191.430.1.Thereisherebyestablishedwithinthedepartmentofhealthand
2seniorservicesthe"HealthProfessionalLoanRepaymentProgram"toprovide
3forgivableloansforthepurposeofrepayingexistingloansrelatedtoapplicable
4educationalexpensesforhealthcare,mentalhealth,andpublichealthprofessionals.
5Thedepartmentofhealthandseniorservicesshallbetheadministrativeagencyforthe
6implementationoftheprogramestablishedbythissection.
7 2.Thedepartmentofhealthandseniorservicesshallprescribetheformandthe
8timeandmethodoffilingapplicationsandsupervisetheprocessing,includingoversight
9andmonitoringoftheprogram,andshallpromulgaterulestoimplementtheprovisions

11section536.010,thatiscreatedundertheauthoritydelegatedinthissectionshall
12becomeeffectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter
13536and,ifapplicable,section536.028.Thissectionandchapter536arenonseverable
14andifanyofthepowersvestedwiththegeneralassemblypursuanttochapter536to
15review,todelaytheeffectivedate,ortodisapproveandannularulearesubsequently
16heldunconstitutional,thenthegrantofrulemakingauthorityandanyruleproposedor
17adoptedafterAugust28,2023,shallbeinvalidandvoid.
18 3.Thedirectorofthedepartmentofhealthandseniorservicesshallhavethe
19discretiontodeterminethehealthprofessionalsandpractitionerswhowillreceive
20forgivablehealthprofessionalloansfromthedepartmenttopaytheirexistingloans.
21Thedirectorshallmakesuchdeterminationseachfiscalyearbasedonevidence
22associatedwiththegreatestneedsinthebestinterestsofthepublic.Thehealthcare,
23mentalhealth,andpublichealthprofessionalsordisciplinesfundedinanygivenyear
24shallbecontingentuponconsultationwiththeofficeofworkforcedevelopmentinthe
25departmentofhighereducationandworkforcedevelopmentandthedepartmentof
26mentalhealth,ortheirsuccessoragencies.
27 4.Thedepartmentofhealthandseniorservicesshallenterintoacontractwith
28eachselectedapplicantwhoreceivesahealthprofessionalloanunderthissection.Each
29selectedapplicantshallapplytheloanawardtohisorhereducationaldebt.The
30contractshalldetailthemethodsofforgivenessassociatedwithaserviceobligationand
31thetermsassociatedwiththeprincipalandinterestaccruingontheloanatthetimeof
32theaward.Thecontractshallcontaindetailsconcerninghowforgivenessisearned,
33includingwhenpartialforgivenessisearnedthroughaserviceobligation,andtheterms
34andconditionsassociatedwithrepaymentoftheloansforanyobligationnotserved.
35 5.Allhealthprofessionalloansshallbemadefromfundsappropriatedbythe
36generalassemblytothehealthprofessionalloanincentivefundestablishedinsection
37191.445.
191.435.Thedepartmentofhealthandseniorservicesshalldesignatecounties,
2communities,orsectionsofareasinthestateasareasofdefinedneedforhealthcare,
3mentalhealth,andpublichealthservices.Ifacounty,community,orsectionofanarea
4hasbeendesignatedordeterminedasaprofessionalshortagearea,ashortagearea,ora
5healthcare,mentalhealth,orpublichealthprofessionalshortageareabythefederal
6DepartmentofHealthandHumanServicesoritssuccessoragency,thedepartmentof
7healthandseniorservicesshalldesignateitasanareaofdefinedneedunderthissection.
8Ifthedirectorofthedepartmentofhealthandseniorservicesdeterminesthatacounty,
9community,orsectionofanareahasanextraordinaryneedforhealthcareprofessional
HB542	2 10serviceswithoutacorrespondingsupplyofsuchprofessionals,thedepartmentofhealth
11andseniorservicesmaydesignateitasanareaofdefinedneedunderthissection.
