14 (2)Withintwenty-fivefeetofanypollingplaceonanyelectionday.Possessionofa 15firearminavehicleonthepremisesofthepollingplaceshallnotbeacriminaloffenseso 16longasthefirearmisnotremovedfromthevehicleorbrandishedwhilethevehicleisonthe 17premises; HB282 17 18 (3)Thefacilityofanyadultorjuveniledetentionorcorrectionalinstitution,prisonor 19jail.Possessionofafirearminavehicleonthepremisesofanyadult,juveniledetention,or 20correctionalinstitution,prisonorjailshallnotbeacriminaloffensesolongasthefirearmis 21notremovedfromthevehicleorbrandishedwhilethevehicleisonthepremises; 22 (4)Anycourthousesolelyoccupiedbythecircuit,appellateorsupremecourt,orany 23courtrooms,administrativeoffices,librariesorotherroomsofanysuchcourtwhetherornot 24suchcourtsolelyoccupiesthebuildinginquestion.Thissubdivisionshallalsoinclude,but 25notbelimitedto,anyjuvenile,family,drug,orothercourtoffices,anyroomorofficewherein 26anyofthecourtsorofficeslistedinthissubdivisionaretemporarilyconductinganybusiness 27withinthejurisdictionofsuchcourtsoroffices,andsuchotherlocationsinsuchmanneras 28maybespecifiedbysupremecourtrulepursuanttosubdivision(6)ofthissubsection. 29Nothinginthissubdivisionshallprecludethosepersonslistedinsubdivision(1)ofsubsection 302ofsection571.030whilewithintheirjurisdictionandonduty,thosepersonslistedin 31subdivisions(2),(4),and(10)ofsubsection2ofsection571.030,orsuchotherpersonswho 32serveinalawenforcementcapacityforacourtasmaybespecifiedbysupremecourtrule 33pursuanttosubdivision(6)ofthissubsectionfromcarryingaconcealedfirearmwithinanyof 34theareasdescribedinthissubdivision.Possessionofafirearminavehicleonthepremisesof 35anyoftheareaslistedinthissubdivisionshallnotbeacriminaloffensesolongasthefirearm 36isnotremovedfromthevehicleorbrandishedwhilethevehicleisonthepremises; 37 (5)Anymeetingofthegoverningbodyofaunitoflocalgovernment;oranymeeting 38ofthegeneralassemblyoracommitteeofthegeneralassembly,exceptthatnothinginthis 39subdivisionshallprecludeamemberofthebodyholdingavalidconcealedcarrypermitor 40endorsementfromcarryingaconcealedfirearmatameetingofthebodywhichheorsheisa 41member.Possessionofafirearminavehicleonthepremisesshallnotbeacriminaloffense 42solongasthefirearmisnotremovedfromthevehicleorbrandishedwhilethevehicleison 43thepremises.Nothinginthissubdivisionshallprecludeamemberofthegeneralassembly,a 44full-timeemployeeofthegeneralassemblyemployedunderSection17,ArticleIII, 45ConstitutionofMissouri,legislativeemployeesofthegeneralassemblyasdeterminedunder 46section21.155,orstatewideelectedofficialsandtheiremployees,holdingavalidconcealed 47carrypermitorendorsement,fromcarryingaconcealedfirearminthestatecapitolbuilding 48oratameetingwhetherofthefullbodyofahouseofthegeneralassemblyoracommittee 49thereof,thatisheldinthestatecapitolbuilding; 50 (6)Thegeneralassembly,supremecourt,countyormunicipalitymaybyrule, 51administrativeregulation,orordinanceprohibitorlimitthecarryingofconcealedfirearmsby 52permitorendorsementholdersinthatportionofabuildingowned,leasedorcontrolledby 53thatunitofgovernment.Anyportionofabuildinginwhichthecarryingofconcealed 54firearmsisprohibitedorlimitedshallbeclearlyidentifiedbysignspostedattheentranceto HB282 18 55therestrictedarea.Thestatute,ruleorordinanceshallexemptanybuildingusedforpublic 56housingbyprivatepersons,highwaysorrestareas,firingranges,andprivatedwellings 