassCmisdemeanor,atermnottoexceedfifteendays.
14 2.IncasesofclassDandEfelonies,thecourtshallhavediscretiontoimprisonfora
15specialtermnottoexceedoneyearinthecountyjailorotherauthorizedpenalinstitution,and
16theplaceofconfinementshallbefixedbythecourt.Ifthecourtimposesasentenceof
17imprisonmentforatermlongerthanoneyearuponapersonconvictedofaclassDorE
18felony,itshallcommitthepersontothecustodyofthedepartmentofcorrections.
19 3.(1)Whenaregularsentenceofimprisonmentforafelonyisimposed,thecourt
20shallcommitthepersontothecustodyofthedepartmentofcorrectionsforthetermimposed
21undersection557.036,oruntilreleasedunderproceduresestablishedelsewherebylaw.
22 (2)Asentenceofimprisonmentforamisdemeanorshallbeforadefinitetermandthe
23courtshallcommitthepersontothecountyjailorotherauthorizedpenalinstitutionforthe
24termofhisorhersentenceoruntilreleasedunderprocedureestablishedelsewherebylaw.
25 4.(1)Exceptasotherwiseprovided,asentenceofimprisonmentforatermofyears
26forfeloniesotherthandangerousfeloniesasdefinedinsection556.061,andotherthan
27sentencesofimprisonmentwhichinvolvetheindividual'sfourthorsubsequentremandtothe
28departmentofcorrectionsshallconsistofaprisontermandaconditionalreleaseterm.The
29conditionalreleasetermofanytermimposedundersection557.036shallbe[:
30 (a)One-thirdfortermsofnineyearsorless;
31 (b)Threeyearsfortermsbetweennineandfifteenyears;
32 (c)Fiveyearsfortermsmorethanfifteenyears;andtheprisontermshallbethe
33remainderofsuchterm.Theprisontermmaybeextendedbytheparoleboardpursuantto
34subsection5ofthissection] nomorethanfifteenpercentofthesentenceofimprisonment.
HB1227	5 35 (2)"Conditionalrelease"meanstheconditionaldischargeofanoffenderbytheparole
36board,subjecttoconditionsofreleasethattheparoleboarddeemsreasonabletoassistthe
37offendertoleadalaw-abidinglife,andsubjecttothesupervisionunderthedivisionof
38probationandparole.Theconditionsofreleaseshallincludeavoidancebytheoffenderof
39anyotheroffense,federalorstate,andotherconditionsthattheparoleboardinitsdiscretion
40deemsreasonablynecessarytoassistthereleaseeinavoidingfurtherviolationofthelaw.A
41conditionalreleasetermofanytermimposedundersection557.036shallbenomore
42thanfifteenpercentofthesentenceofimprisonment.
43 5.Thedateofconditionalreleasefromtheprisontermmaybeextendeduptoa
44maximumoftheentiresentenceofimprisonmentbytheparoleboard.Thedirectorofany
45divisionofthedepartmentofcorrectionsexceptthedivisionofprobationandparolemayfile
46withtheparoleboardapetitiontoextendtheconditionalreleasedatewhenanoffenderfails
47tofollowtherulesandregulationsofthedivisionorcommitsanactinviolationofsuchrules.
48Withintenworkingdaysofreceiptofthepetitiontoextendtheconditionalreleasedate,the
49paroleboardshallconveneahearingonthepetition.Theoffendershallbepresentandmay
50callwitnessesinhisorherbehalfandcross-examinewitnessesappearingagainsttheoffender.
51Thehearingshallbeconductedasprovidedinsection217.670.Iftheviolationoccursin
52closeproximitytotheconditionalreleasedate,theconditionalreleasemaybeheldfora
53maximumoffifteenworkingdaystopermitnecessarytimeforthedivisiondirectortofilea
54petitionforanextensionwiththeparoleboardandfortheparoleboardtoconductahearing,
55providedsomeaffirmativemanifestationofanintenttoextendtheconditionalreleasehas
56occurredpriortotheconditionalreleasedate.Ifattheendofafifteen-working-dayperioda
57paroleboarddecisionhasnotbeenreached,theoffendershallbereleasedconditionally.The
58decisionoftheparoleboardshallbefinal.
558.019.1.Thissectionshallnotbeconstruedtoaffectthepowersofthegovernor
2underArticleIV,Section7,oftheMissouriConstitution.Thisstatuteshallnotaffectthose
3provisionsofsection565.020,section566.125,orsection571.015,whichsetminimumterms
4ofsentences,ortheprovisionsofsection559.115,relatingtoprobation.
5 2.Theprovisionsofsubsections2to5ofthissectionshallonlybeapplicabletothe
6offensescontainedinsections565.021,565.023,565.024,565.027,565.050,565.052,

