313.813.Thecommissionmaypromulgaterulesallowingapersonthatisaproblem

4beenself-excludedisguiltyoftrespassinginthefirstdegreepursuanttosection569.140if
5suchpersonentersanexcursiongamblingboat.Anypersonwhohasbeenself-excluded
6andisfoundtohaveplacedawagerundersections313.1000to313.1022shallforfeithis
7orherwinningsandsuchwinningsshallbecreditedtothecompulsivegamblersfund
8createdundersection313.842.
313.842.1.There[may] shallbeestablishedprogramswhichshallprovide
2treatment,prevention, recovery,andeducationservicesforcompulsivegambling.Asusedin
3thissection,"compulsivegambling"meansaconditionsufferedbyapersonwhois
4chronicallyandprogressivelypreoccupiedwithgamblingandtheurgetogamble.Subjectto
5appropriation,suchprogramsshallbefundedfromtheone-centadmissionfeeauthorized
6pursuanttosection313.820,andinaddition,maybefundedfromthetaxescollectedand
7distributedtoanycityorcountyundersection313.822oranyotherfundsappropriatedby
8thegeneralassembly. Suchmoneysshallbesubmittedtothestateandcreditedtothe
9"CompulsiveGamblersFund",whichisherebyestablishedwithinthedepartmentofmental
10health.Notwithstandingtheprovisionsofsection33.080tothecontrary,moneysinthefund
11attheendofanybienniumshallnotbetransferredtothecreditofthegeneralrevenuefund.
12Thedepartmentofmentalhealthshalladministerprograms,eitherdirectlyorbycontract,for
13compulsivegamblers.Thecommission[may] shalladministerprogramstoeducatethe
14publicaboutproblemgamblingandpromotetreatmentprogramsofferedbythedepartmentof
15mentalhealth.Inaddition,thecommissionshalladministerthevoluntaryexclusionprogram
16forproblemgamblersauthorizedbysection[313.833] 313.813.
17 2.Thecommission,incooperationwiththedepartmentofmentalhealth,shall
18developatriennialresearchreportinordertoassessthesocialandeconomiceffectsof
19gaminginthestateandtoobtainscientificinformationrelatedtotheneuroscience,
HCSHBs556&581	4 20psychology,sociology,epidemiology,andetiologyofcompulsivegambling.Thereport
21andassociatedstudiesshallbesubmittedtothegovernor,thepresidentprotemporeof
22thesenate,andthespeakerofthehouseofrepresentativesnolaterthanDecember31,
232024,andnotlaterthanDecemberthirty-firstofeverythirdyearthereafter.The
24researchreportshallconsistofatleast:
25 (1)Abaselinestudyoftheexistingoccurrenceofcompulsivegamblinginthe
26state.Thestudyshallexamineanddescribetheexistinglevelsofcompulsivegambling
27andtheexistingprogramsavailablethathaveagoalofpreventingandaddressingthe
28harmfulconsequencesofcompulsivegambling;
29 (2)Acomprehensivelegalandfactualstudyofthesocialandeconomicimpacts
30ofgamblingonthestate;and
31 (3)Recommendationsonprogramsandlegislativeactionstoaddresscompulsive
32gamblinginthestate,includingarecommendedappropriationtothecompulsive
33gamblersfundbasedonthestudyrequiredinsubdivision(1)ofthissubsection.
313.1000.1.Asusedinsections313.1000to313.1022,thefollowingtermsshall

4 (a)Thetotalofallcashandcashequivalentsreceivedbyasportswagering
5operatorfromsportswageringminusthetotalof:
6 a.Allcashandcashequivalentspaidoutaswinningstosportswagering
7patrons;
8 b.Theactualcostspaidbyasportswageringoperatorforanythingofvalue
9providedtoandredeemedbypatrons,includingmerchandiseorservicesdistributedto
10sportswageringpatronstoincentivizesportswagering;
11 c.Voidedorcancelledwagers;
12 d.Forthefirstyearofimplementation,onehundredpercentofthecostsoffree
13playorpromotionalcreditsprovidedtoandredeemedbypatronsanddecreasingby

15costoffreeplayorpromotionalcreditsshallbededucted;