57owned,leased,orcontrolledbythatunitofgovernmentfromanyrestrictiononthecarrying 58orpossessionofafirearm.Thestatute,ruleorordinanceshallnotspecifyanycriminal 59penaltyforitsviolationbutmayspecifythatpersonsviolatingthestatute,ruleorordinance 60maybedeniedentrancetothebuilding,orderedtoleavethebuildingandifemployeesofthe 61unitofgovernment,besubjectedtodisciplinarymeasuresforviolationoftheprovisionsof 62thestatute,ruleorordinance.Theprovisionsofthissubdivisionshallnotapplytoanyother 63unitofgovernment; 64 (7)Anyestablishmentlicensedtodispenseintoxicatingliquorforconsumptiononthe 65premises,whichportionisprimarilydevotedtothatpurpose,withouttheconsentofthe 66ownerormanager.Theprovisionsofthissubdivisionshallnotapplytothelicenseeofsaid 67establishment.Theprovisionsofthissubdivisionshallnotapplytoanybonafiderestaurant 68opentothegeneralpublichavingdiningfacilitiesfornotlessthanfiftypersonsandthat 69receivesatleastfifty-onepercentofitsgrossannualincomefromthediningfacilitiesbythe 70saleoffood.Thissubdivisiondoesnotprohibitthepossessionofafirearminavehicleonthe 71premisesoftheestablishmentandshallnotbeacriminaloffensesolongasthefirearmisnot 72removedfromthevehicleorbrandishedwhilethevehicleisonthepremises.Nothinginthis 73subdivisionauthorizesanyindividualwhohasbeenissuedaconcealedcarrypermitor 74endorsementtopossessanyfirearmwhileintoxicated; 75 (8)Anyareaofanairporttowhichaccessiscontrolledbytheinspectionofpersons 76andproperty.Possessionofafirearminavehicleonthepremisesoftheairportshallnotbea 77criminaloffensesolongasthefirearmisnotremovedfromthevehicleorbrandishedwhile 78thevehicleisonthepremises; 79 (9)Anyplacewherethecarryingofafirearmisprohibitedbyfederallaw; 80 (10)Anyhighereducationinstitutionorelementaryorsecondaryschoolfacility 81withouttheconsentofthegoverningbodyofthehighereducationinstitutionoraschool 82officialorthedistrictschoolboard,unlessthepersonwiththeconcealedcarryendorsementor 83permitisateacheroradministratorofanelementaryorsecondaryschoolwhohasbeen 84designatedbyhisorherschooldistrictasaschoolprotectionofficerandiscarryingafirearm 85inaschoolwithinthatdistrict,inwhichcasenoconsentisrequired.Possessionofafirearm 86inavehicleonthepremisesofanyhighereducationinstitutionorelementaryorsecondary 87schoolfacilityshallnotbeacriminaloffensesolongasthefirearmisnotremovedfromthe 88vehicleorbrandishedwhilethevehicleisonthepremises; 89 (11)Anyportionofabuildingusedasachildcarefacilitywithouttheconsentofthe 90manager.Nothinginthissubdivisionshallpreventtheoperatorofachildcarefacilityina HB282 19 91familyhomefromowningorpossessingafirearmoraconcealedcarrypermitor 92endorsement; 93 (12)Anyriverboatgamblingoperationaccessiblebythepublicwithouttheconsent 94oftheownerormanagerpursuanttorulespromulgatedbythegamingcommission. 95Possessionofafirearminavehicleonthepremisesofariverboatgamblingoperationshall 96notbeacriminaloffensesolongasthefirearmisnotremovedfromthevehicleorbrandished 97whilethevehicleisonthepremises; 98 (13)Anygatedareaofanamusementpark.Possessionofafirearminavehicleon 99thepremisesoftheamusementparkshallnotbeacriminaloffensesolongasthefirearmis 100notremovedfromthevehicleorbrandishedwhilethevehicleisonthepremises; 101 (14)[Anychurchorotherplaceofreligiousworshipwithouttheconsentofthe 102ministerorpersonorpersonsrepresentingthereligiousorganizationthatexercisescontrol 103overtheplaceofreligiousworship.Possessionofafirearminavehicleonthepremisesshall 