Torepealsection537.555,RSMo,andtoenactinlieuthereofonenewsectionrelatingto
immunityfromcivilliabilityforforcibleentryintoalockedvehicle.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section537.555,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection537.555,toreadasfollows:
537.555.1.Apersonshallnotbeheldcivillyliablefordamagesresultingfromthe
2forcibleentryintoavehicleforthepurposeofremovinganunsupervisedminororananimal
3ifsuchperson:
4 (1)Determinesthatthevehicleislockedorthereisnootherreasonablemethodfor
5removingtheminororanimalfromthevehicle;
6 (2)Hasagoodfaithbeliefthatforcibleentryintothevehicleisnecessarybecausethe
7minororanimalisinimminentdangerofsufferingharmifnotimmediatelyremovedfrom
8thevehicle;
9 (3)Contactsemergencyresponsepersonnelincludinganyfirefighter,emergency
10medicaltechnician,lawenforcementofficer,registerednurse,physician,orfirstresponder
11priortoforciblyenteringthevehicle;
12 (4)Remainswiththeminororanimalatasafelocationreasonablyclosetothe
13vehicleuntilemergencyresponsepersonnelarrives;and
14 (5)Usesnomoreforcetoenterthevehicleandremovetheminororanimalfromthe
15vehiclethanwasnecessaryunderthecircumstances.
16 2.Nothinginthissectionshallprovideimmunityfromcivilliabilityforactionstoaid
17aminororanimalinadditiontowhatisauthorizedbythissection.