18 (i)Areasonableprovisionforuncollectiblepatronchecks,automatedclearing
19house(ACH)transactions,debitcardtransactions,andcreditcardtransactions
20receivedfromsportswageringoperations;or
21 (ii)Twopercentofthetotalofallsums,includingchecks,whethercollected,less
22theamountpaidoutaswinningstosportswageringpatrons.Forpurposesofthis
23section,acounterorpersonalcheckthatisinvalidorunenforceableunderthissectionis

7physicallylocatedinthisstate.
8 3.Notwithstandinganyotherprovisionoflawtothecontrary,exceptas
9providedundersections313.1000to313.1022,sportswageringcommercialactivityshall
10beprohibitedfromoccurringwithinanydesignatedsportsdistrictwithouttheapproval
11ofeachprofessionalsportsteamentityapplicabletosuchdesignatedsportsdistrict;
12provided,however,thatnosuchapprovalshallberequiredforthesoleactivityof
13offeringsportswageringovertheinternetviaaninteractivesportswageringplatform
14thatisaccessibletopersonsphysicallylocatedwithinsuchdesignatedsportsdistrict.
313.1004.1.Thecommissionshallhavefulljurisdictiontosuperviseall
2gamblingoperatorsgovernedbysections313.1000to313.1022andshalladoptrulesand
3regulationstoimplementtheprovisionsofsections313.1000to313.1022.Anyruleor
4portionofarule,asthattermisdefinedinsection536.010,thatiscreatedunderthe
5authoritydelegatedinthissectionshallbecomeeffectiveonlyifitcomplieswithandis
6subjecttoalloftheprovisionsofchapter536and,ifapplicable,section536.028.This
7sectionandchapter536arenonseverableandifanyofthepowersvestedwiththe

32sportswageringoperatorifthesportswageringoperatorisalicensedfacilitythatisan
33excursiongamblingboat;
34 (2)Ensurethesecurityandintegrityofsportswagersacceptedthroughany
35interactivesportswageringplatformoperatedorauthorizedbysuchsportswagering
36operator;
37 (3)Ensurethatthesportswageringoperator'ssurveillancesystemcoversall
38areasofthein-personsportswageringactivityconductedwithinalicensedfacilitythat
39isanexcursiongamblingboat;
40 (4)Allowthecommissiontobepresentthroughthecommission'sgamingagents
41whensportswageringisconductedinallareasofthesportswageringoperator's
42licensedfacilitythatisanexcursiongamblingboatinwhichsportswageringis

3conditionsthatthecommissionconsidersappropriatepriortoauthorizingasports

5compositeofsportswagering.Thecommissionmayutilizeanapprovedindependent
6testinglaboratorytoassistwithanyrequirementsofthissection.Thecommissionshall

8commissiondeterminesthetestingofthatgoverningbodyissubstantiallysimilartothe

12 2.Alicensedfacilitythatisanexcursiongamblingboatmayalsooffersports
13wageringthroughuptothreeindividuallybrandedinteractivesportswagering
14platformsunderthebrand,tradename,oranothernameitisdoingbusinessas(d/b/
15a)selectedbythesportswageringoperatoror,asapplicable,theinteractivesports
16wageringplatformoperator.Asportswageringoperatormayoperateeachinteractive
17sportswageringplatformorcontractwithoneormoreinteractivesportswagering
18platformoperatorstoadministeranyoralloftheinteractivesportswageringplatforms
19onthelicensedfacility'sbehalf.Notwithstandinganyprovisionofthissectionand
20anythingtothecontrarysetforthundersections313.1000through313.1022,innoevent
21shallsportswageringbeofferedthroughmorethansixsportswageringplatforms
22contractingwithanyoneownerofalicensedfacility,directlyorindirectlythroughany
23parentcompany,subsidiary,oraffiliateofsuchowner.
24 3.Eachdesignatedsportsdistrictmobilelicenseemayoffersportswagering
25withinthestatethroughoneinteractivesportswageringplatform.Eachdesignated
26sportsdistrictmobilelicenseeshallberequiredtobelicensedbythecommissionasan
27interactivesportswageringplatformoperator.Sportswageringovertheinternet
28throughanyinteractivesportswageringplatformmaybeofferedbyanylicensedsports
29wageringoperatorwithinanydesignatedsportsdistrict.
30 4.Notwithstandinganythingtothecontrarysetforthundersections313.1000
31through313.1022,nosportswageringoperatormayoffersportswageringinpersonor
32throughanysportswageringkiosk,exceptwithinalicensedfacilitythatisanexcursion