104notbeacriminaloffensesolongasthefirearmisnotremovedfromthevehicleorbrandished 105whilethevehicleisonthepremises; 106 (15)] Anyprivatepropertywhoseownerhaspostedthepremisesasbeingoff-limits 107toconcealedfirearmsbymeansofoneormoresignsdisplayedinaconspicuousplaceofa 108minimumsizeofeleveninchesbyfourteenincheswiththewritingthereoninlettersofnot 109lessthanoneinch.Theowner,businessorcommerciallessee,managerofaprivatebusiness 110enterprise,oranyotherorganization,entity,orpersonmayprohibitpersonsholdinga 111concealedcarrypermitorendorsementfromcarryingconcealedfirearmsonthepremisesand 112mayprohibitemployees,notauthorizedbytheemployer,holdingaconcealedcarrypermitor 113endorsementfromcarryingconcealedfirearmsonthepropertyoftheemployer.Ifthe 114buildingorthepremisesareopentothepublic,theemployerofthebusinessenterpriseshall 115postsignsonoraboutthepremisesifcarryingaconcealedfirearmisprohibited.Possession 116ofafirearminavehicleonthepremisesshallnotbeacriminaloffensesolongasthefirearm 117isnotremovedfromthevehicleorbrandishedwhilethevehicleisonthepremises.An 118employermayprohibitemployeesorotherpersonsholdingaconcealedcarrypermitor 119endorsementfromcarryingaconcealedfirearminvehiclesownedbytheemployer; 120 [(16)] (15)Anysportsarenaorstadiumwithaseatingcapacityoffivethousandor 121more.Possessionofafirearminavehicleonthepremisesshallnotbeacriminaloffenseso 122longasthefirearmisnotremovedfromthevehicleorbrandishedwhilethevehicleisonthe 123premises; 124 [(17)] (16)Anyhospitalaccessiblebythepublic.Possessionofafirearminavehicle 125onthepremisesofahospitalshallnotbeacriminaloffensesolongasthefirearmisnot 126removedfromthevehicleorbrandishedwhilethevehicleisonthepremises. HB282 20 127 2.Carryingofaconcealedfirearminalocationspecifiedinsubdivisions(1)to[(17)] 128(16)ofsubsection1ofthissectionbyanyindividualwhoholdsaconcealedcarrypermit 129issuedpursuanttosections571.101to571.121orsections571.205to571.230, ora 130concealedcarryendorsementissuedpriortoAugust28,2013,shallnotbeacriminalactbut 131maysubjectthepersontodenialtothepremisesorremovalfromthepremises.Ifsuchperson 132refusestoleavethepremisesandapeaceofficerissummoned,suchpersonmaybeissueda 133citationforanamountnottoexceedonehundreddollarsforthefirstoffense.Ifasecond 134citationforasimilarviolationoccurswithinasix-monthperiod,suchpersonshallbefinedan 135amountnottoexceedtwohundreddollarsandhisorherpermit,and,ifapplicable, 136endorsementtocarryconcealedfirearmsshallbesuspendedforaperiodofoneyear.Ifa 137thirdcitationforasimilarviolationisissuedwithinoneyearofthefirstcitation,suchperson 138shallbefinedanamountnottoexceedfivehundreddollarsandshallhavehisorher 139concealedcarrypermit,and,ifapplicable,endorsementrevokedandsuchpersonshallnotbe 140eligibleforaconcealedcarrypermitforaperiodofthreeyears.Uponconvictionofcharges 141arisingfromacitationissuedpursuanttothissubsection,thecourtshallnotifythesheriffof 142thecountywhichissuedtheconcealedcarrypermit,or,ifthepersonisaholderofaconcealed 143carryendorsementissuedpriortoAugust28,2013,thecourtshallnotifythesheriffofthe 144countywhichissuedthecertificateofqualificationforaconcealedcarryendorsementandthe 145departmentofrevenue.Thesheriffshallsuspendorrevoketheconcealedcarrypermitor,if 146applicable,thecertificateofqualificationforaconcealedcarryendorsement.Iftheperson 147holdsanendorsement,thedepartmentofrevenueshallissueanoticeofsuchsuspensionor 148revocationoftheconcealedcarryendorsementandtakeactiontoremovetheconcealedcarry 149endorsementfromtheindividual'sdrivingrecord.Thedirectorofrevenueshallnotifythe 150licenseethatheorshemustapplyforanewlicensepursuanttochapter302whichdoesnot 151containsuchendorsement.Thenoticeissuedbythedepartmentofrevenueshallbemailedto 152thelastknownaddressshownontheindividual'sdrivingrecord.Thenoticeisdeemed 153receivedthreedaysaftermailing. 