SectionA.Section571.030,RSMo,isrepealedandonenewsectionenactedinlieu
2thereof,tobeknownassection571.030,toreadasfollows:
571.030.1.Apersoncommitstheoffenseofunlawfuluseofweapons,exceptas
2otherwiseprovidedbysections571.101to571.121,ifheorsheknowingly:
3 (1)Carriesconcealeduponorabouthisorherpersonaknife,afirearm,ablackjack
4oranyotherweaponreadilycapableoflethaluseintoanyareawherefirearmsarerestricted
5undersection571.107;or
6 (2)Setsaspringgun;or
7 (3)Dischargesorshootsafirearmintoadwellinghouse,arailroadtrain,boat,
8aircraft,ormotorvehicleasdefinedinsection302.010,oranybuildingorstructureusedfor
9theassemblingofpeople;or
10 (4)Exhibits,inthepresenceofoneormorepersons,anyweaponreadilycapableof
11lethaluseinanangryorthreateningmanner;or
12 (5)Hasafirearmorprojectileweaponreadilycapableoflethaluseonhisorher
13person,whileheorsheisintoxicated,andhandlesorotherwiseusessuchfirearmorprojectile

32 2.Subdivisions(1),(8),and(10)ofsubsection1ofthissectionshallnotapplytothe
33personsdescribedinthissubsection,regardlessofwhethersuchusesarereasonably
34associatedwithorarenecessarytothefulfillmentofsuchperson'sofficialdutiesexceptas
35otherwiseprovidedinthissubsection.Subdivisions(3),(4),(6),(7),and(9)ofsubsection1
36ofthissectionshallnotapplytooraffectanyofthefollowingpersons,whensuchusesare

43whethersuchofficersareonoroffduty,andwhethersuchofficersarewithinoroutsideofthe

97571.121,avalidconcealedcarryendorsementissuedbeforeAugust28,2013,oravalid
98permitorendorsementtocarryconcealedfirearmsissuedbyanotherstateorpolitical
99subdivisionofanotherstate.
100 5.Subdivisions(3),(4),(5),(6),(7),(8),(9),and(10)ofsubsection1ofthissection
101shallnotapplytopersonswhoareengagedinalawfulactofdefensepursuanttosection

103 6.Notwithstandinganyprovisionofthissectiontothecontrary,thestateshallnot
104prohibitanystateemployeefromhavingafirearmintheemployee'svehicleonthestate's
105propertyprovidedthatthevehicleislockedandthefirearmisnotvisible.Thissubsection
106shallonlyapplytothestateasanemployerwhenthestateemployee'svehicleisonproperty
107ownedorleasedbythestateandthestateemployeeisconductingactivitieswithinthescope
108ofhisorheremployment.Forthepurposesofthissubsection,"stateemployee"meansan
109employeeoftheexecutive,legislative,orjudicialbranchofthegovernmentofthestateof

120 8.Apersonwhocommitsthecrimeofunlawfuluseofweaponsunder:
121 (1)Subdivision(2),(3),(4),or(11)ofsubsection1ofthissectionshallbeguiltyofa
122classEfelony;
123 (2)Subdivision(1),(6),(7),or(8)ofsubsection1ofthissectionshallbeguiltyofa
124classBmisdemeanor,exceptwhenaconcealedweaponiscarriedontoanyprivateproperty
125whoseownerhaspostedthepremisesasbeingoff-limitstoconcealedfirearmsbymeansof
126oneormoresignsdisplayedinaconspicuousplaceofaminimumsizeofeleveninchesby

151impositionofsentenceifsuchpersonhaspreviouslyreceivedasuspendedimpositionof
152sentenceforanyotherfirearms-orweapons-relatedfelonyoffense.
153 12.Asusedinthissection"qualifiedretiredpeaceofficer"meansanindividualwho:
154 (1)Retiredingoodstandingfromservicewithapublicagencyasapeaceofficer,
155otherthanforreasonsofmentalinstability;
156 (2)Beforesuchretirement,wasauthorizedbylawtoengageinorsupervisethe
157prevention,detection,investigation,orprosecutionof,ortheincarcerationofanypersonfor,
158anyviolationoflaw,andhadstatutorypowersofarrest;
159 (3)Beforesuchretirement,wasregularlyemployedasapeaceofficerforan
160aggregateoffifteenyearsormore,orretiredfromservicewithsuchagency,aftercompleting
161anyapplicableprobationaryperiodofsuchservice,duetoaservice-connecteddisability,as
162determinedbysuchagency;

164suchaplanisavailable;
