4temporaryinstructionpermitentitlingtheapplicant,whilehavingsuchpermitinthe 5applicant'simmediatepossession,todriveamotorvehicleoftheappropriateclassuponthe 6highwaysforaperiodoftwelvemonths,butanysuchperson,exceptwhenoperatinga 7motorcycleormotortricycle,mustbeaccompaniedbyalicensedoperatorforthetypeof 8motorvehiclebeingoperatedwhoisactuallyoccupyingaseatbesidethedriverforthe 9purposeofgivinginstructionindrivingthemotorvehicle,whoisatleasttwenty-oneyearsof 12twenty-fiveyearsofagewhohasbeenlicensedforaminimumofthreeyearsandhasreceived 13writtenpermissionfromtheparentorlegalguardiantoescortoraccompanythedriver,a 14drivertraininginstructorholdingavaliddrivereducationendorsementonateaching 15certificateissuedbythedepartmentofelementaryandsecondaryeducationoraqualified 16instructorofaprivatedrivers'educationprogramwhohasavaliddriver'slicense.Any 17personoccupyingaseatbesideadriverasrequiredunderthissubsectionshallnotbe 18undertheinfluenceofalcohol,controlledsubstances,ormarijuana.Anapplicantfora 19temporaryinstructionpermitshallsuccessfullycompleteavisiontestandatestofthe 20applicant'sabilitytounderstandhighwaysignswhichregulate,warnordirecttrafficand 21practicalknowledgeofthetrafficlawsofthisstate,pursuanttosection302.173.Inaddition, 22beginningJanuary1,2007,nopermitshallbegrantedpursuanttothissubsectionunlessa 23parentorlegalguardiangiveswrittenpermissionbysigningtheapplicationandinsosigning, 24statethey,ortheirdesigneeassetforthinsubsection2ofthissection,willprovidea 25minimumoffortyhoursofbehind-the-wheeldrivinginstruction,includingaminimumoften 26hoursofbehind-the-wheeldrivinginstructionthatoccursduringthenighttimehoursfalling 27betweensunsetandsunrise.Thefortyhoursofbehind-the-wheeldrivinginstructionthatis 28completedpursuanttothissubsectionmayincludeanytimethattheholderofaninstruction 29permithasspentoperatingamotorvehicleinadrivertrainingprogramtaughtbyadriver 30traininginstructorholdingavaliddrivereducationendorsementonateachingcertificate 31issuedbythedepartmentofelementaryandsecondaryeducationorbyaqualifiedinstructor 32ofaprivatedrivers'educationprogram.Iftheapplicantforapermitisenrolledinafederal 33residentialjobtrainingprogram,theinstructor,asdefinedinsubsection5ofthissection,is 34authorizedtosigntheapplicationstatingthattheapplicantwillreceivethebehind-the-wheel 35drivinginstructionrequiredbythissection. 36 2.Intheeventtheparent,grandparentorguardianofthepersonundersixteenyears 37ofagehasaphysicaldisabilitywhichprohibitsordisqualifiessaidparent,grandparentor 38guardianfrombeingaqualifiedlicensedoperatorpursuanttothissection,saidparent, 39grandparentorguardianmaydesignateamaximumoftwoindividualsauthorizedto 40accompanytheapplicantforthepurposeofgivinginstructionindrivingthemotorvehicle. 41Anauthorizeddesigneemustbealicensedoperatorforthetypeofmotorvehiclebeing 42operatedandhaveattainedtwenty-oneyearsofage.Atleastoneofthedesigneesmust 43occupytheseatbesidetheapplicantwhilegivinginstructionindrivingthemotorvehicle. 44Anypersonoccupyingaseatbesideadriverasrequiredunderthissubsectionshallnot 45beundertheinfluenceofalcohol,controlledsubstances,ormarijuana.Thenameofthe 46authorizeddesigneesmustbeprovidedtothedepartmentofrevenuebytheparent, 47grandparentorguardianatthetimeofapplicationforthetemporaryinstructionpermit.The 48nameofeachauthorizeddesigneeshallbeprintedonthetemporaryinstructionpermit, 49however,thedirectormaydelaythetimeatwhichpermitsareprintedbearingsuchnames 50untiltheinventoriesofblankpermitsandrelatedformsexistingonAugust28,1998,are 51exhausted. 