154 3.Notwithstandinganyprovisionofthischapterorchapter70,577,or578tothe 155contrary,apersoncarryingafirearmconcealedonorabouthisorherpersonwhois 156lawfullyinpossessionofavalidconcealedcarrypermitorendorsementshallnotbe 157prohibitedorimpededfromaccessingorusinganypubliclyfundedtransportation 158systemandshallnotbeharassedordetainedforcarryingaconcealedfirearmonthe 159property,vehicles,orconveyancesowned,contracted,orleasedbysuchsystemsthatare 160accessibletothepublic.Forpurposesofthissubsection,"publiclyfunded 161transportationsystem"meanstheproperty,equipment,rights-of-way,orbuildings, 162whetherpubliclyorprivatelyownedandoperated,ofanentitythatreceivespublic 163fundsandholdsitselfouttothegeneralpublicforthetransportationofpersons.This HB282 21 164includesportionsofapublictransportationsystemprovidedthroughacontractwitha 165privateentitybutexcludesanycorporationthatprovidesintercitypassengertrain 166serviceonrailroadsthroughouttheUnitedStatesoranyprivatepartnershipinwhich 167thecorporationengages. 571.111.1.Anapplicantforaconcealedcarrypermitshalldemonstrateknowledge 2offirearmssafetytraining.Thisrequirementshallbefullysatisfiediftheapplicantfora 3concealedcarrypermit: 4 (1)Submitsaphotocopyofacertificateoffirearmssafetytrainingcoursecompletion, 5asdefinedinsubsection2ofthissection,signedbyaqualifiedfirearmssafetyinstructoras 6definedinsubsection6ofthissection;or 7 (2)Submitsaphotocopyofacertificatethatshowstheapplicantcompletedafirearms 8safetycoursegivenbyorunderthesupervisionofanystate,county,municipal,orfederallaw 9enforcementagency;or 10 (3)Isaqualifiedfirearmssafetyinstructorasdefinedinsubsection6ofthissection; 11or 12 (4)Submitsproofthattheapplicantcurrentlyholdsanytypeofvalidpeaceofficer 13licenseissuedundertherequirementsofchapter590;or 14 (5)Submitsproofthattheapplicantiscurrentlyallowedtocarryfirearmsin 15accordancewiththecertificationrequirementsofsection217.710;or 16 (6)Submitsproofthattheapplicantiscurrentlycertifiedasanyclassofcorrections 17officerbytheMissouridepartmentofcorrectionsandhaspassedatleastoneeight-hour 18firearmstrainingcourse,approvedbythedirectoroftheMissouridepartmentofcorrections 19undertheauthoritygrantedtohimorher,thatincludesinstructiononthejustifiableuseof 20forceasprescribedinchapter563;or 21 (7)Submitsaphotocopyofacertificateoffirearmssafetytrainingcoursecompletion 22thatwasissuedonAugust27,2011,orearliersolongasthecertificatemettherequirements 23ofsubsection2ofthissectionthatwereineffectonthedateitwasissued. 