SectionA.Chapter192,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection192.257,toreadasfollows:
192.257.1.Forpurposesofthissection,thefollowingtermsmean:
2 (1)"COVID-19healthorder",anyorder,ordinance,rule,orregulationmadeby
3astate,county,city,orlocalgovernmententity,department,oragencywithorwithout
4thepowersgrantedundertheConstitutionofMissourioranystatelaw,including,but
5notlimitedto,chapter44orsection192.020or192.300,thatisintendedtopreventor
6limitthespreadofCOVID-19;
7 (2)"Localpublichealthagency",acountyhealthcenterboardestablished
8underchapter205,acountyhealthdepartment,acityhealthdepartmentoragency,a
9combinedcityandcountyhealthdepartmentoragency,amulticountyhealth
10departmentoragency,oranyothercountyorcityhealthauthority.
11 2.Notwithstandingtheprovisionsofchapter44oranyotherprovisionoflaw,a
12localpublichealthagencythatimposedafineorothermonetarypenaltyagainstan
13individual,abusiness,orachurchafterMarch12,2020,andbeforetheeffectivedateof
14thissection,forafailuretocomplywithaCOVID-19healthordershallreturnall
15moneyscollectedfromtheindividual,business,orchurchasaresultofthefineor
16monetarypenalty.Thelocalpublichealthagencyshallreturnsuchmoneysbefore
17November1,2023.
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18 3.Notwithstandingtheprovisionsofchapter44oranyotherprovisionoflaw,a
19localpublichealthagencythatimposesafineorothermonetarypenaltyagainstan
20individual,abusiness,orachurchonoraftertheeffectivedateofthissectionfora
21failuretocomplywithaCOVID-19healthordershallreturnallmoneyscollectedfrom
22theindividual,business,orchurchasaresultofthefineormonetarypenalty,including
23courtcostsandlegalfeesofuptotwohundredfiftydollarsperpenaltyimposed.The
24localpublichealthagencyshallreturnsuchmoneyswithinsixtydaysofthecollectionof
25themoneys.
26 4.Theprovisionsofthissectionshallnotapplytoanyfineormonetarypenalty
27thatisnotdirectlyrelatedtoafailuretocomplywithaCOVID-19healthorder,except
28thattheprovisionsofthissectionshallapplytosuchfineormonetarypenaltyifthelocal
29publichealthagencyamendedtheoriginalbasisforthefineormonetarypenaltyfroma
30failuretocomplywithaCOVID-19healthordertoafailuretocomplywithanyother
31lawthatimposesamunicipalfineormonetarypenaltyforitsviolation.