52 3.Thedirector,uponproperapplicationonaformprescribedbythedirector,inhisor 53herdiscretion,mayissuearestrictedinstructionpermiteffectiveforaschoolyearormore 54restrictedperiodtoanapplicantwhoisenrolledinahighschooldrivertrainingprogram HB1300 2 55taughtbyadrivertraininginstructorholdingavaliddrivereducationendorsementona 56teachingcertificateissuedbythestatedepartmentofelementaryandsecondaryeducation 57eventhoughtheapplicanthasnotreachedtheageofsixteenyearsbuthaspassedtheageof 58fifteenyears.Suchinstructionpermitshallentitletheapplicant,whentheapplicanthassuch 59permitinhisorherimmediatepossession,tooperateamotorvehicleonthehighways,but 60onlywhenadrivertraininginstructorholdingavaliddrivereducationendorsementona 61teachingcertificateissuedbythestatedepartmentofelementaryandsecondaryeducationis 62occupyingaseatbesidethedriver. 63 4.Thedirector,inhisorherdiscretion,mayissueatemporarydriver'spermittoan 64applicantwhoisotherwisequalifiedforalicensepermittingtheapplicanttooperateamotor 65vehiclewhilethedirectoriscompletingthedirector'sinvestigationanddeterminationofall 66factsrelativetosuchapplicant'srightstoreceivealicense.Suchpermitmustbeinthe 67applicant'simmediatepossessionwhileoperatingamotorvehicle,anditshallbeinvalid 68whentheapplicant'slicensehasbeenissuedorforgoodcausehasbeenrefused. 69 5.Intheeventthattheapplicantforatemporaryinstructionpermitdescribedin 70subsection1ofthissectionisaparticipantinafederalresidentialjobtrainingprogram,the 71permitteemayoperateamotorvehicleaccompaniedbyadrivertraininginstructorwhoholds 72avaliddrivereducationendorsementissuedbythedepartmentofelementaryandsecondary 73educationandavaliddriver'slicense. 74 6.Apersonatleastfifteenyearsofagemayoperateamotorvehicleaspartofa 75drivertrainingprogramtaughtbyadrivertraininginstructorholdingavaliddrivereducation 76endorsementonateachingcertificateissuedbythedepartmentofelementaryandsecondary 77educationoraqualifiedinstructorofaprivatedrivers'educationprogram. 78 7.BeginningJanuary1,2003,thedirectorshallissuewitheverytemporary 79instructionpermitissuedpursuanttosubsection1ofthissectionastickerorsignbearingthe 80words"PERMITDRIVER".Thedesignandsizeofsuchstickerorsignshallbedetermined 81bythedirectorbyregulation.Everyapplicantissuedatemporaryinstructionpermitand 82stickeronorafterJanuary1,2003,maydisplayoraffixthestickerorsignontherearwindow 83ofthemotorvehicle.Suchstickerorsignmaybedisplayedontherearwindowofthemotor 84vehiclewhenevertheholderoftheinstructionpermitoperatesamotorvehicleduringhisor 85hertemporarypermitlicensureperiod. 86 8.BeginningJuly1,2005,thedirectorshallverifythatanapplicantforaninstruction 87permitissuedunderthissectionislawfullypresentintheUnitedStatesbeforeacceptingthe 88application.Thedirectorshallnotissueaninstructionpermitforaperiodthatexceedsan 89applicant'slawfulpresenceintheUnitedStates.Thedirectormayestablishproceduresto 90verifythelawfulpresenceoftheapplicantandestablishthedurationofanypermitissued 91underthissection. HB1300 3 92 9.Thedirectormayadoptrulesandregulationsnecessarytocarryouttheprovisions 93ofthissection. 