84.012.Inallcitiesofthisstatenotwithinacounty,thecommoncouncilor
2municipalassemblyofsuchcitiesmaypassordinancesforpreservingorder;securing
3propertyandpersonsfromviolence,danger,ordestruction;protectingpublicand
4privateproperty;andpromotingtheinterestsandensuringthegoodgovernanceofthe
5cities,butnoordinancesheretoforepassed,orthatmayhereafterbepassed,bythe
6commoncouncilormunicipalassemblyofthecitiesshall,inanymanner,conflictor
7interferewiththepowersortheexerciseofthepowersoftheboardsofpolice
8commissionersofthecitiesascreatedbysection84.020,norshallthecitiesoranyofficer
9oragentofthecorporationofthecities,orthemayorthereof,inanymannerimpede,
10obstruct,hinder,orinterferewiththeboardsofpoliceoranyofficer,oragentorservant
11thereoforthereunder.

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 84.020.Inallcitiesofthisstatethatnowhave,ormayhereafterattain,apopulation
2offivehundredthousandinhabitantsorover,thereshallbe,andisherebyestablished,within
3andforsaidcities,aboardofpolice,toconsistoffourcommissioners,asprovidedinsections
484.040to84.080,togetherwiththe[mayor] presidentoftheboardofaldermenofsaid
5citiesforthetimebeing,orwhosoevermaybeofficiallyactinginthatcapacity,andsaid
6boardshallappointoneofitsmembersaspresident,andonememberwhoshallactasvice
7presidentduringtheabsenceofthepresident;andsuchpresidentorvicepresidentshallbethe
8executiveofficeroftheboardandshallactforitwhentheboardisnotinsession.
84.030.Beginningon[January9,1989] August28,2024,andnolaterthan
2September28,2024, thegovernorofthestateofMissouri,byandwiththeadviceand
3consentofthesenate,shallappointthefourcommissionersprovidedforinsection84.020,
4andonecommissionershallbeappointedforatermofoneyear;onecommissionershallbe
5appointedforatermoftwoyears;onecommissionershallbeappointedforatermofthree
6years;onecommissionershallbeappointedforatermoffouryears.Theirsuccessorsshall
7eachbeappointedforatermoffouryears,andsaidcommissionersshallholdofficefortheir
8termofappointmentanduntiltheirsuccessorsshallhavebeenappointedandqualified.In
9caseofavacancyinsaidboardforanycausewhatsoever,itshallbefilledbyappointmentfor
10theunexpiredterm,inthesamemannerasinthecaseoforiginalappointments.Thegovernor
11shallissuecommissionstothepersonssoappointed,designatingthetimeforwhichtheyare
12appointedincasetheappointmentistofillanunexpiredtermoccasionedbydeath,
13resignationoranyothercause,andwheneverthetermofofficeofanycommissionerexpires,
14theappointmentofhissuccessorshallbeforfouryears.[Thecommissionersnowholding
15officesunderexistinglawsinanycityofthisstatetowhichsections84.010to84.340apply
16aretoholdtheirofficesuntiltheexpirationoftheirterms,andtheirsuccessorsareduly
17appointedandqualified.]
84.100.Toenabletheboardstoperformthedutiesimposeduponthem,theyare
2herebyauthorizedandrequiredtoappoint,enrollandemployapermanentpoliceforceforthe
3citieswhichtheyshallequipandarmastheymayjudgenecessary.Exceptasprovidedbelow,
4thenumberofpatrolmentobeappointedshallnotbe[more] lessthanonethousand[six]one
5hundred[eighty-three] forty-twoofwhichnumbernotmorethantwohundredfiftyaretobe
6probationarypatrolmen.Anyincreaseinthenumberofpatrolmenauthorized,inadditionto
7thatprovidedforabove,shallbepermitteduponrecommendationbytheboardofpolice
8commissioners,withtheapprovalofthemunicipalboardofestimateandapportionment.
9[Thenumberofturnkeystobeappointedshallbesixty-five,exceptthatforeachpatrolman
10hereafterpromoted,demoted,removed,resignedorotherwiseseparatedfromtheforce,an
11additionalturnkeymaybeappointed,butundernocircumstancesshallmorethanone
12hundredfiftyturnkeysbeappointed.Aseachadditionalturnkeyisappointed,themaximum
HB359	2 13numberofpatrolmentobeappointedshallbereducedaccordinglysothatwhenonehundred
14fiftyturnkeyshavebeenappointed,thenumberofpatrolmentobeappointedshallnotbe
15morethanonethousandfivehundredninety-eight] Theboardmaycontinuetoemployas
16manynoncommissionedpolicecivilians,whichshallincludecitymarshalsandpark
17rangers,asitdeemsnecessaryinordertoperformthedutiesimposeduponthem.