24 2.Acertificateoffirearmssafetytrainingcoursecompletionmaybeissuedtoany 25applicantbyanyqualifiedfirearmssafetyinstructor.Onthecertificateofcoursecompletion 26thequalifiedfirearmssafetyinstructorshallaffirmthattheindividualreceivinginstruction 27hastakenandpassedafirearmssafetycourseofatleasteighthoursinlengthtaughtbythe 28instructorthatincluded: 29 (1)Handgunsafetyintheclassroom,athome,onthefiringrangeandwhilecarrying 30thefirearm; 31 (2)Aphysicaldemonstrationperformedbytheapplicantthatdemonstratedhisorher 32abilitytosafelyloadandunloadeitherarevolverorasemiautomaticpistolanddemonstrated 33hisorhermarksmanshipwitheitherfirearm; HB282 22 34 (3)Thebasicprinciplesofmarksmanship; 35 (4)Careandcleaningofconcealablefirearms; 36 (5)Safestorageoffirearmsathome; 37 (6)Therequirementsofthisstateforobtainingaconcealedcarrypermitfromthe 38sheriffoftheindividual'scountyofresidence; 39 (7)Thelawsrelatingtofirearmsasprescribedinthischapter; 40 (8)Thelawsrelatingtothejustifiableuseofforceasprescribedinchapter563; 41 (9)Alivefiringexerciseofsufficientdurationforeachapplicanttofireeithera 42revolverorasemiautomaticpistol,fromastandingpositionoritsequivalent,aminimumof 43twentyroundsfromthehandgunatadistanceofsevenyardsfromaB-27silhouettetargetor 44anequivalenttarget; 45 (10)Alive-firetestadministeredtotheapplicantwhiletheinstructorwaspresentof 46twentyroundsfromeitherarevolverorasemiautomaticpistolfromastandingpositionorits 47equivalentatadistancefromaB-27silhouettetarget,oranequivalenttarget,ofsevenyards. 48 3.However,aqualifiedfirearmssafetyinstructormayalsoissueacertificateof 49firearmssafetytrainingcoursecompletion[mayalsobeissued] to: 50 (1)Anapplicantwho: 51 (a)Presentsproof[toaqualifiedfirearmssafetyinstructor] thattheapplicant[has] 52passedaregularoronlinecourseonfirearmsafetyconductedbyaninstructorcertifiedbythe 53NationalRifleAssociationthatisatleastonehourinlength; and[whoalso] 54 (b)Passestherequirementsofsubdivisions(1),(2),(6),(7),(8),(9),and(10)of 55subsection2ofthissectioninacourse,notrestrictedbyaperiodofhours,thatistaughtbya 56qualifiedfirearmssafetyinstructor; or 57 (2)Anapplicantwho: 58 (a)IsservingonactivedutyintheUnitedStatesArmedForces; 59 (b)Presentsproofthattheapplicantreceivedamarksmanshipqualification 60badgewithapistol,amarksmanshipribbonwithapistol,orapistolmarksmanship 61award;and 62 (c)Passestherequirementsofsubdivisions(1),(4),(5),(6),(7),and(8)of 63subsection2ofthissectioninacourse,notrestrictedbyaperiodofhours,thatistaught 64byaqualifiedfirearmssafetyinstructor. 65 4.Aqualifiedfirearmssafetyinstructorshallnotgiveagradeofpassingtoan 66applicantforaconcealedcarrypermitwho: 67 (1)Doesnotfollowtheordersofthequalifiedfirearmsinstructororcognizantrange 68officer;or 69 (2)Handlesafirearminamannerthat,inthejudgmentofthequalifiedfirearmsafety 70instructor,posesadangertotheapplicantortoothers;or HB282 23 71 (3)Duringthelive-firetestingportionofthecoursefailstohitthesilhouetteportion 72ofthetargetswithatleastfifteenrounds. 73 5.Qualifiedfirearmssafetyinstructorswhoprovidefirearmssafetyinstructiontoany 74personwhoappliesforaconcealedcarrypermitshall: 75 (1)Maketheapplicant'scourserecordsavailableuponrequesttothesheriffofthe 76countyinwhichtheapplicantresides; 77 (2)Maintainallcourserecordsonstudentsforaperiodofnolessthanfouryears 78fromcoursecompletiondate;and 79 (3)Nothavemorethanfortystudentspercertifiedinstructorintheclassroomportion 80ofthecourseormorethanfivestudentsperrangeofficerengagedinrangefiring. 