193.145.1.Acertificateofdeathforeachdeathwhichoccursinthisstateshallbe
2filedwiththelocalregistrar,orasotherwisedirectedbythestateregistrar,withinfivedays
3afterdeathandshallberegisteredifsuchcertificatehasbeencompletedandfiledpursuantto
4thissection.Alldataprovidersinthedeathregistrationprocess,including,butnotlimitedto,
5thestateregistrar,localregistrars,thestatemedicalexaminer,countymedicalexaminers,
6coroners,funeraldirectorsorpersonsactingassuch,embalmers,sheriffs,attending
7physiciansandresidentphysicians,physicianassistants,assistantphysicians,advanced
HB557	2 8practiceregisterednurses,andthechiefmedicalofficersoflicensedhealthcarefacilities,and
9otherpublicorprivateinstitutionsprovidingmedicalcare,treatment,orconfinementto
10persons,shallberequiredtouseandutilizeanyelectronicdeathregistrationsystemrequired
11andadoptedundersubsection1ofsection193.265withinsixmonthsofthesystembeing
12certifiedbythedirectorofthedepartmentofhealthandseniorservices,orthedirector's
13designee,tobeoperationalandavailabletoalldataprovidersinthedeathregistrationprocess.
14However,shouldthepersonorentitythatcertifiesthecauseofdeathnotbepartof,ordoes
15notuse,theelectronicdeathregistrationsystem,thefuneraldirectororpersonactingassuch
16mayentertherequiredpersonaldataintotheelectronicdeathregistrationsystemandthen
17completethefilingbypresentingthesignedcauseofdeathcertificationtothelocalregistrar,
18inwhichcasethelocalregistrarshallissuedeathcertificatesassetoutinsubsection2of
19section193.265.Nothinginthissectionshallpreventthestateregistrarfromadoptingpilot
20programsorvoluntaryelectronicdeathregistrationprogramsuntilsuchtimeasthesystem
21canbecertified;however,nosuchpilotorvoluntaryelectronicdeathregistrationprogram
22shallpreventthefilingofadeathcertificatewiththelocalregistrarortheabilitytoobtain
23certifiedcopiesofdeathcertificatesundersubsection2ofsection193.265untilsixmonths
24aftersuchcertificationthatthesystemisoperational.
25 2.Iftheplaceofdeathisunknownbutthedeadbodyisfoundinthisstate,the
26certificateofdeathshallbecompletedandfiledpursuanttotheprovisionsofthissection.
27Theplacewherethebodyisfoundshallbeshownastheplaceofdeath.Thedateofdeath
28shallbethedateonwhichtheremainswerefound.
29 3.WhendeathoccursinamovingconveyanceintheUnitedStatesandthebodyis
30firstremovedfromtheconveyanceinthisstate,thedeathshallberegisteredinthisstateand
31theplacewherethebodyisfirstremovedshallbeconsideredtheplaceofdeath.Whena
32deathoccursonamovingconveyancewhileininternationalwatersorairspaceorinaforeign
33countryoritsairspaceandthebodyisfirstremovedfromtheconveyanceinthisstate,the
34deathshallberegisteredinthisstatebutthecertificateshallshowtheactualplaceofdeathif
35suchplacemaybedetermined.
36 4.Thefuneraldirectororpersoninchargeoffinaldispositionofthedeadbodyshall
37filethecertificateofdeath.Thefuneraldirectororpersoninchargeofthefinaldispositionof
38thedeadbodyshallobtainorverifyandenterintotheelectronicdeathregistrationsystem:
39 (1)Thepersonaldatafromthenextofkinorthebestqualifiedpersonorsource
40available;
41 (2)Themedicalcertificationfromthepersonresponsibleforsuchcertificationif
42designatedtodosoundersubsection5ofthissection;and
HB557	3 43 (3)Anyotherinformationordatathatmayberequiredtobeplacedonadeath
44certificateorenteredintotheelectronicdeathcertificatesystemincluding,butnotlimitedto,
45thenameandlicensenumberoftheembalmer.
