46 2.Thedepartmentoftransportationoranylawenforcementofficerwithinthe
47officer'sjurisdictionmayimmediatelyremoveanyabandoned,unattended,wrecked,burned
48orpartiallydismantledproperty,spilledcargoorotherpersonalpropertyfromtheright-of-
49wayofanyinterstatehighway,freeway,orstatehighwayiftheabandonedproperty,cargoor
50personalpropertyiscreatingatraffichazardbecauseofitspositioninrelationtotheinterstate
51highway,freeway,orstatehighway.Intheeventthepropertycreatingatraffichazardisa
52commercialmotorvehicle,asdefinedinsection302.700,thedepartment'sauthorityunder
53thissubsectionshallbelimitedtoauthorizingatowingcompanytoremovethecommercial

55theowner'sdesignatedrepresentativeshallhaveareasonableopportunitytocontactatowing
56companyofchoice.Theprovisionsofthissubsectionshallnotapplytovehiclestransporting
57anymaterialwhichhasbeendesignatedashazardousunderSection5103(a)ofTitle49,
58U.S.C.
59 3.Anylawenforcementagencyauthorizingatowpursuanttothissectioninwhich
60theabandonedpropertyismovedfromtheimmediatevicinityshallcompleteacrimeinquiry
61andinspectionreport.Anystateorfederalgovernmentagencyotherthanalawenforcement
62agencyauthorizingatowpursuanttothissectioninwhichtheabandonedpropertyismoved
63awayfromtheimmediatevicinityinwhichitwasabandonedshallreportthetowingtothe
64statehighwaypatrolorwaterpatrolwithintwohoursofthetowalongwithacrimeinquiry
65andinspectionreportasrequiredinthissection.Anylocalgovernmentagency,otherthana
66lawenforcementagency,authorizingatowpursuanttothissectionwherepropertyistowed
67awayfromtheimmediatevicinityshallreportthetowtothelocallawenforcementagency
68withintwohoursalongwithacrimeinquiryandinspectionreport.
69 4.Neitherthelawenforcementofficer,governmentagencyofficialnoranyone
70havingcustodyofabandonedpropertyunderhisdirectionshallbeliableforanydamageto
71suchabandonedpropertyoccasionedbyaremovalauthorizedbythissectionorbyordinance
72ofacountyormunicipalitylicensingandregulatingthesaleofabandonedpropertybythe
73municipality,otherthandamagesoccasionedbynegligenceorbywillfulorwantonactsor
74omissions.
75 5.Theownerofabandonedpropertyremovedasprovidedinthissectionorinsection
76304.157shallberesponsibleforpaymentofallreasonablechargesfortowingandstorageof
77suchabandonedpropertyasprovidedinsection304.158.
78 6.Uponthetowingofanyabandonedpropertypursuanttothissectionorunder
79authorityofalawenforcementofficerorlocalgovernmentagencypursuanttosection
80304.157,thelawenforcementagencythatauthorizedsuchtowingorwasproperlynotifiedby
81anothergovernmentagencyofsuchtowingshallpromptlymakeaninquirywiththenational
82crimeinformationcenterandanystatewideMissourilawenforcementcomputersystemto
83determineiftheabandonedpropertyhasbeenreportedasstolenandshallenterthe
84informationpertainingtothetowedpropertyintothestatewidelawenforcementcomputer
85system.Iftheabandonedpropertyisnotclaimedwithintenworkingdaysofthetowing,the
86towerwhohasonlineaccesstothedepartmentofrevenue'srecordsshallmakeaninquiryto
87determinetheabandonedpropertyownerandlienholder,ifany,ofrecord.Intheeventthat
88therecordsofthedepartmentofrevenuefailtodisclosethenameoftheownerorany
89lienholderofrecord,thetowershallcomplywiththerequirementsofsubsection3ofsection
90304.156.Ifthetowerdoesnothaveonlineaccess,thelawenforcementagencyshallsubmita