81 6.Afirearmssafetyinstructorshallbeconsideredtobeaqualifiedfirearmssafety 82instructorbyanysheriffissuingaconcealedcarrypermitpursuanttosections571.101to 83571.121iftheinstructor: 84 (1)IsavalidfirearmssafetyinstructorcertifiedbytheNationalRifleAssociation 85holdingaratingasapersonalprotectioninstructororpistolmarksmanshipinstructor;or 86 (2)Submitsaphotocopyofanotarizedcertificatefromafirearmssafetyinstructor's 87courseofferedbyalocal,state,orfederalgovernmentalagency;or 88 (3)Submitsaphotocopyofanotarizedcertificatefromafirearmssafetyinstructor 89courseapprovedbythedepartmentofpublicsafety;or 90 (4)Hassuccessfullycompletedafirearmssafetyinstructorcoursegivenbyorunder 91thesupervisionofanystate,county,municipal,orfederallawenforcementagency;or 92 (5)Isacertifiedpoliceofficerfirearmssafetyinstructor. 93 7.Anyfirearmssafetyinstructorqualifiedundersubsection6ofthissectionmay 94submitacopyofatraininginstructorcertificate,courseoutlinebearingthenotarized 95signatureoftheinstructor,andarecentphotographoftheinstructortothesheriffofthe 96countyinwhichtheinstructorresides.Thesheriffshallreviewthetraininginstructor 97certificatealongwiththecourseoutlineandverifythefirearmssafetyinstructorisqualified 98andthecoursemeetstherequirementsprovidedunderthissection.Ifthesheriffverifiesthe 99firearmssafetyinstructorisqualifiedandthecoursemeetstherequirementsprovidedunder 100thissection,thesheriffshallcollectanannualregistrationfeeoftendollarsfromeach 101qualifiedinstructorwhochoosestosubmitsuchinformationandsubmittheregistrationtothe 102Missourisheriffmethamphetaminerelieftaskforce.TheMissourisheriffmethamphetamine 103relieftaskforce,oritsdesignatedagent,shallcreateandmaintainastatewidedatabaseof 104qualifiedinstructors.Thisinformationshallbeaclosedrecordexceptforaccessbyany 105sheriff.Firearmssafetyinstructorsmayregisterannuallyandtheregistrationisonlyeffective 19personnelwhoareinpossessionofweaponsusedwithinthecourseandscopeoftheir 20employment;[norshalltheprovisionsofthissubsectionapplyto] 21 (2)Personswhoareinpossessionofweaponsorothermeansofinflictingserious 22bodilyinjurywiththeconsentoftheownerofsuchbus,hisorheragent,orthelesseeor 23baileeofsuchbus;or 24 (3)Personscarryingaconcealedfirearmwholawfullypossessavalidconcealed 25carrypermitorendorsementinaccordancewithsections571.101to571.126orsections 26571.205to571.230. 577.712.1.Inordertoprovideforthesafety,comfort,andwell-beingofpassengers 2andothershavingabonafidebusinessinterestinanyterminal,abustransportationcompany 3mayrefuseadmissiontoterminalstoanypersonnothavingbonafidebusinesswithinthe 4terminal.Anysuchrefusalshallnotbeinconsistentorcontrarytostateorfederallaws, 5regulationspursuantthereto,ortoanyordinanceofthepoliticalsubdivisioninwhichsuch 6terminalislocated.Adulyauthorizedcompanyrepresentativemayaskanypersonina 7terminaloronthepremisesofaterminaltoidentifyhimselforherselfandstatehisorher 8business.Failuretocomplywithsuchrequestorfailuretostateanacceptablebusiness 9purposeshallbegroundsforthecompanyrepresentativetorequestthatsuchpersonleavethe 10terminal.Refusaltocomplywithsuchrequestshallconstitutedisorderlyconduct.Disorderly 11conductshallbeaclassCmisdemeanor. 12 2.Exceptasotherwiseprovidedbysection571.107,itisunlawfulforanypersonto 13carryadeadlyordangerousweaponoranyexplosivesorhazardousmaterialintoaterminal 14oraboardabus.Possessionofadeadlyordangerousweapon,explosiveorhazardous 15materialshallbeaclassDfelony.Uponthediscoveryofanysuchitemormaterial,the 16companymayobtainpossessionandretaincustodyofsuchitemormaterialuntilitis 17transferredtothecustodyoflawenforcementofficers. ✔ HB282 41