46 5.Themedicalcertificationshallbecompleted,attestedtoitsaccuracyeitherby
47signatureoranelectronicprocessapprovedbythedepartment,andreturnedtothefuneral
48directororpersoninchargeoffinaldispositionwithinseventy-twohoursafterdeathbythe
49physician,physicianassistant,assistantphysician,oradvancedpracticeregisterednursein
50chargeofthepatient'scarefortheillnessorconditionwhichresultedindeath.Intheabsence
51ofthephysician,physicianassistant,assistantphysician,advancedpracticeregisterednurse
52orwiththephysician's,physicianassistant's,assistantphysician's,oradvancedpractice
53registerednurse'sapprovalthecertificatemaybecompletedandattestedtoitsaccuracyeither
54bysignatureoranapprovedelectronicprocessbythephysician'sassociatephysician,the
55chiefmedicalofficeroftheinstitutioninwhichdeathoccurred,orthephysicianwho
56performedanautopsyuponthedecedent,providedsuchindividualhasaccesstothemedical
57historyofthecase,viewsthedeceasedatorafterdeathanddeathisduetonaturalcauses.
58Thepersonauthorizedtocompletethemedicalcertificationmay,inwriting,designateany
59otherpersontoenterthemedicalcertificationinformationintotheelectronicdeath
60registrationsystemifthepersonauthorizedtocompletethemedicalcertificatehasphysically
61orbyelectronicprocesssignedastatementstatingthecauseofdeath.Anypersons
62completingthemedicalcertificationorenteringdataintotheelectronicdeathregistration
63systemshallbeimmunefromcivilliabilityforsuchcertificationcompletion,dataentry,or
64determinationofthecauseofdeath,absentgrossnegligenceorwillfulmisconduct.Thestate
65registrarmayapprovealternatemethodsofobtainingandprocessingthemedicalcertification
66andfilingthedeathcertificate.TheSocialSecuritynumberofanyindividualwhohasdied
67shallbeplacedintherecordsrelatingtothedeathandrecordedonthedeathcertificate.
68 6.Whendeathoccursfromnaturalcausesmorethanthirty-sixhoursafterthe
69decedentwaslasttreatedbyaphysician,physicianassistant,assistantphysician,oradvanced
70practiceregisterednurse,thecaseshallbereferredtothecountymedicalexaminerorcoroner
71orphysicianorlocalregistrarforinvestigationtodetermineandcertifythecauseofdeath.If
72thedeathisdeterminedtobeofanaturalcause,themedicalexaminerorcoronerorlocal
73registrarshallreferthecertificateofdeathtotheattendingphysician,physicianassistant,
74assistantphysician,oradvancedpracticeregisterednurseforsuchcertification.Ifthe
75attendingphysician,physicianassistant,assistantphysician,oradvancedpracticeregistered
76nurserefusesorisotherwiseunavailable,themedicalexaminerorcoronerorlocalregistrar
77shallattesttotheaccuracyofthecertificateofdeatheitherbysignatureoranapproved
78electronicprocesswithinthirty-sixhours.
HB557	4 79 7.Ifthecircumstancessuggestthatthedeathwascausedbyotherthannaturalcauses,
80themedicalexaminerorcoronershalldeterminethecauseofdeathandshall,eitherby
81signatureoranapprovedelectronicprocess,completeandattesttotheaccuracyofthe
82medicalcertificationwithinseventy-twohoursaftertakingchargeofthecase.
83 8.Ifthecauseofdeathcannotbedeterminedwithinseventy-twohoursafterdeath,
84theattendingmedicalexaminer,coroner,attendingphysician,physicianassistant,assistant
85physician,advancedpracticeregisterednurse,orlocalregistrarshallgivethefuneraldirector,
86orpersoninchargeoffinaldispositionofthedeadbody,noticeofthereasonforthedelay,
87andfinaldispositionofthebodyshallnotbemadeuntilauthorizedbythemedicalexaminer,
88coroner,attendingphysician,physicianassistant,assistantphysician,advancedpractice
89registerednurse,orlocalregistrar.
