2.Anyotherpersonwhobecomesawareofcircumstancesthatmayreasonablybe 25expectedtobetheresultof,orresultin,abuseorneglectofaneligibleadultmayreporttothe 26department. 27 3.Thepenaltyforfailingtoreportasrequiredundersubdivision(2)ofsubsection1 28ofthissectionisprovidedundersection565.188. 29 4.Asusedinthissection,"firstresponder"meansanypersontrainedandauthorized 30bylaworruletorenderemergencymedicalassistanceortreatment.Suchpersonsmay 31include,butshallnotbelimitedto,emergencyfirstresponders,policeofficers,sheriffs, 32deputysheriffs,firefighters,emergencymedicaltechnicians,oremergencymedical 33technician-paramedics. 192.2510.1.Allpersonsprovidingprotectiveservicestoeligibleadults,assuch 2termsaredefinedinsection192.2400,andwhohavedirectcontactwithsuchadultsshall 3berequiredtocompleteatleastonehouroftrainingwithinthefirstsixtydaysof 4employment.Thetrainingshallincludethefollowing: 5 (1)Requirementstoreportcompanionanimalabuseorneglectandthepenalties 6associatedwithfailuretoreportundersection273.410; 7 (2)Howtoidentifycompanionanimalabuseorneglect; 8 (3)Howtomakeareportofcompanionanimalabuseorneglect;and 9 (4)Therelationshipbetweeneligibleadultabuseorneglectandcompanion 10animalabuseorneglect. 11 2.Thedepartmentofhealthandseniorservices,inconsultationwithanimal 12welfareassociations,shalldeveloporadaptanduseavailabletrainingmaterialsforthe 13trainingrequiredunderthissection.Personsrequiredtocompletetrainingunderthis 14sectionshallbeprovidedwithopportunitiestodosoduringregularworkinghours. 15 3.Asusedinthissection,thefollowingtermsshallmean: 16 (1)"Animalwelfareorganization",anonprofitorganizationthatisestablished 17topromoteanimalwelfare,isrecognizedbytheInternalRevenueServiceastaxexempt (2)"Companionanimal",thesamemeaningasinsection273.410. 210.115.1.Whenanyphysician,medicalexaminer,coroner,dentist,chiropractor, 2optometrist,podiatrist,resident,intern,nurse,hospitalorclinicpersonnelthatareengagedin 3theexamination,care,treatmentorresearchofpersons,andanyotherhealthpractitioner, 8investigatorasdefinedinsection273.415,volunteerorpersonnelofacommunityservice 9programthatofferssupportservicesforfamiliesincrisistoassistinthedelegationofany 10powersregardingthecareandcustodyofachildbyaproperlyexecutedpowerofattorney 11pursuanttosections475.600to475.604,orotherpersonwithresponsibilityforthecareof 12childrenhasreasonablecausetosuspectthatachildhasbeenormaybesubjectedtoabuseor 13neglectorobservesachildbeingsubjectedtoconditionsorcircumstanceswhichwould 14reasonablyresultinabuseorneglect,thatpersonshallimmediatelyreporttothedivisionin 15accordancewiththeprovisionsofsections210.109to210.183.Nointernalinvestigation 16shallbeinitiateduntilsuchareporthasbeenmade.Asusedinthissection,theterm"abuse" 17isnotlimitedtoabuseinflictedbyapersonresponsibleforthechild'scare,custodyand 18controlasspecifiedinsection210.110,butshallalsoincludeabuseinflictedbyanyother 19person. 20 2.Iftwoormoremembersofamedicalinstitutionwhoarerequiredtoreportjointly 21haveknowledgeofaknownorsuspectedinstanceofchildabuseorneglect,asinglereport 22maybemadebyadesignatedmemberofthatmedicalteam.Anymemberwhohas 23knowledgethatthememberdesignatedtoreporthasfailedtodososhallthereafter 24immediatelymakethereport.Nothinginthissection,however,ismeanttoprecludeany 25personfromreportingabuseorneglect. 