5constructionprocessandotherspecifiedservicestothepublicownerandshallperforminan 6expeditiousandeconomicalmannerconsistentwiththeinterestofthepublicowner.Should 7thepublicownerdetermineittobeinthepublic'sbestinterest,theconstructionmanagermay HB1244 2 8provideorperformbasicservicesforwhichreimbursementisprovidedinthegeneral 9conditionstotheconstructionmanagementservicescontract.Theconstructionmanagershall 10not,however,bepermittedtobidonorperformanyoftheactualconstructiononapublic 3regulations,inadditiontotherequirementsprovidedbylawfortheapprovalofplats,may 4providerequirementsforthecoordinateddevelopmentofthecity,townorvillage;forthe 5coordinationofstreetswithinsubdivisionswithotherexistingorplannedstreetsorwithother 6featuresofthecityplanorofficialmapofthecity,townorvillage;foradequateopenspaces 7fortraffic,recreation,lightandair;andforadistributionofpopulationandtraffic;provided 8that,thecity,townorvillagemayonlyimposerequirementsforthepostingofbonds,letters 9ofcreditorescrowsforsubdivision-relatedimprovementsasprovidedforinsubsections2to 105ofthissection. 11 2.Theregulationmayincluderequirementsastotheextentandthemannerinwhich 12thestreetsofthesubdivisionoranydesignatedportionstheretoshallbegradedandimproved 13aswellasincludingrequirementsastotheextentandmanneroftheinstallationofallutility 14facilities.Compliancewithalloftheserequirementsisaconditionprecedenttotheapproval 15oftheplat.Theregulationsorpracticeofthecouncilmayprovideforthetentativeapproval 16oftheplatprevioustotheimprovementsandutilityinstallations;butanytentativeapproval 17shallnotbeenteredontheplat.Theregulationsmayprovidethat,inlieuofthecompletionof 18theworkandinstallationsprevioustothefinalapprovalofaplat,thecouncilshallaccept,at 19theoptionofthedeveloper,anescrowsecuredwithcashoranirrevocableletterofcredit HB1244 3 20depositedwiththecity,town,orvillage.Thecity,town,orvillagemayacceptasuretybond, 21andsuchbondshallbeinanamountandwithsuretyandotherreasonableconditions, 22providingforandsecuringtheactualconstructionandinstallationoftheimprovementsand 23utilitieswithinaperiodspecifiedbythecouncilandexpressedinthebond.Thereleaseof 24anysuchescrow,letterofcredit,orbondbythecity,townorvillageshallbeasspecifiedin 25thissection.Thecouncilmayenforcetheescroworbondbyallappropriatelegaland 26equitableremedies.Theregulationsmayprovide,inlieuofthecompletionoftheworkand 27installationsprevioustothefinalapprovalofaplat,foranassessmentorothermethod 28wherebythecouncilisputinanassuredpositiontodotheworkandmaketheinstallationsat 29thecostoftheownersofthepropertywithinthesubdivision.Theregulationsmayprovide 30forthededication,reservationoracquisitionoflandsandopenspacesnecessaryforpublic 31usesindicatedonthecityplanandforappropriatemeansofprovidingforthecompensation, 32includingreasonablechargesagainstthesubdivision,ifany,andoveraperiodoftimeandina 33mannerasisinthepublicinterest. 34 3.Theregulationsshallprovidethatintheeventadeveloperwhohaspostedan 35escrow,orletterofcredit,orbondwithacity,town,orvillageinaccordancewithsubsection 362ofthissectiontransferstitleofthesubdivisionpropertypriortofullreleaseoftheescrow, 37letterofcredit,orbond,themunicipalityshallacceptareplacementescroworletterofcredit 38fromthesuccessordeveloperintheformallowedinsubsection2ofthissectionandinthe 39amountoftheescroworletterofcreditheldbythecity,town,orvillageatthetimeofthe 40propertytransfer,anduponreceiptofthereplacementescroworletterofcredit,thecity, 41town,orvillageshallreleasetheoriginalescroworletterofcreditinfullandreleasetheprior 42developerfromallfurtherobligationswithrespecttothesubdivisionimprovementsifthe 43successordeveloperassumesalloftheoutstandingobligationsofthepreviousdeveloper.The 44city,town,orvillagemayacceptasuretybondfromthesuccessordeveloperintheform 45allowedinsubsection2ofthissectionandintheamountofthebondheldbythecity,town,or 46villageatthetimeofthepropertytransfer,anduponreceiptofthereplacementbond,thecity, 47town,orvillageshallreleasetheoriginalbondinfull,andreleasethepriordeveloperfromall 48furtherobligationswithrespecttothesubdivisionimprovements. 