90 9.Whenadeathispresumedtohaveoccurredwithinthisstatebutthebodycannotbe
91located,adeathcertificatemaybepreparedbythestateregistraruponreceiptofanorderofa
92courtofcompetentjurisdictionwhichshallincludethefindingoffactsrequiredtocomplete
93thedeathcertificate.Suchadeathcertificateshallbemarked"Presumptive",showonitsface
94thedateofregistration,andidentifythecourtandthedateofdecree.
95 10.(1)Thedepartmentofhealthandseniorservicesshallnotifyallphysicians,
96physicianassistants,assistantphysicians,andadvancedpracticeregisterednurseslicensed
97underchapters334and335oftherequirementsregardingtheuseoftheelectronicvital
98recordssystemprovidedforinthissection.
99 (2)OnorbeforeAugust30,2015,thedepartmentofhealthandseniorservices,
100divisionofcommunityandpublichealthshallcreateaworkinggroupcomprisedof
101representationfromtheMissourielectronicvitalrecordssystemusersandrecipientsofdeath
102certificatesusedforprofessionalpurposestoevaluatetheMissourielectronicvitalrecords
103system,developrecommendationstoimprovetheefficiencyandusabilityofthesystem,and
104toreportsuchfindingsandrecommendationstothegeneralassemblynolaterthanJanuary1,
1052016.
106 11.Notwithstandinganyprovisionoflawtothecontrary,ifacoronerordeputy
107coronerisnotcurrentwithoriswithouttheapprovedtrainingunderchapter58,the
108departmentofhealthandseniorservicesshallprohibitsuchcoronerfromattestingtothe
109accuracyofacertificateofdeath.Nopersonelectedorappointedtotheofficeofcoronercan
110assumesuchelectedofficeuntilthetraining,asestablishedbythecoronerstandardsand
111trainingcommissionundertheprovisionsofsection58.035,hasbeencompletedanda
112certificateofcompletionhasbeenissued.Intheeventacoronercannotfulfillhisorher
113dutiesorisnolongerqualifiedtoattesttotheaccuracyofadeathcertificate,thesheriffofthe
114countyshallappointamedicalprofessionaltoattestdeathcertificatesuntilsuchtimeasthe
115coronercanresumehisorherdutiesoranothercoronerisappointedorelectedtotheoffice.
HB557	5 193.175.[1.Thefuneraldirectororpersonactingassuchinchargeoffinal
2dispositionofadeadbodyshallfileacompletednotificationofdeathwiththelocalregistrar
3wherethedeathoccurred.Suchnotificationofdeathshallbeonaformorinaformat
4prescribedandfurnishedbythestateregistrarandshallbefiledorpostmarkedpriortothe
5dateoffinaldispositionofthebody.Suchnotificationofdeathshallauthorizefinal
6dispositionexceptasotherwisestatedinthissectionorinsection193.145.Ifthebodyisto
7becremated,acompleteddeathcertificateshallbefiledwiththelocalregistrarpriorto
8cremationandshallauthorizecremationexceptasstatedinsection193.145.
9 2.]Thefuneraldirectororpersoninchargeoffinaldispositionofadeadbodyshall,
10priortotheintermentofsuchdeadbody,affixontheankleorwristofthedeceasedand/orina
11capsuleorothercontainerplacedinthecasketor,ifthedeadbodyiscremated,ontheinside
12ofthevesselcontainingtheremains,atagencasedindurableandlong-lastingmaterial
13containingthenameofthedeceased,thedateofbirth,dateofdeathandSocialSecurity
14numberofthedeceased.
