sectionrelatingtothesecondamendmentpreservationact.
BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Sections1.450,1.460,and1.470,RSMo,arerepealedandonenewsection
2enactedinlieuthereof,tobeknownassection1.450,toreadasfollows:
1.450.[Noentityorperson,includinganypublicofficeroremployeeofthisstateor
2anypoliticalsubdivisionofthisstate,shallhavetheauthoritytoenforceorattempttoenforce
3anyfederalacts,laws,executiveorders,administrativeorders,rules,regulations,statutes,or
4ordinancesinfringingontherighttokeepandbeararmsasdescribedundersection1.420.]
5Nothinginsections1.410to1.480shallbeconstruedtoprohibitMissouriofficialsfrom
6acceptingaidfromfederalofficialsinanefforttoenforceMissourilaws.
[1.460.1.Anypoliticalsubdivisionorlawenforcementagencythat
2 employsalawenforcementofficerwhoactsknowingly,asdefinedunder
3 section562.016,toviolatetheprovisionsofsection1.450orotherwise
4 knowinglydeprivesacitizenofMissourioftherightsorprivilegesensuredby
5 AmendmentIIoftheConstitutionoftheUnitedStatesorArticleI,Section23
6 oftheConstitutionofMissouriwhileactingunderthecolorofanystateor
7 federallawshallbeliabletotheinjuredpartyinanactionatlaw,suitinequity,
8 orotherproperproceedingforredress,andsubjecttoacivilpenaltyoffifty
9 thousanddollarsperoccurrence.Anypersoninjuredunderthissectionshall
10 havestandingtopursueanactionforinjunctivereliefinthecircuitcourtofthe
11 countyinwhichtheactionallegedlyoccurredorinthecircuitcourtofCole
12 Countywithrespecttotheactionsofsuchindividual.Thecourtshallholda
13 hearingonthemotionfortemporaryrestrainingorderandpreliminary
14 injunctionwithinthirtydaysofserviceofthepetition.

2 knowinglyemploysanindividualactingorwhopreviouslyactedasanofficial,
3 agent,employee,ordeputyofthegovernmentoftheUnitedStates,or
4 otherwiseactedunderthecoloroffederallawwithinthebordersofthisstate,
5 whohasknowingly,asdefinedundersection562.016,aftertheadoptionof
6 thissection:
7 (1)Enforcedorattemptedtoenforceanyoftheinfringements
8 identifiedinsection1.420;or
9 (2)Givenmaterialaidandsupporttotheeffortsofanotherwho
10 enforcesorattemptstoenforceanyoftheinfringementsidentifiedinsection
11 1.420;

13 shallbesubjecttoacivilpenaltyoffiftythousanddollarsperemployeehired
14 bythepoliticalsubdivisionorlawenforcementagency.Anypersonresiding
15 inajurisdictionwhobelievesthatanindividualhastakenactionthatwould
16 violatetheprovisionsofthissectionshallhavestandingtopursueanaction.
17 2.Anypersonresidingorconductingbusinessinajurisdictionwho
18 believesthatanindividualhastakenactionthatwouldviolatetheprovisionsof
19 thissectionshallhavestandingtopursueanactionforinjunctivereliefinthe
20 circuitcourtofthecountyinwhichtheactionallegedlyoccurredorinthe
21 circuitcourtofColeCountywithrespecttotheactionsofsuchindividual.
22 Thecourtshallholdahearingonthemotionforatemporaryrestrainingorder
23 andpreliminaryinjunctionwithinthirtydaysofserviceofthepetition.
