218 (b)Therespondentshallhavetheburdenofprovingbyclearandconvincing 219evidencethattherespondentdoesnotposeasignificantdangerofcausingpersonal 220injurytohimselforherselforothersbyhavinginhisorhercustodyorcontrol, 221purchasing,possessing,orreceivingafirearmorammunition.Thecourtmayconsider 222anyrelevantevidence,includingevidenceoftheconsiderationslistedinsubdivision(3) 223ofsubsection3ofthissection; HB458 9 310 (6)Upontheissuanceofariskprotectionorder,thecourtshallorderanew 311hearingdateandrequiretherespondenttoappearnolaterthanthreebusinessdays 312aftertheissuanceoftheorder.Thecourtshallrequireproofthattherespondenthas 313surrenderedanyfirearmsorammunitionownedbytherespondentintherespondent’s 314custody,control,orpossession.Thecourtmaycancelthehearinguponasatisfactory 315showingthattherespondentisincompliancewiththeorder. 316 (7)Alllawenforcementagenciesshalldeveloppoliciesandproceduresregarding 317theacceptance,storage,andreturnoffirearms,ammunition,orlicensesrequiredtobe 318surrenderedunderthissection. 319 8.(1)Ifariskprotectionorderisvacatedorendswithoutextension,alaw 320enforcementagencyholdingafirearmoranyammunitionownedbytherespondentora 321licensetocarryaconcealedweaponorfirearmissuedundersections571.101to571.126 322orsections571.205to571.230,heldbytherespondent,thathasbeensurrenderedor 323seizedpursuanttothissectionshallreturnsuchsurrenderedfirearm,ammunition,or 324licensetocarryaconcealedweaponorfirearmissuedundersections571.101to571.126 325orsections571.205to571.230,asrequestedbyarespondentonlyafterconfirming 326throughabackgroundcheckthattherespondentiscurrentlyeligibletoownorpossess 327firearmsandammunitionunderfederalandstatelawandafterconfirmingwiththe 328courtthattheriskprotectionorderhasbeenvacatedorhasendedwithoutextension. 329 (2)Ifariskprotectionorderisvacatedorendswithoutextensionandthesheriff 330thatissuedtheconcealedcarrypermithassuspendedalicensetocarryaconcealed 331weaponorfirearmpursuanttothissection,thesheriffshallreinstatesuchlicenseonly 332afterconfirmingthattherespondentiscurrentlyeligibletohavealicensetocarrya 333concealedweaponorfirearmpursuantsections571.101to571.126orsections571.205to 334571.230. 335 (3)Alawenforcementagencyshallprovidenoticetoanyfamilyorhousehold 336membersoftherespondentbeforethereturnofanysurrenderedfirearmand 337ammunitionownedbytherespondent. 338 (4)Anyfirearmandammunitionsurrenderedbyarespondentpursuantto 339subsection7ofthissectionthatremainsunclaimedforoneyearbythelawfulowner 340afteranordertovacatetheriskprotectionordershallbedisposedofinaccordancewith 341thelawenforcementagency’spoliciesandproceduresforthedisposaloffirearmsin 342policecustody. 343 9.Arespondentmayelecttotransferallfirearmsandammunitionownedbythe 344respondentthathavebeensurrenderedtoorseizedbyalocallawenforcementagency 345pursuanttosubsection7ofthissectiontoanotherpersonwhoiswillingtoreceivethe HB458 10 346respondent'sfirearmsandammunition.Thelawenforcementagencyshallallowsucha 347transferonlyifitisdeterminedthatthechosenrecipient: 348 (1)Currentlyiseligibletoownorpossessafirearmandammunitionunder 349federalandstatelawafterconfirmationthroughabackgroundcheck; 350 (2)Atteststostoringthefirearmsandammunitioninamannersuchthatthe 351respondentdoesnothaveaccesstoorcontrolofthefirearmsandammunitionuntilthe 352riskprotectionorderagainsttherespondentisvacatedorendswithoutextension;and 353 (3)Attestsnottotransferthefirearmsorammunitionbacktotherespondent 354untiltheriskprotectionorderagainsttherespondentisvacatedorendswithout 355extension. 356 10.(1)Withintwenty-fourhoursafterissuance,theclerkofthecourtshallenter 357anyriskprotectionorderortemporaryexparteriskprotectionorderissuedunderthis 358sectionintotheuniformcasereportingsystem. 359 (2)Withintwenty-fourhoursafterissuance,theclerkofthecourtshallforward 360acopyofanorderissuedunderthissectiontotheappropriatelawenforcementagency 361specifiedintheorder.Uponreceiptofthecopyoftheorder,thelawenforcementagency 362shallentertheorderintotheMissouriUniformLawEnforcementSystem(MULES) 363andtheNationalCrimeInformationCenter(NCIC).Theordershallremainineach 364systemfortheperiodstatedintheorder,andthelawenforcementagencymayonly 365removeanorderfromthesystemsthathasendedorbeenvacated.Entryoftheorder 366intotheMULESandNCICconstitutesnoticetoalllawenforcementagenciesofthe 367existenceoftheorder.Theorderisfullyenforceableinanycountyinthisstate. 368 (3)Theissuingcourtshall,withinthreebusinessdaysafterissuanceofarisk 369protectionorderortemporaryexparteriskprotectionorder,forwardallavailable 370identifyinginformationconcerningtherespondent,alongwiththedateoforder 371issuance,tothesheriffofthecountyinwhichtherespondentresides.Uponreceiptof 372theinformation,thesheriffshalldetermineiftherespondenthasalicensetocarrya 373concealedweaponorfirearm.Iftherespondentdoeshavealicensetocarryaconcealed 374weaponorfirearm,thesheriffshallimmediatelysuspendthelicense. 