22Otherprovisionsofthelawtothecontrarynotwithstanding,anyoffenderwhohasbeenfound
23guiltyofafelonyotherthanadangerousfelonyasdefinedinsection556.061andis
24committedtothedepartmentofcorrectionsshallberequiredtoservethefollowingminimum
25prisonterms:
26 (1)Iftheoffenderhasonepreviousprisoncommitmenttothedepartmentof
27correctionsforafelonyoffense,theminimumprisontermwhichtheoffendermustserveshall
28be[forty] sixtypercentofhisorhersentenceoruntiltheoffenderattainsseventyyearsof
29age,andhasservedatleastthirtypercentofthesentenceimposed,whicheveroccursfirst;
30 (2)Iftheoffenderhastwopreviousprisoncommitmentstothedepartmentof
31correctionsforfeloniesunrelatedtothepresentoffense,theminimumprisontermwhichthe
32offendermustserveshallbe[fifty] seventy-fivepercentofhisorhersentenceoruntilthe
33offenderattainsseventyyearsofage,andhasservedatleastfortypercentofthesentence
34imposed,whicheveroccursfirst;
35 (3)Iftheoffenderhasthreeormorepreviousprisoncommitmentstothedepartment
36ofcorrectionsforfeloniesunrelatedtothepresentoffense,theminimumprisontermwhich
37theoffendermustserveshallbe[eighty] ninetypercentofhisorhersentenceoruntilthe
38offenderattainsseventyyearsofage,andhasservedatleastfortypercentofthesentence
39imposed,whicheveroccursfirst.
40 3.Otherprovisionsofthelawtothecontrarynotwithstanding,anyoffenderwhohas
41beenfoundguiltyofadangerousfelonyasdefinedinsection556.061andiscommittedtothe
42departmentofcorrectionsshallberequiredtoserveaminimumprisontermofeighty-five
43percentofthesentenceimposedbythecourtoruntiltheoffenderattainsseventyyearsofage,
44andhasservedatleastfortypercentofthesentenceimposed,whicheveroccursfirst.
45 4.Forthepurposeofdeterminingtheminimumprisontermtobeserved,the
46followingcalculationsshallapply:
47 (1)Asentenceoflifeshallbecalculatedtobethirtyyears;
48 (2)Anysentenceeitheraloneorintheaggregatewithotherconsecutivesentencesfor
49offensescommittedatornearthesametimewhichisoverseventy-fiveyearsshallbe
50calculatedtobeseventy-fiveyears.
HB1227	7 51 5.Forpurposesofthissection,theterm"minimumprisonterm"shallmeantime
52requiredtobeservedbytheoffenderbeforeheorsheiseligibleforparole,conditional
53releaseorotherearlyreleasebythedepartmentofcorrections.
54 6.[Anoffenderwhowasconvictedof,orpledguiltyto,afelonyoffenseotherthan
55thoseoffenseslistedinsubsection2ofthissectionpriortoAugust28,2019,shallnolonger
56besubjecttotheminimumprisontermprovisionsundersubsection2ofthissection,andshall
57beeligibleforparole,conditionalrelease,orotherearlyreleasebythedepartmentof
58correctionsaccordingtotherulesandregulationsofthedepartment.
59 7.](1)Asentencingadvisorycommissionisherebycreatedtoconsistofeleven
60members.Onemembershallbeappointedbythespeakerofthehouse.Onemembershallbe
61appointedbythepresidentprotemofthesenate.Onemembershallbethedirectorofthe
62departmentofcorrections.Sixmembersshallbeappointedbyandserveatthepleasureofthe
63governorfromamongthefollowing:thepublicdefendercommission;privatecitizens;a
64privatememberoftheMissouriBar;theboardofprobationandparole;andaprosecutor.
65Twomembersshallbeappointedbythesupremecourt,onefromametropolitanareaandone
66fromaruralarea.Allmembersshallbeappointedtoafour-yearterm.Allmembersofthe
67sentencingcommissionappointedpriortoAugust28,1994,shallcontinuetoserveonthe
68sentencingadvisorycommissionatthepleasureofthegovernor.
69 (2)Thecommissionshallstudysentencingpracticesinthecircuitcourtsthroughout
70thestateforthepurposeofdeterminingwhetherandtowhatextentdisparitiesexistamong
71thevariouscircuitcourtswithrespecttothelengthofsentencesimposedandtheuseof
72probationforoffendersconvictedofthesameorsimilaroffensesandwithsimilarcriminal
73histories.Thecommissionshallalsostudyandexaminewhetherandtowhatextent
74sentencingdisparityamongeconomicandsocialclassesexistsinrelationtothesentenceof
75deathandifso,thereasonstherefor,ifsentencesarecomparabletootherstates,ifthelength
76ofthesentenceisappropriate,andtherateofrehabilitationbasedonsentence.Itshall
77compilestatistics,examinecases,drawconclusions,andperformotherdutiesrelevanttothe
78researchandinvestigationofdisparitiesindeathpenaltysentencingamongeconomicand
79socialclasses.
80 (3)Thecommissionshallstudyalternativesentences,prisonworkprograms,work
81release,home-basedincarceration,probationandparoleoptions,andanyotherprogramsand
82reportthefeasibilityoftheseoptionsinMissouri.
83 (4)Thegovernorshallselectachairpersonwhoshallcallmeetingsofthecommission
84asrequiredorpermittedpursuanttothepurposeofthesentencingcommission.
85 (5)Themembersofthecommissionshallnotreceivecompensationfortheirduties
86onthecommission,butshallbereimbursedforactualandnecessaryexpensesincurredinthe
HB1227	8 87performanceofthesedutiesandforwhichtheyarenotreimbursedbyreasonoftheirother
88paidpositions.
89 (6)Thecircuitandassociatecircuitcourtsofthisstate,theofficeofthestatecourts
90administrator,thedepartmentofpublicsafety,andthedepartmentofcorrectionsshall
91cooperatewiththecommissionbyprovidinginformationoraccesstoinformationneededby
92thecommission.Theofficeofthestatecourtsadministratorwillprovideneededstaffing
93resources.
94 [8.]7.Courtsshallretaindiscretiontolowerorexceedthesentencerecommendedby

