BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Chapter565,RSMo,isamendedbyaddingtheretoonenewsection,tobe 2knownassection565.260,toreadasfollows: 565.260.1.Exceptasprovidedinsubsection2ofthissection,apersoncommits 2theoffenseofunlawfultrackingofamotorvehicleifthepersonknowinglyinstalls, 3conceals,orotherwiseplacesanelectronictrackingdeviceinoronamotorvehicle 4withouttheconsentofallownersofthevehicleforthepurposeofmonitoringor 5followinganoccupantoroccupantsofthevehicle.Asusedinthissection,"person"does 6notincludethemanufacturerofthemotorvehicle. 7 2.(1)Itshallnotbeanoffenseunderthissectioniftheinstalling,concealing,or 8placingofanelectronictrackingdeviceinoronamotorvehicleisby,oratthedirection 9of,alawenforcementofficerinfurtheranceofacriminalinvestigationandsuch 10investigationiscarriedoutinaccordancewithapplicablestateandfederallaw. 11 (2)Iftheinstalling,concealing,orplacingofanelectronictrackingdeviceinor 12onamotorvehicleisby,oratthedirectionof,aparentorlegalguardianwhoownsor 13leasesthevehicle,andifthedeviceisusedsolelyforthepurposeofmonitoringthe 14minorchildoftheparentorlegalguardianwhenthechildisanoccupantofthevehicle, 15theinstallation,concealment,orplacementofthedeviceinoronthevehiclewithoutthe 16consentofanyoralloccupantsofthevehicleshallnotbeanoffenseunderthissection. EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 (3)Itshallnotbeanoffenseunderthissectioniftheinstalling,concealing,or 18placingofanelectronictrackingdeviceinoronamotorvehicleisforthepurposeof 19trackingthelocationofstolengoodsbeingtransportedinthevehicleorforthepurpose 20oftrackingthelocationofthevehicleifthemotorvehicleisstolen. 21 (4)Itshallnotbeanoffenseunderthissectioniftheinstalling,concealing,or 22placingofanelectronictrackingdeviceinoronamotorvehicleisbyalienholderor 23agentofalienholderactingtotrackthemovementorlocationofamotorvehiclein 24ordertorepossessthemotorvehicle. 25 (5)Itshallnotbeanoffenseunderthissectioniftheinstalling,concealing,or 26placingofanelectronictrackingdeviceinoronamotorvehicleisbyalegally 27authorizedrepresentativeofavulnerableadult.Asusedinthissubdivision, 28"vulnerableadult"meansanypersoneighteenyearsofageorolderwhoisimpaired 29byreasonofmentalillness,intellectualordevelopmentaldisability,physicalillnessor 30disability,orothercauses,includingage,totheextenttheadultlackssufficient 31understandingorcapacitytomake,communicate,orcarryoutreasonabledecisions 32concerninghisorherwell-beingorhasoneormorelimitationsthatsubstantiallyimpair 33theadult'sabilitytoindependentlyprovideforhisorherdailyneedsorsafeguardhisor 34herperson,property,orlegalinterests. 35 (6)Itshallnotbeanoffenseunderthissectioniftheinstalling,concealing,or 36placingofanelectronictrackingdeviceinoronamotorvehicleisbyacompanythat 37rentsmotorvehiclesforthepurposeoftrackingthemotorvehiclesownedbysuch 38company. 39 (7)Itshallnotbeanoffenseunderthissectioniftheinstalling,concealing,or 40placingofanelectronictrackingdeviceinoronamotorvehicleisbyaprivate 41investigatoriftheprivateinvestigatorobtainsconsentfromallpersonswhoownorlease 42themotorvehicle. 43 3.Theprovisionsofthissectionshallnotapplytoatrackingsysteminstalledby 44themanufacturerofamotorvehicle. 45 4.TheoffenseofunlawfultrackingofamotorvehicleisaclassBmisdemeanor. ✔ HB531 2
