BeitenactedbytheGeneralAssemblyofthestateofMissouri,asfollows:
SectionA.Chapter344,RSMo,isamendedbyaddingtheretothreenewsections,to
2beknownassections344.045,344.055,and344.102,toreadasfollows:
344.045.1.Theboardshallreceivecomplaintsconcerningitslicensees'
2professionalpractices.Theboardshallestablishbyruleaprocedureforthehandlingof
3suchcomplaintspriortothefilingofformalcomplaintsbeforetheadministrative
4hearingcommission.Theruleshallprovide,ataminimum,fortheloggingofeach
5complaintreceived,therecordingofthelicensee'sname,thenameofthecomplaining
6party,thedateofthecomplaint,andabriefstatementofthecomplaintanditsultimate
7disposition.Theruleshallprovideforinformingthecomplainingpartyoftheprogress
8oftheinvestigation,thedismissalofthecharges,orthefilingofacomplaintbeforethe
9administrativehearingcommission.
10 2.Notwithstandinganyotherprovisionoflaw,nocomplaint,investigatory
11report,orinformationreceivedfromanysourceshallbedisclosedpriortoitsreviewby
12theboard.
13 3.Atitsdiscretion,theboardmaydisclosecomplaints,completedinvestigatory
14reports,andinformationobtainedfromstateadministrativeandlawenforcement
15agenciestoalicenseeorlicenseapplicantinordertofurtheraninvestigationorto
16facilitatesettlementnegotiations.

intendedtobeomittedfromthelaw.Matterinbold-facetypeintheabovebillisproposedlanguage. 17 4.Informationobtainedfromafederaladministrativeorlawenforcement
18agencyshallbedisclosedonlyuponreceiptofwrittenconsenttothedisclosurefromthe
19federaladministrativeorlawenforcementagency.
20 5.Atitsdiscretion,theboardmaydisclosecomplaintsandinvestigatoryreports
21ifanysuchdisclosureis:
22 (1)Inthecourseofvoluntaryinterstateexchangeofinformation;
23 (2)Inaccordancewithalawfulrequest;or
24 (3)Tootherstateorfederaladministrativeorlawenforcementagenciesacting
25withinthescopeoftheirstatutoryauthority.
26 6.Exceptwheredisclosureisspecificallyauthorizedinthissectionandas
27describedinsection610.021,deliberations,votes,orminutesofclosedproceedingsshall
28notbesubjecttodisclosureordiscovery.Onceafinaldispositionisrendered,that
29decisionshallbemadeavailabletothepartiesandthepublic.
344.055.1.Alleducationaltranscripts,testscores,complaints,investigatory
2reports,andinformationpertainingtoanypersonwhoisanapplicantorlicenseeofthe
3boardareconfidentialandshallnotbedisclosedtothepublicoranymemberofthe
4public,exceptwiththewrittenconsentofthepersonwhoserecordsareinvolved.The
5boardshalldisclosetherecordsorinformationifthepersonwhoserecordsor
6informationisinvolvedhasconsentedtothedisclosure.Theboardisentitledtothe
7attorney-clientprivilegeandwork-productprivilegetothesameextentasanyother
8person.
9 2.Notwithstandingtheprovisionsofsubsection1ofthissection,theboardmay
10discloseconfidentialinformationwithouttheconsentofthepersoninvolvedifthe
11disclosureis:
12 (1)Inthecourseofvoluntaryinterstateexchangeofinformation;
13 (2)Inaccordancewithalawfulrequest;or
14 (3)Tootheradministrativeorlawenforcementagenciesactingwithinthescope
15oftheirstatutoryauthority.
16 3.Informationregardingidentity,includingnamesandaddresses,registration,
17andcurrencyofthelicenseofthepersonspossessingnursinghomeadministrator
18licensesandthenamesandaddressesofapplicantsfornursinghomeadministrator
19licenses,isnotconfidentialinformation.
344.102.Nopersonshallpracticeasanursinghomeadministratorinthisstate
2orholdhimselforherselfoutasanursinghomeadministratorifhisorherlicenseis

4violationsofthischapterandtherulespromulgatedthereunder.
