SectionA.Section565.023,RSMo,isrepealedandtwonewsectionsenactedinlieu
2thereof,tobeknownassections565.023and565.185,toreadasfollows:
565.023.1.Apersoncommitstheoffenseofvoluntarymanslaughterifheorshe:
2 (1)Causesthedeathofanotherpersonundercircumstancesthatwouldconstitute
3murderintheseconddegreeundersubdivision(1)ofsubsection1ofsection565.021,except
4thatheorshecausedthedeathundertheinfluenceofsuddenpassionarisingfromadequate
5cause;[or]
6 (2)Knowinglyassistsanotherinthecommissionofself-murder; or
7 (3)Abusesanelderlyperson,apersonwithadisability,oravulnerableperson,
8asprovidedundersection565.184,andsuchabusesignificantlycontributedtothe
9victim'ssuicide.
10 2.Thedefendantshallhavetheburdenofinjectingtheissueofinfluenceofsudden
11passionarisingfromadequatecauseundersubdivision(1)ofsubsection1ofthissection.
12 3.TheoffenseofvoluntarymanslaughterisaclassBfelony.
