4 2.Theidentityofanyindividualwhoreportstoorparticipatesinthereporting
5systemundersubsection1ofthissectionshall:
6 (1)Besealedfrominspectionbythepublicoranyotherentityorindividualwho
7isotherwiseprovidedaccesstothedepartmentofsocialservices'confidentialrecords;
8 (2)Notbesubjecttodiscoveryorintroductionintoevidenceinanycivil
9proceeding;and
10 (3)Bedisclosedonlyasnecessarytocarryoutthepurposeofthereporting
11systemundersubsection1ofthissection.

8andwherethedivisiondeterminestheallegationofabuseorneglectwasmademaliciously,

29notplaceanunknownperpetratoronthecentralregistry.Thedivisionshallretainall
30information.Thedivisionshallretainanddiscloseinformationandfindingsinthesame
31mannerasthedivisionretainsanddisclosesfamilyassessments.Ifthedivisionmadea
32findingofabuseorneglectagainstanunknownperpetratorpriortoAugust28,2017,the
33divisionshallremovetheunknownperpetratorfromthecentralregistrybutshallretainand
34utilizeallinformationasotherwiseprovidedinthissection;
35 (3)Forreportswherethedivisionusesthefamilyassessmentandservicesapproach,
36informationshallberetainedbythedivision;

