SectionA.Section566.223,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection566.223,toreadasfollows:
566.223.1.Anyindividualwhoisallegingthataviolationofsections566.200to
2566.218andsection578.475hasoccurredagainsthisorherpersonshallbeaffordedthe
3rightsandprotectionsprovidedinthefederalTraffickingVictimsProtectionActof2000,
4PublicLaw106-386,asamended.
5 2.Itisanaffirmativedefensefortheoffenseofprostitutionundersection567.020
6thatthedefendantengagedintheconductchargedtoconstituteanoffensebecauseheorshe
7wascoercedtodosobytheuseof,orthreateneduseof,unlawfulphysicalforceuponhimself
8orherselforathirdperson,whichforceorthreatenedforceapersonofreasonablefirmnessin
9hisorhersituationwouldhavebeenunabletoresist.
10 3.Thedepartmentofpublicsafetyisauthorizedtoestablishproceduresfor
11identifyingvictimsoftraffickingundersections566.200to566.223.Thedepartmentmay
12establishtrainingprogramsaswellasstandardprotocolsforappropriateagenciestoeducate
13officialsandemployeesonstatestatutesandfederallawsregulatinghumantraffickingand
14withtheidentificationandassistanceofvictimsofhumantrafficking.Suchagenciesmay
15includebutnotbelimitedtostateemployeesandcontractors,includingthechildren'sdivision
16ofthedepartmentofsocialservices,juvenilecourts,statelawenforcementagencies,health
17careprofessionals,andrunawayandhomelessyouthshelteradministrators.Trainingunder
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 18thissection,whenconductedforlawenforcementofficers,shallincludeinstructionon
19victims'statementsinordertoassistofficersinidentifyingpersonsassociatedwith
20humantraffickingandhumantraffickingvictims.
21 4.Assoonaspossibleafterafirstencounterwithapersonwhoreasonablyappearsto
22alawenforcementagencytobeavictimoftraffickingasdefinedinsection566.200,that
23agencyorofficeshallnotifythedepartmentofsocialservicesand,whereapplicable,juvenile
24justiceauthoritiesthatthepersonmaybeavictimoftrafficking,inorderthatsuchagencies
25maydeterminewhetherthepersonmaybeeligibleforstateorfederalservices,programs,or
26assistance.
27 5.Thedepartmentofsocialservicesmaycoordinatewithrelevantstate,federal,and
28localagenciestoevaluateappropriateservicesforvictimsoftrafficking.Stateagenciesmay
29implementprogramsandenterintocontractswithnonprofitagencies,domesticandsexual
30violenceshelters,andothernongovernmentorganizationstoprovideservicestoconfirmed
31victimsoftrafficking,insofarasfundsareavailableforthatpurpose.Suchservicesmay
32include,butarenotlimitedto,casemanagement,emergencytemporaryhousing,healthcare,
33mentalhealthcounseling,alcoholanddrugaddictionscreeningandtreatment,language
34interpretationandtranslationservices,Englishlanguageinstruction,jobtraining,and
35placementassistance.
36 6.Avictimoftraffickingmaybringacivilactionagainstapersonorpersonswho
37pleadguiltytoorarefoundguiltyofaviolationofsection566.203,566.206,566.209,
38566.210,or566.211torecovertheactualdamagessustainedbythevictim,courtcosts,
39includingreasonableattorney'sfees,andpunitivedamages,whendeterminedtobe
40appropriatebythecourt.Anyactioncommencedunderthissectionshallbefiledwithin
41tenyearsafterthelaterof:
42 (1)Thefinalorderintherelatedcriminalcase;
43 (2)Thevictim'semancipationfromthedefendant;or
44 (3)Thevictim'seighteenthbirthday.
45 7.Theattorneygeneralmaybringacivilaction,inthecircuitcourtinwhichthe
46victimoftraffickingwasfound,torecoverfromanypersonorentitythatbenefits,financially
47orbyreceivinganythingofvalue,fromviolationsofsection566.203,566.206,566.209,
48566.210,or566.211,acivilpenaltyofnotmorethanfiftythousanddollarsforeachviolation
49ofsection566.203,566.206,566.209,566.210,or566.211,andinjunctiveandotherequitable
50reliefasthecourtmay,initsdiscretion,order.Thefirstpriorityofanymoneyorproperty
51collectedundersuchanactionshallbetopayrestitutiontothevictimsoftraffickingonwhose
52behalfthecivilactionwasbrought.
