SectionA.Chapter1,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection1.1010,toreadasfollows:
1.1010.1.Thissectionshallbeknownandmaybecitedasthe"PublicDomain
2PreservationAct".
3 2.Ifproducedaspartofaperson'sofficialduties,federalcopyrightorpatent
4protectionshallnotbeassertedforjudicialopinions;administrativerulings;legislative
5enactments;publicordinances;oranyothermaterialproducedbyanofficer,employee,
6director,boardmember,oragentofthestateofMissouri,anystatedepartment,political
7subdivision,orspecialdistrictofthisstate.Thissubsectionshallnotapplytomaterial
8producedbyindependentcontractorsorthird-partyentitiesunlesssuchcontentis
9commissionedspecificallyforpublicuse.
10 3.Theprovisionsofsubsection2shallnotapplytoanyresearch,discovery,or
11inventionthatwasdiscovered,documented,orpublishedbyanemployeeofanypublic
12school,asthattermisdefinedinsection160.011,orstateinstitutionofhighereducation,
13asnamedinsection174.020,duringhisorhertermofemploymentandonpremises
14ownedorcontrolledbythestateofMissourioranyofitspoliticalsubdivisions.
15 4.Anymaterialpublishedbyastatedepartment,politicalsubdivision,orspecial
16districtofthisstatethatcontainscontentdescribedinsubsection2ofthissectionshall,
17whereverpracticable,beaccompaniedbythefollowingnotice:"PublicDomain
18Content,NoRightsReserved".Ifthematerialalsoincludescontentnotsubjecttothe

26administrator.Theprovisionsofthissubsectionshallnotapplytoanycontent
27publishedordistributedbyathirdpartywithoutchargetothedepartment,political
28subdivision,orspecialdistrict,ortoanycontentusedinternallyordistributedto
29anothergovernmententityorpublicbody.
30 6.Anyexistingworkcoveredbysubsection2onwhichfederalcopyrightor
31patentprotectionhasbeenassertedbythestateoranyofitspoliticalsubdivisionsbefore
32August28,2023,shallbemadeavailableatnocostunderaperpetual,transferable,
33worldwidelicense,theprovisionsofwhichstipulatethatnoenforcementofsuch
34copyrightorpatentprotectionshallbeexercised,andtheworkshallbeconsidered
35withinthepublicdomain.
36 7.Theprovisionsofthissectionshallnotprecludethisstateoranypolitical
37subdivisionthereoffromreceivingandholdingcopyrightsorpatentstransferredby
38assignment,bequest,orotherwise.
