BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows: SectionA.Section67.280,RSMo,isrepealedandthreenewsectionsenactedinlieu 2thereof,tobeknownassections67.280,67.488,and71.985,toreadasfollows: 67.280.1.Asusedinthissection,thefollowingtermsmean: 2 (1)"Code",anypublishedcompilationofrulespreparedbyvarioustechnicaltrade 3associations,federalagencies,thisstateoranyagencythereof,butshallbelimitedto: 4regulationsconcerningtheconstructionofbuildingsandcontinuedoccupancythereof; 5mechanical,plumbing,andelectricalconstruction;andfireprevention; 6 (2)"Community",anycounty,fireprotectiondistrict, ormunicipality; 7 (3)"County",anycountyinthestate; 8 (4)"Dwelling",anysingle-familydwelling,two-familydwelling,orbuilding 9consistingofthreeormoretownhouseunits; 10 (5)"Fireprotectiondistrict",anyfireprotectiondistrictinthestate;and 11 [(5)](6)"Municipality",anyincorporatedcity,townorvillage. 12 2.Anycommunity,ifthecommunityotherwisehasthepowerunderthelawtoadopt 13suchanordinance,mayadoptorrepealanordinancewhichincorporatesbyreferencethe 14provisionsofanycodeorportionsofanycode,oranyamendmentthereof,properlyidentified 15astodateandsource,withoutsettingforththeprovisionsofsuchcodeinfull.Atleastone 16copyofsuchcode,portionoramendmentwhichisincorporatedoradoptedbyreference,shall 17befiledintheofficeoftheclerkofthecommunityandtherekeptavailableforpublicuse, 18inspection,andexamination.Thefilingrequirementshereinprescribedshallnotbedeemed EXPLANATION—Matterenclosedinbold-facedbrackets[thus] intheabovebillisnotenactedandis intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 19tobecompliedwithunlesstherequiredcopiesofsuchcodes,portion,oramendmentorpublic 20recordarefiledwiththeclerkofsuchcommunityforaperiodofninetydayspriortothe 21adoptionoftheordinancewhichincorporatessuchcode,portion,oramendmentbyreference. 22 3.Anyordinanceadoptingacode,portion,oramendmentbyreferenceshallstatethe 23penaltyforviolatingsuchcode,portion,oramendment,oranyprovisionsthereofseparately, 24andnopartofanysuchpenaltyshallbeincorporatedbyreference. 25 4.(1)Notwithstandinganyotherlawtothecontrary,nocommunityshalladopt 26anyordinance,resolution,regulation,code,orpolicythat: 27 (a)Prohibits,orhastheeffectofprohibiting,framedcavitiesinnewdwellings 28frombeingusedasductsorplenums;or 29 (b)Requires,orhastheeffectofrequiring: 30 a.NewdwellingstohaveawoodframewallcavityinsulationR-valuegreater 31thanthirteen; 32 b.Newdwellingstoutilizeexteriorcontinuousinsulation; 33 c.NewdwellingstohaveaceilinginsulationR-valuegreaterthanthirty-eight;or 34 d.Newdwellingstohaveamaximumairleakageratelessthanfiveairchanges 35perhour. 36 (2)Nothinginthissubsectionshallbeconstruedtoprohibittheowneror 37purchaserofadwellingfromchoosingtoinstall,atsuchownerorpurchaser'sexpense, 38anyofthefeaturesdescribedundersubdivision(1)ofthissubsectioniffeasiblewiththe 39designofthedwelling.Anyordinance,resolution,regulation,code,orpolicyadoptedin 40violationofthissubsectionshallbenullandvoid. 67.488.1.Thissectionshallbeknownandmaybecitedasthe"BuildingPermit 2ReformAct". 3 2.Forpurposesofthissection,theterm"exempthomeowner"meansaresident, 4noncorporateownerofadetached,single-familyresidence. 5 3.(1)Nopoliticalsubdivisionshallrequireanexempthomeownertoobtainany 6license,certification,orprofessionalregistrationorsubmittoanyexaminationortesting 7asaconditionofapplyingfororutilizingabuildingorconstructionpermit,providedall 8workisperformedbytheownerorothercurrentresident. 