newsectionsrelatingtothetransportationofpersonswithmentaldisorders.

SectionA.Sections632.300,632.305,and632.310,RSMo,arerepealedandthree
2newsectionsenactedinlieuthereof,tobeknownassections632.300,632.305,and632.310,
3toreadasfollows:
632.300.1.Whenamentalhealthcoordinatorreceivesinformationallegingthata
2person,astheresultofamentaldisorder,presentsalikelihoodofseriousharmtohimselfor
3herselforothers,heorsheshall:
4 (1)Conductaninvestigation;
5 (2)Evaluatetheallegationsandthedatadevelopedbyinvestigation;and
6 (3)Evaluatethereliabilityandcredibilityofallsourcesofinformation.
7 2.If,astheresultofpersonalobservationorinvestigation,thementalhealth
8coordinatorhasreasonablecausetobelievethatsuchpersonismentallydisorderedand,asa
9result,presentsalikelihoodofseriousharmtohimselforherselforothers,thementalhealth
10coordinatormayfileanapplicationwiththecourthavingprobatejurisdictionpursuanttothe
11provisionsofsection632.305;provided,however,thatshouldthementalhealthcoordinator
12havereasonablecausetobelieve,astheresultofpersonalobservationorinvestigation,that
13thelikelihoodofseriousharmbysuchpersontohimselforherselforothersasaresultofa
14mentaldisorderisimminentunlessthepersonisimmediatelytakenintocustody,themental
15healthcoordinatorshall[requestapeaceofficertotakeorcause] ensuresuchperson[tobe]is
16takenintocustodyandtransportedtoamentalhealthfacilityinaccordancewiththe

18apeaceofficeroranyothercapableindividualororganizationtotransportsuchperson.
19 3.Ifthementalhealthcoordinatordeterminesthatinvoluntarycommitmentisnot
20appropriate,heorsheshouldinformeithertheperson,hisorherfamilyorfriendsabout
21thosepublicandprivateagenciesandcourtswhichmightbeofassistance.
632.305.1.Anapplicationfordetentionforevaluationandtreatmentmaybe
2executedbyanyadultperson,whoneednotbeanattorneyorrepresentedbyanattorney,
3includingthementalhealthcoordinator,onaformprovidedbythecourtforsuchpurpose,
4andshallallegeunderoath,withoutanotarizationrequirement,thattheapplicanthasreason
5tobelievethattherespondentissufferingfromamentaldisorderandpresentsalikelihoodof
6seriousharmtohimselforherselfortoothers.Theapplicationshallspecifythefactual
7informationonwhichsuchbeliefisbasedandshouldcontainthenamesandaddressesofall
8personsknowntotheapplicantwhohaveknowledgeofsuchfactsthroughpersonal
9observation.
10 2.Thefilingofawrittenapplicationincourtbyanyadultperson,whoneednotbean
11attorneyorrepresentedbyanattorney,includingthementalhealthcoordinator,shall
12authorizetheapplicanttobringthematterbeforethecourtonanexpartebasistodetermine
13whethertherespondentshouldbetakenintocustodyandtransportedtoamentalhealth
14facility.Theapplicationmaybefiledinthecourthavingprobatejurisdictioninanycounty
15wheretherespondentmaybefound.Ifthecourtfindsthatthereisprobablecause,either
16upontestimonyunderoathoruponareviewofaffidavits,tobelievethattherespondentmay
17besufferingfromamentaldisorderandpresentsalikelihoodofseriousharmtohimselfor
18herselforothers,itshalldirect[apeaceofficertotake]therespondenttobetakeninto
19custodyand[transporthimorher]transportedtoamentalhealthfacilityfordetentionfor
20evaluationandtreatmentforaperiodnottoexceedninety-sixhoursunlessfurtherdetention
21andtreatmentisauthorizedpursuanttothischapter.Thecourtmaydirectapeaceofficer
22oranyothercapableindividualororganizationtotransporttherespondent.Nothing
23hereinshallbeconstruedtoprohibitthecourt,intheexerciseofitsdiscretion,fromgivingthe
24respondentanopportunitytobeheard.
