Torepealsection578.012,RSMo,andtoenactinlieuthereoftwonewsectionsrelatingto
animalabuse,withpenaltyprovisions.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section578.012,RSMo,isrepealedandtwonewsectionsenactedinlieu
2thereof,tobeknownassections578.012and589.750,toreadasfollows:
578.012.1.Apersoncommitstheoffenseofanimalabuseifheorshe:
2 (1)Intentionallyorpurposelykillsananimalinanymannernotallowedbyor
3expresslyexemptedfromtheprovisionsofsections578.005to578.023and273.030;
4 (2)Purposelyorintentionallycausesinjuryorsufferingtoananimal;or
5 (3)Havingownershiporcustodyofananimalknowinglyfailstoprovideadequate
6carewhichresultsinsubstantialharmtotheanimal.
7 2.Animalabuseisaclass[Amisdemeanor] Efelony, unlessthedefendanthas
8previouslybeenfoundguiltyofanimalabuseorthesufferinginvolvedinsubdivision(2)of
9subsection1ofthissectionistheresultoftortureormutilationconsciouslyinflictedwhilethe
10animalwasalive,inwhichcaseitisaclass[E]Dfelony.
589.750.1.Theprovisionsofthissectionshallbeknownandmaybecitedasthe
2"MissouriAnimalAbuserRegistrationAct".
3 2.Asusedinthissection,thefollowingtermsshallmean:
4 (1)"Abuser"or"animalabuser",apersonwhohasbeenconvictedinthisstate
5ofcommittingananimalabuseoffense;
6 (2)"Animal",acompanionanimalnotincludinglivestockorwildlife;
7 (3)"Animalabuseoffense":

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 8 (a)Animalabuseundersection578.012;
9 (b)Dogfightingundersection578.025iftheperson'sactconstitutesafelony;
10 (c)Bullbaitingorcockfightingundersection578.050;or
11 (d)Sexwithananimalundersection566.111;
12 (4)"Companionanimal",anylivedogofthespeciesCanisfamiliarisorlivecat
13ofthespeciesFeliscatus;
14 (5)"Conviction",ajudgmententeredbyaMissouricourtuponapleaofguilty,
15apleaofnolocontendere,orafindingofguiltbyajuryorthecourt,notwithstanding
16anypendingappealorhabeascorpusproceedingarisingfromthejudgment.
17 3.BeginningJanuary1,2024,theMissouristatehighwaypatrolshallposta
18publiclyaccessiblelistonitswebsiteofanypersonconvictedofananimalabuseoffense
19onoraftersuchdate.Thelistshallincludeaphotographtakenofeachconvicted
20animalabuseraspartofthebookingprocess,theanimalabuser'sfulllegalname,and
21otheridentifyingdataasthehighwaypatroldeterminesisnecessarytoproperlyidentify
22theanimalabuserandtoexcludeinnocentpersons.Thelistshallnotincludetheanimal
23abuser'sSocialSecuritynumber,driver'slicensenumber,oranyotherstateorfederal
24identificationnumber.
25 4.Allcircuitcourtclerksshallforwardacopyofthejudgmentanddateofbirth
26ofallpersonsconvictedofananimalabuseoffensetotheMissouristatehighwaypatrol
27withinsixtycalendardaysofthedateofjudgment.
28 5.Uponaperson'sfirstconvictionforananimalabuseoffense,theMissouri
29statehighwaypatrolshallmaintaintheperson'snameandotheridentifyinginformation
30onthelistundersubsection3ofthissectionfortwoyearsfollowingthedateof
31conviction,afterwhichtimethehighwaypatrolshallremovetheperson'snameand
32identifyinginformationfromthelist;providedthat,thepersonisnotconvictedof
33anotheranimalabuseoffenseduringsuchtwo-yearperiod.
34 6.Uponaperson'ssecondorsubsequentconvictionforananimalabuseoffense,
35theMissouristatehighwaypatrolshallmaintaintheperson'snameandother
36identifyinginformationonthelistundersubsection3ofthissectionforfiveyears
37followingthedateofthemostrecentconviction,afterwhichtimethehighwaypatrol
38shallremovetheperson'snameandidentifyinginformationfromthelist;providedthat,
39thepersonisnotconvictedofanotheranimalabuseoffenseduringsuchfive-year
40period.
41 7.TheMissouristatehighwaypatrolshallremovetheperson'snameand
42identifyinginformationfromtheregistrylistifthesoleoffensethatsubjectedtheperson
43totheprovisionsofthissectionisexpunged.
HB40	2 44 8.TheMissouristatehighwaypatrolmaypromulgaterulesandregulationsto
45implementtheprovisionsofthissection.Anyruleorportionofarule,asthattermis
46definedinsection536.010,thatiscreatedundertheauthoritydelegatedinthissection
47shallbecomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsof
48chapter536and,ifapplicable,section536.028.Thissectionandchapter536are
49nonseverableandifanyofthepowersvestedwiththegeneralassemblypursuantto
50chapter536toreview,todelaytheeffectivedate,ortodisapproveandannularuleare
51subsequentlyheldunconstitutional,thenthegrantofrulemakingauthorityandanyrule
52proposedoradoptedafterAugust28,2023,shallbeinvalidandvoid.