84.140.Theboardsshallgranteverymemberofthepoliceforcewhohasservedfor
2oneyearormoreatotalofthreeweeksvacationeachyearwithpay,andeachmemberofthe
3policeforcewhohasservedthedepartmentfor[twelve] fiveyearsormoreshallreceive
4[four] fiveweeksvacationeachyearwithpay,andeachmemberofthepoliceforcewhohas
5servedthedepartmentfor[twenty-one] tenyearsormoreshallreceive[five] sixweeks
6vacationeachyearwithpay,andeachmemberofthepoliceforcewhohasservedthe
7departmentfor[thirty] fifteenyearsormore[andiseligibletoparticipateinthedeferred
8retirementoptionplan]shallreceive[six]sevenweeksvacationeachyearwithpay[;however
9theboardmaygrantanadditionalweekofpaidvacationtomembersafteroneyearof
10service], andeachmemberofthepoliceforcewhohasservedthedepartmentfortwenty
11yearsormoreshallreceiveeightweeksvacationeachyearwithpay.Allmembersofthe
12policeforceshallreceive[fifteen] sixteenholidayswithpay,howevertheboardmaygrant
13additionalholidayswithpay,andonehundredfourdaysoffdutyeachyearwithpay,andthe
14boardsmayfromtimetotimegrantadditionaldaysoffdutyeachyearwithpaywheninthe
15judgmentoftheboards,thegrantingthereofwillnotmateriallyimpairtheefficiencyofthe
16department.
84.150.Themaximumnumberofofficersofthepoliceforceineachrankineach
2suchcityshallbeasfollows:onechiefofpolicewiththerankofcolonel;oneassistantchief
3ofpolicewiththerankoflieutenantcolonel;fouradditionallieutenantcolonels[, notto
4exceedfiveinnumberandothersuchranksandnumberofmemberswithinsuchranksasthe
5boardfromtimetotimedeemsnecessary]; tencaptains;fifty-sevenlieutenants;andone
6hundredeighty-eightsergeants.Nofurtherappointmentstotherankofmajorshall
7hereafterbemade,butallmembersoftheforcenowholdingtherankofmajorshall
8continueinsuchrankuntiltheirpromotion,demotion,removal,resignation,orother
9separationfromtheforce.Theofficersofthepoliceforceshallhavecommissionsissuedto
10thembytheboardsofpolicecommissioners,andthoseheretoforeandthosehereafter
11commissionedshallservesolongastheyshallfaithfullyperformtheirdutiesandpossessthe
12necessarymentalandphysicalability,andbesubjecttoremovalonlyforcauseafterahearing
13bytheboard,whoareherebyinvestedwithexclusivejurisdictioninthepremises.
84.160.1.AsofAugust28,[2006] 2023, theboardofpolicecommissionersshall
2havetheauthoritytocomputeandestablishtheannualsalaryofeachmemberofthepolice
3forcewithoutreceivingpriorauthorizationfromthegeneralassembly, whichshallnotbe
HB359	3 4lessthantheannualsalarypaidtoanymemberatthetimeoftheenactmentofthis
5sectionandwhichannualsalaryshallincreasebynolessthanfourthousanddollarsas
6ofJuly1,2024.
7 2.Eachofficerofpoliceandpatrolmanwhoseregularassignmentrequires
8nonuniformedattiremayreceive,inadditiontohisorhersalary,anallowancenottoexceed
9threehundredsixtydollarsperannumpayablebiweekly.Notwithstandingtheprovisionsof
10subsection1ofthissectiontothecontrary,noadditionalcompensationorcompensatorytime
11offforovertime,courttime,orstandbycourttimeshallbepaidorallowedtoanyofficerof
12therankof[sergeant] lieutenantorabove.Notwithstandinganyotherprovisionoflawtothe
13contrary,nothinginthissectionshallprohibitthepaymentofadditionalcompensation
14pursuanttothissubsectiontoofficersoftheranksofsergeantsandabove,providedthat
15fundingforsuchcompensationshallnot:
16 (1)Bepaidfromthegeneralfundsofeitherthecityortheboardofpolice
17commissionersofthecity;or
18 (2)Beviolativeofanyfederallaworotherstatelaw.
