2 (1)Tocausepollutionofanywatersofthestateortoplaceorcauseorpermittobe
3placedanywatercontaminantinalocationwhereitisreasonablycertaintocausepollutionof
4anywatersofthestate;

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 5 (2)Todischargeanywatercontaminantsintoanywatersofthestatewhichreducethe
6qualityofsuchwatersbelowthewaterqualitystandardsestablishedbythecommission;
7 (3)Toviolateanypretreatmentandtoxicmaterialcontrolregulations,ortodischarge
8anywatercontaminantsintoanywatersofthestatewhichexceedeffluentregulationsor
9permitprovisionsasestablishedbythecommissionorrequiredbyanyfederalwaterpollution

11 (4)Todischargeanyradiological,chemical,orbiologicalwarfareagentorhigh-level
12radioactivewasteintothewatersofthestate.
13 2.Itshallbeunlawfulforanypersontooperate,useormaintainanywater
14contaminantorpointsourceinthisstatethatissubjecttostandards,rulesorregulations
15promulgatedpursuanttotheprovisionsofsections644.006to644.141unlesssuchperson
16holdsanoperatingpermitfromthecommission,subjecttosuchexceptionsasthecommission
17mayprescribebyruleorregulation.However,nooperatingpermitshallberequiredofany
18personforanyemissionintopubliclyownedtreatmentfacilitiesorintopubliclyownedsewer
19systemstributarytopubliclyownedtreatmentworks.
20 3.Itshallbeunlawfulforanypersontoconstruct,build,replaceormakemajor
21modificationtoanypointsourceorcollectionsystemthatisprincipallydesignedtoconveyor
22dischargehumansewagetowatersofthestate,unlesssuchpersonobtainsaconstruction
23permitfromthecommission,exceptasprovidedinthissection.Thefollowingactivitiesshall
24beexcludedfromconstructionpermitrequirements:
25 (1)Facilitiesgreaterthanonemilliongallonsperdaythatareauthorizedthrougha
26localsupervisedprogram,andarenotreceivinganydepartmentfinancialassistance;
27 (2)Allsewerextensionsorcollectionprojectsthatareonethousandfeetinlengthor
28lesswithfewerthantwoliftstations;
29 (3)Allsewercollectionprojectsthatareauthorizedthroughalocalsupervised
30program;[and]
31 (4)Anyearthenbasinconstructedtoretainandsettleearthenmaterialssuchas
32soil,silt,androck;and
33 (5)Anyotherexclusionsthecommissionmaypromulgatebyrule.
34 4.Aconstructionpermitmayberequiredbythedepartmentinthefollowing
35circumstances:
36 [(a)](1)Substantialdeviationfromthecommission'sdesignstandards;
37 [(b)](2)Toaddressnoncompliance;
38 [(c)](3)Whenanunauthorizeddischargehasoccurredorhasthepotentialtooccur;
39or
40 [(d)](4)Tocorrectaviolationofwaterqualitystandards.

