drivingundertheinfluenceofalcohol,withapenaltyprovision.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Chapter557,RSMo,isamendedbyaddingtheretoonenewsection,tobe
2knownassection557.520,toreadasfollows:
557.520.1.Forpurposesofthissection,thefollowingtermsshallmean:
2 (1)"Failedstart",anyattempttostartthevehiclewithabreathalcohol
3concentrationexceedingtwenty-fivethousandthsofonepercentbyweightofalcoholin
4suchperson'sbreath,unlessasubsequentretestperformedwithintenminutesregisters
5abreathalcoholconcentrationnotexceedingtwenty-fivethousandthsofonepercentby
6weightofalcoholinsuchperson'sbreath;
7 (2)"Runningretest",failuretotakeabreathtestperformedbythedriverupon
8acertifiedignitioninterlockdeviceatrandomintervalsaftertheinitialenginestartup
9breathtestandwhilethevehicle'smotorisrunningorfailuretotakeabreathretest
10withabreathalcoholconcentrationnotexceedingtwenty-fivethousandthsofone
11percentbyweightofalcoholinsuchperson'sbreath;
12 (3)"Vehicle",anymechanicaldeviceonwheels,designedprimarilyforuse,or
13used,onhighways.
14 2.Inanycriminalcaseinvolvinganintoxicated-relatedtrafficoffense,the
15prosecutingorcircuitattorneymaydivertthecriminalcase,withtheconsentofthe
16defendant,toadrivingwhileintoxicated(DWI)diversionprogrambyfilingamotion
17withthecourtrequestingthecourttostaythecriminalproceeding,ifthedefendant
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18meetsthefollowingcriteriaforeligibilityintothedrivingwhileintoxicateddiversion
19program:
20 (1)Thedefendanthasnotpreviouslypledguiltytoorbeenconvictedofan
21intoxicated-relatedtrafficoffenseinviolationofsection577.010,577.012,577.013,
22577.014,577.015,or577.016;
23 (2)Thedefendantisnotcurrentlyenrolledin,andhasnotinthepreviousten
24yearscompleted,adiversionprogrampursuanttothissection;
25 (3)Thedefendantdoesnotholdacommercialdriver'slicense;
26 (4)Theoffensedidnotoccurwhileoperatingacommercialvehicle;and
27 (5)Theoffensedidnotresultintheinjuryordeathofanotherperson.
28 3.Uponamotionfiledbyaprosecutingorcircuitattorney,thecourtmay
29continueadivertedcaseinvolvinganintoxicated-relatedtrafficoffenseforaperiodnot
30toexceedtwenty-fourmonthsandorderthedefendanttocomplywithterms,conditions,
31orrequirementsthattheprosecutingorcircuitattorneydeemsappropriatebasedonthe
32specificsituationofthedefendant.
33 4.TheDWIdiversionplanshallbeforaspecifiedperiodandbeinwriting.The
34prosecutingorcircuitattorneyhasthesoleauthoritytodevelopdiversionaryprogram
35requirements,butshallrequireinstallationofanignitioninterlockdeviceforaperiodof
36notlessthanoneyear,requirethedefendanttoparticipateinavictimimpactpanel
37sponsoredbyanonprofitorganization,andothertermsdeemednecessarybythecourt.
38 5.IfthecourtcontinuesthecriminalcasetodivertthedefendanttoaDWI
39diversionprogram,thedepartmentofrevenueshallcontinueanyproceedingtosuspend
40orrevokealicensepursuanttochapter302foraperiodnottoexceedtwenty-four
41months.AfterthedefendantsuccessfullycompletestherequirementsoftheDWI
42diversionprogram,thedepartmentshalldismissanyproceedingagainstthedefendant.
43 6.Thecourtshallnotifythedefendantthatheorsheisrequiredtoinstalla
44functioning,certifiedignitioninterlockdeviceonanyvehiclethatthepersonoperates
45andthepersonisprohibitedfromoperatingamotorvehicleunlessthatvehicleis
46equippedwithafunctioning,certifiedignitioninterlockdevicepursuanttothissection.
47Theserequirementsshallbeinadditiontoanyotherprovisionsofthischapteror
48chapter302requiringinstallationandmaintenanceofanignitioninterlockdevice.Any
49personrequiredtouseanignitioninterlockdeviceshallcomplywithsuchrequirement
50subjecttothepenaltiesprovidedbysection577.599.