49 4.Theregulationsshallprovidethatanyescroworbondamountheldbythecity, 50townorvillagetosecureactualconstructionandinstallationoneachcomponentofthe 51improvementsorutilitiesshallbereleasedwithinthirtydaysofcompletionofeachcategory 52ofimprovementorutilityworktobeinstalled,minusamaximumretentionoffivepercent 53whichshallbereleaseduponcompletionofallimprovementsandutilitywork.Thecity, 54town,orvillageshallinspecteachcategoryofimprovementorutilityworkwithintwenty 55businessdaysafterarequestforsuchinspection.Anysuchcategoryofimprovementor 56utilityworkshallbedeemedtobecompleteduponcertificationbythecity,townorvillage HB1244 4 57thattheprojectiscompleteinaccordancewiththeordinanceofthecity,townorvillage 58includingthefilingofalldocumentationandcertificationsrequiredbythecity,townor 59village,incompleteandacceptableform.Thereleaseshallbedeemedeffectivewhenthe 60escrowfundsorbondamountaredulypostedwiththeUnitedStatesPostalServiceorother 61agreed-upondeliveryserviceorwhentheescrowfundsorbondamountarehanddeliveredto 62anauthorizedpersonorplaceasspecifiedbytheownerordeveloper. 63 5.Ifthecity,townorvillagehasnotreleasedtheescrowfundsorbondamountwithin 64thirtydaysasprovidedinthissectionorprovidedatimelyinspectionoftheimprovementsor 65utilityworkafterrequestforsuchinspection,thecity,townorvillageshallpaytheowneror 66developerinadditiontotheescrowfundsduetheownerordeveloper,interestattherateof 2.Theprovisionsofthissectionshallbeenforcedbythedepartmentoflaborand 6industrialrelationsthroughthedivisionoflaborstandards.Uponafindingbyacourtof 7competentjurisdictionthataprimaryemployerorcontractorhaswillfullyviolatedoromitted 8tocomplywiththerequirementsofthissection,suchpersonorpersonsshallbe[subjectto 9penaltyasprovidedbysection290.340] 26licensureforatleastoneyearintheotherjurisdiction,totherelevantoversightbodyinthis 27state. 28 3.Theoversightbodyinthisstateshall: 29 (1)Withinsixmonthsofreceivinganapplicationdescribedinsubsection2ofthis 30section,waiveanyexamination,educational,orexperiencerequirementsforlicensureinthis 31statefortheapplicantifitdeterminesthattherewereminimumeducationrequirementsand,if 32applicable,workexperienceandclinicalsupervisionrequirementsineffectandtheotherstate 33verifiesthatthepersonmetthoserequirementsinordertobelicensedorcertifiedinthatstate. 34Anoversightbodythatadministersanexaminationonlawsofthisstateaspartofitslicensing 35applicationrequirementmayrequireanapplicanttotakeandpassanexaminationspecificto 36thelawsofthisstate;or 37 (2)Withinthirtydaysofreceivinganapplicationdescribedinsubsection2ofthis 38sectionfromanonresidentmilitaryspouseoraresidentmilitaryspouse,waiveany 39examination,educational,orexperiencerequirementsforlicensureinthisstateforthe 45pending,orwhoiscurrentlyunderdisciplinaryaction,exceptasprovidedinsubdivision(2) 46ofthissubsection,withanoversightbodyoutsidethestate;whodoesnotholdalicensein 47goodstandingwithanoversightbodyoutsidethestate;whohasacriminalrecordthatwould 48disqualifyhimorherforlicensureinMissouri;orwhodoesnotholdavalidcurrentlicensein HB1244 8 49theotherjurisdictiononthedatetheoversightbodyreceiveshisorherapplicationunderthis 50section. 