92nothaveonlineaccesstothedepartment'srecordsandthatisinpossessionofabandoned
93propertyaftertenworkingdaysshallreportsuchfacttothelawenforcementagencywith
94whichthecrimeinquiryandinspectionreportwasfiled.Thecrimeinquiryandinspection
95reportshallbedesignedbythedirectorofrevenueandshallincludethefollowing:
96 (1)Theyear,model,makeandpropertyidentificationnumberofthepropertyandthe
97ownerandanylienholders,ifknown;
98 (2)Adescriptionofanydamagetothepropertynotedbytheofficerauthorizingthe
99tow;
100 (3)Thelicenseplateorregistrationnumberandthestateofissuance,ifavailable;
101 (4)Thestoragelocationofthetowedproperty;
102 (5)Thename,telephonenumberandaddressofthetowingcompany;
103 (6)Thedate,placeandreasonforthetowingoftheabandonedproperty;
104 (7)Thedateoftheinquiryofthenationalcrimeinformationcenter,anystatewide
105Missourilawenforcementcomputersystemandanyothersimilarsystemwhichhastitling
106andregistrationinformationtodetermineiftheabandonedpropertyhadbeenstolen.This
107informationshallbeenteredonlybythelawenforcementagencymakingtheinquiry;
108 (8)Thesignatureandprintednameoftheofficerauthorizingthetow;

110operator,andanindicatordisclosingwhetherthetowerhasonlineaccesstothedepartment's

113 7.Onecopyofthecrimeinquiryandinspectionreportshallremainwiththeagency
114whichauthorizedthetow.Onecopyshallbeprovidedtoandretainedbythestoragefacility
115andonecopyshallberetainedbythetowingfacilityinanaccessibleformatinthebusiness
116recordsforaperiodofthreeyearsfromthedateofthetoworremoval.
117 8.Theownerofsuchabandonedproperty,ortheholderofavalidsecurityinterestof
118record,mayreclaimitfromthetowingcompanyuponproofofownershiporvalidsecurity
119interestofrecordandpaymentofallreasonablechargesforthetowingandstorageofthe
120abandonedproperty.
121 9.Anypersonwhoremovesabandonedpropertyatthedirectionofalawenforcement
122officeroranofficerofagovernmentagencywherethatagency'srealpropertyisconcernedas
123providedinthissectionshallhavealienforallreasonablechargesforthetowingandstorage
124oftheabandonedpropertyuntilpossessionoftheabandonedpropertyisvoluntarily
125relinquishedtotheowneroftheabandonedpropertyortotheholderofavalidsecurity
126interestofrecord.Suchlienshallbeenforcedinthemannerprovidedundersection

HCSHB543	4 128 10.Anypersonalpropertywithin[the]abandonedproperty[neednot]removedas
129providedinthissectionorinsection304.157shallbereleasedtotheownerthereof[until
130thereasonableoragreedchargesforsuchrecovery,transportationorsafekeepinghavebeen
131paidorsatisfactoryarrangementsforpaymenthavebeenmade,exceptthat],includingbut
132notlimitedtoanymedicationprescribedbyaphysician[shallbereleasedtotheowner
133thereofuponrequest]. Thecompanyholdingorstoringtheabandonedpropertyshall[either]
134releasethepersonalpropertytotheowneroftheabandonedproperty[orallowtheownerto
135inspectthepropertyand]whenrequested.However,thecompanyholdingorstoringthe
136abandonedpropertymayrequirethattheowneroftheabandonedpropertycomplete
137documentationevidencingthereleaseofthepersonalpropertytosuchownerandshall
138provideanitemizedreceiptforthecontents.Thecompanyholdingorstoringtheproperty
139shallbestrictlyliablefortheconditionandsafereturnofthepersonalpropertywhileit
140remainsintheirpossessionorcontrol.[Suchlienshallbeenforcedinthemannerprovided

