18categoriesdescribedinsubsection1ofthissectionshallbedeniedissuanceofacommercial
19driver'slicenseorcommercialdriver'sinstructionpermit.
20 3.Anapplicantcertifyingtooperationinnonexceptedinterstateornonexcepted
21intrastatecommerceshallprovidethestatewithanoriginalorcopyofacurrentmedical
22examiner'scertificateoramedicalexaminer'scertificateaccompaniedbyamedicalvariance
23orwaiver[, untilsuchtimeasthemedicalexaminer'scertificateinformationisreceived
24electronically]. Documentationrequiredunderthissubsectionmaybeprovidedin
25personorbymail,facsimile,orelectronicmail,orthroughaverificationsystemapproved
26bytheFederalMotorCarrierSafetyAdministration.Thestateshallretainthedocumentation
27ofphysicalqualificationforaminimumofthreeyearsbeyondthedatethecertificatewas
28issued.
29 4.Applicantscertifyingtooperationinnonexceptedinterstatecommerceor
30nonexceptedintrastatecommerceshallprovideupdatedmedicalcertificateorvariance
31informationtomaintainacertifiedstatusduringthetermofthecommercialdriver'slicenseor
32commercialdriver'sinstructionpermitinordertoretaincommercialprivileges.
33 5.Thedirectorshallpostthemedicalexaminer'scertificateofinformation,medical
34varianceifapplicable,theapplicant'sself-certificationandcertificationstatustotheMissouri
35driverrecordwithintencalendardaysandsuchinformationwillbecomepartoftheCDLIS
36driverrecord.
37 6.Applicantscertifyingtooperationinnonexceptedinterstatecommerceor
38nonexceptedintrastatecommercewhofailtoprovideormaintainacurrentmedical
39examiner'scertificate,orifthestatehasreceivednoticeofamedicalvarianceorwaiver
40expiringorbeingrescinded,thestateshall,withintencalendardays,updatethedriver's
41medicalcertificationstatusto"notcertified".Thestateshallnotifythedriverofthechangein
42certificationstatusandrequirethedrivertoannuallycomplywithrequirementsfora
43commercialdriver'slicensedowngradewithinsixtydaysoftheexpirationoftheapplicant
44certification.
45 7.Thedepartmentofrevenuemay,byrule,establishthecostandcriteriafor
46submissionofupdatedmedicalcertificationstatusinformationasrequiredunderthissection.
47 8.Anypersonwhofalsifiesanyinformationinanapplicationfororupdateof
48medicalcertificationstatusinformationforacommercialdriver'slicenseshallnotbelicensed
49tooperateacommercialmotorvehicle,ortheperson'scommercialdriver'slicenseshallbe
50cancelledforaperiodofoneyearafterthedirectordiscoverssuchfalsification.
51 9.Thedirectormaypromulgaterulesandregulationsnecessarytoadministerand
52enforcethissection.Anyruleorportionofarule,asthattermisdefinedinsection536.010,
53thatiscreatedundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifit
HB1372 2 54complieswithandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section
55536.028.Thissectionandchapter536arenonseverableandifanyofthepowersvestedwith
56thegeneralassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto
57disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof
58rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2012,shallbeinvalid
59andvoid.