51 7.Thedepartmentofrevenueshallinformthedefendantoftherequirementsof
52thissection,includingthetermforwhichthepersonisrequiredtohaveacertified
53ignitioninterlockdeviceinstalledandshallnotifythepersonthatinstallationofa
54functioning,certifiedignitioninterlockdeviceonavehicledoesnotallowthepersonto
HCSHB346	2 55drivewithoutavaliddriver'slicense.Thedepartmentshallrecordthemandatoryuse
56ofthedeviceforthetermrequiredandthetimewhenthedeviceisrequiredtobe
57installedpursuanttothecourtorder.Apersonwhoisnotifiedbythedepartmentshall
58doallofthefollowing:
59 (1)Arrangeforeachvehicleoperatedbythepersontobeequippedwitha
60functioning,certifiedignitioninterlockdevicebyacertifiedignitioninterlockdevice
61providerasdeterminedbythedepartmentoftransportation;and
62 (2)Arrangeforeachvehiclewithafunctioning,certifiedignitioninterlock
63devicetobeservicedbytheinstalleratleastonceeverythirtydaysfortheinstallerto
64recalibrateandmonitortheoperationofthedevice.
65 8.Thecertifiedignitioninterlockdeviceprovidershallnotifythedepartment:
66 (1)Ifthedeviceisremovedorindicatesthatthepersonhasattemptedtoremove,
67bypassbyarunningretest,ortamperwiththedevice;
68 (2)Ifthepersonfailsthreeormoretimestocomplywithanyrequirementfor
69themaintenanceorcalibrationoftheignitioninterlockdevice;or
70 (3)Ifthedeviceregistersafailedstart.

72Ifapersonhasanyfailedstartthatoccurswithinthelastninetydaysoftherequired
73periodofinstallationoftheignitioninterlockdevice,thetermshallbeextendedfora
74periodofninetydays.
75 9.AfterthecompletionoftheDWIdiversionprogramandifthedefendanthas
76compliedwithalltheimposedtermsandconditions,thecourtshalldismissthecriminal
77caseagainstthedefendant,recordthedismissal,andtransmittherecordtothecentral
78repositoryupondismissal.Anycourtautomationsystem,includinganypilotproject,
79thatprovidespublicaccesstoelectronicrecordontheinternetshallredactanypersonal
80identifyinginformationofthedefendant,includingname,address,andyearofbirth.
81Suchinformationshallbeprovidedinaconfidentialfilingsheetcontemporaneously
82filedwiththecourtorenteredbythecourt,whichshallnotbesubjecttopublic
83inspectionoravailability.
84 10.Intheeventofnoncompliancebythedefendantwiththetermsand
85conditionsoftheDWIdiversionprogram,theprosecutingorcircuitattorneymayfilea
86motiontoterminatethedefendantfromthediversionprogramandmayrecommendthe
87prosecutionoftheunderlyingcase.Uponthefilingofsuchmotion,afternoticetothe
88defendant,thecourtshallholdahearingtodeterminebypreponderanceoftheevidence
89whetherthedefendanthasfailedtocomplywiththetermsandconditionsofthe
90diversionprogram.Ifthecourtfindsthatthedefendanthasnotcompliedwiththe
HCSHB346	3 91termsandconditionsofthediversionprogram,thecourtmayendthediversion
92programandsetthecaseonthenextavailablecriminaldocket.
93 11.Anydefendantwhoisfoundguiltyofanyintoxicated-relatedtrafficoffense
94andwhohaspreviouslyutilizedtheDWIdiversionprogrampursuanttothissection
95shallbeconsideredaprioroffenderasdefinedinsection577.001,providedthatthe
96prioroffenseoccurredwithinfiveyearsoftheintoxicated-relatedoffenseforwhichthe
97personischarged,asprovidedinsubsection20ofsection577.001.
98 12.Forthelimitedpurposeofdeterminingwhetheradefendantisachronic,
99habitual,persistent,orprioroffenderundersection577.001,acriminalcasedivertedto
100aDWIdiversionprogramshallbecountedasoneintoxication-relatedtrafficoffense.