142 10.]11.Towingcompaniesshallkeeparecordforthreeyearsonanyabandoned
143propertytowedandnotreclaimedbytheowneroftheabandonedproperty.Suchrecordshall
144containinformationregardingtheauthorizationtotow,copiesofallcorrespondencewiththe
145departmentofrevenueconcerningtheabandonedproperty,includingcopiesofanyonline
146recordsofthetowingcompanyaccessedandinformationconcerningthefinaldispositionof
147thepossessionoftheabandonedproperty.
148 [11.]12.Ifalienholderrepossessesanymotorvehicle,trailer,all-terrainvehicle,
149outboardmotororvesselwithouttheknowledgeorcooperationoftheowner,thenthe
150repossessorshallnotifythelocallawenforcementagencywheretherepossessionoccurred
151withintwohoursoftherepossessionandshallfurtherprovidethelocallawenforcement
152agencywithanyadditionalinformationtheagencydeemsappropriate.Thelocallaw
153enforcementagencyshallmakeaninquirywiththenationalcrimeinformationcenterandthe
154Missouristatewidelawenforcementcomputersystemandshallentertherepossessedvehicle
155intothestatewidelawenforcementcomputersystem.
156 [12.]13.Notwithstandingtheprovisionsofsection301.227,anytowingcompany
157whohascompliedwiththenotificationprovisionsinsection304.156includingnoticethat
158anypropertyremainingunredeemedafterthirtydaysmaybesoldasscrappropertymaythen
159disposeofsuchpropertyasprovidedinthissubsection.Suchsaleshallonlyoccurifatleast
160thirtydayshaspassedsincethedateofsuchnotification,theabandonedpropertyremains
161unredeemedwithnosatisfactoryarrangementsmadewiththetowingcompanyforcontinued
162storage,andtheownerorholderofasecurityagreementhasnotrequestedahearingas
163providedinsection304.156.Thetowingcompanymaydisposeofsuchabandonedproperty
164bysellingthepropertyonabillofsaleasprescribedbythedirectorofrevenuetoascrap
HCSHB543	5 165metaloperatororlicensedsalvagedealerfordestructionpurposesonly.Thetowingcompany
166shallforwardacopyofthebillofsaleprovidedbythescrapmetaloperatororlicensed
167salvagedealertothedirectorofrevenuewithintwoweeksofthedateofsuchsale.The
168towingcompanyshallkeeparecordofeachsuchvehiclesoldfordestructionforthreeyears
169thatshallbeavailableforinspectionbylawenforcementandauthorizeddepartmentof
170revenueofficials.Therecordshallcontaintheyear,make,identificationnumberofthe
171property,dateofsale,andnameofthepurchasingscrapmetaloperatororlicensedsalvage
172dealerandcopiesofallnotificationsissuedbythetowingcompanyasrequiredinthischapter.
173Scrapmetaloperatorsorlicensedsalvagedealersshallkeeparecordofthepurchaseofsuch
174propertyasprovidedinsection301.227.Scrapmetaloperatorsandlicensedsalvagedealers
175mayobtainajunkcertificateasprovidedinsection301.227onvehiclespurchasedonabillof
176salepursuanttothissection.
304.156.1.Withinfiveworkingdaysofreceiptofthecrimeinquiryandinspection
2reportundersection304.155ortheabandonedpropertyreportundersection304.157,the
3directorofrevenueshallsearchtherecordsofthedepartmentofrevenue,orinitiateaninquiry
4withanotherstate,iftheevidencepresentedindicatedtheabandonedpropertywasregistered
5ortitledinanotherstate,todeterminethenameandaddressoftheownerandlienholder,if
6any.Afterascertainingthenameandaddressoftheownerandlienholder,ifany,the
7departmentshall,withinfifteenworkingdays,notifythetowingcompany.Anytowing
8companywhichcomesintopossessionofabandonedpropertypursuanttosection304.155or
9304.157andwhoclaimsalienforrecovering,towingorstoringabandonedpropertyshall
10givenoticetothetitleownerandtoallpersonsclaimingalienthereon,asdisclosedbythe
11recordsofthedepartmentofrevenueorofacorrespondingagencyinanyotherstate.The
12towingcompanyshallnotifytheownerandanylienholderwithintenbusinessdaysofthe
13dateofmailingindicatedonthenoticesentbythedepartmentofrevenue,bycertifiedmail,
14returnreceiptrequested.Thenoticeshallcontainthefollowing:
15 (1)Thename,addressandtelephonenumberofthestoragefacility;
16 (2)Thedate,reasonandplacefromwhichtheabandonedpropertywasremoved;
17 (3)Astatementthattheamountoftheaccruedtowing,storageandadministrative
18costsaretheresponsibilityoftheowner,andthatstorageand/oradministrativecostswill
19continuetoaccrueasalegalliabilityoftheowneruntiltheabandonedpropertyisredeemed;
20 (4)Astatementthatthestoragefirmclaimsapossessorylienforallsuchcharges;
21 (5)Astatementthattheownerorholderofavalidsecurityinterestofrecordmay
22retakepossessionoftheabandonedpropertyatanytimeduringbusinesshoursbyproving
23ownershiporrightstoasecuredinterestandpayingalltowingandstoragecharges;