25 3.Amentalhealthcoordinatormayrequestapeaceofficertotakeorapeaceofficer
26maytakeapersonintocustodyfordetentionforevaluationandtreatmentforaperiodnotto
27exceedninety-sixhoursonlywhensuchmentalhealthcoordinatororpeaceofficerhas
28reasonablecausetobelievethatsuchpersonissufferingfromamentaldisorderandthatthe
29likelihoodofseriousharmbysuchpersontohimselforherselforothersisimminentunless
30suchpersonisimmediatelytakenintocustody.Thementalhealthcoordinatororpeace
31officermayrequestanyothercapableindividualororganizationtotransportsuch
32persontothementalhealthfacility.Uponarrivalatthementalhealthfacility,thepeace
HB1374	2 33officerormentalhealthcoordinatorwhoconveyedsuchpersonorcausedhimorhertobe
34conveyedshalleitherpresenttheapplicationfordetentionforevaluationandtreatmentupon
35whichthecourthasissuedafindingofprobablecauseandtherespondentwastakeninto
36custodyorcompleteanapplicationforinitialdetentionforevaluationandtreatmentfora
37periodnottoexceedninety-sixhourswhichshallbebaseduponhisorherownpersonal
38observationsorinvestigationsandshallcontaintheinformationrequiredinsubsection1of
39thissection.
40 4.Ifapersonpresentshimselforherselforispresentedbyotherstoamentalhealth
41facilityandalicensedphysician,aregisteredprofessionalnurseoramentalhealth
42professionaldesignatedbytheheadofthefacilityandapprovedbythedepartmentforsuch
43purposehasreasonablecausetobelievethatthepersonismentallydisorderedandpresentsan
44imminentlikelihoodofseriousharmtohimselforherselforothersunlessheorsheis
45acceptedfordetention,thelicensedphysician,thementalhealthprofessionalortheregistered
46professionalnursedesignatedbythefacilityandapprovedbythedepartmentmaycomplete
47anapplicationfordetentionforevaluationandtreatmentforaperiodnottoexceedninety-six
48hours.Theapplicationshallbebasedonhisorherownpersonalobservationsor
49investigationandshallcontaintheinformationrequiredinsubsection1ofthissection.
50 5.Anyoathrequiredbytheprovisionsofthissectionshallbesubjecttothe
51provisionsofsection492.060.
632.310.1.Wheneveracourthasauthorizedtheinitialdetentionandevaluationofa
2respondentpursuanttosubsection2ofsection632.305,orwheneveramentalhealth
3coordinatorsubmitsanapplicationforinitialdetentionandevaluationpursuanttosubsection
43ofsection632.305,orwheneveralicensedphysician,aregisteredprofessionalnurse
5designatedbythefacilityandapprovedbythedepartment,oramentalhealthprofessional
6submitsanapplicationforinitialdetentionandevaluationpursuanttosubsection4ofsection
7632.305,apublicmentalhealthfacilityshall,andaprivatementalhealthfacilitymay
8immediatelyacceptsuchapplicationandtherespondentonaprovisionalbasis,andthe
9facilityshallthenevaluatetherespondent'sconditionandadmithimorherfortreatmentor
10releasehimorherinaccordancewiththeprovisionsofthischapter.
11 2.Wheneverapeaceofficerappliesforinitialdetentionandevaluationpursuantto
12subsection3ofsection632.305,thementalhealthfacilitymay,butisnotrequiredto,accept
13theapplicationandtherespondent.Ifthefacilityacceptstheapplicationandtherespondent,
14thefacilityshallevaluatetherespondent'sconditionandadmithimorherfortreatmentor
15releasehimorherinaccordancewiththeprovisionsofthischapter.
16 3.Iftherespondentisnotacceptedforadmissionbyafacilityprovidingninety-six-
17hourevaluationandtreatment,thefacilityshallimmediatelyfurnishtransportation,ifnot
18otherwiseavailable,toreturntherespondenttohisorherplaceofresidenceorother
HB1374	3 19appropriateplace;provided,thatinthecaseofapersontransportedtothefacilitybyapeace
20officerorothergovernmentalagency,suchpeaceofficeroragency[shall] mayfurnishor
21arrangeforsuchtransportation.
22 4.Thedepartmentmayrequire,pursuanttoanaffiliationagreementandcontractwith
23acommunity-basedservicecertifiedbythedepartmenttoservethecatchmentareawherea
24respondentwhosementaldisorderconsistsofalcoholordrugabuseresides,thattheservice
25immediatelyaccepttheapplicationandrespondentengaginginalcoholordrugabuseona
26provisionalbasisandthattheservicethenevaluatesuchrespondent'sconditionandadmithim
27orherfortreatmentforuptoninety-sixhours,petitionforfurtherdetentionandtreatment,or
28releasehimorherinaccordancewiththeprovisionsofchapter631.