194.010.[Adisinterredhumanbody,deadofadiseaseoranycause,willbetreatedas
2infectiousanddangeroustothepublichealth,andshallnotbeofferedtooracceptedbyany
3commoncarrierfortransportationunlessitisencasedinanairtightmetalormetal-lined
4burialcase,coffin,casketorboxthatisclosedandhermeticallysealed] 1.Thedepartment
5ofhealthandseniorservicesmayissueregulationssettingforthhealthandsafety
6requirementsfortransportingdeadhumanbodiesthatareplacedoncommoncarriers
7inthestateofMissouri.Anyruleorportionofarule,asthattermisdefinedinsection
8536.010,thatiscreatedundertheauthoritydelegatedinthissectionshallbecome
9effectiveonlyifitcomplieswithandissubjecttoalloftheprovisionsofchapter536and,
10ifapplicable,section536.028.Thissectionandchapter536arenonseverableandifany
11ofthepowersvestedwiththegeneralassemblypursuanttochapter536toreview,to
12delaytheeffectivedate,ortodisapproveandannularulearesubsequentlyheld
13unconstitutional,thenthegrantofrulemakingauthorityandanyruleproposedor
14adoptedafterAugust28,2023,shallbeinvalidandvoid.
15 2.Anytransportingofdeadhumanbodiesonaircraftshallcomplywiththe
16TransportationSecurityAdministration'srulesandregulations.
17 3.Priortotransportingadeadhumanbody,theattendingmedicalexaminer,
18coroner,attendingphysician,physicianassistant,assistantphysician,oranadvanced
19practiceregisterednurseshallaffixontheankleorwristofthedeceasedatagencased
20indurableandlong-lastingmaterialcontainingthenameofthedeceased,thedateof
21birth,dateofdeath,andSocialSecuritynumberofthedeceased.
194.105.Inadditiontoanyrecordsfiledpursuanttochapter193,anypersonorowner
2oroperatorofanycemeterywhichremovesanybodywhichhasbeenproperlyburiedor
HB557	6 3interredfortransportationtoalocationoutsidetheoriginalcemeteryshall,priortosuch
4disinterment,filenoticewiththecountycoronerorcountymedicalexaminer[andalsonotify
5bycertifiedmail,theclosestlivingrelativeknowntothecemeteryoperator,ofthebodybeing
6moved.Suchnoticeshallprovidethenameandaddressofthepersonmovingthebody,the
7nameofthepersonwhosebodyistobemoved,andthelocationtowhichthebodyistobe
8moved.Transportationofthebodyshallbeinaccordancewiththeprovisionsofsections
9194.010to194.110,andinaccordancewithanyotherapplicablelaworregulation].
194.119.1.Asusedinthissection,theterm"rightofsepulcher"meanstherightto
2chooseandcontroltheburial,cremation,orotherfinaldispositionofadeadhumanbody.
3 2.Forpurposesofthischapterandchapters193,333,and436,andinallcases
4relatingtothecustody,control,anddispositionofdeceasedhumanremains,includingthe
5commonlawrightofsepulcher,wherenototherwisedefined,theterm"next-of-kin"means
6thefollowingpersonsintheprioritylistedifsuchpersoniseighteenyearsofageorolder,is
7mentallycompetent,andiswillingtoassumeresponsibilityforthecostsofdisposition:
8 (1)Anattorneyinfactdesignatedinadurablepowerofattorneywhereinthe
9deceasedspecificallygrantedtherightofsepulcheroverhisorherbodytosuchattorneyin
10fact;
11 (2)ForadecedentwhowasonactivedutyintheUnitedStatesmilitaryatthetimeof
12death,thepersondesignatedbysuchdecedentinthewritteninstrumentknownastheUnited
13StatesDepartmentofDefenseForm93,RecordofEmergencyData,inaccordancewith[P.L.