375 (4)Ifariskprotectionorderisvacatedbeforeitsenddate,theclerkofthecourt 376shall,onthedayoftheordertovacate,forwardacopyoftheordertothesheriffofthe 377countyinwhichtherespondentresidesandanyotherlawenforcementagencyspecified 378intheordertovacate.Uponreceiptoftheorder,thelawenforcementagencyshall 379promptlyremovetheorderfromanycomputer-basedsysteminwhichitwasentered 380pursuanttosubdivision(2)ofthissubsection. HB458 11 381 11.(1)Apersonwhomakesafalsestatement,whichheorshedoesnotbelieveto 382betrue,underoathinahearingunderthissectioninregardtoanymaterialmatteris 383guiltyofaclassEfelony. 384 (2)Apersonwhohasinhisorhercustodyorcontrolafirearmorany 385ammunitionorwhopurchases,possesses,orreceivesafirearmoranyammunitionwith 386knowledgethatheorsheisprohibitedfromdoingsobyanorderissuedunderthis 387sectionisguiltyofaclassEfelony. 388 12.Thissectiondoesnotaffecttheabilityofalawenforcementofficertoremove 389afirearmorammunitionorlicensetocarryaconcealedweaponorconcealedfirearm 390fromanypersonortoconductanysearchandseizureforfirearmsorammunition 391pursuanttootherlawfulauthority. 392 13.Exceptasprovidedinsubsection8or11ofthissection,thissectiondoesnot 393imposecriminalorcivilliabilityonanypersonorentityforactsoromissionsrelatedto 394obtainingariskprotectionorderortemporaryexparteriskprotectionorderincluding, 395butnotlimitedto,providingnoticetothepetitioner,afamilyorhouseholdmemberof 396therespondent,andanyknownthirdpartywhomaybeatriskofviolenceorfailureto 397providesuchnotice,orreporting,decliningtoreport,investigating,decliningto 398investigate,filing,ordecliningtofile,apetitionunderthissection. 399 14.(1)Theofficeofthestatecourtsadministratorshalldevelopandprepare 400instructionsandinformationalbrochures,standardpetitionsandriskprotectionorder 401forms,andacourtstaffhandbookontheriskprotectionorderprocess.Thestandard 402petitionandorderformsshallbeusedafterJanuary1,2024,forallpetitionsfiledand 403ordersissuedpursuanttothissection.Theofficeshalldeterminethesignificantnon- 404English-speakingorlimitedEnglish-speakingpopulationsinthestateandpreparethe 405instructionsandinformationalbrochuresandstandardpetitionsandriskprotection 406orderformsinsuchlanguages.Theinstructions,brochures,forms,andhandbookshall 407bepreparedinconsultationwithinterestedpersons,includingrepresentativesofgun 408violencepreventiongroups,judges,andlawenforcementpersonnel.Materialsshallbe 409basedonbestpracticesandshallbeavailableonlinetothepublic,and: 410 (a)Theinstructionsshallbedesignedtoassistpetitionersincompletingthe 411petitionandshallincludeasampleofastandardpetitionandorderforprotection 412forms; 413 (b)Theinstructionsandstandardpetitionshallincludeameansforthe 414petitionertoidentify,withonlylayman’sknowledge,thefirearmsorammunitionthe 415respondentmayown,possess,receive,orhaveinhisorhercustodyorcontrol.The 416instructionsshallprovidepicturesoftypesoffirearmsandammunitionthatthe 417petitionermaychoosefromtoidentifytherelevantfirearmsorammunition,orshall HB458 12 418provideanequivalentmeanstoallowpetitionerstoidentifyfirearmsorammunition 419withoutrequiringspecificortechnicalknowledgeregardingthefirearmsor 420ammunition; 421 (c)Theinformationalbrochureshalldescribetheuseofandtheprocessfor 422obtaining,extending,andvacatingariskprotectionorderunderthissectionandshall 423providerelevantforms; 424 (d)Theriskprotectionorderformshallinclude,inaconspicuouslocation, 425noticeofcriminalpenaltiesresultingfromviolationoftheorderandthefollowing 426statement:"Youhavethesoleresponsibilitytoavoidorrefrainfromviolatingthis 427order’sprovisions.Onlythecourtcanchangetheorderandonlyuponwritten 428request.";and 429 (e)Thecourtstaffhandbookshallallowfortheadditionofacommunity 430resourcelistbytheclerkofthecourt. 431 (2)Anyclerkofacourtmaycreateacommunityresourcelistofcrisis 432intervention,mentalhealth,substanceabuse,interpreter,counseling,andotherrelevant 433resourcesservingthecountyinwhichthecourtislocated.Thecourtmaymakethe 434communityresourcelistavailableaspartoforinadditiontotheinformational 435brochuresdescribedinsubdivision(1)ofthissubsection. 436 (3)Theofficeofthestatecourtsadministratorshalldistributeamastercopyof 437thepetitionandorderforms,instructions,andinformationalbrochurestotheclerksof 438court.Distributionofalldocumentsshall,ataminimum,beinanelectronicformator 439formatsaccessibletoallcourtsandclerksofcourtinthestate. 440 (4)Withinninetydaysafterreceiptofthemastercopyfromtheofficeofthe 441statecourtsadministrator,theclerkofthecourtshallmakeavailablethestandardized 442forms,instructions,andinformationalbrochuresrequiredbythissubsection. 443 (5)Theofficeofthestatecourtsadministratorshallupdatetheinstructions, 444brochures,standardpetitionandriskprotectionorderforms,andcourtstaffhandbook 445asnecessary,includingwhenchangesinthelawmakeanupdatenecessary. ✔ HB458 13
