BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Sections307.173,307.179,and307.380,RSMo,arerepealedandfour 2newsectionsenactedinlieuthereof,tobeknownassections43.253,307.173,307.179,and 3307.380,toreadasfollows: 43.253.1.Notwithstandinganyotherprovisionoflawtothecontrary,a 2minimumfeeofsixdollarsmaybechargedbytheMissouristatehighwaypatrolfora 3recordsrequestforaMissouriUniformCrashReportorMarineAccidentInvestigation 4Reportwherethereareallowablefeesoflessthansixdollarsunderthischapteror 5chapter610.Suchsix-dollarfeeshallbeinplaceofanyallowablefeeoflessthansix 6dollars. 7 2.ThesuperintendentoftheMissouristatehighwaypatrolmayincreasethe 8minimumfeedescribedinthissectionbynomorethanonedollareveryotheryear 9beginningAugust28,2024;however,theminimumfeedescribedinthissectionshallnot 10exceedtendollars. 307.173.1.Anypersonmayoperateamotorvehiclewithfrontsidewingventsor 2windowslocatedimmediatelytotheleftandrightofthedriverthathaveasun-screening 3device,inconjunctionwithsafetyglazingmaterial,thathasalighttransmissionofthirty-five 4percentormoreplusorminusthreepercentandaluminousreflectanceofthirty-fivepercent 5orlessplusorminusthreepercent.Exceptasprovidedinsubsection5ofthissection,any 6sun-screeningdeviceappliedtofrontsidewingventsorwindowslocatedimmediatelytothe EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 7leftandrightofthedriverinexcessoftherequirementsofthissectionshallbeprohibited 8withoutapermitpursuanttoaphysician'sprescriptionasdescribedbelow.Apermitto 9operateamotorvehiclewithfrontsidewingventsorwindowslocatedimmediatelytotheleft 10andrightofthedriverthathaveasun-screeningdevice,inconjunctionwithsafetyglazing 11material,whichpermitslesslighttransmissionandluminousreflectancethanallowedunder 12therequirementsofthissubsection,maybeissuedbythedepartmentofpublicsafetytoa 13personhavingaseriousmedicalconditionwhichrequirestheuseofasun-screeningdeviceif 14thepermittee'sphysicianprescribesitsuse.Thedirectorofthedepartmentofpublicsafety 15shallpromulgaterulesandregulationsfortheissuanceofthepermit.Thepermitshallallow 16operationofthevehiclebyanytitleholderorrelativewithintheseconddegreeby 17consanguinityoraffinity,whichshallmeanaspouse,eachgrandparent,parent,brother,sister, 18niece,nephew,aunt,uncle,child,andgrandchildofaperson,whoresidesinthehousehold. 19Exceptasprovidedinsubsection2ofthissection,allsun-screeningdevicesappliedtothe 20windshieldofamotorvehicleareprohibited. 21 2.Thissectionshallnotprohibitlabels,stickers,decalcomania,orinformationalsigns 22onmotorvehiclesortheapplicationoftintedorsolarscreeningmaterialtorecreational 23vehiclesasdefinedinsection700.010,providedthatsuchmaterialdoesnotinterferewiththe 24driver'snormalviewoftheroad.Thissectionshallnotprohibitfactory-installedtintedglass, 25theequivalentreplacementthereofortintingmaterialappliedtotheupperportionofthe 26motorvehicle'swindshieldwhichisnormallytintedbythemanufacturerofmotorvehicle 27safetyglass. 28 3.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis 29createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies 30withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028. 31Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe 32generalassemblypursuanttochapter536toreview,todelaytheeffectivedateorto 33disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof 34rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2001,shallbeinvalid 35andvoid. 36 4.Anypersonwhoviolatestheprovisionsofthissectionisguiltyofaclass[C]D 37misdemeanor. 38 5.Anyvehiclelicensedwithahistoricallicenseplateshallbeexemptfromthe 39requirementsofthissection. 307.179.1.Asusedinthissection,thefollowingtermsshallmean: 2 (1)"Childboosterseat",aseatingsystemwhichmeetstheFederalMotorVehicle 3SafetyStandardssetforthin49C.F.R.571.213,asamended,thatisdesignedtoelevatea 4childtoproperlysitinafederallyapprovedsafetybeltsystem; HCSHB443 2 5 (2)"Childpassengerrestraintsystem",aseatingsystemwhichmeetstheFederal 6MotorVehicleSafetyStandardssetforthin49C.F.R.571.213,asamended,andwhichis 7eitherpermanentlyaffixedtoamotorvehicleorisaffixedtosuchvehiclebyasafetybeltora 8universalattachmentsystem; 9 (3)"Driver",apersonwhoisinactualphysicalcontrolofamotorvehicle. 