51 (2)Ifanotherjurisdictionhastakendisciplinaryactionagainstanapplicant,the 52oversightbodyshalldetermineifthecausefortheactionwascorrectedandthematter 53resolved.Ifthematterhasnotbeenresolvedbythatjurisdiction,theoversightbodymay 54denyalicenseuntilthematterisresolved. 55 5.Nothinginthissectionshallprohibittheoversightbodyfromdenyingalicenseto 56anapplicantunderthissectionforanyreasondescribedinanysectionassociatedwiththe 57occupationorprofessionforwhichtheapplicantseeksalicense. 58 6.Anypersonwhoislicensedundertheprovisionsofthissectionshallbesubjectto 59theapplicableoversightbody'sjurisdictionandallrulesandregulationspertainingtothe 60practiceofthelicensedoccupationorprofessioninthisstate. 61 7.Thissectionshallnotbeconstruedtowaiveanyrequirementforanapplicantto 62payanyfees,postanybondsorsuretybonds,orsubmitproofofinsuranceassociatedwiththe 63licensetheapplicantseeks. 64 324.025.1.Theprovisionsofthissectionshallbeknownandmaybecitedasthe 2"ExpandedWorkforceAccessActof2020". 3 2.Forpurposesofthissection,thefollowingtermsmean: HB1244 9 4 (1)"Apprenticeship",aprogramthattheUnitedStatesDepartmentofLabordeemsto 5meetthefederalguidelinessetoutin29CFRPart29and29U.S.C.Section50; 6 (2)"License",alicense,certificate,registration,permit,oraccreditationthatenablesa 7persontolegallypracticeanoccupation,profession,oractivityinthestate; 8 (3)"Licensingauthority",anagency,examiningboard,credentialingboard,orother 9officeofthestatewiththeauthoritytoimposeoccupationalfeesorlicensingrequirementson 10anyprofession. 11 3.BeginningJanuary1,2021,withintheparametersestablishedunderthefederal 12LaborStandardsFortheRegistrationofApprenticeshipProgramsunder29CFRPart29and 1329U.S.C.Section50,eachstatelicensingauthorityshallgrantalicensetoanyapplicantwho 14meetsthefollowingcriteria: 15 (1)Successfullycompletedtheeighthgrade; 16 (2)Completedanapprenticeshipapprovedbythedivisionofprofessionalregistration 17ortheUnitedStatesDepartmentofLabor,orotherwisepermittedunderstateorfederallaw; 18and 19 (3)Passedanexamination,ifoneisdeemedtobenecessary,bytheappropriate 20licensingauthority. 21 4.(1)Theappropriatelicensingauthorityshallestablishapassingscoreforany 22necessaryexaminationsundertheapprenticeshipprogramwhichshallnotexceedanypassing 23scoresthatareotherwiserequiredforanonapprenticeshiplicenseforthespecificprofession. 24 (2)Ifthereisnoexaminationrequirementforanonapprenticeshiplicense,no 25examinationshallberequiredforapplicantswhocompleteanapprenticeship. 26 (3)Thenumberofworkinghoursrequiredforacompetency-basedapprenticeshipor 27ahybridapprenticeshipunder29CFRPart29.5shallnotexceedthenumberofeducational 28hoursotherwiserequiredforanonapprenticeshiplicenseforthespecificprofession. 29 5.Anydepartmentwithoversightoveralicensingauthoritymaypromulgateall forpenaltieshereinprescribed,andshallenforcegenerallytheprovisionsof 4 sections290.210to290.340.Complaintsregardinganyviolationofsections 5 290.210to290.340shallbefiledwiththedepartment.Thefollowing 6 byanyauthorizedrepresentativeofthecontractingpublicbodyorofthe 8 departmentatanyreasonabletimeandasoftenasmaybenecessaryandsuch 9 recordsshallnotbedestroyedorremovedfromthestatefortheperiodofone 10 yearfollowingthecompletionofthepublicworkinconnectionwithwhichthe 11 recordsaremade. 