38abusedorneglected,informationshallberetainedforeighteenyearsfromthedateofthe
39reportandthenshallberemovedfromtherecordsbythedivision.
40 2.Withinninetydays,orwithinonehundredtwentydaysincasesinvolvingsexual
41abuse,oruntilthedivision'sinvestigationiscompleteincasesinvolvingachildfatalityor
42near-fatality,afterreceiptofareportofabuseorneglectthatisinvestigated,thealleged
43perpetratornamedinthereportandtheparentsofthechildnamedinthereport,ifthealleged
44perpetratorisnotaparent,shallbenotifiedinwritingofanydeterminationmadebythe
45divisionbasedontheinvestigation.Thenoticeshalladviseeither:
46 (1)ThatthedivisionhasdeterminedbyaprobablecausefindingpriortoAugust28,
472004,orbyapreponderanceoftheevidenceafterAugust28,2004,thatabuseorneglect
48existsandthatthedivisionshallretainallinformationregardingtheabuseorneglect;that
49suchinformationshallremainconfidentialandwillnotbereleasedexcepttolawenforcement
50agencies,prosecutingorcircuitattorneys,orasprovidedinsection210.150;thatthealleged
51perpetratorhassixtydaysfromthedateofreceiptofthenoticetoseekreversalofthe
52division'sdeterminationthroughareviewbythechildabuseandneglectreviewboardas
53providedinsubsection4ofthissection;
54 (2)Thatthedivisionhasnotmadeaprobablecausefindingordeterminedbya
55preponderanceoftheevidencethatabuseorneglectexists;or
56 (3)Thedivisionhasbeenunabletodeterminetheidentityoftheperpetratorofthe
57abuseorneglect.Thenoticeshallalsoinformthechild'sparentsandlegalguardianthatthe
58divisionshallretain,utilize,anddiscloseallinformationandfindingsasprovidedinfamily
59assessmentandservicescases.
60 3.Thechildren'sdivisionmayreopenacaseforreviewifnew,specific,andcredible
61evidenceisobtained.
62 4.Anypersonnamedinaninvestigationasaperpetratorwhoisaggrievedbya
63determinationofabuseorneglectbythedivisionasprovidedinthissectionmayseekan
64administrativereviewbythechildabuseandneglectreviewboardpursuanttotheprovisions
65ofsection210.153.Suchrequestforreviewshallbemadewithinsixtydaysofnotificationof
66thedivision'sdecisionunderthissection.Inthosecaseswherecriminalchargesarisingoutof
67factsoftheinvestigationarepending,therequestforreviewshallbemadewithinsixtydays
68fromthecourt'sfinaldispositionordismissalofthecharges.Nothinginthissectionshall
69precludetheofficeofchildadvocatefromreleasingfindingsregardingtheprofessional
70performanceofanyindividualmemberofthemultidisciplinaryteamasdescribedin
71section660.520.
72 5.Inanysuchactionforadministrativereview,thechildabuseandneglectreview
73boardshallsustainthedivision'sdeterminationifsuchdeterminationwassupportedby
HB562	3 74evidenceofprobablecausepriortoAugust28,2004,orissupportedbyapreponderanceof
75theevidenceafterAugust28,2004,andisnotagainsttheweightofsuchevidence.Thechild
76abuseandneglectreviewboardhearingshallbeclosedtoallpersonsexcepttheparties,their
77attorneysandthosepersonsprovidingtestimonyonbehalfoftheparties.
78 6.Iftheallegedperpetratorisaggrievedbythedecisionofthechildabuseandneglect
79reviewboard,theallegedperpetratormayseekdenovojudicialreviewinthecircuitcourtin
80thecountyinwhichtheallegedperpetratorresidesandincircuitswithsplitvenue,inthe
81venueinwhichtheallegedperpetratorresides,orinColeCounty.Iftheallegedperpetratoris
82notaresidentofthestate,propervenueshallbeinColeCounty.Thecasemaybeassignedto
83thefamilycourtdivisionwheresuchadivisionhasbeenestablished.Therequestfora
84judicialreviewshallbemadewithinsixtydaysofnotificationofthedecisionofthechild
85abuseandneglectreviewboarddecision.Inreviewingsuchdecisions,thecircuitcourtshall
86providetheallegedperpetratortheopportunitytoappearandpresenttestimony.Thealleged
87perpetratormaysubpoenaanywitnessesexcepttheallegedvictimorthereporter.However,
88thecircuitcourtshallhavethediscretiontoallowthepartiestosubmitthecaseupona
89stipulatedrecord.
90 7.Inanysuchactionforadministrativereview,thechildabuseandneglectreview
91boardshallnotifythechildortheparent,guardianorlegalrepresentativeofthechildthata
92reviewhasbeenrequested.
610.021.Excepttotheextentdisclosureisotherwiserequiredbylaw,apublic
2governmentalbodyisauthorizedtoclosemeetings,recordsandvotes,totheextenttheyrelate
3tothefollowing:
4 (1)Legalactions,causesofactionorlitigationinvolvingapublicgovernmentalbody
5andanyconfidentialorprivilegedcommunicationsbetweenapublicgovernmentalbodyor
6itsrepresentativesanditsattorneys.However,anyminutes,voteorsettlementagreement
7relatingtolegalactions,causesofactionorlitigationinvolvingapublicgovernmentalbody
8oranyagentorentityrepresentingitsinterestsoractingonitsbehalforwithitsauthority,
9includinganyinsurancecompanyactingonbehalfofapublicgovernmentbodyasitsinsured,
10shallbemadepublicuponfinaldispositionofthemattervoteduponoruponthesigningby
11thepartiesofthesettlementagreement,unless,priortofinaldisposition,thesettlement
12agreementisorderedclosedbyacourtafterawrittenfindingthattheadverseimpacttoa
13plaintifforplaintiffstotheactionclearlyoutweighsthepublicpolicyconsiderationsof
14section610.011,however,theamountofanymoneyspaidby,oronbehalfof,thepublic
15governmentalbodyshallbedisclosed;provided,however,inmattersinvolvingtheexerciseof
16thepowerofeminentdomain,thevoteshallbeannouncedorbecomepublicimmediately
17followingtheactiononthemotiontoauthorizeinstitutionofsuchalegalaction.Legalwork
18productshallbeconsideredaclosedrecord;
HB562	4 19 (2)Leasing,purchaseorsaleofrealestatebyapublicgovernmentalbodywhere
20publicknowledgeofthetransactionmightadverselyaffectthelegalconsiderationtherefor.
21However,anyminutes,voteorpublicrecordapprovingacontractrelatingtotheleasing,
22purchaseorsaleofrealestatebyapublicgovernmentalbodyshallbemadepublicupon
23executionofthelease,purchaseorsaleoftherealestate;
24 (3)Hiring,firing,discipliningorpromotingofparticularemployeesbyapublic
25governmentalbodywhenpersonalinformationabouttheemployeeisdiscussedorrecorded.
26However,anyvoteonafinaldecision,whentakenbyapublicgovernmentalbody,tohire,
27fire,promoteordisciplineanemployeeofapublicgovernmentalbodyshallbemade
28availablewitharecordofhoweachmembervotedtothepublicwithinseventy-twohoursof
29thecloseofthemeetingwheresuchactionoccurs;provided,however,thatanyemployeeso
30affectedshallbeentitledtopromptnoticeofsuchdecisionduringtheseventy-two-hour
31periodbeforesuchdecisionismadeavailabletothepublic.Asusedinthissubdivision,the
32term"personalinformation"meansinformationrelatingtotheperformanceormeritof
33individualemployees;
34 (4)Thestatemilitiaornationalguardoranypartthereof;
35 (5)Nonjudicialmentalorphysicalhealthproceedingsinvolvingidentifiablepersons,
36includingmedical,psychiatric,psychological,oralcoholismordrugdependencydiagnosisor
37treatment;
38 (6)Scholasticprobation,expulsion,orgraduationofidentifiableindividuals,
39includingrecordsofindividualtestorexaminationscores;however,personallyidentifiable
40studentrecordsmaintainedbypubliceducationalinstitutionsshallbeopenforinspectionby
41theparents,guardianorothercustodianofstudentsundertheageofeighteenyearsandbythe
42parents,guardianorothercustodianandthestudentifthestudentisovertheageofeighteen
43years;
44 (7)Testingandexaminationmaterials,beforethetestorexaminationisgivenor,ifit
45istobegivenagain,beforesogivenagain;
46 (8)Welfarecasesofidentifiableindividuals;
47 (9)Preparation,includinganydiscussionsorworkproduct,onbehalfofapublic
48governmentalbodyoritsrepresentativesfornegotiationswithemployeegroups;

