Currentlawrequiresthatifacauseofdeathcannotbedetermined
after72hours,theattendingmedicalprofessionalmustgivethe
funeraldirectorinchargeoffinaldispositionofthedeadbody
notice.Thisbillrequiresthattheattendingmedicalprofessional
completethemedicalcertificationbyindicatingthecertification
ispendinginvestigation, thenamendthecertificateofdeathupon
conclusionoftheinvestigation.
Undertheprovisionsofthisbill,theDepartmentofHealthand
SeniorServicesmayissuerulesandregulations,settingforth
healthandsafetyrequirementsforthetransportation ofdeadhuman
bodiesplacedoncommoncarriersinthestate.Thebillrepeals
currentprovisionsrelatedtothetransportation ofdeadbodies.
Thebillalsoclarifiesthatfortherightofsepulcher,next-of-
kinshallonlyincludethesurvivingspouseiftherehasnotbeen
anactionforthedissolutionofthemarriagefiled.Itfurther
allowsthenext-of-kintodelegatecontrolofthefinaldisposition
oftheremainsofanydeadhumanbeingtoanagent.

PROPONENTS: Supporterssaythatthisbillprotectstheinterests
ofthedeceasedandsurvivingfamilymembersintheeventthe
deceasedhadbegun,butnotfinalized,divorceproceedings.
