287.069.1.Forthepurposesofthissection,thefollowingtermsmean:
2 (1)"Emergencymedicaltechnician",apersonlicensedinemergencymedical
3careinaccordancewithstandardsprescribedbysections190.001to190.245andby
4rulesadoptedbythedepartmentundersections190.001to190.245;
5 (2)"Emergencyservicestelecommunicator",anypersonemployedasan
6emergencytelephoneworker,calltaker,orpublicsafetydispatcherwhosedutiesinclude
7receiving,processing,ortransmittingpublicsafetyinformationreceivedthrougha911
8publicsafetyansweringpoint;
9 (3)"Firstresponder",alawenforcementofficer;afirefighter;aparamedic;an
10emergencymedicaltechnician;aregisterednurseemployedtoprovideemergency
11medicalservicesoutsideofamedicalfacility;anemergencyservicestelecommunicator;
12anofficeremployedbythestateorapoliticalsubdivisionatacorrections,detention,or
13securetreatmentfacility;asherifforfull-timedeputysheriffofanycounty;ora
14memberoftheMissouristatehighwaypatrol;
15 (4)"Mentalimpairment",adiagnosisofposttraumaticstressdisorderbya
16licensedpsychiatristorpsychologist;

21recentlypublishededitionoftheDiagnosticandStatisticalManualofMentalDisorders
22bytheAmericanPsychiatricAssociation.
23 2.If,precedingthedateofinjuryordeath,anemployeewhowasemployedon
24activedutyasafirstresponderisdiagnosedwithamentalimpairmentandhadnotbeen
25diagnosedwiththementalimpairmentpreviously,thementalimpairmentshall
26presumptivelybeconsideredanoccupationaldiseaseandshallbepresumedtohave
27arisenoutofandinthecourseofemployment.Thispresumptionmayberebuttedby
28substantialfactorsbroughtbytheemployerorinsurer.Anysubstantialfactorsthatare
29usedtorebutthispresumptionandthatareknowntotheemployerorinsureratthe
30timeofthedenialofliabilityshallbecommunicatedtotheemployeeonthedenialof
31liability.
32 3.Oneormorecompensablementalimpairmentclaimsarisingoutofasingle
33accidentshallconstituteasingleinjury.However,amentalimpairmentarisingoutof
34andinthecourseofemploymentcausedbyasingleaccidentorcumulativetraumashall
35alsoconstituteacompensablementalimpairmentclaim.
36 4.Amentalimpairmentshallnotbeconsideredanoccupationaldiseaseifit
37resultsfromadisciplinaryaction,workevaluation,jobtransfer,layoff,demotion,
38promotion,termination,retirement,orsimilaractiontakeningoodfaithbythe
39employer.