25improperornotlegallyjustified,theownerhasarighttorequestahearingasprovidedinthis
26sectiontocontesttheproprietyofsuchtowingorremoval;
27 (7)Astatementthatiftheabandonedpropertyremainsunclaimedforthirtydaysfrom
28thedateofmailingthenotice,titletotheabandonedpropertywillbetransferredtotheperson
29orfirminpossessionoftheabandonedpropertyfreeofallpriorliens;and
30 (8)Astatementthatanychargesinexcessofthevalueoftheabandonedpropertyat

32 2.Atowingcompanymayonlyassessreasonablestoragechargesforabandoned
33propertytowedwithouttheconsentoftheowner.Reasonablestoragechargesshallnot
34exceedthechargesforvehicleswhichhavebeentowedwiththeconsentoftheownerona
35negotiatedbasis.Storagechargesmaybeassessedonlyforthetimeinwhichthetowing
36companycomplieswiththeproceduralrequirementsofsections304.155to304.158.
37 3.Intheeventthattherecordsofthedepartmentofrevenuefailtodisclosethename
38oftheowneroranylienholderofrecord,thedepartmentshallnotifythetowingcompany
39whichshallattempttolocatedocumentsorotherevidenceofownershiponorwithinthe
40abandonedpropertyitself.Thetowingcompanymustcertifythataphysicalsearchofthe
41abandonedpropertydisclosedthatnoownershipdocumentswerefoundandagoodfaith
42efforthasbeenmade.Forpurposesofthissection,"goodfaitheffort"meansthatthe
43followingcheckshavebeenperformedbythecompanytoestablishthepriorstateof
44registrationandtitle:
45 (1)Checkoftheabandonedpropertyforanytypeoflicenseplates,licenseplate
46record,temporarypermit,inspectionsticker,decalorotherevidencewhichmayindicatea
47stateofpossibleregistrationandtitle;
48 (2)Checkthelawenforcementreportforalicenseplatenumberorregistration
49numberiftheabandonedpropertywastowedattherequestofalawenforcementagency;
50 (3)Checkthetowticket/reportofthetowtruckoperatortoseeifalicenseplatewas
51ontheabandonedpropertyatthebeginningofthetow,ifaprivatetow;and
52 (4)Ifthereisnoaddressoftheownerontheimpoundreport,checkthelaw
53enforcementreporttoseeifanout-of-stateaddressisindicatedonthedriverlicense
54information.
55 4.Ifnoownershipinformationisdiscovered,thedirectorofrevenueshallbenotified
56inwritingandtitleobtainedinaccordancewithsubsection7ofthissection.
57 5.(1)Theowneroftheabandonedpropertyremovedpursuanttotheprovisionsof
58section304.155or304.157oranypersonclaimingalien,otherthanthetowingcompany,
59withintendaysafterthereceiptofnotificationfromthetowingcompanypursuantto
60subsection1ofthissectionmayfileapetitionintheassociatecircuitcourtinthecounty
HCSHB543	7 61wheretheabandonedpropertyisstoredtodetermineiftheabandonedpropertywas
62wrongfullytakenorwithheldfromtheowner.Thepetitionshallnamethetowingcompany
63amongthedefendants.Thepetitionmayalsonametheagencyorderingthetowortheowner,
64lesseeoragentoftherealpropertyfromwhichtheabandonedpropertywasremoved.The
65directorofrevenueshallnotbeapartytosuchpetitionbutacopyofthepetitionshallbe
66servedonthedirectorofrevenuewhoshallnotissuetitletosuchabandonedproperty
