SectionA.Chapter568,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection568.180,toreadasfollows:
568.180.1.Apersonisguiltyoffailingtosuperviseachildifthepersonisthe
2parent,lawfulguardian,orotherpersonlawfullychargedwiththecareorcustodyofa
3childunderfifteenyearsofageandthechild:
4 (1)Commitsanactthatbringsthechildwithinthejurisdictionofthejuvenile
5courtunderchapter211;
6 (2)Violatesacurfewlawofacountyoranyotherpoliticalsubdivision;or
7 (3)Failstoattendschoolasrequiredundersection167.031.
8 2.Nothinginthissectionappliestoachildplacingagencyortofosterparents.
9 3.Inaprosecutionofapersonforfailingtosuperviseachildundersubdivision
10(1)ofsubsection1ofthissection,itisanaffirmativedefensethattheperson:
11 (1)Isavictimoftheactthatbringsthechildwithinthejurisdictionofthe
12juvenilecourt;or
13 (2)Reportedtheacttotheappropriateauthorities.
14 4.Inaprosecutionofapersonforfailingtosuperviseachildundersubsection1
15ofthissection,itisanaffirmativedefensethatthepersontookreasonablestepsto
16controltheconductofthechildatthetimethepersonisallegedtohavefailedto
17supervisethechild.