9 (2)Ifanexempthomeownertransfersownershipofthepropertywithinoneyear 10ofcompletinganyworkperformedundertheprovisionsofthissubsection,therelevant 11politicalsubdivisionispermittedtoassessaone-timeadministrationfeeinanamount 12nottoexceedfivethousanddollars.Thehomeownershallbeinformedofthispotential 13administrationfeeatthetimeofpermitapplication. HCSHB580 2 14 (3)Nothinginthissubsectionshallbeconstruedtoprohibittheenforcementof 15anyapplicablebuildingcodesorrelevantinspectionsasotherwiserequiredby 16ordinanceorlaw. 17 (4)Nothinginthissubsectionshallbeconstruedtoprohibitanownerfrom 18hiringacontractorotherwiseauthorizedbylawtoperformworkonbehalfoftheowner. 19 (5)Theprovisionsofthissubsectionshallnotapplyto: 20 (a)Anystructurebeingrented,leased,subleased,orotherwiseoccupiedoutside 21oftheowner'sprincipalresidence; 22 (b)Anygasapplianceinstallationorrepairoranyworkthatrequiresthe 23installationormodificationofanydeviceordeliverysystemthatutilizesacombustible 24fuelsource;or 25 (c)Theactofmakingadirectconnectiontopubliclyprovidedwaterorsewer 26service,orthemodificationtosuchexistingconnectionsatthepointofservice. 27 4.Nopoliticalsubdivisionshallrequireanypermit,license,variance,orother 28typeofpriorapprovalforanexempthomeownertoperformanyofthefollowing 29activities,providedallworkisperformedbytheownerorothercurrentresident: 30 (1)Replacinganexistingelectricappliancewithasubstantiallysimilarone, 31providednomajoradditionsormodificationstoexistingbuildingwiringareperformed; 32 (2)Replacinganexistingsink,faucet,ordishwasher,providednomajor 33modificationstoexistingbuildingplumbingareperformed; 34 (3)Repairing,replacing,orinstallinggypsumboard,plaster,orother 35nonstructuralinteriorwallcoveringorcladding;and 36 (4)Repairing,replacing,orinstallingcarpet,tile,vinyl,orotherfloorcoverings. 37 5.Anypoliticalsubdivisionthatfailstoperformaninspectionpursuanttoa 38permitwithintenbusinessdaysofarequestmadebyanexempthomeownershall 39refundfiftypercentofanychargesassessedforthepermit.Iftheinspectionisnot 40performedwithintwentybusinessdaysfromtheinitialrequest,thepoliticalsubdivision 41shallwaivetheinspectionrequirementsandallowtheexempthomeownertoproceedas 42iftheexempthomeownerhadpassedtheinspection. 43 6.Noexempthomeownershallbechargedafeetoextendorrenewanexpiring 44buildingorconstructionpermit,providedthepermitisnotallowedtoexpirepriorto 45renewal.Nolimitshallbeplacedonthenumberofextensionsorrenewalsofpermits 46issuedtoexempthomeownersunlesstheworkbeingperformedisvisiblefrom 47neighboringpropertiesoradjacentstreets.Nothinginthissubsectionshallbeconstrued 48toprohibitapoliticalsubdivisionfromrequiringjobsiteswithuncompletedworktobe 49maintainedinastatethatdoesnotposeanimminentthreattopublichealthorsafety. HCSHB580 3 50 7.Noexempthomeownershallbeassessedafineorfeeforworkdonewithouta 51permitinanamountgreaterthandoublethechargethatwouldhavebeenassessedifthe 52permithadbeenissuedatthetimetheunpermittedworkwasdiscovered. 53 8.Noexempthomeownershallberequiredtodestroy,remove,orsubstantially 54alteranystructureorpartofastructureuponwhichworkwaspreviouslydonewithout 55permitsunlessthepoliticalsubdivisionhavingjurisdictioncandemonstratethrough 56photographicorsimilarobjectiveevidencethattheworkperformeddidnotmeet 57applicablebuildingcodesorsafetystandardsinplaceatthetimetheworkwas 58performed. 59 9.(1)Nopoliticalsubdivisionshallissueastop-workorder,citation,penalty,or 60requirementforremediationforanyordinanceorbuildingcodeviolationdiscovered 61duringaninspectioniftheviolationfoundisoutsidethescopeofworkthatwas 62requestedtobeinspected. 