610.021.Excepttotheextentdisclosureisotherwiserequiredbylaw,apublic
2governmentalbodyisauthorizedtoclosemeetings,recordsandvotes,totheextenttheyrelate
3tothefollowing:
4 (1)Legalactions,causesofactionorlitigationinvolvingapublicgovernmentalbody
5andanyconfidentialorprivilegedcommunicationsbetweenapublicgovernmentalbodyor
6itsrepresentativesanditsattorneys.However,anyminutes,voteorsettlementagreement
7relatingtolegalactions,causesofactionorlitigationinvolvingapublicgovernmentalbody
8oranyagentorentityrepresentingitsinterestsoractingonitsbehalforwithitsauthority,
9includinganyinsurancecompanyactingonbehalfofapublicgovernmentbodyasitsinsured,
10shallbemadepublicuponfinaldispositionofthemattervoteduponoruponthesigningby
11thepartiesofthesettlementagreement,unless,priortofinaldisposition,thesettlement
12agreementisorderedclosedbyacourtafterawrittenfindingthattheadverseimpacttoa
13plaintifforplaintiffstotheactionclearlyoutweighsthepublicpolicyconsiderationsof
14section610.011,however,theamountofanymoneyspaidby,oronbehalfof,thepublic
15governmentalbodyshallbedisclosed;provided,however,inmattersinvolvingtheexerciseof
16thepowerofeminentdomain,thevoteshallbeannouncedorbecomepublicimmediately
17followingtheactiononthemotiontoauthorizeinstitutionofsuchalegalaction.Legalwork
18productshallbeconsideredaclosedrecord;
19 (2)Leasing,purchaseorsaleofrealestatebyapublicgovernmentalbodywhere
20publicknowledgeofthetransactionmightadverselyaffectthelegalconsiderationtherefor.
21However,anyminutes,voteorpublicrecordapprovingacontractrelatingtotheleasing,
22purchaseorsaleofrealestatebyapublicgovernmentalbodyshallbemadepublicupon
23executionofthelease,purchaseorsaleoftherealestate;
24 (3)Hiring,firing,discipliningorpromotingofparticularemployeesbyapublic
25governmentalbodywhenpersonalinformationabouttheemployeeisdiscussedorrecorded.

27fire,promoteordisciplineanemployeeofapublicgovernmentalbodyshallbemade
28availablewitharecordofhoweachmembervotedtothepublicwithinseventy-twohoursof
29thecloseofthemeetingwheresuchactionoccurs;provided,however,thatanyemployeeso
30affectedshallbeentitledtopromptnoticeofsuchdecisionduringtheseventy-two-hour
31periodbeforesuchdecisionismadeavailabletothepublic.Asusedinthissubdivision,the
32term"personalinformation"meansinformationrelatingtotheperformanceormeritof
33individualemployees;
34 (4)Thestatemilitiaornationalguardoranypartthereof;
35 (5)Nonjudicialmentalorphysicalhealthproceedingsinvolvingidentifiablepersons,
36includingallrecordsorportionsofrecordsrelatingtomedical,psychiatric,psychological,
37oralcoholismordrugdependencydiagnosisortreatment;
38 (6)Scholasticprobation,expulsion,orgraduationofidentifiableindividuals,
39includingrecordsofindividualtestorexaminationscores;however,personallyidentifiable
40studentrecordsmaintainedbypubliceducationalinstitutionsshallbeopenforinspectionby

82body'sabilitytoprotectthesecurityorsafetyofpersonsorrealproperty,andshallinthesame
83writingstatethatthepublicinterestinnondisclosureoutweighsthepublicinterestin
84disclosureoftherecords;
85 (19)Existingorproposedsecuritysystems, securityprotocols,andstructuralplans
86ofrealpropertyownedorleasedbyapublicgovernmentalbody,andinformationthatis
87voluntarilysubmittedbyanonpublicentityowningoroperatinganinfrastructuretoany
88publicgovernmentalbodyforusebythatbodytodeviseplansforprotectionofthat

150subdivisionaswellasanemployeeofsuchelectedofficialwhensuchemployeeisacting
151inanofficialcapacity.Nothinginthissubdivisionshallauthorizetheclosureofarecord
152thathasbeenofferedinapublicmeetingofthepublicgovernmentalbody,orany
153committeethereof;
154 (28)Inter-agencyorintra-agencymemorandaorlettersthatwouldnotbe
155availablebystateorfederallawtoapartyotherthananagencyinlitigationwiththe
156agency,providedthatthedeliberativeprocessprivilegeshallnotapplytorecords

610.023.1.Eachpublicgovernmentalbodyistoappointacustodianwhoistobe
2responsibleforthemaintenanceofthatbody'srecords.Theidentityandlocationofapublic
3governmentalbody'scustodianistobemadeavailableuponrequest.
4 2.Eachpublicgovernmentalbodyshallmakeavailableforinspectionandcopyingby
5thepublicofthatbody'spublicrecords.Nopersonshallremoveoriginalpublicrecordsfrom
HB394	8 6theofficeofapublicgovernmentalbodyoritscustodianwithoutwrittenpermissionofthe
7designatedcustodian.Nopublicgovernmentalbodyshall,afterAugust28,1998,granttoany
8personorentity,whetherbycontract,licenseorotherwise,theexclusiverighttoaccessand
9disseminateanypublicrecordunlessthegrantingofsuchrightisnecessarytofacilitate
10coordinationwith,oruniformityamong,industryregulatorshavingsimilarauthority.
11 3.Eachrequestforaccesstoapublicrecordshallbeacteduponassoonaspossible,
12butinnoeventlaterthantheendofthe[third] fifthbusinessdayfollowingthedatethe
13requestisreceivedbythecustodianofrecordsofapublicgovernmentalbody.Ifrecordsare
14requestedinacertainformat,thepublicbodyshallprovidetherecordsintherequested
15format,ifsuchformatisavailable.Ifaccesstothepublicrecordisnotgrantedimmediately,
16thecustodianshallgiveadetailedexplanationofthecauseforfurtherdelayandtheplaceand
17earliesttimeanddatethattherecordwillbeavailableforinspection.Accesstoandthe
18productionoftherecordsmaybeconditioneduponreceiptofpaymentundersection
19610.026.Thisperiodfordocumentproductionmayexceed[three] fivedaysforreasonable
20cause.
21 4.Ifarequestforaccessisdenied,thecustodianshallprovide,uponrequest,awritten
22statementofthegroundsforsuchdenial.Suchstatementshallcitethespecificprovisionof
23lawunderwhichaccessisdeniedandshallbefurnishedtotherequesternolaterthantheend