191.440.1.Thedepartmentofhealthandseniorservicesshallenterintoa
2contractwitheachindividualqualifyingforaforgivableloanundersections191.430to
3191.450.Thewrittencontractbetweenthedepartmentandtheindividualshallcontain,
4butnotbelimitedto,thefollowing:
5 (1)Anagreementthatthestateagreestoawardaloanandtheindividualagrees
6toserveforaperiodequaltotwoyears,oralongerperiodastheindividualmayagree
7to,inanareaofdefinedneedasdesignatedbythedepartment,withsuchserviceperiod
8tobeginonthedateidentifiedonthesignedcontract;
9 (2)Aprovisionthatanyfinancialobligationsarisingoutofacontractentered
10intoandanyobligationoftheindividualthatisconditionedthereoniscontingentupon
11fundsbeingappropriatedforloans;
12 (3)Theareaofdefinedneedwherethepersonwillpractice;
13 (4)Astatementofthedamagestowhichthestateisentitledfortheindividual's

17 2.Thedepartmentofhealthandseniorservicesmaystipulatespecificpractice
18sites,contingentupondepartment-generatedhealthcare,mentalhealth,andpublic
19healthprofessionalneedpriorities,whereapplicantsshallagreetopracticeforthe
20durationoftheirparticipationintheprogram.
191.445.Thereisherebycreatedinthestatetreasurythe"HealthProfessional
2LoanIncentiveFund",whichshallconsistofanyappropriationsmadebythegeneral
3assembly,allfundsrecoveredfromanindividualundersection191.450,andallfunds
4generatedbyloanrepaymentsreceivedundersections191.430to191.450.Thestate
5treasurershallbecustodianofthefund.Inaccordancewithsections30.170and30.180,
6thestatetreasurermayapprovedisbursements.Thefundshallbeadedicatedfundand,
7uponappropriation,moneysinthisfundshallbeusedsolelybythedepartmentof
8healthandseniorservicestoprovideloansundersections191.430to191.450.
9Notwithstandingtheprovisionsofsection33.080tothecontrary,anymoneys
10remaininginthefundattheendofthebienniumshallnotreverttothecreditofthe
11generalrevenuefund.Thestatetreasurershallinvestmoneysinthefundinthesame
12mannerasotherfundsareinvested.Anyinterestandmoneysearnedonsuch
13investmentsshallbecreditedtothefund.
191.450.1.Anindividualwhoentersintoawrittencontractwiththe
2departmentofhealthandseniorservices,asdescribedinsection191.440,andwhofails
HB542	3 3tomaintainanacceptableemploymentstatusshallbeliabletothestateforanyamount
4awardedasaloanbythedepartmentdirectlytotheindividualwhoenteredintothe
5contractthathasnotyetbeenforgiven.
6 2.Anindividualfailstomaintainanacceptableemploymentstatusunderthis
7sectionwhenthecontractedindividualinvoluntarilyorvoluntarilyterminates
8qualifyingemployment,isdismissedfromsuchemploymentbeforecompletionofthe
9contractualserviceobligationwithinthespecifictimeframeoutlinedinthecontract,or
10failstorespondtorequestsmadebythedepartment.
11 3.Ifanindividualbreachesthewrittencontractoftheindividualbyfailingto
12beginorcompletesuchindividual'sserviceobligation,thestateshallbeentitledto
13recoverfromtheindividualanamountequaltothesumof:
14 (1)Thetotalamountoftheloanawardedbythedepartmentor,ifthe
15departmenthadalreadyawardedpartialforgivenessatthetimeofthebreach,the
16amountoftheloannotyetforgiven;
17 (2)Theinterestontheamountthatwouldbepayableifatthetimetheloanwas
18awardeditwasaloanbearinginterestatthemaximumprevailingrateasdeterminedby
19theTreasureroftheUnitedStates;
20 (3)Anamountequaltoanydamagesincurredbythedepartmentasaresultof
21thebreach;and
22 (4)Anylegalfeesorassociatedcostsincurredbythedepartmentorthestateof
23Missouriinthecollectionofdamages.