26 3.Thereportingrequirementsunderthissectionareindividual,andnosupervisoror 27administratormayimpedeorinhibitanyreportingunderthissection.Nopersonmakinga 28reportunderthissectionshallbesubjecttoanysanction,includinganyadverseemployment 29action,formakingsuchreport.Everyemployershallensurethatanyemployeerequiredto 30reportpursuanttosubsection1ofthissectionhasimmediateandunrestrictedaccessto 31communicationstechnologynecessarytomakeanimmediatereportandistemporarily 32relievedofotherworkdutiesforsuchtimeasisrequiredtomakeanyreportrequiredunder 33subsection1ofthissection. 34 4.Notwithstandinganyotherprovisionofsections210.109to210.183,anychildwho 35doesnotreceivespecifiedmedicaltreatmentbyreasonofthelegitimatepracticeofthe 36religiousbeliefofthechild'sparents,guardian,orotherslegallyresponsibleforthechild,for HB300 3 37thatreasonalone,shallnotbefoundtobeanabusedorneglectedchild,andsuchparents, 38guardianorotherpersonslegallyresponsibleforthechildshallnotbeenteredintothecentral 39registry.However,thedivisionmayacceptreportsconcerningsuchachildandmay 40subsequentlyinvestigateorconductafamilyassessmentasaresultofthatreport.Suchan 41exceptionshallnotlimittheadministrativeorjudicialauthorityofthestatetoensurethat 42medicalservicesareprovidedtothechildwhenthechild'shealthrequiresit. 43 5.Inadditiontothosepersonsandofficialsrequiredtoreportactualorsuspected 44abuseorneglect,anyotherpersonmayreportinaccordancewithsections210.109to210.183 45ifsuchpersonhasreasonablecausetosuspectthatachildhasbeenormaybesubjectedto 46abuseorneglectorobservesachildbeingsubjectedtoconditionsorcircumstanceswhich 47wouldreasonablyresultinabuseorneglect. 48 6.Anypersonorofficialrequiredtoreportpursuanttothissection,including 49employeesofthedivision,whohasprobablecausetosuspectthatachildwhoisormaybe 50undertheageofeighteen,whoiseligibletoreceiveacertificateoflivebirth,hasdiedshall 51reportthatfacttotheappropriatemedicalexaminerorcoroner.If,uponreviewofthe 52circumstancesandmedicalinformation,themedicalexaminerorcoronerdeterminesthatthe 53childdiedofnaturalcauseswhileundermedicalcareforanestablishednaturaldisease,the 54coroner,medicalexaminerorphysicianshallnotifythedivisionofthechild'sdeathandthat 55thechild'sattendingphysicianshallbesigningthedeathcertificate.Inallothercases,the 56medicalexaminerorcoronershallacceptthereportforinvestigation,shallimmediatelynotify 57thedivisionofthechild'sdeathasrequiredinsection58.452andshallreportthefindingsto 58thechildfatalityreviewpanelestablishedpursuanttosection210.192. 59 7.Anypersonorindividualrequiredtoreportmayalsoreportthesuspicionofabuse 60orneglecttoanylawenforcementagencyorjuvenileoffice.Suchreportshallnot,however, 61taketheplaceofreportingtothedivision. 62 8.Ifanindividualrequiredtoreportsuspectedinstancesofabuseorneglectpursuant 63tothissectionhasreasontobelievethatthevictimofsuchabuseorneglectisaresidentof 64anotherstateorwasinjuredasaresultofanactwhichoccurredinanotherstate,theperson 65requiredtoreportsuchabuseorneglectmay,inlieuofreportingtotheMissourichildren's 66division,makesuchareporttothechildprotectionagencyoftheotherstatewiththeauthority 67toreceivesuchreportspursuanttothelawsofsuchotherstate.Ifsuchagencyacceptsthe 68report,noreportisrequiredtobemade,butmaybemade,tothechildren'sdivision. 69 9.Forthepurposesofprovidingsupportiveservicesorverifyingthestatusofayouth 70asunaccompaniedorhomelessforthepurposesofaccessingsupportiveservices,thefactthat 71achildisanunaccompaniedyouthasdefinedin42U.S.C.Section11434a(6)isnot,inandof 72itself,asufficientbasisforreportingchildabuseorneglect,unlessthechildisundersixteen 73yearsofageorisanincapacitatedperson,asdefinedinsection475.010.Nothinginthis HB300 4 74subsectionshalllimitamandatedreporterfrommakingareportunderthissectionifthe 75mandatedreporterknowsorhasreasonablecausetosuspectthatanunaccompaniedyouthhas 76beenormaybeavictimofabuseorneglect. 