67pursuanttothissectionuntilthepetitionisfinallydecided.
68 (2)Uponfilingofapetitionintheassociatecircuitcourt,theownerorlienholdermay
69havetheabandonedpropertyreleaseduponpostingwiththecourtacashorsuretybondor
70otheradequatesecurityequaltotheamountofthechargesfortowingandstoragetoensure
71thepaymentofsuchchargesintheeventhedoesnotprevail.BeginningOctober1,2024,
72thesecurityrequiredforreleaseofacommercialvehicleunderthissubdivisionshallbe
73thirtypercentofthechargesfortowingandstorage.Uponthepostingofthebondandthe
74paymentoftheapplicablefees,thecourtshallissueanordernotifyingthetowingcompanyof
75thepostingofthebondanddirectingthetowingcompanytoreleasetheabandonedproperty.
76Atthetimeofsuchrelease,afterreasonableinspection,theownerorlienholdershallgivea
77receipttothetowingcompanyrecitinganyclaimsforlossordamagetotheabandoned
78propertyorthecontentsthereof.
79 (3)Upondeterminingtherespectiverightsoftheparties,thefinalorderofthecourt
80shallprovideforimmediatepaymentinfullofrecovery,towing,andstoragefeesbythe
81abandonedpropertyownerorlienholderortheowner,lessee,oragentthereofofthereal
82propertyfromwhichtheabandonedpropertywasremoved.
83 6.Atowingandstoragelienshallbeenforcedasprovidedinsubsection7ofthis
84section.
85 7.Thirtydaysafterthenotificationformhasbeenmailedtotheabandonedproperty
86ownerandholderofasecurityagreementandthepropertyisunredeemedandnosatisfactory
87arrangementhasbeenmadewiththelienholderinpossessionforcontinuedstorage,andthe
88ownerorholderofasecurityagreementhasnotrequestedahearingasprovidedinsubsection
895ofthissection,thelienholderinpossessionmayapplytothedirectorofrevenuefora
90certificate.Theapplicationfortitleshallbeaccompaniedby:
91 (1)Anaffidavitfromthelienholderinpossessionthathehasbeeninpossessionof
92theabandonedpropertyforatleastthirtydaysandtheowneroftheabandonedpropertyor
93holderofasecurityagreementhasnotmadearrangementsforpaymentoftowingandstorage
94charges;
95 (2)Anaffidavitthatthelienholderinpossessionhasnotbeennotifiedofany
96applicationforhearingasprovidedinthissection;
97 (3)Acopyoftheabandonedpropertyreportorcrimeinquiryandinspectionreport;

99holdingavalidsecurityinterestandacopyofthecertifiedmailreceiptindicatingthatthe

103 8.Ifnoticetotheownerandholderofasecurityagreementhasbeenreturnedmarked

105subsection3ofthissection.
106 9.Anymunicipalityorcountymayadoptanordinanceregulatingtheremovaland
107saleofabandonedpropertyprovidedsuchordinanceisconsistentwithsections304.155to
108304.158,and,forahomerulecitywithmorethanfourhundredthousandinhabitantsand
109locatedinmorethanonecounty,includesthefollowingprovisions:

138propertycameintotheirpossession,includingthenameoftheownerorpossessorofreal
139propertyfromwhichtheabandonedpropertywasremoved;

141 (3)Thecurrentlocationoftheabandonedproperty;
142 (4)Aninspectionoftheabandonedpropertyasprescribedbythedirector;and