191.600.1.Sections191.600to191.615establishaloanrepaymentprogramfor
2graduatesofapprovedmedicalschools,schoolsofosteopathicmedicine,schoolsofdentistry
3andaccreditedchiropracticcollegeswhopracticeinareasofdefinedneedandshallbeknown
4asthe"HealthProfessionalStudentLoanRepaymentProgram".Sections191.600to191.615
5shallapplytograduatesofaccreditedchiropracticcollegeswhenfederalguidelinesfor
6chiropracticshortageareasaredeveloped.
7 2.The"HealthProfessionalStudentLoanandLoanRepaymentProgramFund"is
8herebycreatedinthestatetreasury.Allfundsrecoveredfromanindividualpursuantto
9section191.614andallfundsgeneratedbyloanrepaymentsandpenaltiesreceivedpursuant
10tosection191.540shallbecreditedtothefund.Themoneysinthefundshallbeusedbythe
11departmentofhealthandseniorservicestoprovideloanrepaymentspursuanttosection
12191.611inaccordancewithsections191.600to191.614[andtoprovideloanspursuantto
13sections191.500to191.550].

17subsections2,3,and4ofthissection.Suchpilotprojectshallbeknownasthe"Alt-care"
18program.Inaddition,someoftheproceedsdepositedtothehealthinitiativesfundpursuantto
19sections149.015and149.160shallbeappropriatedannuallytothedivisionofalcoholand
20drugabuseofthedepartmentofmentalhealthtobeusedfortheadministrationandoversight
21ofthesubstanceabusetraffic[offenders] offenderprogramdefinedinsection302.010[and
22section577.001]. Theprovisionsofsection33.080tothecontrarynotwithstanding,moneyin
23thehealthinitiativesfundshallnotbetransferredatthecloseofthebienniumtothegeneral
24revenuefund.
25 2.Thedirectorofthedivisionofalcoholanddrugabuseandthedirectorofthe
26departmentofcorrectionsshalldevelopandadministerapilotprojecttoprovidea
27comprehensivesubstanceabusetreatmentandrehabilitationprogramasanalternativeto
28incarceration,hereinafterreferredtoas"Alt-care".Alt-careshallbefundedusingmoney
29providedundersubsection1ofthissectionthroughtheMissouriMedicaidprogram,theC-
30STARprogramofthedepartmentofmentalhealth,andthedivisionofalcoholanddrug
31abuse'spurchase-of-servicesystem.Alt-careshallofferaflexiblecombinationofclinical
32servicesandlivingarrangementsindividuallyadaptedtoeachclientandherchildren.Alt-
33careshallconsistofthefollowingcomponents:
34 (1)Assessmentandtreatmentplanning;
35 (2)Communitysupporttoprovidecontinuity,monitoringofprogressandaccessto
36servicesandresources;
37 (3)Counselingfromindividualtofamilytherapy;
38 (4)Daytreatmentserviceswhichincludeaccessibilitysevendaysperweek,
39transportationtoandfromtheAlt-careprogram,weeklydrugtesting,leisureactivities,
40weeklyeventsforfamiliesandcompanions,jobandeducationpreparednesstraining,peer
41supportandself-helpanddailylivingskills;and
42 (5)Livingarrangementoptionswhicharepermanent,substance-freeandconducive
43totreatmentandrecovery.
44 3.Anyfemalewhoispregnantoristhecustodialparentofachildorchildrenunder
45theageoftwelveyears,andwhohaspleadedguiltytoorfoundguiltyofviolatingthe
46provisionsofchapter195,andwhosecontrolledsubstanceabusewasaprecipitatingor
47contributingfactorinthecommissionoftheoffense,andwhoisplacedonprobationmaybe
48required,asaconditionofprobation,toparticipateinAlt-care,ifspaceisavailableinthe
49pilotprojectarea.Determinationsofeligibilityfortheprogram,placement,andcontinued
50participationshallbemadebythedivisionofalcoholanddrugabuse,inconsultationwiththe
51departmentofcorrections.
HB542	6 52 4.TheavailabilityofspaceinAlt-careshallbedeterminedbythedirectorofthe
53divisionofalcoholanddrugabuseinconjunctionwiththedirectorofthedepartmentof
54corrections.Ifthesentencingcourtisadvisedthatthereisnospaceavailable,thecourtshall
55considerotherauthorizeddispositions.
