BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Chapter42,RSMo,isamendedbyaddingtheretoonenewsection,tobe 2knownassection42.018,toreadasfollows: 42.018.1.Thissectionshallbeknownandmaybecitedasthe"Veterans 2TraumaticBrainInjuryTreatmentAct". 3 2.Asusedinthissection,thefollowingtermsmean: 4 (1)"Eligiblepatient",amilitaryveteranwhomeetstherequirementsofthis 5section; 6 (2)"Healthcarefacility",thesamemeaningasprovidedundersection190.100, 7anyoutpatientorinpatientfacilityutilizinghyperbaricoxygentherapy,oranyprivate 8hyperbaricoxygentreatmentcenterlicensedinthisstate; 9 (3)"Healthcareprovider",alicensedphysician,chiropractor,oracertified 10hyperbaricoxygentechnician; 11 (4)"Posttraumaticstressdisorder"or"PTSD",amentalhealthdisorderthatis 12developedafterhavingexperiencedorwitnessedalife-threateningeventincluding,but 13notlimitedto,militarysexualtrauma; 14 (5)"Traumaticbraininjury"or"TBI",anacquiredinjurytothebrain. 15"Traumaticbraininjury"doesnotincludebraindysfunctioncausedbycongenitalor 16degenerativedisordersorbirthtrauma. EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 3.Theveteranscommissionmaycontractwithpublicorprivateinstitutionsof 18highereducationinthisstate,orpublicorprivateclinicsorhospitals,tofurnish 19alternativetreatmentoptionsforveteranswhohavebeencertifiedbytheUnitedStates 20DepartmentofVeteransAffairs,anybranchoftheUnitedStatesArmedForces,orany 21state-licensedphysicianashavingatraumaticbraininjuryorposttraumaticstress 22disorder.Theinstitutionofhighereducationshallmanage,monitor,andensurethe 23complianceofcontractedprovidersofanyofthefollowingalternativetreatment 24options: 25 (1)Acceleratedresolutiontherapy; 26 (2)Equinetherapy; 27 (3)Hyperbaricoxygentherapy,whichshallbeprovidedataregisteredand 28licensedhyperbaricoxygenfacility; 29 (4)Musictherapy;or 30 (5)Serviceanimaltrainingtherapy. 31 4.Aveteranqualifiestoreceivealternativetreatmentunderthissectionifheor 32she: 33 (1)Hasbeendiagnosed,byahealthcarepractitioner,withservice-connected 34posttraumaticstressdisorderoraservice-connectedtraumaticbraininjury;and 35 (2)Voluntarilyagreestosuchalternativetreatment. 36 5.(1)Theprovisionofalternativetreatmentshallbeunderthedirectionand 37supervisionofanindividuallicensedinthisstatetoperformsuchalternativetreatment. 38 (2)Thesupervisinglicensedprovidershallagreetocooperatewiththeveterans 39commissiontoprovidedatasufficienttoassesstheefficacyofalternativetreatment 40modalities.Acceptabledatamayinclude,butshallnotbelimitedto,institutionalreview 41boardclinicaltrialdata,pretreatmentandposttreatmentMRIbrainscans,cognitive 42testingsuchastheRightEyetestingapprovedbytheUnitedStatesFoodandDrug 43Administration,AutomatedNeuropsychologicalAssessmentMetrics(ANAM)approved 44bytheUnitedStatesDepartmentofDefense,andCNSVitalSigns(CNSVS)metrics. 45 6.(1)Ahealthcareproviderorhealthcarefacilityshallmakehyperbaric 46oxygentherapyavailabletoaneligiblepatientwhohasrequestedsuchtherapyunder 47theprovisionsofthissubsection. 48 (2)Suchahealthcareproviderorhealthcarefacilitymay: 49 (a)Providethehyperbaricoxygentherapywithoutreceivingcompensation; 50 (b)Requireaneligiblepatienttopayforthecostofthehyperbaricoxygen 51therapyandanyassociatedcosts,ataratethatshallnotexceedthemaximumrate 52allowedbyMedicare;or HB1313 2 53 (c)Allowaneligiblepatienttoutilizealternativesourcesoffundingtocoverthe 54costofthehyperbaricoxygentherapyandanyassociatedcosts.Suchalternative 55sourcesoffundingmayinclude,butshallnotbelimitedto,gifts,grants,donations, 56reimbursementsfromfederalprograms,andcontributionsfromthirdparties.The 57eligiblepatientshallremainliabletothehealthcareproviderorhealthcarefacilityfor 58anyportionofcostsnotcoveredbyalternativesourcesoffunding. 59 (3)Notwithstandinganyprovisionoflawtothecontrary,aneligiblepatientshall 60beentitledtoreceivehyperbaricoxygentherapyunderthissubsectioniftheeligible 61patient: 62 (a)HasreceivedadiagnosisofPTSDorTBI; 63 (b)Hasreceivedanofficialrecommendationforhyperbaricoxygentherapy 64fromthehealthcareproviderthattreatstheeligiblepatient;and 65 (c)Residesinthisstate. 66 7.Alicensingboardshallnotrevoke,suspend,orfailtorenewthelicenseofa 67healthcareprovider,ortakeanyotherpunitiveactionagainstahealthcareprovider, 68basedonarecommendationorcounselingbythehealthcareproviderrelatingtoaccess 69toortreatmentwithahyperbaricoxygenchamberforaneligiblepatient. 70 8.Nopersonactingonbehalfofthisstateshallblockorattempttoblockan 71eligiblepatientfromreceivingaccesstohyperbaricoxygentreatment. 72 9.Thedepartmentofpublicsafetymaypromulgateallnecessaryrulesand 73regulationsfortheimplementationofthissection.Anyruleorportionofarule,asthat 74termisdefinedinsection536.010,thatiscreatedundertheauthoritydelegatedinthis 75sectionshallbecomeeffectiveonlyifitcomplieswithandissubjecttoallofthe 76provisionsofchapter536and,ifapplicable,section536.028.Thissectionandchapter 77536arenonseverableandifanyofthepowersvestedwiththegeneralassembly 78pursuanttochapter536toreview,todelaytheeffectivedate,ortodisapproveandannul 79arulearesubsequentlyheldunconstitutional,thenthegrantofrulemakingauthority 80andanyruleproposedoradoptedafterAugust28,2023,shallbeinvalidandvoid. ✔ HB1313 3