42structuretohold,convey,contain,storeortreatdomestic,agricultural,orindustrialprocess
43wastewateralsoshallbesubjecttotheconstructionpermitprovisionsofthissubsection
44unlessexemptedbythecommission. Allotherconstruction-relatedactivitiesatpoint
45sourcesshallbeexemptfromtheconstructionpermitrequirements.Allactivitiesthatare
46exemptedfromtheconstructionpermitrequirementaresubjecttothefollowingconditions:
47 [a.](1)Anypointsourcesystemdesignedtohold,convey,contain,storeortreat
48domestic,agriculturalorindustrialprocesswastewatershallbedesignedbyaprofessional
49engineerregisteredinMissouriinaccordancewiththecommission'sdesignrulesunless
50exemptedbythecommission;
51 [b.](2)Suchpointsourcesystemshallbeconstructedinaccordancewiththe
52registeredprofessionalengineer'sdesignandplansunlessexemptedbythecommission; and
53 [c.](3)Suchpointsourcesystemmayreceiveapost-constructionsiteinspectionby
54thedepartmentpriortoreceivingoperatingpermitapproval.Asiteinspectionmaybe
55performedbythedepartment,uponreceiptofacompleteoperatingpermitapplicationor
56submissionofanengineer'sstatementofworkcomplete.
57 6.Agovernmentalunitmayapplytothedepartmentforauthorizationtooperatea
58localsupervisedprogram,andthedepartmentmayauthorizesuchaprogram.Alocal
59supervisedprogramwouldrecognizethegovernmentalunit'sengineeringcapacityandability
60toconductengineeringwork,superviseconstructionandmaintaincompliancewithrelevant
61operatingpermitrequirements.
62 [4.]7.Beforeissuinganypermitrequiredbythissection,thedirectorshallissuesuch
63notices,conductsuchhearings,andconsidersuchfactors,commentsandrecommendationsas
64requiredbysections644.006to644.141oranyfederalwaterpollutioncontrolact.The
65directorshalldetermineifanystateoranyprovisionsofanyfederalwaterpollutioncontrol
66actthestateisrequiredtoenforce,anystateorfederaleffluentlimitationsorregulations,
67waterquality-relatedeffluentlimitations,nationalstandardsofperformance,toxicand
68pretreatmentstandards,orwaterqualitystandardswhichapplytothesource,oranysuch
69standardsinthevicinityofthesource,arebeingexceeded,andshalldeterminetheimpacton
70suchwaterqualitystandardsfromthesource.Thedirector,inordertoeffectuatethepurposes
71ofsections644.006to644.141,shalldenyapermitifthesourcewillviolateanysuchacts,
72regulations,limitationsorstandardsorwillappreciablyaffectthewaterqualitystandardsor
73thewaterqualitystandardsarebeingsubstantiallyexceeded,unlessthepermitisissuedwith
74suchconditionsastomakethesourcecomplywithsuchrequirementswithinanacceptable
75timeschedule.
76 [5.]8.Thedirectorshallgrantordenythepermitwithinsixtydaysafterall
77requirementsoftheFederalWaterPollutionControlActconcerningissuanceofpermitshave