559.125.1.Theclerkofthecourtshallkeepinapermanentfileallapplicationsfor
2probationorparolebythecourt,andshallkeepinsuchmannerasmaybeprescribedbythe
3courtcompleteandfullrecordsofallpresentenceinvestigationsrequested,probationsor
4parolesgranted,revokedorterminatedandalldischargesfromprobationsorparoles.All
5courtordersrelatingtoanypresentenceinvestigationrequestedandprobationorparole
6grantedundertheprovisionsofthischapterandsections558.011and558.026shallbekeptin
7alikemanner,and,ifthedefendantsubjecttoanysuchorderissubjecttoaninvestigationor

7 2.Theoffenseofrapeinthefirstdegreeoranattempttocommitrapeinthefirst
8degreeisafelonyforwhichtheauthorizedtermofimprisonmentislifeimprisonmentora
9termofyearsnotlessthanfiveyears,unless:
10 (1)Theoffenseisanaggravatedsexualoffense,inwhichcasetheauthorizedtermof
11imprisonmentislifeimprisonmentoratermofyearsnotlessthanfifteenyears;

24 3.Subsection4ofsection558.019shallnotapplytothesentenceofapersonwhohas
25beenfoundguiltyofrapeinthefirstdegreeorattempttocommitrapeinthefirstdegreewhen
26thevictimislessthantwelveyearsofage,and"lifeimprisonment"shallmeanimprisonment
27forthedurationofaperson'snaturallifeforthepurposesofthissection.

11calendaryears] untilthepersonconvictedservesonehundredpercentofthesentenced