335.203.1.Thereisherebyestablishedthe"NursingEducationIncentiveProgram"
2withinthestateboardofnursing.
3 2.Subjecttoappropriationandboarddisbursement,grantsshallbeawardedthrough
4thenursingeducationincentiveprogramtoeligibleinstitutionsofhighereducationbasedon
5criteriajointlydeterminedbytheboardandthedepartmentofhighereducationandworkforce
6development.[Grantawardamountsshallnotexceedonehundredfiftythousanddollars.]
7Nocampusshallreceivemorethanonegrantperyear.
8 3.Tobeconsideredforagrant,aneligibleinstitutionofhighereducationshalloffera
9programofnursingthatmeetsthepredeterminedcategoryandareaofneedasestablishedby
10theboardandthedepartmentundersubsection4ofthissection.
11 4.Theboardandthedepartmentshalldeterminecategoriesandareasofneedfor
12designatinggrantstoeligibleinstitutionsofhighereducation.Inestablishingcategoriesand
13areasofneed,theboardanddepartmentmayconsidercriteriaincluding,butnotlimitedto:
14 (1)Datageneratedfromlicensurerenewaldataandthedepartmentofhealthand
15seniorservices;and
16 (2)Nationalnursingstatisticaldataandtrendsthathaveidentifiednursingshortages.
17 5.Theboardshallbetheadministrativeagencyresponsibleforimplementationofthe
18programestablishedundersections335.200to335.203,andshallpromulgatereasonable
19rulesfortheexerciseofitsfunctionsandtheeffectuationofthepurposesofsections335.200
20to335.203.Theboardshall,byrule,prescribetheform,time,andmethodoffiling
21applicationsandshallsupervisetheprocessingofsuchapplications.
22 6.Anyruleorportionofarule,asthattermisdefinedinsection536.010,thatis
23createdundertheauthoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplies
24withandissubjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.
25Thissectionandchapter536arenonseverableandifanyofthepowersvestedwiththe
26generalassemblypursuanttochapter536toreview,todelaytheeffectivedate,orto
27disapproveandannularulearesubsequentlyheldunconstitutional,thenthegrantof
28rulemakingauthorityandanyruleproposedoradoptedafterAugust28,2011,shallbeinvalid
29andvoid.
335.205.Theboard,inadditiontoanyotherdutiesitmayhaveregarding
2licensureofnurses,shallcollect,atthetimeofanyinitiallicenseapplicationorlicense
3renewalapplication,anursingeducationincentiveprogramsurchargefromeachperson
4licensedorrelicensedunderchapter335,intheamountofonedollarperyearfor

6fundsshallbedepositedinthestateboardofnursingfunddescribedinsection335.036.

2 clearlyindicatesotherwise,thefollowingtermsmean:
3 (1)"Areaofdefinedneed",acommunityorsectionofanurbanareaof
4 thisstatewhichiscertifiedbythedepartmentofhealthandseniorservicesas
5 beinginneedoftheservicesofaphysiciantoimprovethepatient-doctorratio
6 inthearea,tocontributeprofessionalphysicianservicestoanareaof
7 economicimpact,ortocontributeprofessionalphysicianservicestoanarea
8 sufferingfromtheeffectsofanaturaldisaster;

2 thousanddollarsforeachacademicyear,whichshallrunfromAugustfirstof
3 anyyearthroughJulythirty-firstofthefollowingyear.Allloansshallbe
4 madefromfundsappropriatedtothemedicalschoolloanandloanrepayment
5 programfundcreatedbysection191.600,bythegeneralassembly.]
[191.525.Nomorethantwenty-fiveloansshallbemadetoeligible
2 studentsduringthefirstacademicyearthisprogramisineffect.Twenty-five
3 newloansmaybemadeforthenextthreeacademicyearsuntilatotalofone
4 hundredloansareavailable.Atleastone-halfoftheloansshallbemadeto
5 studentsfromruralareasasdefinedinsection191.500.Aneligiblestudent
6 mayreceiveloansforeachacademicyearheispursuingacourseofstudy
7 directlyleadingtoadegreeofdoctorofmedicineordoctorofosteopathy,