79pollutioncontrolact.Thedirectororthecommissionmayrequiretheapplicanttoprovide
80andmaintainsuchfacilitiesortoconductsuchtestsandmonitoreffluentsasnecessaryto
81determinethenature,extent,quantityordegreeofwatercontaminantdischargedorreleased
82fromthesource,establishandmaintainrecordsandmakereportsregardingsuch
83determination.
84 [6.]9.Thedirectorshallpromptlynotifytheapplicantinwritingof[hisorher]the
85director'sactionandifthepermitisdeniedstatethereasonsforsuchdenial.Asprovidedby
86sections621.250and640.013,theapplicantmayappealtotheadministrativehearing
87commissionfromthedenialofapermitorfromanyconditioninanypermitbyfilinga
88petitionwiththeadministrativehearingcommissionwithinthirtydaysofthenoticeofdenial
89orissuanceofthepermit.Afterafinalactionistakenonaneworreissuedgeneralpermit,a
90potentialapplicantforthegeneralpermitwhocandemonstratethat[heorshe]suchpotential
91applicantisormaybeadverselyaffectedbyanypermittermorconditionmayappealthe
92termsandconditionsofthegeneralpermitwithinthirtydaysofthedepartment'sissuanceof
93thegeneralpermit.Innoeventshallapermitconstitutepermissiontoviolatethelaworany
94standard,ruleorregulationpromulgatedpursuantthereto.Oncetheadministrativehearing
95commissionhasreviewedtheappeal,theadministrativehearingcommissionshallissuea
96recommendeddecisiontothecommissiononpermitissuance,denial,oranyconditionofthe
97permit.Thecommissionshallissueitsowndecision,basedontheappeal,forpermit
98issuance,denial,oranyconditionofthepermit.Ifthecommissionchangesafindingoffact
99orconclusionoflawmadebytheadministrativehearingcommission,ormodifiesorvacates
100thedecisionrecommendedbytheadministrativehearingcommission,itshallissueitsown
101decision,whichshallincludefindingsoffactandconclusionsoflaw.Thecommissionshall
102mailcopiesofitsfinaldecisiontothepartiestotheappealortheircounselofrecord.The
103commission'sdecisionshallbesubjecttojudicialreviewpursuanttochapter536,exceptthat
104thecourtofappealsdistrictwithterritorialjurisdictioncoextensivewiththecountywherethe
105pointsourceistobelocatedshallhaveoriginaljurisdiction.Nojudicialreviewshallbe
106availableuntilandunlessalladministrativeremediesareexhausted.
107 [7.]10.Inanyhearingheldpursuanttothissectionthatinvolvesapermit,license,or
108registration,theburdenofproofisonthepartyspecifiedinsection640.012.Anydecisionof
109thecommissionmadepursuanttoahearingheldpursuanttothissectionissubjecttojudicial
110reviewasprovidedinsection644.071.
111 [8.]11.Inanyevent,nopermitissuedpursuanttothissectionshallbeissuedif
112properlyobjectedtobythefederalgovernmentoranyagencyauthorizedtoobjectpursuantto
113anyfederalwaterpollutioncontrolactunlesstheapplicationdoesnotrequireanypermit
114pursuanttoanyfederalwaterpollutioncontrolact.
HB622	4 115 [9.]12.Permitsmaybemodified,reissued,orterminatedattherequestofthe
116permittee.Allrequestsshallbeinwritingandshallcontainfactsorreasonssupportingthe
117request.
118 [10.]13.Nomanufacturingorprocessingplantoroperatinglocationshallberequired
119topaymorethanoneoperatingfee.Operatingpermitsshallbeissuedforaperiodnotto
120exceedfiveyearsafterdateofissuance,exceptthatgeneralpermitsshallbeissuedforafive-
121yearperiod,andalsoexceptthatneitheraconstructionnoranannualpermitshallberequired
122forasingleresidence'swastetreatmentfacilities.Applicationsforrenewalofasite-specific
123operatingpermitshallbefiledatleastonehundredeightydayspriortotheexpirationofthe
124existingpermit.Applicationsseekingtorenewcoverageunderageneralpermitshallbe
125submittedatleastthirtydayspriortotheexpirationofthegeneralpermit,unlessthepermittee
126hasbeennotifiedbythedirectorthatanearlierapplicationmustbemade.Generalpermits
127maybeappliedforandissuedelectronicallyoncemadeavailablebythedirector.
128 [11.]14.Everypermitissuedtomunicipaloranypubliclyownedtreatmentworksor
129facilityshallrequirethepermitteetoprovidethecleanwatercommissionwithadequate
130noticeofanysubstantialnewintroductionsofwatercontaminantsorpollutantsintosuch
131worksorfacilityfromanysourceforwhichsuchnoticeisrequiredbysections644.006to
132644.141oranyfederalwaterpollutioncontrolact.Suchpermitshallalsorequirethe
133permitteetonotifythecleanwatercommissionofanysubstantialchangeinvolumeor
134characterofwatercontaminantsorpollutantsbeingintroducedintoitstreatmentworksor
135facilitybyasourcewhichwasintroducingwatercontaminantsorpollutantsintoitsworksat
136thetimeofissuanceofthepermit.Noticemustdescribethequalityandquantityofeffluent
137beingintroducedortobeintroducedintosuchworksorfacilitybyasourcewhichwas
138introducingwatercontaminantsorpollutantsintoitsworksatthetimeofissuanceofthe
139permit.Noticemustdescribethequalityandquantityofeffluentbeingintroducedortobe
140introducedintosuchworksorfacilityandtheanticipatedimpactofsuchintroductiononthe
141qualityorquantityofeffluenttobereleasedfromsuchworksorfacilityintowatersofthe
142state.
143 [12.]15.Thedirectororthecommissionmayrequirethefilingorpostingofabond
144asaconditionfortheissuanceofpermitsforconstructionoftemporaryorfuturewater
145treatmentfacilitiesorfacilitiesthatutilizeinnovativetechnologyforwastewatertreatmentin
146anamountdeterminedbythecommissiontobesufficienttoensurecompliancewithall
147provisionsofsections644.006to644.141,andanyrulesorregulationsofthecommissionand
148anyconditionastosuchconstructioninthepermit.Forthepurposesofthissection,
149"innovativetechnologyforwastewatertreatment"shallmeanacompletelynewandgenerally
150unproventechnologyinthetypeormethodofitsapplicationthatbenchtestingortheory
151suggesthasenvironmental,efficiency,andcostbenefitsbeyondthestandardtechnologies.
HB622	5 152Nobondshallberequiredfordesignsapprovedbyanyfederalagencyorenvironmental
153regulatoryagencyofanotherstate.Thebondshallbesignedbytheapplicantasprincipal,
154andbyacorporatesuretylicensedtodobusinessinthestateofMissouriandapprovedbythe
155commission.Thebondshallremainineffectuntilthetermsandconditionsofthepermitare
156metandtheprovisionsofsections644.006to644.141andrulesandregulationspromulgated
157pursuanttheretoarecompliedwith.
158 [13.]16.(1)Thedepartmentshallissueordenyapplicationsforconstructionand
159site-specificoperatingpermitsreceivedafterJanuary1,2001,withinonehundredeightydays
160ofthedepartment'sreceiptofanapplication.Forgeneralconstructionandoperatingpermit
161applicationsreceivedafterJanuary1,2001,thatdonotrequireapublicparticipationprocess,
162thedepartmentshallissueordenythepermitswithinsixtydaysofthedepartment'sreceiptof
163anapplication.Foranapplicationseekingcoverageunderarenewedgeneralpermitthatdoes
164notrequireanindividualpublicparticipationprocess,thedirectorshallissueordenythe
165permitwithinsixtydaysofthedirector'sreceiptoftheapplication,oruponissuanceofthe
166generalpermit,whicheverislater.Inregardtoanapplicationseekingcoverageunderan
167initialgeneralpermitthatdoesnotrequireanindividualpublicparticipationprocess,the
168directorshallissueordenythepermitwithinsixtydaysofthedepartment'sreceiptofthe
169application.Foranapplicationseekingcoverageunderarenewedgeneralpermitthat
170requiresanindividualpublicparticipationprocess,thedirectorshallissueordenythepermit
171withinninetydaysofthedirector'sreceiptoftheapplication,oruponissuanceofthegeneral
172permit,whicheverislater.Inregardtoanapplicationforaninitialgeneralpermitthat
173requiresanindividualpublicparticipationprocess,thedirectorshallissueordenythepermit
174withinninetydaysofthedirector'sreceiptoftheapplication.
175 (2)Ifthedepartmentfailstoissueordenywithgoodcauseaconstructionor
176operatingpermitapplicationwithinthetimeframesestablishedinsubdivision(1)ofthis
177subsection,thedepartmentshallrefundthefullamountoftheinitialapplicationfeewithin
178forty-fivedaysoffailuretomeettheestablishedtimeframe.Ifthedepartmentfailstorefund
179theapplicationfeewithinforty-fivedays,therefundamountshallaccrueinterestatarate
180establishedpursuanttosection32.065.
181 (3)Permitfeedisputesmaybeappealedtothecommissionwithinthirtydaysofthe