210.191.1.Allchildren'sdivisionemployees,andcontractorsforchildren's 2services,whohavedirectcontactwithchildrenthroughthestate'schildprotectionand 3welfaresystemshallberequiredtocompleteatleastonehouroftrainingwithinthefirst 4sixtydaysofemploymentorcontract.Thetrainingshallincludethefollowing: 5 (1)Requirementstoreportcompanionanimalabuseorneglectandthepenalties 6associatedwithfailuretoreportundersection273.410; 7 (2)Howtoidentifycompanionanimalabuseorneglect; 8 (3)Howtomakeareportofcompanionanimalabuseorneglect;and 9 (4)Therelationshipbetweenchildabuseorneglectandcompanionanimalabuse 10orneglect. 11 2.Thedivision,inconsultationwithanimalwelfareassociations,shalldevelopor 12adaptanduseavailabletrainingmaterialsforthetrainingrequiredunderthissection. 4volunteerorpersonnelofacommunityserviceprogramthatofferssupportoradvocacy 5servicesforchildreninfostercarehasreasonablecausetosuspectthatacompanion 6animalhasbeenormaybesubjectedtoabuseorneglectorobservesacompanion 7animalbeingsubjectedtoconditionsorcircumstancesthatwouldreasonablyresultin 8abuseorneglect,thatpersonshallimmediatelymakeareporttothehotlineestablished 9andoperatedbytheMissouriAnimalControlAssociation(MACA). 10 2.Thehotlineworkershallrequestallofthefollowinginformationforthe 11report: 12 (1)Thenameanddescriptionofthecompanionanimalinvolved,ifknown; 13 (2)Theaddressandtelephonenumberoftheownerorotherpersonresponsible 14forthecareofthecompanionanimal,ifknown; 15 (3)Thenatureandextentofthesuspectedabuseorneglect; HB300 5 16 (4)Anyotherinformationthatthepersonmakingthereportbelievesmaybe 17usefulinestablishingtheexistenceofthesuspectedabuseorneglectortheidentityofthe 18personcausingtheabuseorneglect. 19 3.Uponreceivingareportofsuspectedabuseorneglect,MACAshallprovide 20thereporttoanyduly-authorizedlawenforcementofficial,countyormunicipalanimal 21controlofficer,oranyMissouripeaceofficerstandardsandtraining(POST)-certified 22orMACA-certifiedanimalcrueltyinvestigator. 23 4.Anypersonrequiredtoreportcompanionanimalabuseorneglectunderthis 24sectionshallbeimmunefromcivilorcriminalliabilityinconnectionwithmakingany 25requiredreportifthepersonactedingoodfaithwhenmakingsuchreport. 26 5.Nopersonrequiredtomakeareportofcompanionanimalabuseorneglect 27underthissectionshallknowinglymakeafalsereport.Thepenaltyformakingafalse 28reportandthedefensestoprosecutionshallbethesameasundersection575.080. 29 6.Ifanagencyorpoliticalsubdivisionofthestatedeterminesthatanemployee 30whoisamandatedreporterunderthissectionhasfailedtomakeareportasrequiredby 31thissection,theagencyorpoliticalsubdivisionshallissueawrittennoticetosuch 32employeethatshallincludeafindingoffactsinsupportofthefailuretomakeareport 33andanexplanationofthereportingrequirement.Suchnoticeshallnotberetainedina 34permanentemploymentfileandshallberetainedinaseparatefileordatabase 35maintainedbytheagencyorpoliticalsubdivision.Suchnoticeshallbeconsidereda 36closedrecordundertheprovisionsofchapter610. 37 7.Anypersonrequiredtomakeareportunderthissectionwhoissubjectto 38professionallicensureandwhofailstomakeareportasrequiredbythissectionshallbe 39subjecttodisciplinebyhisorherrespectivelicensingboardasfollows: 40 (1)Forthefirstinstanceofafailuretoreport,thelicensingboardshallissuea 41writtennoticetosuchemployeethatshallincludeafindingoffactsinsupportofthe 42failuretomakeareportandanexplanationofthereportingrequirement; 43
