191.1011.1.Thedepartmentofhealthandseniorservicesshallestablisha
2registrationprocessforentitiesdesiringtooperateasyringeaccessprogramorsimilar
3programintendedtomitigatethehealthrisksassociatedwithunsterileinjectiondrug
4usewherebyanyentitythatwouldliketooperatesuchaprogramshallbeallowedtodo
5soifitmeetsrequirementssetbythedepartmentofhealthandseniorservices.
6 2.Noentityregisteredwiththedepartmentofhealthandseniorservicesunder
7subsection1ofthissectionshallbepresentwithinfivehundredfeetofanyschool
8buildingunlesstheschoolbuildingwasconstructedorestablishedasaschoolafterthe
9entitywasinoperation.
10 3.Thedepartmentofhealthandseniorservicesshallpromulgaterulesto
11implementtheprovisionsofthissection.Anyruleorportionofarule,asthattermis
12definedinsection536.010,thatiscreatedundertheauthoritydelegatedinthissection
13shallbecomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsof
14chapter536and,ifapplicable,section536.028.Thissectionandchapter536are
15nonseverableandifanyofthepowersvestedwiththegeneralassemblypursuantto
16chapter536toreview,todelaytheeffectivedate,ortodisapproveandannularuleare
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis

579.040.1.(1)Apersoncommitstheoffenseofunlawfuldistribution,delivery,or
2saleofdrugparaphernaliaifheorsheunlawfullydistributes,delivers,orsells,orpossesses
3withintenttodistribute,deliver,orselldrugparaphernaliaknowing,orundercircumstances
4inwhichonereasonablyshouldknow,thatitwillbeusedtoplant,propogate,cultivate,grow,
5harvest,manufacture,compound,convert,produce,process,prepare,test,analyze,pack,
6repack,store,contain,conceal,inject,ingest,inhale,orotherwiseintroduceintothehuman
7bodyacontrolledsubstanceoranimitationcontrolledsubstanceinviolationofthischapter.
8 (2)Thefollowingentitiesandpersonsshallbeexemptfromtheprovisionsofthis
9section:
10 (a)Anyentityregisteredwiththedepartmentofhealthandseniorservices
11undersection191.1011thatpossesses,distributes,ordelivershypodermicneedlesor
12syringesforthepurposeofoperatingasyringeaccessprogramorsimilarprogram
13describedundersection191.1011;and
14 (b)Anystaffmember,volunteer,orparticipantinasyringeaccessprogramor
15similarprogramoperatedbyanentitydescribedunderparagraph(a)ofthis
16subdivisionwhopossesses,distributes,ordelivershypodermicneedlesorsyringesin
17connectionwithhisorherdutiesorparticipationinthesyringeaccessprogramor
18similarprogram.
19 2.TheoffenseofunlawfuldeliveryofdrugparaphernaliaisaclassAmisdemeanor,
20unlessdoneforcommercialpurposes,inwhichcaseitisaclassEfelony.
