BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Chapter590,RSMo,isamendedbyaddingtheretoonenewsection,tobe 2knownassection590.1035,toreadasfollows: 590.1035.1.Forpurposesofthissection,thefollowingtermsmean: 2 (1)"Criticalinjury",aninjurythatisreasonablylikelytoresultinthedeathof 3theinjuredperson; 4 (2)"Lawenforcementofficer",aPOST-certifiedlawenforcementofficerwho 5hasthepowerofarrestandisemployedbyanylawenforcementagencyinthisstate; 6 (3)"Officer-involvedshooting",theshootingofaperson: 7 (a)Byalawenforcementofficerwhilethelawenforcementofficerisondutyor 8whilethelawenforcementofficerisoffdutybutperformingactivitiesthatarewithin 9thescopeoftheofficer'slawenforcementduties;and 10 (b)Thatresultsinthedeathorcriticalinjuryoftheperson. 11 2.BeginningJanuary1,2024,wheneveranofficer-involvedshootingoccursina 12citynotwithinacountyorinacountywithmorethanonemillioninhabitants,thelaw 13enforcementagencywithjurisdictionovertheshootingshallimmediatelynotifythe 14attorneygeneral.Uponsuchnotification,theattorneygeneralshallappointalaw 15enforcementagencylocatedwithinonehundredmilesofthejurisdictioninwhichthe 16shootingoccurredtoconductaspecialinvestigationoftheofficer-involvedshooting. 17Thelawenforcementagencywithjurisdictionoverthesceneoftheshootingshallsecure EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18thesceneoftheshootinguntilthearrivalofinvestigatorsfromthelawenforcement 19agencyappointedtoconductthespecialinvestigation. 20 3.Attheconclusionofitsinvestigationundersubsection2ofthissection,thelaw 21enforcementagencyconductingthespecialinvestigationshallprovideacompletereport 22ofitsfindingstotheattorneygeneralandtothelawenforcementagencywith 23jurisdictionoverthesceneoftheshooting.Thereportshallincludearecommendation 24tothecircuitattorneyortotheprosecutorofthecountywheretheofficer-involved 25shootingoccurredastowhetherthelawenforcementofficershouldbechargedwitha 26crimeduetohisorherinvolvementintheshooting.Iftheattorneygeneraldetermines 27thereisnobasistoprosecutethelawenforcementofficerinvolvedintheshooting,the 28attorneygeneralshallprepareandpubliclydiscloseareportexplainingthereasonsfor 29suchdetermination.Thereportshallcontain,ataminimum,thefollowing: 30 (1)Abriefstatementoffacts; 31 (2)Adescriptionofthewitnessesinterviewed; 32 (3)Thereasonfortheofficer'sinitialinteractionwiththepersonwhowasshot; 33 (4)Theextenttowhichanysuspects,witnesses,orpersonsofinterestwere 34detainedduringtheinvestigationandonwhatgroundseachpersonwasdetained; 35 (5)Adescriptionofanyactsofaggressioncommittedbyanypartytothe 36shooting; 37 (6)Whetherthepersonshotwasarmed; 38 (7)Thelegaljustificationfortheshooting,includingwhethertheofficeractedin 39self-defense;and 40 (8)Anyotherappropriateinformationfromtheinvestigativefile,asdetermined 41bytheattorneygeneral. 42 4.Thelawenforcementagencythatemploystheofficerinvolvedintheshooting 43mayconductaseparateinternalinvestigationintotheshooting;provided,however,that 44theinternalinvestigationshallnotbeinlieuoforinterferewiththeinvestigation 45conductedundersubsection2ofthissection. 46 5.Thelocallawenforcementagencywithjurisdictionovertheshootingshall 47reimbursethelawenforcementagencythatconductedthespecialinvestigationforany 48expensesincurredbysuchlawenforcementagencyininvestigatingincidentsunder 49subsection2ofthissection. ✔ HB1256 2