63 (2)Nothinginthissubsectionshallbeinterpretedtoprohibittheproductionofa 64reportdetailingsuchviolationsfound,providedthereportisprovideddirectlytothe 65homeownerforinformationalpurposesonlyandisnotretainedorotherwiseutilizedor 66distributedbythepoliticalsubdivisionoritsagents. 67 10.Anyexempthomeownerwhoappliesforanybuildingorconstructionpermit 68andsubsequentlyfailsaninspectionperformedpursuanttosuchpermitshallbe 69informedinwritingastothereasonstheinspectionwasdeemedafailureandtheactions 70requiredtobetakentopassafollow-upinspection. 71 11.Noexempthomeownershallbeassessedachargetoreinspectpreviously 72inspectedworkforanamountthatexceedsthecostoftheinitialpermitorinspection 73unlessaperiodofoverninetydayshaselapsedsincetheoriginalinspection. 74 12.Ifthestateoranyofitspoliticalsubdivisionsenactsastatute,ordinance,or 75administrativerulethatincorporatesbyreferenceanythird-partystandardorcode 76otherwisesubjecttocopyrightprotection,thestateorpoliticalsubdivisionresponsible 77forthestatute,ordinance,oradministrativeruleshall,uponrequest,provide,freeof 78chargeinadigitalorphysicalformat,thethird-partystandardorcodeincorporatedby 79reference.Accesstoaphysicalformatinatemporaryortime-limitedmanneris 80sufficienttomeettherequirementsofthissubsectionprovidedthataphysicalcopymay 81remaininthepossessionoftherequestoruntilthecompletionofanycurrently 82permittedwork.Thestateorpoliticalsubdivisionshallpayallcostsassociatedwith 83providingthethird-partystandardorcode,exceptthatthestateorpoliticalsubdivision 84mayalternativelydeclarebyexecutiveoradministrativeactthattheprovisionsofthe 85standardorcodeincorporatedbyreferenceshallberepealedandnotenforceduntil 86suchrepealisachieved. HCSHB580 4 87 13.Notwithstandinganyotherprovisionoflaw,noagentofapolitical 88subdivisionshallhavetheauthoritytoenterintoaprivateresidenceforthepurposeof 89performingasafetyinspectionorinvestigationintomunicipalorcodeviolationswithout 90firstsecuringpermissionfromthepropertyownerortheowner'sdesigneeorawarrant 91fromacourtofcompetentjurisdiction. 92 14.Nothinginthissectionshallbeconstruedtorequireanypoliticalsubdivision 93toenactanybuildingcodesorstandardswherenonecurrentlyexist. 71.985.1.Asusedinthissection,theterm"request"shallmeananapplication 2forabuildingpermitorvariancefromapoliticalsubdivisionforanactionrelatedtothe 3developmentorimprovementofaproperty. 4 2.Ifanapplicantsubmitsarequesttoapoliticalsubdivision,thepolitical 5subdivisionshallapproveordenytheapplicant'srequestwithin60days. 6 (1)Ifnoresponseisreceivedbyanapplicantwithin60days,therequestshallbe 7approvedinthisstate. 8 (2)Iftherequestisapproved,thepoliticalsubdivisionshallnotimposeonthe 9applicantadditionalrequirementsrelatedtotherequest. 10 (3)Ifthepoliticalsubdivisiondeniestherequest,thepoliticalsubdivisionshall 11stateinwritingtotheapplicantthereasonsforthedenial. 12 (4)Thetimelimitinthissubsectionbeginsuponthepoliticalsubdivision's 13receiptoftheapplicant'srequest. 14 3.Apoliticalsubdivisionmaydenyanapplicant'srequestundersubsection2of 15thissectionasincomplete. 16 (1)Therequestisincompleteifthepoliticalsubdivisiondeterminestherequest 17failstocontainallinformationrequiredbylaw,orbyruleorordinanceofthepolitical 18subdivision,adoptedpriortothesubmissionoftherequest. 19 (2)Ifthepoliticalsubdivisiondeniesarequestasincomplete,thepolitical 20subdivisionshallstateinwritingtotheapplicantthereasonsforthedenialofthe 21requestasincomplete. 22 (3)Thetimelimitinsubsection2ofthissectionwillresetonlyif,within20days 23ofreceiptoftheapplicant'srequest,thepoliticalsubdivisionsendswrittennoticetothe 24applicantofthedenialoftherequestasincomplete. ✔ HCSHB580 5