19 3.Itisthedutyofthemunicipalassemblyorcommoncouncilofthecitiestomake
20thenecessaryappropriationfortheexpensesofthemaintenanceofthepoliceforceinthe
21mannerhereinandhereafterprovided;provided,thatinnoeventshallsuchmunicipal
22assemblyorcommoncouncilberequiredtoappropriateforsuchpurposes(including,butnot
23limitedto,costsoffundingpensionsorretirementplans)foranyfiscalyearasuminexcessof
24anylimitationimposedbyarticleX,section21,MissouriConstitution;andprovidedfurther,
25thatsuchmunicipalassemblyorcommoncouncilmayappropriateasuminexcessofsuch
26limitationforanyfiscalyearbyanappropriationsordinanceenactedinconformitywiththe
27provisionsofthecharterofsuchcities.
28 4.Notwithstandingtheprovisionsofsubsection1ofthissectiontothecontrary,the
29boardofpolicecommissionersshallpayadditionalcompensationforallhoursofservice
30renderedbyprobationarypatrolmen[and],patrolmen, andsergeantsinexcessofthe
31establishedregularworkingperiod,andtherateofcompensationshallbeoneandone-half
32timestheregularhourlyrateofpaytowhicheachmembershallnormallybeentitled;except
33that,thecourttimeandcourtstandbytimeshallbepaidattheregularhourlyrateofpayto
34whicheachmembershallnormallybeentitled.Nocreditshallbegivenordeductionsmade
35frompaymentsforovertimeforthepurposeofretirementbenefits.
36 5.Notwithstandingtheprovisionsofsubsection1ofthissectiontothecontrary,
37probationarypatrolmen[and], patrolmen, andsergeantsshallreceiveadditional
38compensationforauthorizedovertime,courttimeandcourtstandbytimewheneverthe
39totalaccumulatedtimeexceedsfortyhours.Theaccumulatedfortyhoursshallbetakenas
40compensatorytimeoffattheofficer'sdiscretionwiththeapprovalofhissupervisor.
HB359	4 41 6.Theallowanceofcompensationorcompensatorytimeoffforcourtstandbytime
42shallbecomputedattherateofone-thirdofonehourforeachhourspentoncourtstandby
43time.
44 7.Theboardofpolicecommissioners[may] shalleffectprogramstoprovide
45additionalcompensationtoitsemployeesforsuccessfulcompletionofacademicworkatan
46accreditedcollegeoruniversity,inamountsnottoexceedtenpercentoftheiryearlysalaries
47orforfieldtrainingofficerandleadofficerresponsibilitiesinamountsnottoexceedthree
48percentoftheiryearlysalariesforfieldtrainingofficerresponsibilitiesandanadditionalthree
49percentoftheiryearlysalariesforleadofficerresponsibilities.Theboardmaydesignateup
50toonehundredfiftyemployeesasfieldtrainingofficersanduptofiftyemployeesaslead
51officers.
52 8.Theboardofpolicecommissioners:
53 (1)Shallprovideorcontractforlifeinsurancecoverageandforinsurancebenefits
54providinghealth,medicalanddisabilitycoverageforofficersandemployeesofthe
55department;
56 (2)Shallprovideorcontractforinsurancecoverageprovidingsalarycontinuation
57coverageforofficersandemployeesofthepolicedepartment;
58 (3)Shallprovidehealth,medical,andlifeinsurancecoverageforretiredofficersand
59employeesofthepolicedepartment.Health,medicalandlifeinsurancecoverageshallbe
60madeavailableforpurchasetothespousesordependentsofdeceasedretiredofficersand
61employeesofthepolicedepartmentwhoreceivepensionbenefitspursuanttosections86.200
62to86.364attheratethatsuchdependent'sorspouse'scoveragewouldcostunderthe
63appropriateplanifthedeceasedwereliving;
64 (4)Maypayanadditionalshiftdifferentialcompensationtomembersofthepolice
65forceforeveningandnighttourofdutyinanamountnottoexceedtenpercentoftheofficer's
66basehourlyrate.
67 9.Notwithstandingtheprovisionsofsubsection1ofthissectiontothecontrary,the
68boardofpolicecommissionersshallpayadditionalcompensationtomembersofthepolice
69forceuptoandincludingtherankofpoliceofficerforanyfullhourworkedbetweenthe
70hoursof11:00p.m.and7:00a.m.,inamountsequalto[five]tenpercentoftheofficer'sbase
71hourlypay.
72 10.Theboardofpolicecommissioners,fromtimetotimeandinitsdiscretion,may
73payadditionalcompensationtopoliceofficers,sergeantsandlieutenantsbypaying
74commissionedofficersintheaforesaidranksforaccumulated,unusedvacationtime.Any
75suchpaymentsshallbemadeinincrementsofnotlessthanfortyhours,andatrates
76equivalenttothebasestraight-timeratesbeingearnedbysaidofficersatthetimeofpayment;
HB359	5 77exceptthat,nosuchofficershallberequiredtoacceptpaymentforaccumulatedunused
78vacationtime.
