BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Section40.490,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection40.490,toreadasfollows:
40.490.1.Membersofthestatemilitaryforcesofthisstatewhoareorderedtoactive
2statedutybythegovernor,anyMissouriemployeewhoisamemberoftheNationalGuardof
3anotherstateandwhoiscalledintoactivestatedutybythegovernorofthatstate,orany
4memberofanyreservecomponentoftheArmedForcesoftheUnitedStateswhoiscalledto
5activedutyshall,uponbeingrelievedfromsuchduty,beentitledtothesamereemployment
6rightsprovidedbyTitle38oftheUnitedStatesCode,theRevisedStatutesofMissouri,and
7allamendmentsthereto.Theattorneygeneralshallenforcethereemploymentrights
8containedinthissectionformembersofthestatemilitaryforceswhoareorderedtoactive
9statedutybythegovernor.
10 2.MembersoftheMissouriNationalGuardwhoarecalledtoactivestateduty
11bythegovernorandanyMissouriemployeeswhoaremembersoftheNationalGuardof
12anotherstateandarecalledtoactivestatedutybythegovernorofthatstateshall,upon
13beingrelievedfromsuchduty,beentitledtoallrightsandprotectionsprovidedbythe
14ServicemembersCivilReliefAct,50U.S.C.Section3901etseq.,andallamendments
15thereto.
EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis
intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 16 3.Thedepartmentoflaborandindustrialrelationsshallmakeavailablethe

23ordeniedtheserightsbecauseofyourserviceintheNationalGuard,contactthe
24MissouricommitteeoftheEmployerSupportoftheGuardandReserve(ESGR)at573-
25638-9625.".
26 4.AnymemberoftheMissouriNationalGuardandanyMissouriemployeewho
27isamemberoftheNationalGuardofanotherstatemaybringsuitinanycourtof
28competentjurisdictionandappropriatevenueifsuchindividualbelievesthathisorher
29rightsunderthissectionhavebeenviolated.Theattorneygeneralmayalsobringsuit
30againstanemployerwhoviolatestheprovisionsofthissection.