74publicsafetyorhealth.Financialrecordsrelatedtotheprocurementoforexpenditures
75relatingtooperationalguidelines,policiesorplanspurchasedwithpublicfundsshallbeopen.
76Whenseekingtocloseinformationpursuanttothisexception,thepublicgovernmentalbody
77shallaffirmativelystateinwritingthatdisclosurewouldimpairthepublicgovernmental
78body'sabilitytoprotectthesecurityorsafetyofpersonsorrealproperty,andshallinthesame
79writingstatethatthepublicinterestinnondisclosureoutweighsthepublicinterestin
80disclosureoftherecords;
81 (19)Existingorproposedsecuritysystemsorproceduresandstructuralplansofreal
82propertyownedorleasedbyapublicgovernmentalbodyincluding,butnotlimitedto,
83evacuationandlockdownproceduresforthebuildingsonsuchrealproperty, and
84informationthatisvoluntarilysubmittedbyanonpublicentityowningoroperatingan
85infrastructuretoanypublicgovernmentalbodyforusebythatbodytodeviseplansfor
86protectionofthatinfrastructureincluding,butnotlimitedto,softwareorsurveillance
87companiesthatsecureaccesstosuchbuildings, thepublicdisclosureofwhichwould
88threatenpublicsafety:
89 (a)Recordsrelatedtotheprocurementoforexpendituresrelatingtosecuritysystems
90purchasedwithpublicfundsshallbeopen;
91 (b)Whenseekingtocloseinformationpursuanttothisexception,thepublic
92governmentalbodyshallaffirmativelystateinwritingthatdisclosurewouldimpairthepublic

94shallinthesamewritingstatethatthepublicinterestinnondisclosureoutweighsthepublic

112 (22)Creditcardnumbers,personalidentificationnumbers,digitalcertificates,
113physicalandvirtualkeys,accesscodesorauthorizationcodesthatareusedtoprotectthe
114securityofelectronictransactionsbetweenapublicgovernmentalbodyandapersonorentity