84.170.1.Whenanyvacancyshalltakeplaceinanygradeofofficers,itshallbe
2filledfromthenextlowestgrade;provided,however,thatprobationarypatrolmenshallserve
3atleastsixmonthsassuchbeforebeingpromotedtotherankofpatrolman;patrolmenshall
4serveatleastthreeyearsassuchbeforebeingpromotedtotherankofsergeant;sergeants
5shallserveatleastoneyearassuchbeforebeingpromotedtotherankoflieutenant;
6lieutenantsshallserveatleastoneyearassuchbeforebeingpromotedtotherankofcaptain;
7andinnocaseshallthechieforassistantchiefbeselectedfrommennotmembersoftheforce
8orbelowthegradeofcaptain.Patrolmenshallserveatleastthreeyearsassuchbefore
9promotiontotherankofdetective;theinspectorshallbetakenfrommenintheranknot
10belowthegradeoflieutenant.
11 2.Theboardsofpoliceareherebyauthorizedtomakeallsuchrulesandregulations,
12notinconsistentwithsections[84.010] 84.012to84.340,orotherlawsofthestate,asthey
13mayjudgenecessary,fortheappointment,employment,uniforming,discipline,trialand
14governmentofthepolice.Atthetimeoftheeffectivedateofthisactanduntilsuchtime
15astheboardadoptsotherinvestigativeanddisciplinarypoliciesandproceduresnot
16inconsistentwithsection590.502,disciplineandinvestigativeproceduresfor
17commissionedandcivilianemployeesofthepoliceforceshallberegulatedbyrule7
18ofthepolicemanualofthepolicedepartmentineffectasofNovember4,2013;except
19that,whererule7isinconflictwithsection590.502,theboardshallcomplywiththe
20requirementsofsection590.502.Undernocircumstancesshalltheboardinitiallyor
21hereafteradoptinvestigativeanddisciplinaryproceduresthatdonotincludethe
22summaryhearingboardproceduresprovidedforinrule7ofthepolicemanualofthe
23policedepartmentineffectasofNovember4,2013.Thesaidboardsshallalsohavepower
24torequireofanyofficerorpolicemanbondwithsuretieswhentheymayconsiderit
25demandedbythepublicinterests.Alllawfulrulesandregulationsoftheboardshallbe
26obeyedbythepoliceforceonpainofdismissalorsuchlighterpunishment,eitherby
27suspension,fine,reductionorforfeitureofpay,orotherwiseastheboardsmayadjudge.
28 3.Theauthoritypossessedbytheboardofpoliceincludes,butisnotlimitedto,the
29authoritytodelegateportionsofitspowersauthorizedinsection84.120,includingpresiding
30overadisciplinaryhearing,toahearingofficerasdeterminedbytheboard.
84.225.Anyofficerorservantofthemayororcommoncouncilormunicipal
2assemblyofthecities,orotherpersonswhatsoever,whoforciblyresistsorobstructsthe
3executionorenforcementofanyoftheprovisionsofsections84.012to84.340orrelating
4tothesame,orwhodisbursesorfailstodisburseanymoneyinviolationthereof,orwho
5hindersorobstructstheorganizationormaintenanceoftheboardofpoliceorthepolice
HB359	6 6forcethereinprovidedtobeorganizedandmaintained,orwhomaintainsorcontrols
7anypoliceforceotherthantheonethereinprovidedfor,orwhodelaysorhindersthe
8dueenforcementofsections84.012to84.340byfailingorneglectingtoperformthe
9dutiesbysuchsectionsimposeduponhimorher,shallbesubjecttoapenaltyofone
10thousanddollarsforeachoffense,recoverablebytheboardsbyactionatlawinthe
11nameofthestate,andshallforeverthereafterbedisqualifiedfromholdingorexercising
12anyofficeoremploymentwhatsoeverunderthemayororcommoncouncilormunicipal
13assemblyofsuchcities,orundersections84.012to84.340;providedthat,nothinginthis
14sectionshallbeconstruedtointerferewiththepunishment,underanyexistingorany
15futurelawsofthisstate,ofanycriminaloffensethatiscommittedbythepartiesinor
16abouttheresistance,obstruction,hindrance,conspiracy,combination,ordisbursement
17aforesaid.