217regulations,forpermitsissuedpursuanttochapter644.
218 [17.]20.Priortothedevelopmentofanewgeneralpermitorreissuanceofageneral
219permitforaquaculture,landdisturbancerequiringastormwaterpermit,orreissuanceofa
220generalpermitunderwhichfiftyormorepermitswereissuedunderageneralpermitduring
221theimmediatelyprecedingfive-yearperiodforadesignatedcategoryofwatercontaminant
222sources,thedirectorshallimplementapublicparticipationprocesscomplyingwiththe
223followingminimumrequirements:

229eightydaysbeforetheproposedeffectivedateofthegeneralpermit;
230 (3)Thedirectorshallholdapublicinformationalmeetingtoprovideinformationon
231anticipatedpermitconditionsandrequirementsandtoreceiveinformalcommentsfrom
232permitteesandotherinterestedpersons.Thedirectorshallincludenoticeofthepublic
233informationalmeetingwiththenoticeofintenttoissueanewgeneralpermitorreissuea
234generalpermitundersubdivision(2)ofthissubsection.Thenoticeofthepublic
235informationalmeeting,includingthedate,timeandlocation,shallbepostedonthe

25420ofthissectionmaybemadebyelectronicmail.Thedepartmentshallnotberequiredto
255makenoticetoanypermitteeorotherpersonwhohasnotprovidedacurrentelectronicmail
