peaceofficerlicensesuspensions.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section590.090,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection590.090,toreadasfollows:
590.090.1.Thedirectorshallhavecausetosuspendimmediatelythepeaceofficer
2licenseofanylicenseewho:
3 (1)Isunderindictmentfor,ischargedwith,orhasbeenconvictedofthecommission
4ofanyfelony;
5 (2)Issubjecttoanorderofanotherstate,territory,thefederalgovernment,orany
6peaceofficerlicensingauthoritysuspendingorrevokingapeaceofficerlicenseor
7certification;or
8 (3)Presentsaclearandpresentdangertothepublichealthorsafetyifcommissioned
9asapeaceofficer.
10 2.Atanytimeafterthefilingofadisciplinarycomplaintpursuanttosection590.080,
11ifthedirectordeterminesthatprobablecauseexiststosuspendimmediatelythepeaceofficer
12licenseofthesubjectofthecomplaint,thedirector[may] shall, withoutnoticeorhearing,
13issueanemergencyordersuspendingsuchlicenseuntilfinaldeterminationofthedisciplinary
14complaint.Suchordershallstatetheprobablecauseforthesuspensionandshallbeserved
15uponthelicenseebycertifiedmailatthelicensee'saddressofrecord[pursuanttosubdivision
16(2)ofsubsection3ofsection590.130]. Proofofrefusalofthelicenseetoacceptdeliveryor
17theinabilityofpostalauthoritiestodeliversuchcertifiedmailshallbeevidencethatrequired

21 3.Alicenseesubjecttoanemergencyorderofsuspensionmaypetitionthe
22administrativehearingcommissionforreviewofthedirector'sdeterminationofprobable
23cause,inwhichcasetheadministrativehearingcommissionshallwithinfivebusinessdays
24conductanemergencyhearing,renderitsdecision,andissuefindingsoffactandconclusions
25oflaw.Swornaffidavitsordepositionsshallbeadmissibleontheissueofprobablecauseand
26maybeheldsufficienttoestablishprobablecause.Theadministrativehearingcommission
27shallhavenoauthoritytostayorterminateanemergencyorderofsuspensionwithouta
28hearingpursuanttothissubsection.Findingsandconclusionsmadeindeterminingprobable
29causeforanemergencysuspensionshallnotbebindingonanypartyinanyproceeding

31 4.Anypartyaggrievedbyadecisionoftheadministrativehearingcommission