302.178.1.Anypersonbetweentheagesofsixteenandeighteenyearswhois 2qualifiedtoobtainalicensepursuanttosections302.010to302.340mayapplyfor,andthe 3directorshallissue,anintermediatedriver'slicenseentitlingtheapplicant,whilehavingsuch 4licenseinhisorherpossession,tooperateamotorvehicleoftheappropriateclassuponthe 5highwaysofthisstateinconjunctionwiththerequirementsofthissection.Anintermediate 6driver'slicenseshallbereadilydistinguishablefromalicenseissuedtothoseovertheageof 7eighteen.Allapplicantsforanintermediatedriver'slicenseshall: 8 (1)Successfullycompletetheexaminationrequiredbysection302.173; 9 (2)Paythefeerequiredbysubsection4ofthissection; 10 (3)Havehadatemporaryinstructionpermitissuedpursuanttosubsection1of 11section302.130foratleastasix-monthperiodoravalidlicensefromanotherstate;and 12 (4)Haveaparent,grandparent,legalguardian,or,iftheapplicantisaparticipantina 13federalresidentialjobtrainingprogram,adrivinginstructoremployedbyafederalresidential 14jobtrainingprogram,signtheapplicationstatingthattheapplicanthascompletedatleast 15fortyhoursofsuperviseddrivingexperienceunderatemporaryinstructionpermitissued 16pursuanttosubsection1ofsection302.130,or,iftheapplicantisanemancipatedminor,the 17personovertwenty-oneyearsofagewhosupervisedsuchdriving.Forpurposesofthis 18section,theterm"emancipatedminor"meansapersonwhoisatleastsixteenyearsofage,but 19lessthaneighteenyearsofage,who: 20 (a)Marrieswiththeconsentofthelegalcustodialparentorlegalguardianpursuantto 21section451.080; 22 (b)Hasbeendeclaredemancipatedbyacourtofcompetentjurisdiction; 23 (c)EntersactivedutyintheArmedForces; 24 (d)Haswrittenconsenttotheemancipationfromthecustodialparentorlegal 25guardian;or 26 (e)Throughemploymentorothermeansprovidesforsuchperson'sownfood,shelter 27andothercost-of-livingexpenses; 28 (5)Havehadnoalcohol-relatedenforcementcontactsasdefinedinsection302.525 29duringtheprecedingtwelvemonths;and 30 (6)Havenononalcoholictrafficconvictionsforwhichpointsareassessedpursuantto 31section302.302,withintheprecedingsixmonths. 32 2.Anintermediatedriver'slicensegrantsthelicenseethesameprivilegestooperate 33thatclassificationofmotorvehicleasalicenseissuedpursuanttosection302.177,exceptthat 34nopersonshalloperateamotorvehicleonthehighwaysofthisstateundersuchan 35intermediatedriver'slicensebetweenthehoursof1:00a.m.and5:00a.m.unless HB1300 4 36accompaniedbyapersondescribedinsubsection1ofsection302.130;exceptthelicensee 37mayoperateamotorvehiclewithoutbeingaccompaniedifthetravelistoorfromaschoolor 38educationalprogramoractivity,aregularplaceofemploymentorinemergencysituationsas 39definedbythedirectorbyregulation.Anypersonaccompanyingadriverasrequired 40underthissubsectionshallnotbeundertheinfluenceofalcohol,controlledsubstances, 41ormarijuana. 42 3.Eachintermediatedriver'slicenseshallberestrictedbyrequiringthatthedriver 43andallpassengersinthelicensee'svehiclewearsafetybeltsatalltimes.Thissafetybelt 44restrictionshallnotapplytoapersonoperatingamotorcycle.Forthefirstsixmonthsafter 45issuanceoftheintermediatedriver'slicense,theholderofthelicenseshallnotoperateamotor 46vehiclewithmorethanonepassengerwhoisundertheageofnineteenwhoisnotamember 47oftheholder'simmediatefamily.Asusedinthissubsection,anintermediatedriver'slicense 48holder'simmediatefamilyshallincludebrothers,sisters,stepbrothersorstepsistersofthe 49driver,includingadoptedorfosterchildrenresidinginthesamehouseholdoftheintermediate 50driver'slicenseholder.Aftertheexpirationofthefirstsixmonths,theholderofan 51intermediatedriver'slicenseshallnotoperateamotorvehiclewithmorethanthreepassengers 52whoareundernineteenyearsofageandwhoarenotmembersoftheholder'simmediate 53family.Thepassengerrestrictionsofthissubsectionshallnotbeapplicabletoany 54intermediatedriver'slicenseholderwhoisoperatingamotorvehiclebeingusedin 55agriculturalwork-relatedactivities. 