14109-163,Section564,]10U.S.C.Section1482;
15 (3)Thesurvivingspouse, unlessanactionforthedissolutionofthemarriagehas
16beenfiledandispendinginacourtofcompetentjurisdiction;
17 (4)Anysurvivingchildofthedeceased.Ifasurvivingchildislessthaneighteen
18yearsofageandhasalegalornaturalguardian,suchchildshallnotbedisqualifiedonthe

25 (c)Ifthedeceasedisaminorandthedeceased'sparentshavejointcustody,theparent
26whoseresidenceistheminorchild'sresidenceforpurposesofmailingandeducation;
27 (6)Anysurvivingsiblingofthedeceased;
28 (7)Thenextnearestsurvivingrelativeofthedeceasedbyconsanguinityoraffinity;
29 (8)Anypersonorfriendwhoassumesfinancialresponsibilityforthedispositionof
30thedeceased'sremainsifnonext-of-kinassumessuchresponsibility;

32ofresponsibilityshallnotmakethecoroner,medicalexaminer,thecounty,orthestate

34 3.Thenext-of-kinofthedeceasedshallbeentitledtocontrolthefinaldispositionof
35theremainsofanydeadhumanbeingconsistentwithallapplicablelaws,includingall
36applicablehealthcodes.Thenext-of-kinmaydelegatethecontrolofthefinaldisposition
37oftheremainsofanydeadhumanbeingtoanagentthrougheitheraspecificorgeneral
38grantofpowerinaccordancewithsection404.710if,atthetimeofdelegation,thenext-
39of-kiniseighteenyearsofageorolderandmentallycompetentandtheprincipalor
40agentistakingfinancialresponsibilityforthedisposition.
41 4.Afuneraldirectororestablishmentisentitledtorelyonandactaccordingtothe
42lawfulinstructionsofanypersonclaimingtobethenext-of-kinofthedeceased;provided
43however,inanycivilcauseofactionagainstafuneraldirectororestablishmentlicensed
44pursuanttothischapterforactionstakenregardingthefuneralarrangementsforadeceased
45personinthedirector'sorestablishment'scare,therelativefault,ifany,ofsuchfuneral
46directororestablishmentmaybereducedifsuchactionsaretakeninrelianceuponaperson's
47claimtobethedeceasedperson'snext-of-kin.
48 5.Anypersonwhodesirestoexercisetherightofsepulcherandwhohasknowledge
49ofanindividualorindividualswithasuperiorrighttocontroldispositionshallnotifysuch
50individualorindividualspriortomakingfinalarrangements.
51 6.Ifanindividualwithasuperiorclaimis[personallyservedwithwrittennotice
52from] notifiedinpersonorbywrittennoticewithdeliveryconfirmationtosuchperson's
53lastknownaddressbyapersonwithaninferiorclaimthatsuchpersondesirestoexercise
54therightofsepulcherandtheindividualsoserveddoesnotobjectwithinforty-eighthoursof
55[receipt] receivingsuchnotice, suchindividualshallbedeemedtohavewaivedsuchright.
56Anindividualwithasuperiorrightmayalsowaivesuchrightatanytimeifsuchwaiverisin
57writinganddated.
58 7.Ifthereismorethanonepersoninaclasswhoareequalinpriorityandthefuneral
59directorhasnoknowledgeofanyobjectionbyothermembersofsuchclass,thefuneral
60directororestablishmentshallbeentitledtorelyonandactaccordingtotheinstructionsof
61thefirstsuchpersonintheclasstomakearrangements;providedthatsuchpersonassumes
62responsibilityforthecostsofdispositionandnootherpersoninsuchclassprovideswritten
63noticeofhisorherobjection.Ifthefuneraldirectorhasknowledgethatthereismorethan
64onepersoninaclasswhoareequalinpriorityandwhodonotagreeonthedisposition,the
65decisionofthemajorityofthemembersofsuchclassshallcontrolthedisposition.
66 8.Forpurposesofconductingamajorityvoteundersubsection7ofthissection,the
67funeraldirectorshallallowvotingbyproxyusingawrittenauthorizationorinstrument.

4 bodyisinawooden,metalormetal-linedboxthatissecurelyclosed,andon