84.325.1.OnAugust28,2023,theboardofpolicecommissionersshallassume
2controlofanymunicipalpoliceforceestablishedwithinanycitynotwithinacounty
3accordingtotheproceduresandrequirementsofthissectionandanyrulespromulgated
4undersubsection6ofthissection.Thepurposeoftheseproceduresandrequirementsis
5toprovideforanorderlyandappropriatetransitioninthegovernanceofthepolice
6forceandprovideforanequitableemploymenttransitionforcommissionedandcivilian
7personnel.
8 2.Upontheassumptionofcontrolbytheboardofpolicecommissionersunder
9subsection1ofthissection,anymunicipalpolicedepartmentwithinanycitynotwithin
10acountyshallconvey,assign,andotherwisetransfertotheboardtitleandownershipof
11allindebtednessandassets,including,butnotlimitedto,allfundsandrealandpersonal
12propertyheldinthenameoforcontrolledbythemunicipalpolicedepartment.Such
13cityshallthereafterceasetheoperationofanypolicedepartmentorpoliceforce.
14 3.Upontheassumptionofcontrolbytheboardofpolicecommissionersunder
15subsection1ofthissection,thestateshallacceptresponsibility,ownership,andliability
16assuccessor-in-interestforcontractualobligationsandotherlawfulobligationsofthe
17municipalpolicedepartment.
18 4.Theboardofpolicecommissionersshallinitiallyemploy,withoutareduction
19inrank,salary,orbenefits,allcommissionedandcivilianpersonnelofthemunicipal
20policedepartmentwhowereemployedbythemunicipalpolicedepartmentimmediately
21priortothedatetheboardassumedcontrol.Theboardshallrecognizeallaccrued
22yearsofservicethatsuchcommissionedandcivilianpersonnelhadwiththemunicipal
23policedepartment,aswellasallaccruedyearsofservicethatsuchcommissionedand
24civilianpersonnelhadpreviouslywiththeboardofpolicecommissioners.Such
25personnelshallbeentitledtothesameholidays,vacation,sickleave,sickbonustime,
HB359	7 26andannualstep-increasestheywereentitledtoasemployeesofthemunicipalpolice
27department.
28 5.Thecommissionedandcivilianpersonnelwhoretirefromservicewiththe
29municipalpolicedepartmentbeforetheboardofpolicecommissionersassumedcontrol
30ofthedepartmentundersubsection1ofthissectionshallcontinuetobeentitledtothe
31samepensionbenefitsprovidedasemployeesofthemunicipalpolicedepartmentand
32thesamebenefitssetforthinsubsection4ofthissection.
33 6.Theboardofpolicecommissionersmaypromulgateallnecessaryrulesand
34regulationsfortheimplementationandadministrationofthissection.Anyruleor
35portionofarule,asthattermisdefinedinsection536.010,thatiscreatedunderthe
36authoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithandis
37subjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.This
38sectionandchapter536arenonseverableandifanyofthepowersvestedwiththe
39generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto
40disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof
41rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2023,shallbe
42invalidandvoid.
105.726.1.Nothinginsections105.711to105.726shallbeconstruedtobroadenthe
2liabilityofthestateofMissouribeyondtheprovisionsofsections537.600to537.610,norto
3abolishorwaiveanydefenseatlawwhichmightotherwisebeavailabletoanyagency,
4officer,oremployeeofthestateofMissouri.Sections105.711to105.726donotwaivethe
5sovereignimmunityofthestateofMissouri.
6 2.Thecreationofthestatelegalexpensefundandthepaymenttherefromofsuch
7amountsasmaybenecessaryforthebenefitofanypersoncoveredtherebyaredeemed
8necessaryandproperpublicpurposesforwhichfundsofthisstatemaybeexpended.
9 3.Moneysinthestatelegalexpensefundshallnotbeavailableforthepaymentof
10anyclaimoranyamountrequiredbyanyfinaljudgmentrenderedbyacourtofcompetent
11jurisdictionagainstaboardofpolicecommissionersestablishedunderchapter84,including
12thecommissioners,anypoliceofficer,notwithstandingsections84.330and84.710,orother
13provisionsoflaw,otheremployees,agents,representative,oranyotherindividualorentity
14actingorpurportingtoactonitsortheirbehalf.Suchwastheintentofthegeneralassembly
15intheoriginalenactmentofsections105.711to105.726,anditismadeexpressbythis
16sectioninlightofthedecisioninWaymanSmith,III,etal.v.StateofMissouri, 152S.W.3d
17275.Exceptthatthecommissionerofadministrationshallreimbursefromthelegalexpense

30 commissionedpersonnelwhopreviouslywereemployedbytheboardmay
31 onlybeinvoluntarilyterminatedbythecitynotwithinacountyforcause.The