56 4.Notwithstandingtheprovisionsofsection302.177tothecontrary,thefeeforan 57intermediatedriver'slicenseshallbefivedollarsandsuchlicenseshallbevalidforaperiodof 58twoyears. 59 5.Anyintermediatedriver'slicenseeaccumulatingsixormorepointsinatwelve- 60monthperiodmayberequiredtoparticipateinandsuccessfullycompleteadriver- 61improvementprogramapprovedbythestatehighwaysandtransportationcommission.The 62driver-improvementprogramorderedbythedirectorofrevenueshallnotbeusedinlieuof 63pointassessment. 64 6.(1)Anintermediatedriver'slicenseewhohas,fortheprecedingtwelve-month 65period,hadnoalcohol-relatedenforcementcontacts,asdefinedinsection302.525andno 66trafficconvictionsforwhichpointsareassessed,uponreachingtheageofeighteenyearsor 67withinthethirtydaysimmediatelyprecedingtheireighteenthbirthdaymayapplyforand 68receivewithoutfurtherexamination,otherthanavisiontestasprescribedbysection302.173, 69alicenseissuedpursuanttothischaptergrantingfulldrivingprivileges.Suchpersonshall 70paytherequiredfeeforsuchlicenseasprescribedinsection302.177. 71 (2)Ifanintermediatedriver'slicenseexpiresonaSaturday,Sunday,orlegalholiday, 72suchlicenseshallremainvalidforthefivebusinessdaysimmediatelyfollowingthe HB1300 5 73expirationdate.Innocaseshallalicenseewhoseintermediatedriver'slicenseexpiresona 74Saturday,Sunday,orlegalholidaybeguiltyofanoffenseofdrivingwithanexpiredorinvalid 75driver'slicenseifsuchoffenseoccurredwithinfivebusinessdaysimmediatelyfollowingan 76expirationdatethatoccursonaSaturday,Sunday,orlegalholiday. 77 (3)Thedirectorofrevenueshalldenyanapplicationforafulldriver'slicenseuntil 78thepersonhashadnotrafficconvictionsforwhichpointsareassessedforaperiodoftwelve 79monthspriortothedateofapplicationforlicenseoruntilthepersoniseligibletoapplyfora 80six-yeardriver'slicenseasprovidedforinsection302.177,providedtheapplicantis 81otherwiseeligibleforfulldrivingprivileges.Anintermediatedriver'slicenseshallexpire 82whenthelicenseeiseligibleandreceivesafulldriver'slicenseasprescribedinsubdivision 83(1)ofthissection. 84 7.Nopersonuponreachingtheageofeighteenyearswhoseintermediatedriver's 85licenseanddrivingprivilegeisdenied,suspended,cancelledorrevokedinthisstateorany 86otherstateforanyreasonmayapplyforafulldriver'slicenseuntilsuchlicenseordriving 87privilegeisfullyreinstated.Anysuchpersonwhoseintermediatedriver'slicensehasbeen 88revokedpursuanttotheprovisionsofsections302.010to302.540shall,uponreceiptof 89reinstatementoftherevocationfromthedirector,passthecompletedriverexamination,apply 90foranewlicense,andpaytheproperfeebeforeagainoperatingamotorvehicleuponthe 91highwaysofthisstate. 92 8.Apersonshallbeexemptfromtheintermediatelicensingrequirementsifthe 93personhasreachedtheageofeighteenyearsandmeetsallotherlicensingrequirements. 94 9.Anypersonwhoviolatesanyoftheprovisionsofthissectionrelatingto 95intermediatedrivers'licensesortheprovisionsofsection302.130relatingtotemporary 96instructionpermitsisguiltyofaninfraction,andnopointsshallbeassessedtohisorher 97drivingrecordforanysuchviolation. 98 10.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis 99createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies 100withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028. 101Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe 102generalassemblypursuanttochapter536toreview,todelaytheeffectivedateorto 103disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof 104rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2000,shallbeinvalid 105andvoid. ✔ HB1300 6