12 2.Eachcontractorandsubcontractorshallfilewiththecontracting 13 publicbodyuponcompletionofthepublicworkandpriortofinalpayment 14 thereforanaffidavitstatingthatheorshehadfullycompliedwiththe 15 provisionsandrequirementsofsections290.210to290.340,andnopublic 16 notbelargerthantwoinches.Incaseswhereequipmentisleasedorwhere 26 affixingalegiblesigntotheequipmentisimpractical,thecontractormay 27 placeatemporarystationarysign,withtheinformationrequiredpursuantto Whereworkersareemployedandtheirrateofwageshasbeendeterminedas 6 providedinsections290.210to290.340,noperson,eitheronhisorherbehalf 7 orforanyotherperson,shallrequest,demandorreceive,eitherbeforeorafter 8 suchworkerisengaged,thatsuchworkerpayback,return,donate,contribute, 9 orgiveanypartorallofsaidworker'swages,salary,orthingofvalue,toany 10 person,uponthestatement,representation,orunderstandingthatfailureto 11 complywithsuchrequestordemandwillpreventsuchworkerfromprocuring 12 orretainingemployment,andnopersonshall,directlyorindirectly,pay, 13 requestorauthorizeanyotherpersontoviolatethissection.Thissectionshall 14 notapplytoanyagentorrepresentativeofadulyconstitutedlabor 15 organizationactinginthecollectionofduesorassessmentsofsuch 16 advertisingforbidsorcontractingforsuchconstruction,tohavethe 4 departmentdeterminethewageratesinthelocalitywheretheworkistobe 5 performedasprovidedinsections290.210to290.340.] [290.325.Nopublicbody,officer,official,member,agentor 2 representativethereofauthorizedtocontractforpublicworksshallawarda 3 contractfortheconstructionofsuchimprovementordisburseanyfundson HB1244 25 4 accountoftheconstructionofsuchpublicimprovement,unlesssuchpublic 5 bodyhasfirsthadthedepartmentdeterminetheratesofwagesrequiredtobe 6 paidinthelocalitywheretheworkistobeperformedandsuchdetermination 7 hasbeenmadeapartofthespecificationsandcontractforsuchpublicworks.] [290.330.Thedepartmentafterinvestigation,uponcomplaintmadeby 2 aninterestedpartylistedundersection290.240oruponitsowninitiative,shall 3 filewiththesecretaryofstatealistofthecontractorsandsubcontractorswho 4 itfindshavebeenprosecutedandconvictedforviolationsofsections290.210 5 to290.340andsuchcontractororsubcontractor,orsimulationsthereof,shall 6 beprohibitedfromcontractingdirectlyorindirectlywithanypublicbodyfor 7 theconstructionofanypublicworksorfromperforminganyworkonthesame 8 asacontractororsubcontractorforaperiodofoneyearfromthedateofthe 9 firstconvictionforsuchviolationandforaperiodofthreeyearsfromthedate 10 ofeachsubsequentviolationandconvictionthereof.Nopublicbodyshall 11 awardacontractforapublicworkstoanycontractororsubcontractor,or 12 simulationthereof,duringthetimethatitsnameappearsonsaidlist.The 13 filingofthenoticeofconvictionwiththesecretaryofstateshallbenoticeto 14 allpublicbodiesandtheirofficers,officials,members,agentsand 15 representatives.] [290.335.Ifitisfoundthatapublicbody,contractororsubcontractor 2 hasnotcompliedwithanyofthetermsofsections290.210to290.340,the 3 departmentshallgivenoticeofthepreciseviolationinwritingtosuchpublic 4 body,contractororsubcontractor.Sufficienttimemaybeallowedfor 5 compliancetherewithasthedepartmentdeemsnecessary.Aftertheexpiration 6 ofthetimeprescribedinsaidnotice,thedepartmentmayinwritinginformthe 7 attorneygeneralofthefactthatsuchnoticehasbeengivenandthatthepublic 8 body,contractororsubcontractorortheauthorizedrepresentativeoragent 9 thereoftowhomitwasdirectedhasnotcompliedwithsuchnotice.Upon 10 receiptthereof,theattorneygeneralshallattheearliestpossibletimebringsuit 11 inthenameofthestateinthecircuitcourtofthecountyinwhichsuchpublic 12 bodyislocatedorwhereanysuchcontractororsubcontractorisengagedin 13 anypublicworkstoenjointheawardofsuchcontractforapublicworks,or 14 anyfurtherworkorpaymentsthereunderifthecontracthasbeenawarded, 15 untiltherequirementsofsuchnoticearefullycompliedwith.Thecourtmay 16 issueatemporaryrestrainingorderwithduenoticetothedefendantinsuch 17 action.Theplaintiffshallinanysuchinjunctiveactionpostanadequatebond 18 tobesetbythecircuitjudge.Uponfinalhearingthereof,ifthecourtis 19