10 2.Everydrivertransportingachildundertheageofsixteenyearsshallbe 11responsible,whentransportingsuchchildinamotorvehicleoperatedbythatdriveronthe 12streetsorhighwaysofthisstate,forprovidingfortheprotectionofsuchchildasfollows: 13 (1)Childrenshallbesecuredinarear-facingchildpassengerrestraintsystem 14untilthechildreachestwoyearsofage,exceptthatachildundertwoyearsofagemay 15besecuredinaforwardfacingsystemwhenthechildreachesthehighestrear-facing 16weightorheightallowedbythemanufactureroftheparticularcarsafetyseat; 17 (2)Childrenlessthanfouryearsofage,regardlessofweight,shallbesecuredina 18childpassengerrestraintsystemappropriateforthatchild; 19 [(2)](3)Childrenweighinglessthanfortypounds,regardlessofage,shallbesecured 20inachildpassengerrestraintsystemappropriateforthatchild; 21 [(3)](4)Childrenatleastfouryearsofagebutlessthaneightyearsofage,whoalso 22weighatleastfortypounds[butlessthaneightypounds,andwhoarealsolessthanfourfeet, 23nineinchestall],shallbesecuredinachildpassengerrestraintsystemorboosterseat 24appropriateforthatchild; 25 [(4)](5)Childrenatleasteightypounds[orchildren] andmorethanfourfeet,nine 26inchesinheight, oratleasteightyearsofage,shallbesecuredbyavehiclesafetybelt[or 27boosterseatappropriateforthatchild] accordingtosection307.178; and 28 [(5)](6)Achildwhootherwisewouldberequiredtobesecuredinaboosterseatmay 29betransportedinthebackseatofamotorvehiclewhilewearingonlyalapbeltiftheback 30seatofthemotorvehicleisnotequippedwithacombinationlapandshoulderbeltforbooster 31seatinstallation[; 32 (6)Whentransportingchildrenintheimmediatefamilywhentherearemorechildren 33thanthereareseatingpositionsintheenclosedareaofamotorvehicle,thechildrenwhoare 34notabletoberestrainedbyachildsafetyrestraintdeviceappropriateforthechildshallsitin 35theareabehindthefrontseatofthemotorvehicleunlessthemotorvehicleisdesignedonly 36forafrontseatarea.Thedrivertransportingchildrenreferredtointhissubsectionisnotin 37violationofthissection]. 38 39Thissubsectionshallonlyapplytotheuseofachildpassengerrestraintsystemorvehicle 40safetybeltforchildrenlessthansixteenyearsofagebeingtransportedinamotorvehicle. HCSHB443 3 41 3.Anydriverwhoviolates[subdivision(1),(2),or(3)ofsubsection2of]thissection 42isguiltyofaninfractionand,uponconviction,maybepunishedbyafineofnotmorethan 43fiftydollarsandcourtcosts.[Anydriverwhoviolatessubdivision(4)ofsubsection2ofthis 44sectionshallbesubjecttothepenaltyinsubsection6ofsection307.178.Ifadriverreceivesa 45citationforviolatingsubdivision(1),(2),or(3)ofsubsection2ofthissection,thecharges 46shallbedismissedorwithdrawnifthedriverpriortoorathisorherhearingprovides 47evidenceofacquisitionofachildpassengerrestraintsystemorchildboosterseatwhichis 48satisfactorytothecourtorthepartyresponsibleforprosecutingthedriver'scitation.] 49 4.Theprovisionsofthissectionshallnotapplytoanypubliccarrierforhire.The 50provisionsofthissectionshallnotapplytostudentsfouryearsofageorolderwhoare 51passengersonaschoolbusdesignedforcarryingelevenpassengersormoreandwhichis 52manufacturedorequippedpursuanttoMissouriMinimumStandardsforSchoolBusesas 53schoolbusesaredefinedinsection301.010. 54 5.Thehighwaysandtransportationcommissionshallinitiateanddevelopaprogram 55ofpublicinformationtodevelopunderstandingof,andensurecompliancewith,the 56provisionsofthissection. 307.380.1.Everyvehicleofthetyperequiredtobeinspecteduponhavingbeen 2involvedinanaccidentandwhensodirectedbyapoliceofficermustbeinspectedandan 3officialcertificateofinspectionandapproval,sticker,sealorotherdevicebeobtainedfor 4suchvehiclebeforeitisagainoperatedonthehighwaysofthisstate. 5 2.Attheseller'sexpenseeveryusedmotorvehicleofthetyperequiredtobe 6inspectedbysection307.350shallimmediatelypriortosalebefullyinspectedregardlessof 7anycurrentcertificateofinspectionandapproval,andanappropriatenewcertificateof 8inspectionandapproval,sticker,sealorotherdeviceshallbeobtainednomorethansixty 9dayspriortothedateofsale.Suchinspectionshallnotberequiredforamotorvehicle 10havinglessthanfortythousandmilesforthethree-yearperiodfollowingthemodelyear 11ofmanufacture.Thesellershallpresentthecertificateofinspectionandapprovaltothe 12buyeratthepointofsaleandthebuyershallberequiredtosubmitthecertificateof 13inspectionwhenapplyingforregistrationofthevehicle. 14 [2.]3.Nothingcontainedintheprovisionsofthissectionshallbeconstruedto 15prohibitadealeroranyotherpersonfromsellingavehiclewithoutacertificateofinspection 16andapprovalifthevehicleissoldforjunk,salvage,orforrebuilding,orforvehiclessoldat 17publicauctionorfromdealertodealer.Thepurchaserofanyvehiclewhichispurchasedfor 18junk,salvage,orforrebuildingshallgivetotheselleranaffidavit,onaformprescribedbythe 19superintendentoftheMissouristatehighwaypatrol,statingthatthevehicleisbeing 20purchasedforoneofthereasonsstatedherein.Novehicleofthetyperequiredtobeinspected 21bysection307.350whichispurchasedasjunk,salvage,orforrebuildingshallagainbe HCSHB443 4 22registeredinthisstateuntiltheownerhassubmittedthevehicleforinspectionandobtained 23anofficialcertificateofinspectionandapproval,sticker,sealorotherdeviceforsuchvehicle. 24 [3.]4.Notwithstandingtheprovisionsofsection307.390,violationofthissection 25shallbedeemedaninfraction. ✔ HCSHB443 5
