Thisbillcreatesacriminalcasediversionprogramspecifically
forcasesinvolvingdrivingundertheinfluence. Insuchcases,
thecurrentdiversionprogramavailabletoprosecutorswillnot
apply;instead,theprovisionsofthisbillshallapply.A
prosecutormaydivertacriminalcaseinvolvingdrivingunderthe
influenceifcertainrequirements,specifiedinthebill,aremet.
Suchdiversionmaycontinueforuptotwoyears,andthedefendant
maybeorderedtocomplywithappropriateterms,conditionsor
programs. Onesuchrequirementistheinstallationofanignition
interlockdeviceforaperiodofnolessthan12monthsonany
vehiclethedefendantoperates,andthedefendantwillbe
prohibitedfromoperatingavehiclethatisnotequippedwithan
ignitioninterlockdevice.Thedefendantwillberesponsiblefor
thecostofinstallingtheignitioninterlockdevice,andthe
defendantwillberequiredtohavethedeviceservicedatleast
onceevery60days.Theinstalleroftheignitioninterlockdevice
mustnotifytheDepartmentofRevenueifthedeviceisremovedor
indicatesthatapersonhasattemptedtoremove,bypass,ortamper
withthedevice;ifthepersonfailsthreeormoretimestocomply
withtherequirementthattheinstallerservicethedeviceonce
every60days;orifthedeviceregistersafailedstart.
Ifthedefendantcomplieswiththetermsandconditionsofthe
diversionprogram,theactionagainstthedefendantwillbe
dismissed,thedismissalwillberecorded,andtherecordwillbe
transmittedtotheDepartmentofRevenue. Ifthedefendantdoes
notcomplywiththetermsandconditions,ahearingwillbeheld
afternoticetothedefendanttodeterminewhetherthecriminal
proceedingswillbereinstated.
